Abstract

In Article 11 of the Law of Fiduciary determined that the object is in the territory of the Republic of Indonesia or outside the territory of the Republic of Indonesia. Bound by fiduciary shall be registered at the registration office fiduciary duties within the scope of the Department of Law and Human Rights. Fiduciary guarantee a follow-up agreement set out in the fiduciary deed as collateral for the repayment of certain money. This became the preferred fiduciary guarantee for creditors if the fiduciary is registered in Fiduciary Registration Office. This is because the preferred position is guaranteed for their registration. The imposition of fiduciary must be made by Deed in Indonesian and thus constitute a fiduciary warranty deed. Imposition by fiduciary guarantee are then required to be registered in Fiduciary Registration Office. The obligation is in terms of the binding fiduciary and fiduciary registration so that the object of the guarantee that has the power of binding and has the same executorial court decision. Abstract

Notary is a public official who is authorized to make authentic certificates and other authorities referred to in Article 1 (1) of Law No. 30 of 2004. Through the deed he had done, the notary must be able to provide legal certainty to users notary services. Deed made by or before a notary may be authentic proof in providing legal protection to the other parties concerned to the deed regarding the certainty of events or legal actions that do Notary is a professional in his duties should be based on the setting in legislation or code ethics into its internal settings. This research is empirical juridical and socio legal research with constructivism. To answer the question in this study the sociological approach of law. Supervision of the notary in order to uphold the dignity Notary office. Notary responsibility as a public official related to material truth, which is liable to civil Notary of the material truth of the deed he had made; Notary criminally liable for the truth material in deed he made; responsibility Notary Regulation Notary of the material truth in deed that made ;, and responsibility in performing tasks Notary office by a Notary ethical code. Reconstruction accountability Notary as a public official in the deed based on the values of justice through law enforcement against Notary mewujudukan legal certainty based on values of Pancasila, rekonsturksi legal relationship Notary with the parties, the reconstruction of the rights and obligations dissenter Notary, as well as the reconstruction of Article 65 of Law Notary to Notary time limit liability. Abstract

The directions of the establishment of Employment Law Indonesia in the era of globalization is influenced by the tendency of the existing market, labor relations aimed to the flexible work system, the indication is the legalization of the system of labor contracts / specified time work agreements (CTWA), outsourcing and daily paid workers agreement (DPWA), nevertheless in practice the flexibility of labor is still being debated in Indonesia (Agusmidah, 2011 : 359). The core existance of the flexible labor market is an attempt to change the rigid of the labor market to be more flexible and better suited to the climate of competition in the global economy that is increasingly liberal, therefore the various regulations that burden the business, deter the investment, employment and economic growth, should be abolished (Hari Nugroho and Indrasasi Tjandrasingsih, 2007 : 4). The Indonesian state concept in national development is the Welfare State, the state must realize the social welfare and also must provide protection for all citizens as a social defense. Welfare means an expectation of an objective condition where the needs for the material, spiritual, social and citizens has been fulfilled, so that they wil have decent live and able to develop themselves, be able to perform their social function as human beings as the goal to be achieved (Enam Suparman, 2015 : 3). In the specific areas of employment, welfare expentancy is formulated in the Constitution of Article 27 paragraph (2) Constitution NRI 1945, namely: "Every citizen has the right to work and a decent living for humanity" and Article 28 D (2) Constitution NRI 1945 namely : "Everyone has the right to work and to receive remuneration and fair handling and proper treatment in the employment relationship" (Eman Suparman, 2015 : 4). The form of the legal certainty is through the establishment of legislation in the field of employment that today is Law No. 13 of 2003 on Manpower. Based on the considerations of Law No. 13 In 2003, the value of the labor laws are: first, the formulation of labor law should provide protection to workers / laborers and their families in accordance with human dignity and values; second, employment law is also pay attention to the improvement of the business world. The second value must be balanced so that justice is reflected in the substance and implementation of the labor law. However the fact is that these two values are not in accordance with the aspired. This study focused on DPWA as one of the phenomena of labor flexibility, especially in the plantation sector. Palm Wacht research results, the current plantation sector employs 10.4 million workers and as many as 70% of them are workers non- guarantees job that are Freelance Workers, Labor Wholesale, Contract Labor and outsourcing ( Sawit Watch, Pers release,May 12th 2015.)  DPWA is not regulated in Law No. 13 of 2003 but included in the Ministry of Manpower and Transmigration Decree No. Kep.100 / Men / VI / 2004 on the Implementation of the Provisions CTWA. Previously there has been Regulations of the Ministry of Manpower  No. Per-06 / Men / 1985 on the Protection of Workers' Day off, in which among other provisions concerning the employer's obligation to provide the labor social security and threats penalties against violations of several articles. The regulation has been declared invalid by the Ministry of Manpower and Transmigration Decree No. : Kep.100 / Men / VI / 2004 which abolished these provisions. Ministry of Manpower and Transmigration Decree No. Kep.100 / Men / VI / 2004 solely put in 3 (three) articles about DPWA, namely Article 10 to Article 12. This provision is DPWA very flexible and does not clear to the type of work, giving rise to multiple interpretations in implementation, there is no decent wage setting, no social security employment which are the fundamental right of workers. This indicates there are discrepancy between the value of labor law with the substance of the law and its implementation, so as to give rise to injustice.  Based on the description above, it is very urgent and actual to investigate more deeply how the working relationship that is based on DPWA should be built in Employment Law so as to realize the value of labor law with the title reseach : "Reconstruction of The Daily Paid Work Agreement in the Employment Law Based on Justice”

