Abstract

Abstract: Nikah Mut’ah (Temporary Marriage) in the Views of Sunni and Shi’i Clerics. This article analyses the different views between Sunni and Shi’i Clerics on the legitimacy of Nikah Mut’ah (Temporary Marriage). Even if both the Sunni and Shi’i clerics agree that the marriage practices were permitted by Prophet Muhammad (PBUH) during his lifetime, the two sides disagree whether or not the marriage is still allowed today. The Imami clerics argue that Nikah Mut’ah was legal only in the Prophet era. In their opinions the temporary marriages is allowed in Islam, for those in traveling or in  a certain conditions .and the permission is still valid until an unspecified time. The majority of Sunni scholars, however, reject the notions, referring to a hadith that Prophet Muhammad had banned the practices of Mut’ah soon after the Battle of Hunain. الملخص: "الإختلاف و مقارنة المذاهب عن نكاح المتعة عند العلماء الشيعة و أهل السنة" ولا خلاف بين الفقهاء من السنيين والإماميين في أن نكاح المتعة كان موجودا في زمن النبيّ رخص به ولكن الخلاف بينهم. تقول الشيعة الإمامية أن المتعة كانت مباحة في صدر الإسلام أيام النبيّ وأبي بكر وصدر من إمرة عمر, وإن هذا الإباحة غير محددة بعدد, وإن المتعة تجوز في كل وقت ولكن إنسان مسافرا كان أومقيما متي استوفت شروطها. أما جمهور الفقهاء من أهل السنة (الحنفي والمالكي والشافعي والحنبلي) فإنهم يقولون إن مشروعية زواج المتعة منسوخة.

Abstract

The concept of maslahat offered by al-Ghazali is more general, compared to the concept offered by al-Tûfi. On the similarity side, both al-Ghazali and al-Tûfi alike have the principle that maslahat theory can be used as an Islamic law to address contemporary issues, although both develop this concept from the earlier scholars especially Imam Malik first pioneering. But both have different concepts, al-Ghazali emphasizes more on the criteria and definitions of the maslahat, both mu’tabarah, mulgha and mursalah, but al-Tûfi actually develops from maslahahmursalah, using much more reason and logic than al-Ghazali, even assumes that al-Tûfi seems strange compared to other figures and is considered inconsistent with his Hanbal school, nevertheless al-Tûfi remained confined to al-mu’âmalah and ‘âdat and not worship and muqaddarah territories.

Abstract

Abstract: Dynamic Development of Family Law in Muslim Countries. This article examines the dynamics of the development/renewal of Islamic family law in Muslim countries. The aim is to obtain a concrete picture of the development, from its original form, i.e conventional fiqh, to become positive law and apply it in Muslim countries. This research is classified as library research using a combination of historical and socio-anthropological approaches. Data were obtained from several secondary sources in the form of laws and regulations, books, articles, and many other documents related to the topic under study. The results of this study indicate that the role of the state in enforcing a legal system is absolute, in the sense that a law can be applied when it has been legislated as positive law. Apart from that, this study also found the fact that three models are applied in the development of family law in Muslim countries, namely; First, the state still applies the conventional legal system (fiqh). Second, the state carries out legal reforms within the school of thought. Third, the state makes its family law that is separate from religious norms to keep up with changes and developments in society.

Abstract

Higher education is an effective means of transforming thought and movement to counteract the negative influence of various extreme and deviant religious schools and understandings, one of which is radical ideology, which has recently begun to emerge among students at several tertiary institutions. This study aims to obtain an overview of the steps that have been taken by UIN Raden Intan Lampung, UIN Sunan Ampel Surabaya, and UIN Sunan Gunung Jati Bandung in grounding the concept of religious moderation to anticipate and counteract the radicalism ideology that has recently infiltrated among University students. This research is classified as descriptive qualitative field research, using the maslahah (benefit) theory. Data were obtained from reviewing several documents in the three institutions, which were then processed and analyzed using the content analysis method. This study concludes that although each University has a different approach in its efforts to prevent and overcome radical religious ideology, the concept offered is the same, namely religious moderation, which is based on the principle of welfare, namely “li jalbi al-mashālih wa li daf'i al-mafāsid” (taking benefit and eliminating harm).
