Abstract

As an area restricted solely to the execution of penal functions, research interests, and mining activities, Nusakambangan Island primarily serves the purposes of securing and rehabilitating inmates. Consequently, the development of Nusakambangan Island should ideally focus on implementing a robust penitentiary system. Currently, however, development efforts on Nusakambangan Island are limited to constructing facilities supporting correctional institutions, overlooking its broader potential and functions for national interests. The aim of this study is to analyze the existing conditions to ascertain its potential and identify the challenges in managing Nusakambangan Island as a special area for rehabilitation, national defense, and security. The research methodology employed is qualitative, utilizing a participatory observation approach with full participation. Primary data was gathered through direct observation by the researcher, while secondary data was obtained through a juridical normative approach. The findings reveal that annual population migration into the Nusakambangan area is increasingly uncontrollable, sedimentation issues in the Segara Anakan area lack clear management, ongoing debates over island management persist, and the Directorate General of Corrections' limited authority over Nusakambangan Island exacerbates these complex issues. To optimize the penitentiary system, it is recommended that Nusakambangan Island be designated as a proportionally closed special area solely open for research, protected forests, and mining interests under clear policy directives.

Abstract

The state is obliged to defend its territory from annexation, but it also targets the economic sector with the aim of weakening the domestic and sovereign government. Many people are trapped by the interest system adopted in conventional co-operatives, because it causes disintegration between the rich and the poor. Gradually, the large gap can threaten the internal state. It also affects the rate of business productivity which is increasingly hampered, due to the substitution of domestic products by foreigners. The research uses descriptive analysis method with qualitative research type and literature study approach. The results of this study are Islamic economics and conventional people's economy have similarities, namely helping and mutual cooperation and differences in the existence of interest, while in Islamic economics using profit sharing and margins. Then the sharia people's economy can be applied as a defence of the country's economy through legislation. In order to maximise the potential of the Islamic people's economy, development is carried out on human resources and the productive sector of small and micro medium enterprises, as well as policies to limit exports and imports of products.

Abstract

This study examines the theoretical basis of the Nebis In Idem principle in civil cases, especially in class actions and how the basis for the Judges' consideration in applying the Nebis In Idem principle in Class Action Decisions, where the method of approach used in this scientific work is normative juridical, namely research that analyzes laws and regulations with literature studies. Using primary source study materials in the form of regulations, while secondary legal materials include books, articles from accredited journals, besides that tertiary legal materials consist of legal dictionaries. This journal begins with a formulation of the meaning of the application of the Nebis In Idem principle. Then describes descriptively the relationship between Article 10 of PERMA No. 1 of 2002 concerning Class Action Procedures with Article 1917 of the Civil Code. It can be concluded that the theoretical basis of this principle is solely to provide legal protection for a person's human rights, so that a person is not tried for the same case and prioritizes legal certainty and does not let the government repeatedly talk about the same event.

Abstract

The emergence of the resistance movement, of course, because there are factors that influence it. The birth of DI/TII in Aceh was caused by the central government's policy to merge Aceh province into North Sumatra province on August 8, 1950. This paper will explain the application of emergency military law. Specifically during the conflict that occurred in the Aceh region which led to the formation of the Free Aceh Movement from 1976 to 2005. By using normative legal research methods. The trigger for the proclamation of Aceh's independence was the exploitation of Aceh's natural resources during the Soeharto era, where petroleum and natural gas were managed by Exxon Mobil Oil Indonesia which caused regional sentiment, that all Aceh's wealth was sent to Jakarta, even Hasan Tiro once said Aceh should have the advantage of its natural resources like Brunei Darussalam. The Presidential Decree (Keppres) to launch a massive military operation in Aceh had been drafted long before, after cabinet meetings held at the Palace, as well as through the deliberations of the people's representatives in Senayan, Jakarta in early 2003. The aim was to crush the Free Aceh Movement (GAM). The Helsinki MOU is one of the negotiations carried out between the Government of the Republic of Indonesia and the Free Aceh Movement held in Helsinki, Finland, August 15, 2005 creating a new system and method of relations between the central government and the Aceh government, which is fully supported by the international community.