Abstract

UUD NRI Tahun 1945 pasca amandemen, tidak memberi ruang kepada Lembaga Tinggi (MPR) dalam membuat produk Hukum TAP MPR lagi. Akibat dari kewenangan MPR yang sudah dihapus dan jelas tertera dalam Bab I ayat (2) dan Bab II Pasal 3 ayat (1) sampai dengan (3) UUD Tahun 1945 sebelum amandemen. Namun, hal dilematis ini menjadi problematika dan perdebatan antar ahli hukum tata Negara di republik ini, akibat dari Pasal I aturan Peralihan yang menyebutkan pengujian status hukum TAP MPR sebagai batu uji. Status Hukum TAP MPR memiliki legitimasi pada konstitusi, namun yang menjadi persoalan ialah kewenangan MPR dalam membentuk kembali TAP MPR serta mencabut. MPR tidak lagi menjadi lembaga tertinggi Negara melainkan lembaga tinggi yang disamaratakan dengan lembaga-lembaga lainnya yang disebutkan dalam UUD NRI Tahun 1945, sehingga ini menjadi buah simalakama dalam praktiknya akibat dari di hapusnya Kewenangan tersebut, dalam Pasal 1 ayat (2) UUD Tahun 1945 sebelum amandemen, pun juga Pasal 3 ayat (3) UUD Tahun 1945 sebelum amandemen. Judicial Review yang pernah diajukan ke Mahkamah Konstitusi (MK) tidak membuahkan hasil, akibat MK tidak memiliki ruang yang cukup jelas atas pengujian TAP MPR ini, UUD NRI Tahun 1945 memiliki kewenangan hanya menguji UU yang bertentangan dengan UUD bukan TAP MPR yang bertentangan dengan UUD.

