Abstract

The rapid development of digital technology has transformed conventional buying and selling practices, particularly through e-commerce platforms such as Shopee. Among its prominent features, the Cash on Delivery (COD) Inspect First method allows consumers to verify products before making payment. This study analyzes the legitimacy of the COD Inspect First method under Islamic law using the concept of ‘urf (customary practice) and explores its educational management implications for Islamic higher education institutions. Using a qualitative descriptive approach with a case study design, the study integrates normative juridical analysis, literature review, and observations of Shopee’s COD practices. Findings indicate that COD Inspect First constitutes a valid custom (‘urf shahih) as it is widely adopted, consistently applied, and does not contradict Qur’anic injunctions or hadith. The system promotes fairness, transparency, and mutual consent, aligning with the maqasid al-shariah (objectives of Islamic law). From an educational management perspective, the study highlights the urgency of integrating digital commerce literacy, Islamic economic ethics, and technology-based learning strategies into higher education curricula. These innovations are essential for preparing graduates to navigate the complexities of modern digital economies responsibly while upholding Islamic moral values.

Abstract

To maintain the cleanliness of the Islamic boarding school environment, the role of students/students in it is needed to achieve a clean and healthy environment, but most students still don't want to play a role in it, such as sometimes throwing rubbish in their rooms, not carrying out room pickets and not maintaining and caring for the environment properly. Therefore, to ensure a clean and healthy learning environment, the Tebuireng Islamic Boarding School created the Santri Husada Organization (SANHUS). Within this organization, of course, many programs are designed. This research wants to find out the duties and roles of Santri Husada regarding the effectiveness of learning in the Putri Tebuireng Islamic Boarding School environment. This research is qualitative research that focuses on the phenomenon of the Santri Husada Organization (SANHUS), such as the behavior and motivation of members. Carried out using field research methods with researchers working directly at the Tebuireng Islamic Boarding School, Jombang. Descriptive methods were used to comprehensively describe the SANHUS situation. The results of this research are that the Santri Husada Organization (SANHUS) plays a significant role in helping condition and train santri hygiene and health habits. With the existence of the Santri Husada Organization (SANHUS) at the Tebuireng Islamic Boarding School for Girls, learning is felt to be quite effective. Because it can help maintain cleanliness and health in Islamic boarding schools so that learning runs effectively.

Abstract

Based on the Constitutional Court Decision Number: 46 PUU-VIII/2010, Article 43 Paragraph (1) of the Marriage Law states that a child born outside of marriage has a civil relationship with their mother and her family, as well as with the man as their father, which can be proven by science, technology, and/or other legal evidence. The child also has a blood relationship, including a civil relationship with the father's family. Inheritance for an illegitimate child through a will is allowed, but it often causes disputes as it is considered to harm the inheritance rights of legitimate children. This study aims to analyze the resolution of inheritance disputes between an illegitimate child who receives a will and a legitimate child according to civil law, as well as the legal protection of an illegitimate child in disputes with a legitimate child. The method used is normative juridical research with a literature study, using primary, secondary, and tertiary legal sources. The approaches used include the Statutory Approach, Conceptual Approach, Analytical Approach, and Case Approach. The research results show that the dispute resolution starts with a non-litigation route through deliberation, but if unsuccessful, the illegitimate child resorts to the contending method to defend their inheritance rights. The researcher recommends amendments to Article 874 of the Civil Code to grant the right to a will for an illegitimate child as long as it does not exceed the legitime portie, and to create codification related to marriage property law and wills.

