Abstract

The occurrence of pros and cons regarding the law of Tabarruk practice against Habaib requires hadith research on the direction of Tabarruk. Because to know the law requires an in-depth study of the meaning of the hadith text itself. This study aims to provide readers with an understanding of the importance of understanding the text of the Prophet’s Hadith. In addition, they also know the methods used by classical and contemporary scholars in practicing Hadith. This research is field research with a qualitative approach. Gedongsari Islamic Boarding School, the administrators and the students, are the main objects of this research. The primary source for the research theories is the book al-Jami’ ash-Shahih by al-Bukhari. Several works such as al-Mutashaddidun by Ali Jumah Muhammad, Mafahim Yajibu ‘an Tushahhah by Sayyid Muhammad Alawi, al-Mulakhas fi Syarh Kitab at-Tauhid by Fauzan Salih, and Fath al-Majid Syarh Kitab at-Tauhid by Abd Rahman Hasan Alu Syaikh are considered as the minor sources. The Hadith about Tabarruk is a category of valid Hadith that can be used as evidence. Al-Qur’an and hadiths with the same theme also corroborate the Hadith. In practice, the practice of the Tabarruk tradition that has been attached and rooted in the Gedongsari Islamic Boarding School is not all based on hadith encouragement. However, several factors influence these habits. It cannot be separated from this habit from the dogma that the kiais and teachers have taught.

Abstract

This study examines the management transformation of the One-Stop Integrated Service (PTSP) at the Ministry of Religious Affairs in Malang City, which achieved a 92% Public Satisfaction Index (IKM) in 2023 from 78% in 2020, with service time reduced from 4.7 to 1.9 working days. Despite growing literature on PTSP efficiency, no study has comprehensively examined the full management transformation cycle within a religious institution while integrating Islamic values as its normative governance foundation. Using a qualitative case study design, data were collected from key informants comprising structural officials, PTSP staff, service users, and public service experts through in-depth interviews, participatory observation, documentation, and focus group discussions, then analyzed using the Miles, Huberman, and Saldana interactive model. Four novel conceptual constructs emerged: the TRUST model (Transformational Religious-based Unified Service Trust), SMART model (Strategic Management Assessment Responsive Transformation), SERVE model (Service Excellence and Responsive Value Engagement), and ETHIC model (Ethical Transparency and Human-centered Institutional Governance), integrating into the overarching SDG–PTSP model (Spiritual Digital Governance for Public Service Transformation). A key theoretical contribution is the extension of Lewin’s (1947) organizational change model from three to four stages, adding Re-Freeforming as a phase of continuous spiritual-digital renewal unique to religious bureaucracies. Keywords: PTSP transformation; public service quality; digital governance; Islamic values; SDG–PTSP; religious bureaucracy.
Reinterpreting Uang Panai: Between Cultural Values and Social Burdens through Ṭāhir Ibn ʿĀshūr's Maqāṣid al-Sharīʿah Muh. Ishak, Andi; Sumbulah, Umi

Abstract

Uang panai is a customary marriage tradition among the Bugis community that embodies symbolic values of respect, sincerity, and the prospective groom's responsibility toward the prospective bride. However, contemporary social transformations have gradually altered its original meaning, turning uang panai into an economic burden that may hinder marriage. This study examines the practice of uang panai as a reflection of the tension between cultural values and burdensome tradition through a thematic analysis of the Qur'an from the perspective of Ṭāhir Ibn ʿĀshūr's maqāṣid al-sharīʿah. Employing a qualitative case study approach, the research combines descriptive-analytical methods with a thematic examination of Qur'anic verses concerning marriage, justice, facilitation, and public welfare (maṣlaḥah). The findings indicate that the Qur'an consistently emphasizes the principles of ease (taysīr), justice (ʿadl), and the prevention of harm in the institution of marriage. From the perspective of Ṭāhir Ibn ʿĀshūr's maqāṣid al-sharīʿah, social customs are considered legitimate only insofar as they remain consistent with the higher objectives of Islamic law, particularly the protection of lineage, property, and social harmony. Accordingly, the practice of uang panai should be critically reinterpreted and proportionally reconstructed so that its cultural significance can be preserved while remaining aligned with the objectives of the Sharīʿah and the ethical spirit of the Qur'an.