Abstract

ABSTRAK Penelitian ini mengenai keabsahan hukum bukti kwitansi jual beli kapal laut di bawah tangan, kedudukan hukum dalam proses peralihan hak atas kapal melalui jual beli di bawah tangan, serta perlindungan hukumnya bagi para pihak yang melakukan transaksi jual beli di bawah tangan, sehingga memberikan pemahaman yang jelas dalam memaknai transaksi jual beli di bawah tangan. Adapun permasalahan pokok: Kepastian hukum terhadap peralihan hak ataskapal di atas 7 GT melalui perjanjian jual beli di bawah tangan di Kota Sibolga. Penelitian ini adalah penelitian yuridis normatif. Hasil penelitian: Secara yuridis formil kapal sebagai objek jual beli tersebut belum sah beralih dari penjual kepada pembeli. Akan tetapi, secara materiil, kapal tersebut telah beralih dari penjual kepada pembeli, sebab telah diserahterimakan yang ditandai dengan dikuasai dan diuasahainya kapal tersebut oleh pembeli. Direkomendasikankepada masyarakat nelayan Kota Sibolga dalam melakukan jual-beli kapal berbobot, sebaiknya menggunakan jasa notaris agar dapat melindungi hak-hak dan kewajiban - kewajiban hukumnya.Kata Kunci: Pendaftaran, Jual-beli, Kapal, Sibolga.

Abstract

The implementation of auctions through Instagram social media often does not provide legal certainty for the parties participating in the auction because many in its implementation are not in accordance with the regulation of the Minister of Finance Number 213/PMK.06/2020 concerning auction implemention guidelines. So that in its implementation can cause disadvantage for the parties carrying out the auction. The research used descriptive analytical juridical normative method. Primary data and secondary data were obtained from library research and field research. The result of the research shows that the legal status of the Instagram account @usedbapeofficial was not an official auction house because it did not meet the requirements as an auction house, which should be in the form of limited liability company and obtaining permission form the Minister. Legal certainty for the owner of the goods has been carried out by @usedbapeofficial in the form of the payment proceeds being transferred to only one account, namely Kenneth Lee’s account as the account owner but does not provide legal certainty regarding when the owner of the goods will receive payment for the goods he auctions, legal certainty for the auction winner has been provides in the form of information that is listed in accordance with the format filled in by the owner of the goods. Legal protection for the owner of the goods is given in the form of holding funds in the @usedbapeofficial account until the goods are received by the buyer, while for the auction winner the legal protection is in the form of preventive and repressive legal protection. The conclusion of this research is the legal status of Instagram account @usedbapeofficial is not an official auction house. Legal certainty for the owner of the goods and the auction winner has not been fulfilled because most of the implementation of the auction on the Instagram account @usedbapeofficial do not comply with the provisions in the regulations of the Minister of Finance Number 213/PMK.06/2020 concerning auction implementation guidelines. Legal protection for the owner of the goods provided by @usedbapeofficial in the form of money auction sales is accommodated in one account, while legal protection for the auction winner has not been fully fulfilled because in its implementation legal protection is not provided by @usedbapeofficial in full to the injured party. It is recommended to @usedbapeofficial to improve the auction procedure into a buying and selling account with an auction mechanism and register its business as a Limited Liability Company, it is suggested to the government to update the regulations governing auction activities through social media, especially Instagram.

Abstract

High rate of smartphone users makes Medan city has big potential for the development of online-base business especially in service application user, such as online transportation. Grab Indonesia is one of the service provider companies for online-base transportation application. Grab sees promising investment value projection in online-base application service as people in Indonesia are highly active users of social media and e- commerce. The problems in this research are whether the agreement between merchant and Grab Indonesia meet the legal construction as electronic contract refers to valid legislation, how is Grab's responsibilities on product quality and safety sold by merchant, and how is dispute settlement procedures between merchant and Grab Indonesia pursuant to agreement contract. This is a normative juridical research with analytical descriptive design that describes the research object through samples or collected data and makes general conclusion. The data are carried out from primary and secondary data, namely primary, secondary and tertiary law; obtained by library study and guided interview. The result demonstrates that agreement between merchant and Grab meet the legal construction as electronic contract refers to valid legislation. Grab's responsibilities on product quality and safety sold by merchant are fully given to the merchant as stated in the term and condition clauses and in Grab's code of conduct. Non-litigation through arbitrage is prioritized in dispute settlement procedures between merchant and Grab pursuant to agreement contract.