Abstract

Abstrak AMDAL berfungsi sebagai alat untuk menilai dampak potensi dari suatu kegiatan atau proyek terhadap lingkungan sebelum kegiatan tersebut dilaksanakan mencegah kerusakan lingkungan di Indonesia serta mengidentifikasi tantangan dan hambatan yang dihadapi dalam kerusakan lingkungan berdasarkan kerangka hukum yang ditetapkan oleh Undang-Undang. Dalam penelitian ini, metode yang digunakan penelitian hukum normatif yuridis dan pendekatan perundang-undangan (statute approach) dilakukan dengan menelaah semua Undang-undang dan regulasi. Kesimpulan dari penulisan ini adalah AMDAL adalah langkah kritis dalam upaya pencegahan kerusakan lingkungan. Penegakan yang tegas dan konsisten terhadap pelanggaran AMDAL diperlukan untuk memastikan bahwa tujuan perlindungan dan pengelolaan lingkungan hidup dapat tercapai, serta untuk mendukung pembangunan yang berkelanjutan di Indonesia.AMDAL merupakan instrumen penting yang diamanatkan oleh UU No. 32 Tahun 2009 untuk mencegah kerusakan lingkungan. Proses AMDAL membantu mengidentifikasi, memprediksi, dan mengevaluasi dampak lingkungan dari suatu kegiatan atau proyek sebelum dimulai, sehingga langkah-langkah mitigasi dapat dirancang dan diterapkan. UU No. 32 Tahun 2009 memberikan landasan hukum bagi penegakan sanksi terhadap pelanggaran AMDAL. Sanksi yang dapat dikenakan meliputi sanksi administratif, sanksi perdata, dan sanksi pidana. Efektivitas penegakan sanksi bergantung pada kapasitas dan integritas aparat penegak hukum, serta kesadaran dan partisipasi masyarakat dalam pengawasan lingkungan. Implementasi AMDAL berdasarkan UU No. 32 Tahun 2009 adalah langkah kritis dalam upaya pencegahan kerusakan lingkungan. Penegakan yang tegas dan konsisten terhadap pelanggaran AMDAL diperlukan untuk memastikan bahwa tujuan perlindungan dan pengelolaan lingkungan hidup dapat tercapai, serta untuk mendukung pembangunan yang berkelanjutan di Indonesia. Kata Kunci: AMDAL, Kerusakan Lingkungan, Pengelolaan Lingkungan Hidup. Abstract AMDAL functions as a tool to assess the potential impact of an activity or project on the environment before the activity is carried out to prevent environmental damage in Indonesia as well as identifying challenges and obstacles faced in environmental damage based on the legal framework established by law. In this research, the method used is normative juridical legal research and a statutory approach (statute approach) is carried out by examining all laws and regulations. The conclusion of this writing is that AMDAL is a critical step in efforts to prevent environmental damage. Firm and consistent enforcement of AMDAL violations is needed to ensure that the objectives of environmental protection and management can be achieved, as well as to support sustainable development in Indonesia. AMDAL is an important instrument mandated by Law no. 32 of 2009 to prevent environmental damage. The AMDAL process helps identify, predict and evaluate the environmental impacts of an activity or project before it begins, so that mitigation measures can be designed and implemented. UU no. 32 of 2009 provides a legal basis for enforcing sanctions for AMDAL violations. Sanctions that can be imposed include administrative sanctions, civil sanctions and criminal sanctions. The effectiveness of sanctions enforcement depends on the capacity and integrity of law enforcement officials, as well as public awareness and participation in environmental monitoring. Implementation of AMDAL based on Law no. 32 of 2009 is a critical step in efforts to prevent environmental damage. Strict and consistent enforcement of AMDAL violations is necessary to ensure that the objectives of environmental protection and management can be achieved, as well as to support sustainable development in Indonesia. Abstract

This study aims to analyze law enforcement in collecting Income Tax (PPh) against foreign companies that have the status of foreign taxpayers in Indonesia in a normative legal manner. In a national economic situation that is experiencing a slowdown, optimizing tax revenues is an important strategy for the government to improve fiscal stability and economic growth. Foreign companies, both those running businesses through Permanent Establishments (PE) or without PE, are subject to tax obligations on income earned in Indonesia. Law enforcement in tax collection is carried out through a preventive approach such as the establishment of the Directorate of International Taxation, the implementation of the Automatic Exchange of Information (AEoI), and intensive supervision of Tax Returns (SPT). In addition, a repressive approach in the form of tax audits and tax collection is strictly carried out against domestic business entities that act as tax collectors for foreign companies. This study concludes that the combination of preventive and repressive efforts carried out by the Directorate General of Taxes is effective in ensuring compliance with foreign taxpayers and increasing state revenues from the international taxation sector.

