Abstract

This article aimed to study about how role of UNHCR in refugee protection and  the legal protection for Rohingya refugees in Medan municipality. According to data from the United Nations High Commissioner for Refugees (hereinafter abbreviated to UNHCR) since January 2012, there were 3275 asylum seekers and 1052 refugees. Most refugees come to Indonesia with the hope of being permanently resettled elsewhere, often in America or Australia, but increasingly stringent immigration policies, massive underfunding and a lack of resources to sustain the influx of newcomers have left them stuck here. This research uses a sosio-legal research with statute approach, conceptual approach, and case approach. There are several provisions regarding refugees, but none have specifically discussed the handling of refugees in Indonesia. The positive law of immigration in Indonesia does not contain any special provisions (lex specialis) for asylum seekers and refugees. Because Indonesia has not ratified the 1951 Convention and 1967 Protocol, the Indonesian government does not have the authority to deal with refugee problems. The authority to handle refugees is given to international organizations such as UNHCR which is a UN organization, IOM, ICRC and various other organizations or NGOs engaged in the humanitarian sector. However, the handling of this international organization has not been implemented optimally due to obstacles

Abstract

The philosophy of juvenile justice system is to emphasize the rehabilitation of children in conflict with law as a person who has restrictions compared with adults. Children need the protection of the state and the society in the next period. It is necessary to seek a minimum intervention of the juvenile justice system against the children in conflict with law as a good strategy to protect them. The ultimum remedium/the last resort principle aims to protect the children in conflict with law in order to get their brighter future by keeping them away of the formal juvenile justice system and put it as the last choice to solve their cases. The ultimum remedium/the last resort principle is also useful to help the children in conflict with law by giving them warn and chance so that, they can find their identity and be the man in charge for themselves, their family, their society and their country. There will no presecution against the children in conflict with law and also they wont known as convict by applying the ultimum remedium/the last resort principle. It is why the juvenile judges need to really understand the principles of law and regulations relating to the disposal of the child so as to produce a wise judgment for the children in conflict with law.

Abstract

ABSTRACTPractice to action discriminative as collision of light human right in law order have been arranged in section 28B sentence (2), section 28I sentence (2) Indonesian constitution 1945 post amendment, then section 1 number 1 of constitution No. 40/2008 about discrimination disposal, race and ethnical, then discrimination context as collision of human right have been assured in section 1 number 3 of constitution no 39 the year 1999 about human right, so that action diskriminative has ought to be punishable if it has done. hence to action discriminative can be given sanction of imprisonment at longest one (1) year or penalty fine maximum one hundred million rupiahs according to at section 15 and 16 of constitution No. 40 the year 2008 about discrimination disposal race and ethnical. Refers such a of action perpetrator discriminative instead seldom be punished and their case have never been brought to justice of human right as justice judging about collision human right. Action discriminative as collision of light HAM cannot be judged in HAM justice domain, caused existence of historical reason that is, in Statute Roma 1998 adopting existence of four badness numbers which can be judged in ICC among others, badness of genosida, crimes againt humanity, badness of war and badness of aggression however doesn't coronate to collision of light HAM like action discriminative as collision of light HAM as which included in DUHAM 1948. Reason of yuridis, according to section 4 constitution No. 26 the year 2000 about justice of human right expresslies state that collision of human right which can be judged in justice of human right is collision of heavy HAM that is badness of genosida and badness to humanity outside from the badness justice of HAM doesn't have authority to investigate breaks and judges it, then reason of basis yuridis as presentation of the forming of constitution justice of human right in judging is special for collision of weight HAM which can be judged in justice of human right but not to collision of light HAM.Keyword : analysis yuridis, action discriminative, and light collusion human right.

Abstract

ABSTRACTBank as a financial intermediary institution often takes a risk of giving negative effect on economy and banking growth. In order to avoid the risk, every management (in this case, board of directors) has to apply risk management in order to give the picture of the loss which be faced by the Bank. Risk is applied by director management in order that the Bank does not undergo loss; therefore, he should keep clients’ finance properly and keep people’s trust. The application of management risk is implicitly stipulated in Law on Banking in due diligence principle and explicitly in PBI No. 11/25/PBI/2009 on Risk Management for Public Bank. If the application of risk management is applied by the director properly and the Bank still undergoes the loss, it is not the director’s responsibility personally. If the loss is caused by the director’s negligence and the lack of carefulness and good faith so that the Bank undergoes the loss, he is personally responsible for it.Keywords: Banking Risk Management, Director’s Responsibility

Abstract

ABSTRACTDumping is the practice of selling commodities in foreign markets at less than normal value. The member countries of GATT / WTO have used instruments of antidumping duties against unfair trade practices and allows members to apply anti-dumping duties. Indonesia and Philippines are part of members in WTO and have ratified the GATT-WTO provisions and should have an obligation to obey all the set provisions to their national laws. Although in the application of anti-dumping provisions, Indonesia and the Philippines are still referring to the provisions in the Antidumping Agreement, but the application of laws regulations is different. The differences are to determine the normal value of antidumping policy in Indonesia does not regulate the export price calculations based on CIF or FOB. Other factors that may affect the normal value as exchange value of the currency, Antidumping policy in Indonesia also not set up a special relationship between a producer and an exporter that should be excluded in the determination of the domestic industry and about the protection of domestic industry in Indonesia is regulated Antidumping Policy on Custom Law, while in Antidumping policy in Philippines is set in its own provisions.Keywords : Antidumping, Comparative