Abstract

Post-deradicalization radicalism remains a serious concern, particularly when former terrorism convicts return to their families and communities. This article analyzes the strengthening of family resilience as a counter-radicalization model for former terrorism convicts in Sampang Regency, Indonesia. This study employed an empirical qualitative approach with a case study design. Data were collected through observation, in-depth interviews, and documentation involving former terrorism convicts, family members, local government officials, security actors, religious leaders, and socio-religious organizations. The data were analyzed using Lawrence M. Friedman’s legal system theory and Jamaluddin Athiyah’s Maqashid al-Usrah perspective. The findings reveal that family resilience plays a strategic role in preventing the risk of re-radicalization through the strengthening of family communication, economic stability, moderate religious education, psychosocial support, and social acceptance. From Friedman’s perspective, the effectiveness of counter-radicalization depends on the synergy between legal structure, legal substance, and legal culture. Meanwhile, the Maqashid al-Usrah perspective affirms that family strengthening is aligned with the protection of religion, life, intellect, lineage, family institutions, and family economic stability. This article offers a family resilience-based counter-radicalization model that integrates the legal system approach and Maqashid al-Usrah as a conceptual contribution to the prevention of violent extremism in the post-deradicalization phase.

Abstract

This paper examines how the views of Joseph Schacht is an orientalist scholar in the field of Islamic law who has done a lot of hadith criticism. Through his work, The Origins of Muhammadan Jurisprudence, Schacht states that the hadiths were made by scholars of the second and third centuries of hijra because in the past the hadiths had not been well codified. The view of this student of Ignaz Goldziher towards the hadith was developed by three theories, namely, the projecting back theory, the theory of argumentum e silentio, and the common link theory.

Abstract

Debates concerning women’s roles in public and domestic spheres remain a dynamic and contested issue within Muslim societies. This study seeks to negotiate the competing paradigms that support and oppose women’s positioning in these two domains by employing feminist hermeneutics and the qirāʾah mubādalah approach. The research adopts a historical–factual design based on a library research method. Data are collected through systematic documentation of relevant texts and analyzed using a descriptive qualitative approach, with validity ensured through source triangulation and data cross-checking. The findings indicate that a proportional reinterpretation of women’s public and domestic roles requires a transformation in mindset among both men and women, enabling each to optimize their respective potentials and contributions. Gender equality is understood not as a fixed or static endpoint, but as a dynamic and evolving condition in which men and women share balanced rights, obligations, roles, and opportunities grounded in mutual respect. The study emphasizes several foundational principles: reciprocity (mubādalah) in gender relations, the central role of education as a cornerstone of gender equality, and the synergistic relationship between public and domestic roles. Accordingly, both men and women possess the legitimate right to determine and perform roles that correspond to their capacities, potentials, and personal choices, whether within the family or in the broader social sphere.

Abstract

The issue of gender equality between men and women continues to be a global concern, not only in developed countries, but also in developing countries such as Indonesia with a majority Muslim population. Although Islamic teachings are claimed to have emphasised the principle of equality, the practice of gender injustice still occurs because of the strong patriarchal culture, biased interpretation of religious texts, and laws that have not fully sided with women. This inequality appears in the context of family law, such as the designation of the husband as the head of the family in the Marriage Law, which strengthens the social construction of the patriarchal culture itself. This research is empirical and uses a structured interview method with a phenomenological approach. Digital media becomes an innovation and a new space in demonising the discourse of gender equality. One of the figures who utilises this space is Nur Rofiah, through the Ngaji Keadilan Gender Islam (KGI) platform in various online media such as instagram, youtube, and zoom meetings. Nur Rofiah uses the Al-Qur'an interpretation approach with the perspective of women's true justice to raise public awareness of the issue of discrimination against women, especially in the family. This research aims to analyse how Nur Rofiah's motive in mediating da'wah about gender equality through digital media. This study is important because it offers a new perspective on Islamic da'wah strategies that are more flexible and can be reached by many people, as well as being an effective means in building relationships between men and women, husbands and wives in a household with a gender justice perspective.