Abstract

The construction of toll roads in Indonesia often causes land acquisition disputes, especially related to compensation for remaining land that is no longer productive. Although Article 65A paragraph (1) of Government Regulation No. 39 of 2023 provides the right for the community to demand compensation for the remaining land, practice on the ground shows a discrepancy between normative rights and the realization of compensation. This research uses a normative legal approach with legislative, conceptual, analytical, and case study methods, and refers to Dean G. Pruitt's Dispute Resolution Theory and Philipus M. Hadjon's Legal Protection Theory. The results of the study show that the non-litigation resolution mechanism (problem solving) is often ineffective due to the lack of education and facilitation from the authorities, so that people tend to take the path of litigation (contending) to fight for their rights. This condition reflects the weak legal protection for people affected by national strategic projects. Therefore, it is necessary to strengthen legal education for the community and revise Government Regulation No. 39 of 2023 to include compensation for the remaining land that has lost its use value. This revision is important to ensure substantive justice and prevent the escalation of disputes. This research contributes to the development of a more responsive and equitable land acquisition policy, as well as encourages synergy between regulations, education, and effective dispute resolution mechanisms in the context of national infrastructure development.

Abstract

Notarial deeds as authentic instruments hold a crucial role in Indonesia’s civil law evidence system, providing perfect proof under Article 1868 of the Civil Code. However, in practice, such deeds are often denied by one party in court, raising debates about the certainty of their evidentiary power. This study examines the legal consequences of denying a notarial deed for the parties in litigation and the assurance of legal certainty for those holding such deeds. Using R. Soeroso’s Theory of Legal Consequences and Jan Michael Otto’s Theory of Legal Certainty, this normative juridical research employs statutory, conceptual, analytical, and case approaches, with literature-based data collection and interpretative legal analysis. The findings reveal that denial of a notarial deed may create new legal relationships, alter good-faith relations into disputes, and result in sanctions imposed by court rulings. Meanwhile, legal certainty remains guaranteed, as authentic deed regulations are clear, binding, and enforceable, serving as a guideline in resolving disputes and upholding sanctions.

Abstract

Pendampingan peningkatan kemampuan membaca kitab merupakan upaya strategis untuk meningkatkan literasi keislaman di kalangan jamaah Majelis Ta’lim Fatayat NU Desa Kayukebek, Tutur, Kabupaten Pasuruan. Program ini dirancang untuk membekali para peserta dengan keterampilan membaca kitab sebagai sumber rujukan utama dalam kajian Islam. Metode yang digunakan melibatkan pendekatan partisipatif dengan tahapan asesmen awal, pelatihan terstruktur, dan evaluasi progres peserta. Pendampingan dilakukan oleh mentor yang memiliki kompetensi di bidang kitab menggunakan berbagai metode. Hasil kegiatan menunjukkan peningkatan signifikan dalam kemampuan membaca kitab peserta, ditunjukkan oleh penguasaan kaidah dasar nahwu dan sharaf, serta pemahaman lebih mendalam terhadap teks keislaman. Program ini juga berdampak positif pada peningkatan semangat belajar dan penguatan nilai-nilai religius di lingkungan komunitas Fatayat NU. Dengan keberlanjutan program ini, diharapkan literasi keislaman masyarakat setempat semakin kokoh dan dapat diwariskan ke generasi berikutnya.

Abstract

Abstrak: Penelitian ini mengkaji fenomena poligami siri yang terjadi di kalangan masyarakat berpenghasilan rendah di Kelurahan Rawa Makmur, Kecamatan Palaran, Kota Samarinda. Dengan pendekatan kualitatif studi kasus, data diperoleh melalui wawancara mendalam, observasi, dan dokumentasi. Hasil penelitian menunjukkan bahwa tekanan ekonomi dan minimnya literasi hukum menjadi faktor utama pendorong praktik poligami siri. Norma budaya dan agama turut melegitimasi praktik ini, meski berdampak negatif terhadap perempuan dan anak-anak. Tidak adanya pencatatan resmi menyebabkan ketidakadilan dalam nafkah, ketiadaan perlindungan hukum, konflik emosional, hingga kendala administratif bagi anak-anak. Studi ini merekomendasikan peningkatan kesadaran hukum dan penegakan regulasi untuk melindungi hak-hak perempuan dan anak dalam rumah tangga poligami.