Abstract

ABSTRACT Criminal act of gambling is set up in a variety of regulations in Indonesia, namely Article 303 of the Criminal Code, 303 bis of the Criminal Code, Law no. 7 of 1974 on Gambling Control. In particular online gambling regulated in Article 27 paragraph (2) of the Act ITE. Coverage gambling within the context of Article 27 paragraph (2) of the Act ITE are in the context of Article 303 bis of the Penal Code and Article 303 of the Criminal Code.  In the investigation of online gambling, the investigator based Act ITE and Criminal Procedure Code. Countermeasures of online gambling in penal done with arrest, detention, search and seizure. Countermeasures non-penal done by cyber patroling. There are several inhibiting factors in Countermeasures the crime of gambling online, inhibiting factor in terms of the law, which is where the investigator difficulty of implementing Article 43 paragraph (6) of the Act ITE., lack of quality and quantity of investigators. not given compensation as a form of tribute to the investigator for his achievements. Terms of the legal culture of society is the number of Indonesian society in the category of poor, high unemployment, cultural lazy to earn money with a short path with gambling. gambling has become a tradition in many areas. Abstract

ABSTRACT The regulation on the discharge of police officers is stipulated in Law No. 2/2002 on the Republic of Indonesia State Police and on PP (Government Regulation) No. 1/2003 on the Discharge of Police Officers. The legal enforcement in the case No. 52/G.TUN/2005/PTUN-MDN has been in line with the provision of the prevailing law of procedure. The obstacle faced by judges in executing the Ruling No. 52/G.TUN/2005/PTUN-MDN is caused by the legal provisions which do not firmly regulate the enforcement of execution of the Ruling of the State Administrative Court, the absence of enforcement institution as the executor of the ruling, and the absence of sanction on the non-compliance to the ruling. Plaintiffs’ obstacle in executing the ruling is also related to the absence of a firm regulation in Law No. 2/2002 and in PP No. 1/2003 related to the court’s ruling on discharge. Abstract

ABSTRACT The Ruling of the Supreme Court on the case of PT. Telkomsel, the Supreme Court does not specify the compensation for the curator, whereas it has stipulated by the panel of judges of the Supreme Court. The objective of the research was to answer the problems about the right and obligation of a curator, the regulation on the compensation for a curator, and the right and obligation of a curator after the Ruling on the cancelation of bankruptcy in the cassation level by the Supreme Court on the case of PT. Telkomsel vs. PT. Prima Jaya Informatika was stipulated. Curator’s task is to manage and/or to settle bankruptcy property, while his right is to get compensation for his service through a judge’s verdict. According to UUKPKPU, the compensation for a curator’s service is charged to the petitioner and the debtor of the bankruptcy; but, according to Kepmen No. M.09-HT.05.10/1998, it is charged to a debtor. According to Permenkumham No. 1/2013, it is charged to the petitioner of the bankruptcy.  After the ruling on the cancellation of bankruptcy in the cassation level on the case of PT. Telkomsel is specified, the obligation of the curator was to announce the ruling in the cassation in the news of the Republic of Indonesia, at least in two daily newspapers. Under the law, a curator’s right should be specified in a judge’s verdict; but, in reality it is not stipulated in the Supreme Court’s Ruling. Keywords: Right, Obligation, Curator, Bankruptcy

Abstract

ABSTRACT Sexual exploitation of children is a serious violation of Human Rights. Handling of this problem is being the main destination countries in the world including Indonesia. Child marriage is one of sexual exploitation crimes againts children, specially to the girls. It has increased year by year. Decision of court with Number 690K/PID.SUS/2010 is one of sexual exploitation of children in the marriage. Based on the survey results revealed that the settings on the prohibition of sexual exploitation in the early marriage is not expressly regulated in the law, but the actions are prohibited. Judge's decision not to accommodate the implementation of the protection of children who are victims of sexual exploitation in the early marriage, because it is concentrated to criminal punishment only. Recommended to the government to immediately assess, formulate, and implement policies abolition of child marriages below the age of criminal sanctions is high, in order to create legal certainty. Revise the Marriage Act by raising the marriage age limit for women. Conduct an education and specialized training to judges on the application of the law of the child, as well as involving them in seminars or forums that discuss the issue of children, in order to create a child protection efforts.

Abstract

ABSTRACT PT. Direct Vision applied a request for rejecting the execution on the Rulings of SIAC in 2010 because of the violation against public order. However, the Central Jakarta District Court and the Supreme Court refused the request for rejecting the execution on the ruling of SIAC in 2010 in Indonesia. Legal provision which regulates the rejection for the execution on the International Arbitration decision according to UUA, APS, and new York 1958 convention permits that the request can be filed to the Court in the petitioner’s country, but the cancelation can only be filed in the country where the decision is made. The main reason for the panel of judges to refuse the request for execution on SIAC decisions in 2010 was because PT. Ayunda Prima Mitra simultaneously filed a complaint about illegal action in the South Jakarta District Court against Astro Group Malaysia. It is recommended that UUA and APS should set the period of the International Arbitration registration, the reasons for rejecting the execution on the International Arbitration Decisions should not be mixed with the reasons for rejecting and canceling, and PT. Direct Vision should wait for the decision to execute from the South Jakarta District Court.   Keywords: International Arbitration, Public Order
