Abstract

Although blood donation in Indonesia has been regulated through various legal instruments and is regarded as a humanitarian act in Islam, numerous ethical and legal issues still arise in practice. This creates a gap between the commercialized reality of implementation and the normative expectation that blood donation should be grounded in sincerity, solidarity, and the principle of hifz al-nafs within Islamic ethics. The purpose of this study is to analyze the regulation of blood donation in Indonesia based on applicable laws and to examine the principles of Islamic ethics in viewing blood donation as a form of health and humanitarian service. This research employs a normative juridical approach with a prescriptive type of study, focusing on literature review to examine the legal framework and Islamic ethical principles in blood donation practices in Indonesia. The study uses secondary data derived from primary, secondary, and tertiary legal materials. Data collection was conducted through literature study, and the analysis applied a qualitative method to interpret legal norms, evaluate regulatory effectiveness, and formulate normative solutions. The results show that the practice of blood donation in Indonesia represents the integration of legal, moral, ethical, and humanitarian values guaranteed by the 1945 Constitution, further elaborated through Law No. 17 of 2023 and Minister of Health Regulation No. 91 of 2015, which emphasize voluntary, non-commercial, and humanitarian principles. The Indonesian Ulema Council (MUI) Fatwa No. 23 of 2019 affirms that blood donation is a virtuous act reflecting the spirit of mutual assistance. From an Islamic ethical perspective, blood donation embodies the values of hifz al-nafs and al-maslahah within maqasid al-shari‘ah, serving as a form of social worship that rejects any exploitation of the human body.

Abstract

This study aims to analyze the effectiveness of legal mechanisms in protecting trademarks in the Bottled Drinking Water (AMDK) sector, with a case study on the FURE brand as a micro, small, and medium enterprise (MSME) product. Employing a normative juridical method with statutory, conceptual, and case study approaches, this research reviews the implementation of Law No. 20 of 2016 on Trademarks and Geographical Indications, which adopts the constitutive principle and the first-to-file system. The findings reveal that while FURE has obtained valid trademark registration and exclusive rights, practical challenges persist, including limited internal legal literacy, inadequate market monitoring, and the lack of optimized digital protection strategies. These results indicate the need for proactive measures such as cross-class registration, online monitoring, and the strengthening of legal literacy among MSMEs. The study contributes practical recommendations for business actors and policy insights for government institutions to enhance trademark protection systems in Indonesia.

Abstract

This study aims to determine 1) the legal review of the crime of narcotics abuse based on Law Number 35 of 2009 concerning narcotics. 2) obstacles and law enforcement efforts against the crime of narcotics abuse based on Law Number 35 of 2009 concerning narcotics. This research method uses a normative legal approach with a prescriptive research type that focuses on literature studies. The data used are secondary data sourced from primary, secondary, and tertiary legal materials. The data collection technique is carried out through literature studies. The data analysis technique is carried out descriptively qualitatively with data reduction, data presentation, and drawing conclusions. The results of the study indicate that the study shows that Law Number 35 of 2009 has clearly regulated provisions regarding narcotics abuse and its sanctions. Obstacles to the crime of narcotics abuse are legal substance obstacles, legal structure obstacles, facilities and infrastructure obstacles, community legal culture obstacles and external factors such as technology and transnational networks. Law enforcement efforts against narcotics abuse crimes are classified into representative efforts, preventive efforts and rehabilitative efforts.

Abstract

Tuntutan terhadap layanan keperawatan yang aman dan profesional terus meningkat, namun literasi hukum di kalangan perawat masih rendah, khususnya di Jawa Tengah. Program pengabdian ini bertujuan memperkuat kesadaran hukum keperawatan melalui pendekatan Teori Integratif-Tetradik Realism. Kegiatan dilaksanakan secara partisipatif dalam satu hari pelatihan tatap muka berbasis andragogi, mencakup asesmen kebutuhan hukum, workshop penyusunan dokumen hukum, diskusi studi kasus, dan refleksi kolektif. Pendekatan Community-Based Participatory Action Research (CBPAR) digunakan untuk membangun pemahaman hukum yang aplikatif dan etis. Hasil pre-test dan post-test menunjukkan peningkatan signifikan dalam pemahaman peserta. Program ini terbukti efektif meningkatkan literasi hukum dan profesionalisme perawat, serta direkomendasikan untuk direplikasi di wilayah lain dan diintegrasikan ke dalam sistem pembinaan profesi nasional melalui pembentukan forum “Duta Hukum Keperawatan” secara berkelanjutan.