Abstract

The Tax Court has a crucial role in resolving tax disputes and optimizing state revenues. This study aims to analyze the effectiveness of the Tax Court in providing legal certainty for taxpayers and identifying obstacles that hinder its role in the Indonesian taxation system. The method used is a normative legal approach with an analysis of laws and regulations, court decisions, and related empirical data. The results of the study indicate that the dualism of guidance between the Supreme Court and the Ministry of Finance creates the potential for a conflict of interest that can affect the independence of judges in deciding tax disputes. In addition, limited access to the Tax Court, which is only located in Jakarta, causes obstacles for taxpayers in the regions to obtain justice quickly and efficiently. The policy of administrative sanctions in the form of a 100% fine for taxpayers whose appeals are rejected is also considered disproportionate and contrary to the principle of tax justice. To improve the effectiveness of the Tax Court, institutional reform is needed by unifying guidance under the Supreme Court, establishing Tax Court branches in various regions, and revising regulations related to tax sanctions in order to improve taxpayer compliance and trust in the national taxation system.

Abstract

This study aims to analyze the influence of organizing sports events on economic growth in Indonesia during the endemic transition period and legal regulations on sports events during the endemic transition period. Using normative juridical and normative empirical methods with a qualitative approach, this study examines relevant legal norms, such as the Indonesian Sports Law, on the influence of the country's economy in organizing sports events. Data were obtained from documentation of primary and secondary legal sources and interviews to understand the factors of economic growth through the sports industry. The results of this study indicate that the influence on economic growth through organizing sports events in Indonesia during the endemic transition period has not been fully accommodated by existing regulations. During the endemic transition period until now, the government and several sectors that work together to boost economic growth in Indonesia have not maximized the existing opportunities. However, with the weak implementation of regulations even though regulations regarding the sports industry have been written in the law. So that inappropriate implementation can hinder economic growth, as well as the occurrence of individuals who violate and damage existing facilities and the occurrence of budget efficiency in 2025 also affect the implementation of sports events. This study recommends that the government, private sector, and community collaborate to improve infrastructure evenly and maintain and build local and international appeal through the sports industry to become a source of foreign exchange for the country like developed countries.

Abstract

Appreciation of IPR in Indonesia is still relatively low and many people consider IPR to be unimportant and even many lay people do not understand IPR. One of them is the protection of trade secrets which plays an important role for both personal and public interests. The research method is normative legal with prescriptive data analysis. Trade secrets cover aspects of pre-production to post-production, including marketing and sales. The use of trade secrets without permission and approval from other parties is a violation of Law Number 30 of 2000 concerning Trade Secrets. The use of information includes production methods, frying, grinding, to marketing and sales of CV ground coffee. Tiga Putra Berlian resembles CV. Bintang Harapan by recruiting employees, offering coffee products that have been produced to CV customers. Bintang Harapan, causing losses and violating Article 17 of Law Number 30 of 2000.

Abstract

Forced marriage of child victims of rape is a phenomenon that places children in a position of double victimization, both as victims of sexual crimes and as subjects who lose their human rights to determine their future freely and with dignity. This research aims to examine forced marriage in the framework of sexual violence against children from the perspective of criminal law and human rights. In its approach, this research uses a normative juridical method with a statutory approach, conceptual approach, comparative approach, and case approach. The results show that forced marriage not only violates children's rights to protection from sexual violence as stipulated in Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, but also violates the principles of non-discrimination, the best interests of the child, and the right to physical and psychological integrity as guaranteed in the Convention on the Rights of the Child (CRC) and other international human rights instruments. This research emphasizes the importance of legal recognition of forced marriage as a form of sexual violence and the need for a comprehensive policy in the handling and recovery of child victims.
