Abstract

The Social Security Administrative Body is a legal entity in administering social security programs to ensure that all people are able to meet the basic needs of a decent life. The purpose of this research is to analyze the BPJS Kesehatan service system which is capable of anticipating a surge in patients seeking treatment abroad. This study uses a Statute Approach and a conceptual approach using the interview method. Data analysis used qualitative analysis techniques to test the validity of the data in this study by looking for existing reference sources. Based on the results of the research, it shows that the National Social Security System (SJSN) is organized with a Social Insurance mechanism in which each participant is required to pay contributions to provide protection for socio-economic risks that befall participants and/or their family members. The BPJS service arrangement or system is complete by providing basic services and referrals as long as the person is still alive but not for treatment abroad. In the absence of this regulation, it automatically prevents someone from seeking treatment abroad, so they continue to seek treatment at home. The BPJS Kesehatan office in serving patients seeking treatment abroad has not found BPJS patients consulting for treatment abroad.

Abstract

The implementation of providing restitution is not easy for the court to grant. assist in fulfilling the rights of restitution to victims because prosecutors in carrying out loans have difficulty presenting evidence of expenditure to determine the size of compensation. Settlement case No. 359 /Pid.Sus/2020/PN Cbi is one of the cases where the panel of judges rejected the request for restitution requested by public submission. This research aims to determine the legal provisions governing restitution as a right for victims of human trafficking crimes in Indonesia, analyze the considerations of judges who deny the right to restitution for victims of TIP and enforce the judge's decision that refuses to grant the right to restitution for victims of TIP in the case of Decision No. 359 / Pid.Sus / 2020 / PN Cbi. This research is included in normative juridical research with data obtained from literature studies or library research. The results of this research are that the legal provisions governing restitution as a right of victims of criminal acts of human trafficking in Indonesia are regulated in Article 48 of Law 21/2017 which basically regulates a series of mechanisms for implementing provisions for providing restitution for criminal acts of human trafficking. The panel of judges was correct in providing a legal opinion in rejecting the request for restitution. This causes general lending to not follow the terms, procedures and procedures for requests for restitution, and the panel of judges cannot decide on its own general order regarding the amount of restitution without being based on the provisions regarding restitution which are considered correct and in accordance with applicable regulations so that the panel of judges must request restitution. what is being requested is not in accordance with the applicable law and the impedance of a judge's sentence who refuses to grant a TIP victim the right to restitution. The victim will suffer either physical injury or physical or mental deterioration due to the absence of compensation given to him as a victim of the criminal act of trafficking in persons.

Abstract

In financing agreements, the phenomenon of debtors defaulting is very possible or occurs, so this causes creditors to take steps such as parate execution by using coercive debt collector services. This is justified because it is under the legal umbrella of the Fiduciary Guarantee Law. After the judicial review of Constitutional Court Decision No. 18/PUU-XVII/2019, the execution parate was abolished and the execution of fiduciary guarantee objects must be carried out by submitting a request for execution to the head of the district court, but in the case of Decision Number 157/Pdt.G/2021/Pn Skt, the judge actually rejected the plaintiff's petitum as a debtor who argued that the execution parate by the defendant (creditor) was an unlawful act. The formulation of the problem in this research is how to analyze the judge's legal considerations in determining whether the execution of fiduciary guarantees is valid in Decision Number 157/Pdt.G/2021/Pn Skt? And how is legal protection for debtors related to Constitutional Court Decision Number 18/PUU-XVII/2019? This research is included in the type of normative juridical research with a statutory approach. The purpose of this research is to determine the analysis of the judge's legal considerations in determining the validity of the execution of fiduciary guarantees in Decision Number 157/Pdt.G/2021/Pn Skt and to determine the legal protection for debtors in connection with Constitutional Court Decision Number 18/PUU-XVII/2019. The theoretical benefit of this research is a contribution to legal science, while the theoretical benefit is aimed at legal practitioners. The results of this research are that the plaintiff is not a party who voluntarily surrenders the object of the fiduciary guarantee and is not a party bound by an agreement to determine default, so the judge was wrong in rejecting the plaintiff's petitum which argued that the defendant was valid in the execution parate, and legal protection for the debtor was linked to Constitutional Court Decision Number 18/PUU-XVII/2019 is contained in Article 23 paragraph (2) and the plaintiff can take legal action to appeal solely to seek correction of the results of a decision that is considered wrong.