Abstract

Generasi muda merupakan aset strategis dalam pembangunan bangsa karena memiliki peran penting dalam menentukan kualitas kehidupan sosial di masa depan. Namun, pesatnya perkembangan sosial dan teknologi tidak selalu diiringi dengan pemahaman yang memadai mengenai norma hukum dan pentingnya penerapan pola kehidupan sehat. Kondisi tersebut berpotensi menimbulkan berbagai permasalahan sosial, seperti perilaku menyimpang, rendahnya kepatuhan terhadap hukum, serta gaya hidup tidak sehat yang berdampak pada kesehatan fisik, mental, dan sosial. Kegiatan Pengabdian kepada Masyarakat ini bertujuan untuk meningkatkan pemahaman hukum, memperkuat karakter, serta menumbuhkan kesadaran pola kehidupan sehat pada generasi muda di Kelurahan Sriwedari. Metode yang digunakan adalah pendekatan kualitatif deskriptif melalui kegiatan sosialisasi hukum dan edukasi pola hidup sehat dengan metode penyampaian materi, diskusi interaktif, dan tanya jawab. Data dikumpulkan melalui observasi langsung selama kegiatan berlangsung dan dokumentasi pendukung. Hasil kegiatan menunjukkan adanya peningkatan pemahaman generasi muda terhadap norma dan aturan hukum, terbentuknya nilai-nilai karakter positif seperti disiplin, tanggung jawab, dan kepedulian sosial, serta meningkatnya kesadaran akan pentingnya menjaga kesehatan fisik, mental, dan sosial. Integrasi antara sosialisasi hukum dan edukasi pola kehidupan sehat terbukti efektif dalam membentuk perilaku generasi muda yang lebih bertanggung jawab, sadar hukum, dan berorientasi pada gaya hidup sehat. Kegiatan ini diharapkan dapat menjadi model pembinaan generasi muda berbasis komunitas yang berkelanjutan dengan melibatkan peran aktif pemerintah kelurahan dan masyarakat.

Abstract

The rapid recovery of the tourism sector in the post-pandemic era has increased the need for sustainable tourism development at the local level. Local governments have a strategic role in ensuring that tourism growth is able to provide economic benefits while maintaining social and environmental sustainability. However, various empirical evidence shows that the implementation of sustainable tourism policies at the regional level is still uneven and often faces institutional challenges and coordination between stakeholders. This study aims to analyze the role of local governments in encouraging sustainable tourism development and identify strategies for optimizing these roles in the current governance context. This research uses a qualitative descriptive approach with a policy and stakeholder analysis framework. Data was collected through document analysis of regional tourism policies, development plans, and relevant secondary data sources, and analyzed using thematic analysis techniques. The results of the study show that local governments generally play the role of regulators and facilitators, but the effectiveness of these roles is still limited by limited institutional capacity, weak collaboration between stakeholders, and the lack of optimal integration of sustainability principles in operational practices. This research also identifies opportunities to strengthen governance through collaborative planning, community empowerment, and the implementation of adaptive policy instruments. The study contributes to the development of the literature by highlighting the gap between policy formulation and implementation at the regional level and offering an integrative framework for optimizing the role of local governments in sustainable tourism development. The findings of this study provide strategic implications for policymakers in strengthening sustainable tourism governance at the regional level.

Abstract

Irrational use of drugs and their abusers is a problem that is often found in society. Based on the survey data obtained, there are still residents who get drugs freely without monitoring medical and pharmaceutical personnel or the drugs purchased are medicines from grocery stores, and many residents in Kopen village, Boyolali, do not know how to use appropriate drugs and how to store them. The correct medicine and many of them are still throwing away liquid medicine in the package and without paying attention to damage the medicine package. Education about the drug Dagusibu is one of the efforts we do as pharmaceutical personnel to prevent irrational drug use and to prevent drug abuse by the community, especially the elderly in Kopen Village, Boyolali. The method used is a preventive intervention method and a quantitative approach to the elderly using the Dagusibu questionnaire that we created. Based on filling out the questionnaire before we do the socilization, it was found that 73% of the elderly who do not understand, 18% of the elderly who have little understanding and 7% of the elderly who are accompanied by a guardian who already understands. The understanding of Dagusibu drugs by the elderly in the Village Kopen, Boyolali categorized't get it. It needs to be held socialization to improve the understanding of the elderly and also residents in the Village kopen, Boyolali. After socialization, the obtained results of the questionnaire 27% still do not understand, 64% already understand and also 9% are elderly, accompanied by a guardian in the use of the drug. The conclusion of this research is the role of pharmaceutical personnel hold a very important role in conveying information and education in an improved understanding of the elderly and residents in the Village kopen, Boyolali..