Copyright is the exclusive right of a creator that arises automatically based on declarative principles after a creation is realized in a tangible form without reducing restrictions in accordance with the provisions of laws and regulations. The results of the discussion the photographer or the person using the portrait whose subject is a human for commercial purposes must first obtain permission from the person being photographed to be able to use the portrait for commercial purposes, so that the photographer and the person using the portrait do not commit an unlawful act. Legal analysis of Supreme Court Decision No. 262.K.PDT.SUS/HKI/2016 which decided that Siloam Hospital had committed an unlawful act in terms of Law no. 29 of 2014 concerning Copyright is based on paragraph 1 of Article 12 where every photo taken by the photographer with a human object must obtain prior permission from the person being photographed.

Abstract

The existence of ASEAN as an international organization with legal personality was referring to the birth of the ASEAN Charter, 2007. The Charter became effective on December 15,2008 that Indonesia has ratified by Law No. 38 Year 2008. The Charter emphasizes the commitment of regional cooperation within the framework of the ASEAN Community basedon three pillars: political security, economic and socio-cultural. The three pillars areinterrelated for the purpose of peace, stability and prosperity in the ASEAN. One area that was agreed by ASEAN is legal protection for migrant workers. Legal protection for migrant workers is important because of some cases of abuse and torture by the employer, as in the case of Siti Hajar 2009. For the Indonesian legal protection for migrant workers is urgent because the number of migrants is increasing every year and it is the Government's obligation to protect its citizens wherever existence. ASEAN, in the regional level already has legal instruments for the protection of migrant workers namely the ASEAN Declaration of the Protection and the Promotion of the Rights of Migrant Workers. While at the national level, Indonesia has a number of legal instruments related, that is Law No. 13 Year 2003 and Law No. 39 Year 2004 on the Placement and Protection of Indonesian Workers Abroad. Based on the above, this paper will examine first, the protection of the rights of migrant workers within the framework of the ASEAN agreement and the second will examine the comparison between the protections of the rights of migrant workers in ASEAN level with Indonesia national law. The goal is to determine the harmonization and synchronization of the legal protection of migrant workers in ASEAN perspective and the perspective of Indonesian national law.

Abstract

ASEAN's decision to accelerate the implementation of the ASEAN Economic Community (AEC) by 2015 based on the Cebu Declaration, 2007. ASEAN then create a blueprint that describes the steps that must be reached in the AEC in 2015 such as the elimination of taxes and tariffs based on sectors which have been agreed, and all the factors of production such as labor and capital are allowed to move freely crossed the line of ten member countries through the common market. In the field of investment, ASEAN has an ASEAN Comprehensive Investment Agreement (ACIA) to conduct a review of the Framework Agreement on the ASEAN Investment Area (AIA) and ASEAN Investment Guarantee Agreement (IGA). The establishment of ACIA is to encourage a more liberal investment environment, transparent, competitive and facilitative. Indonesia has been preparing the investment regime under ASEAN for example by creating a variety of legal instruments to further open the influx of foreign investment and ensure equal treatment of foreign investors to domestic investors as desired by the ACIA. The problem today is that besides the existence of ACIA as regional investment agreements under the ASEAN there is also a multilateral investment agreement under the WTO (TRIMs). In most small scale there is also Bilateral  Investment  Treaty  (BIT). That  condition is  still added  to the  national investment regimes of each country, including for example the Indonesian national investment laws. Based on the above, this paper will examine the ASEAN agreement on investment (ACIA) and the Indonesia national legal arrangements. Then it will also examine Indonesian Government policy on BIT with respect to the ACIA. The purpose of this study was to explain the relevance of Indonesia’s national investment law harmonization with ASEAN Agreement and to determine the relevance of the BIT with the ACIA.