Abstract

Fulfilling the need for decent clothing, the price and quality differ between used clothes and new clothes, so that business actors provide clothing needs with quality models but at affordable prices, so thrifting businesses emerge where this business sells used clothes. The development of the used clothing trade is clearly visible at the moment, one of the places selling used clothes in Surakarta that is well known to many people is the Tirtonadi Convention Hall. However, there is another side, business actors only prioritize profits, thereby ignoring public health problems. The problem in this research is the implementation of Minister of Trade Regulation Number 40 of 2022 concerning Trade in Imported Used Clothing in the City of Surakarta, whether it has been implemented well or not. This type of research is empirical research. Data collection techniques were carried out by interviews at the research location. The results of the research show that the implementation of Minister of Trade Regulation Number 40 of 2022 concerning Trade in Imported Used Clothing in the City of Surakarta has not run optimally due to lack of supervision and law enforcement, lack of education and outreach, economic dependence, availability and quality of local products, inadequate bureaucratic structure. efficient.

Abstract

The problem that arises with medepleger in the crime of document forgery is that its application is not explicitly regulated in the Criminal Code regarding its punishment. Then a gap emerged between das sollen (the Criminal Code does not explicitly regulate the criminal offense of participating in making fake letters) and das sein (many people who commit crimes taking part in making fake letters), as in Supreme Court Decision Number 418 K/Pid /2016. This research aims to determine the regulation of the criminal act of forgery of letters in the Criminal Code and to determine the imposition of criminal sanctions against perpetrators of criminal acts who participate in the continuous production of fake letters. This research is a type of normative juridical research, with a statutory approach and a case approach. Research data relies on primary data in the form of statutory regulations and binding decisions and secondary data, namely library sources. As for the research results: the legal arrangements for inclusion in the Criminal Code are regulated in 55 paragraph 1 of the Criminal Code. Regulations for the act of falsifying letters are regulated in Chapter Overall, what is at the core of all forms of criminal acts of letter forgery are making fake letters, falsifying letters and using fake letters or forged letters. what is formulated in the Articles on falsification of letters is the action on the object or form of the letter. The imposition of criminal sanctions against perpetrators of criminal acts who participated in making fake letters which is carried out continuously in the Supreme Court Decision Number 418K / PID / 2016 is based on legal facts, whether through witness statements, defendant statements, or evidence, mitigating and aggravating matters. the defendant and based on juridical considerations. In this case the defendant committed the act by means of participation. With the fulfillment of the elements in article 263 paragraph 2 of the Criminal Code jo. Article 55 paragraph 1 of the Criminal Code means that the criminal act charged is legally and convincingly proven according to the law.

Abstract

In several court decisions in cases of criminal acts of corruption in State-Owned Enterprises (SOE), the phrase "against the law" is in Article 2 paragraph 1 of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes as amended based on Law Number 20 2001 concerning Amendments to Law Number 31 of 1999 concerning the Eradication of Corruption Crimes (Anti Corruption Act) is interpreted broadly by referring to the explanation of these regulations. Because it relates to an offense, the phrase "against the law" should be interpreted by taking into account the principle of legality, the principle of nullum delictum nulla poena sine previa lege poenali. The use of a broad interpretation of the phrase "against the law" results in unclear differences between unlawful acts in the context of civil law and (onrechtmatige daad) and unlawful acts in the context of criminal law (wederrechtelijkheid). This results in the risk of criminalization of SOE officials, giving rise to fear in making business decisions. The formulation of the problem in this research is how to interpret the phrase "against the law" in article 2 paragraph (1) of the Corruption Law when it is related to cases of criminal acts of corruption in SOE and what is the judge's interpretation of the phrase "against the law" in decisions court for criminal acts of corruption in SOE. The research method used is a research method with a normative juridical approach. The results of the research show that the phrase "against the law" is interpreted broadly in the explanation of article 2 paragraph (1) of the Corruption Law, and judges in several corruption crime decisions interpreted the phrase "against the law" broadly, resulting in violations of the Standard Operating Procedure, Work Plan and The Company's Articles and other internal company regulations are interpreted as unlawful acts that can be considered a criminal act of corruption.