Abstract

Law No. 17/2016 has emphasized that perpetrators of sexual crimes can be castrated, but this is a polemic for medical personnel who are appointed as executor in this action, because eliminating the patient's normal body functions is very contrary to the duties of a doctor. This study aims to obtain answers to legal protection for urology doctors who perform castration and to find out whether the actions taken by urologists at the request of the court were against medical ethics or not. The approach method used in this research is a library research approach with secondary data collection. The results of further research were analyzed qualitatively. Based on the research that has been done, it can be concluded that the urologist who performs castration at the request of the court, means that the action is an order that must be carried out, but this is contrary to professional standards because castration can have a bad impact on the patient and this is very contrary to professional standards and doctor's code of ethics so that it can be concluded that legal protection cannot be provided because the doctor acts contrary to professional standards and doctor's code of ethics. Castration performed by a urologist is against the code of medical ethics even though it is an order from the court. On the other hand, the doctor does not have the authority to act as a direct executor, while the executor himself is actually a public prosecutor, so that the doctor can refuse the action if it is considered contrary to the code of ethics and conscience.

Abstract

ABSTRACT; In health services, hospitals place doctors and nurses as personnel who are most closely related to services to patients, so it does not rule out the possibility of frequent delegation of authority from doctors to nurses for actions taken to patients. In practice, many nurses carry out doctor's orders in the form of medical actions. The task of doctors without clear boundaries with the duties of nurses as nursing care providers, will ultimately have an impact on patient satisfaction in the services of health workers in hospitals. In such conditions nurses and doctors will be very risky to get into legal trouble. The purpose of this study was to determine the hospital's responsibility for the delegation of authority from doctors to nurses, and legal protection for nurses as recipients of delegation of authority. The approach method used in this study is a library research approach with secondary data collection. The nature of this research is prescriptive design, and the data obtained from this research is then analyzed qualitatively. Based on the results of the study, it was found that the hospital's responsibility for the delegation of authority from doctors to nurses, including: conducting guidance and supervision of the act of delegating authority between doctors and nurses, preparing a letter of delegation of authority which is part of the medical record, and fulfilling all the needs that become part of the medical record. the reason for the delegation of authority. Legal protection for nurses as recipients of delegation of authority is divided into 2 (two) parts, namely preventive and repressive efforts. Preventive legal protection, including; prepare, procure, and complete the letter of delegation of authority in writing between doctors and nurses, then carry out the obligations as instructed in the letter of delegation of authority without going outside the limits of authority and reasonableness. Repressive legal protection, including; there is a guarantee from the hospital to the nurse if things happen that are not desirable from the delegation of authority, then there is a responsibility that the hospital can implement towards the delegation of authority from doctors to nurses

Abstract

In Era 5.0, the trading business is increasingly widespread and much-loved by millennials because it promises fantastic income and income. Recently, fake investment news has spread because gambling is disguised as if trading is deceiving investors. Many affiliates and influencers sometimes offer unrealistic profits as a marketing strategy to the detriment of their customers. The purpose of this study is to find out how the trading business is viewed from the legal aspect of business. This research method uses a normative juridical approach with secondary data collection obtained from the literature and legislation. The results of this study were analyzed qualitatively to answer the formulation of the problem. The results of the study show that actually the engagement that occurs between affiliates or influencers with their customers or investors is in accordance with Article 1320 of the Civil Code, but if this trading business leads to online gambling then this becomes a criminal act as regulated in Article 303 of the Criminal Code which carries a maximum prison sentence of 10 years. In Thailand, gambling is prohibited by the B.C. Gambling Act. 2478, however, on October 25, 2011, the Government approved the draft Gambling Bill, which legalized gambling debt. Even so, gambling debts must still be legally processed in court. Gambling must be controlled by the government both in Indonesia and Thailand to improve the economic, social and moral status of the community because the trading business that leads to gambling is very detrimental to one party.