Abstract

Abstract Menikah di bulan Muharam mencerminkan peran konstruksi sosial dan hukum adat dalam membentuk realitas sosial melalui interaksi dan tindakan masyarakat. Penelitian ini bertujuan mengeksplorasi bagaimana konstruksi sosial dan hukum adat di Desa Kare dan Kelurahan Taman membentuk pandangan masyarakat terhadap larangan menikah di bulan Muharam. Minimnya kajian yang menggabungkan perspektif masyarakat desa dan kota menunjukkan adanya celah penting dalam penelitian ini. Penelitian ini menerapkan pendekatan kualitatif dengan metode studi lapangan. Data dikumpulkan melalui observasi, wawancara, serta dokumentasi. Proses analisis data dilakukan dalam tiga tahap, yakni reduksi data, penyajian data, dan penarikan kesimpulan atau verifikasi. Untuk memastikan keabsahan data, peneliti menggunakan teknik pengamatan yang mendalam serta triangulasi. Hasil penelitian menunjukkan bahwa: Pertama, masyarakat Desa Kare dan Kelurahan Taman membentuk makna bulan Muharam sebagai bulan berkabung melalui ajaran agama, adat, dan sejarah Islam, khususnya tragedi Karbala. Hal ini membentuk kesepakatan kolektif bahwa bulan tersebut tidak tepat untuk pernikahan. Kedua, larangan ini dijalankan sebagai hukum adat tanpa aturan tertulis, ditaati secara sukarela sebagai warisan budaya dan spiritual, mencerminkan praktik living law. Ketiga, konstruksi sosial tersebut telah menjadi norma yang memengaruhi perilaku masyarakat, meski generasi muda mulai mempertanyakan relevansinya. Namun, nilai ini tetap dipertahankan sebagai bagian dari identitas budaya dan dapat beradaptasi dengan kondisi tertentu.

Abstract

This paper proposes a novel design of polar codes for rateless transmissions employing extended parity (EP) to enhance performance under broadband channel conditions. The idea of the proposed design is to achieve diversity across all samples by employing simple butterfly XOR operations, which inherently support rateless broadband transmissions. In particular, the design exploits the principle of repetition, where simple XOR operations do not only contribute to error protection but also strengthen the polarization effect and reinforce the rateless property of polar codes. The proposed codes are evaluated over Rayleigh fading, fully interleaved, and additive white Gaussian noise (AWGN) channels. The results show that the proposed codes achieve significant performance improvements, particularly in AWGN and fully interleaved environments, thereby confirming that the use of XOR operations effectively enhances transmission reliability. Furthermore, the proposed codes are investigated through extrinsic information transfer (EXIT) analysis using closed-form expressions. The analysis reveals that the decoding process exhibits faster convergence when EP is employed. In addition, computational complexity analysis shows that the additional overhead introduced by EP remains minimal. Importantly, the proposed structure preserves the standard polar transform and decoding graph, ensuring scalability similar to conventional polar codes. Hence, the proposed design balances performance and computational efficiency, making it a compelling solution for broadband scenarios and dynamic channel environments.

Abstract

This study aims to analyze the trend of pre-wedding photography from the perspective of Imam Shafi'i's thoughts on the concepts of aurat and ikhtilāṭ, and to examine its implementation in the social context of Jombang through a multi-case study approach. The research method used was a qualitative multi-case study design, involving several prospective brides and grooms, photographers, religious leaders, and the Office of Religious Affairs (KUA) as research subjects. Data collection techniques were conducted through observation, in-depth interviews, and documentation, while data analysis utilized the interactive model of Miles and Huberman. The results of this study indicate that pre-wedding photography practices in Jombang Regency vary, ranging from those that are relatively compliant with sharia principles to those that potentially violate the provisions of aurat and ikhtilāṭ according to the Shafi'i school of thought. Dominant factors influencing these practices include the influence of popular culture, social media, religious understanding, and aesthetic and economic considerations. This study emphasizes the importance of strengthening marital fiqh literacy and Islamic visual ethics so that the tradition of pre-wedding photography can be adapted to sharia values ​​without neglecting the social and cultural aspects of society.