Abstract

In the use of animals by humans, over time there have been many function and there are principles that need to be considered in its use and handling. Animal abuse and animal abuse in Positive law have been regulated, regarding prohibitions against mistreating animals include Article 302 of the Criminal Code, Article 66 paragraph 2 of Law no.18 of 2009 concerning Amendments to Law Number 18 of 2009 concerning Animal Husbandry And Animal Health. Dog slaughterhouse activities where dogs are abused slaughtered and their meat traded for human consumption, in an unnatural way. The dog meat trade is an act that violates animal welfare. On In November 2021, problems regarding dog slaughterhouses were discovered in Dukuh Wirroragen, Kartasura District, Sukoharjo Regency. This research aims to find out the review criminal law regarding criminal acts of dog abuse and meat trafficking dogs at the slaughterhouse in Dukuh Wiroragen, Kartasura District, Sukoharjo Regency. In this research the author using a conceptual and comparative approach. The data source comes from primary data obtained through interviews with parties from the animal welfare activist coalition and the Police Sukoharjo. Secondary data in the form of primary legal materials in the form of the Criminal Code, Law no. 41 Years 2014 concerning Amendments to Law Number 18 of 2009 concerning Animal Husbandry and Animal Health. The results of this research show that: (1.) Criminal acts of abuse dogs at the slaughterhouse in Dukuh Wiroragen, Kartasura District, Sukoharjo Regency fulfills the elements and violates Article 302 paragraphs (1) and (2) of the Criminal Code, Article 66 paragraph 2 letters c, e, f and g Law of the Republic of Indonesia Number 41 of 2014 concerning Amendments Law Number 18 of 2009 concerning Animal Husbandry and Animal Health and Article 83 Paragraphs (1) and (2) Government Regulation Number 95 of 2012 concerning Public Health Veterinary and Animal Welfare. (2.) The dog meat trade contributes to and violates criminal threats to the law 18 of 2009 Article 89 paragraph 2 as amended and supplemented by Law number 41 of 2009 , 2014 concerning amendments to Law number 18 of 2009 jo. Article 55 paragraph (1) point 1, related entering animals from areas free from infected or suspected infected areas.

Abstract

In managing risk-based permits in Indonesia, there is a gap between das sollen (PP Number 5 of 2021 is the basis for carrying out Risk-Based business licensing) and das sein (the phenomenon of PTs which are often hampered in processing OSS RBA permits). This research aims to find out the regulations regarding processing business licensing through a risk-based online single submission risk based approach (OSS-RBA), analysis of Limited Liability Companies having difficulty in managing risk-based electronically integrated business licensing and efforts to resolve the problem of Limited Liability Companies making it difficult to process risk-based electronically integrated business licensing. This research is a type of normative juridical research that relies on primary legal materials (legislation) and secondary legal materials (literature studies). The results of this research: Regulations regarding the management of business permits through OSS-RBA are regulated in Government Regulation Number 5 of 2021 concerning Risk-Based Business Licensing. Analysis of limited liability companies having difficulty in processing risk-based electronically integrated business permits is due to overlapping regulations and the absence of implementing regulations for implementing OSS RBA in the regions. Efforts to resolve the problem of limited liability companies which are difficult to obtain risk-based electronically integrated business permits, there are two, namely 1) the government must guarantee compliance with Law Number 40 of 2007 concerning Limited Liability Companies in conjunction with Law Number 11 of 2020 concerning Copyright in conjunction with PP No. 8 in 2021 based on the provisions of the statutory hierarchy and 2) the government must make a policy so that regulations implementing the RBA OSS are made in various regions.

Abstract

The emergence of differences in views regarding whether or not interfaith marriages are permissible in Indonesia because it has not been clearly regulated in the Marriage Law has led several people to apply for interfaith marriages. The aim of this research is to find out the legal basis and considerations of judges in handing down decisions on interfaith marriages in the District Court and the implications of the judge's decisions on these marriages. This research is normative juridical research which is based on several laws and regulations regarding marriage. The results of this research explain that (1) Decision Number 131/Pdt.P/2021/PN Jkt.Sel is an application for permission to register interfaith marriages which was granted by the South Jakarta District Court, where the judge thought there was a lack of explanation of the law because in The law does not expressly prohibit interfaith marriages. The judge's consideration in deciding this case was because he understood Article 2 paragraph 1 of the Marriage Law Number 1 of 1974, which states that marriage is valid according to the laws of each religion and belief. Meanwhile, determination Number 122/Pdt.P/2020/PN.PTI is an application for a marriage permit which was rejected because this application was deemed to contain formal defects so it could not be accepted (niet on vankelijke verklaard). (2) The legal implication of the decree being granted is that there is no problem because legally it is permissible to carry out interfaith marriages. This includes the relationship between husband and wife and their children, which is regulated in law and has permanent legal force. Meanwhile, the implication of a rejected decision regarding the validity of the marriage is that it is invalid and all legal consequences arising from the marriage are not recognized.

Abstract

Bullying is a serious social problem in Indonesia, especially among children and adolescents. According to data from the Ministry of Women Empowerment and Child Protection, in 2023, there were 20,000 cases of bullying reported to the authorities. These bullying cases can hinder children from learning in school, and have a negative impact on the physical and psychological development of the victims. This study aims to understand the definition, impact, types, and ways to prevent bullying. This study uses a literature study method by collecting data from various sources, such as books, journal articles, and previous research results. The results of the study show that audiovisual methods are very focused on the senses of hearing and vision, so they can effectively utilize the child's sensory abilities, namely brain stimulation that can change behavior.
