Abstract

In general, there are three inheritance regulations that apply in Indonesia, namely Islamic inheritance regulations, customary inheritance regulations, and inheritance regulations governed by the state. The research focuses on: How is the practice of land inheritance in the Awo community of Baraka District? What are the obstacles in the implementation of Islamic inheritance in the customary inheritance law of the Awo community in Baraka District? And how is the Maslahah perspective on the land inheritance system in the Awo community of Baraka District? This study uses a qualitative field research method with a normative theological and ethnographic approach. The data sources are community leaders, religious leaders, and the Awo community. Data was collected through observation, interviews, and document studies. The findings of this study show that the land inheritance system in the Awo community has been maintained across generations through oral tradition. Inheritance land, known as "manah," is a family asset managed collectively. This system is based on the bilateral principle, which provides equitable inheritance rights to descendants. The implementation of the Islamic inheritance system in the Awo community faces challenges, as there is a conceptual difference between customary inheritance, which grants equal rights to both men and women, and Islamic law, where inheritance distribution differs. There is also a strong influence of local traditions and a lack of understanding of Islamic law. The land inheritance system in the Awo community can be analyzed through the Maslahah approach, which aims to achieve benefits in accordance with Islamic jurisprudence principles. Unlike Islamic law, this land inheritance practice provides benefits by maintaining the unity of assets and ensuring the sustainability of livelihoods. The collective system applied supports the Maqasid al-Syariah. By maintaining the inheritance system, the land remains a heritage passed down through generations, which has implications for the preservation of wealth (hifz mall) and descendants (hifz nasl).

Abstract

The objective of this study is to explore and analyze the application of maqāṣid al-syarī'ah in the context of contemporary Islamic law, with a focus on how maqāṣid principles can be applied to address the challenges faced by Islamic law today. In an era of globalization and rapid social change, many aspects of Islamic law need to be adapted in order to remain relevant and responsive to the needs of modern society.. The aim of this research is to explore and analyze the application of maqāṣid al-syarī'ah in formulating fairer and more relevant laws, as well as to provide applicable examples of how these principles can be used in real cases, such as family law and sharia economics. Using a kualitatif approach, this study analyzes relevant literature and legal documents. The results indicate that the application of maqāṣid al-syarī'ah can not only improve adherence to Islamic law but also provide innovative solutions for complex contemporary problems. It is hoped that this research can make a significant contribution to the development of Islamic law that is more responsive and inclusive, as well as strengthening understanding of maqāṣid al-syarī'ah in a modern context.

Abstract

This study discusses the role of the Makassar City Religious Affairs Office (KUA) in preventing marital violations based on the principle of maṣlaḥah mursalah. The aim is to obtain a complete picture of the position of the Religious Affairs Office (KUA) as the front guard in resolving various problems and marital violations in the community. This study is qualitative using a descriptive phenomenological approach. Data were obtained from two types of sources, namely primary sources and secondary sources. Primary sources are carried out through interviews, observations, and documentation whereas secondary sources are in the form of certain documents, standard books, articles, or other materials related to the topic studied. Interviews were conducted with the Head of KUA, Penghulu, and office staff. This study involved five KUA in Makassar City with a case study approach that was analyzed in depth through the principle of maṣlaḥah mursalah. This study found that the KUA in Makassar City has played an active role in taking various strategic steps to realize flexible marriage law policies that are in line with the dynamics and needs of society. Other policies that have also been implemented include the formation of a special team, the implementation of routine studies on Islamic marriage law, and increasing cooperation with research institutions. This policy is implemented to make marriage law relevant and responsive to social change. All of this is evidence that in addition to being a public service institution, the KUA in Makassar has also played a role in maintaining legal flexibility so that it remains in line with the interests of the wider community.

Abstract

If the bodies of transgender people who have had genital surgery are carried out according to their original gender, it will cause harm to Muslims. For example, transgender women who are originally male are bathed by men, while their body condition has changed to that of a woman. If it is held according to the current gender it will cause harm to the Islamic religion, namely as if the act of changing gender is permissible. Both of these conditions cause harm. This research aims to analyze the rules of al-ḍarar al-ashaddu yuzālu bi al-ḍarar al-akhaf during the procession of washing the body of a transgender persons that solutions can be found to alleviate these disadvantages. This research is qualitative literature research with a normative juridical approach. The results of the research explain that in the process of washing, the lightest harm is to return the body to its original law. In order to further alleviate the harm that must be done, the washing procession is described in the condition of khunsa musykil, namely that the body can simply be placed in public without washing it, as agreed by the majority of ulama. This is done to protect the private parts and prevent Muslims from seeing and touching it and it is better if the person holding the body is from their own family. Heavy adversity can ultimately be eliminated by enduring lighter adversity and light adversity can still be alleviated by referring to the law of bathing khunsa musykil.

Abstract

Norma atau kaidah-kaidah adalah ketentuan atau peraturan-peraturan yang memberi batasan dan kebebasan kepada se- sama anggota masyarakat, serta mengatur hubungan antara seorang anggota masyarakat dengan yang lain dalam pergaulan hidup sesamanya. Norma atau peraturan hidup itu mulai tumbuh sejak manusia mengenal hidup bermasyarakat, pertumbuhan dan perkembangannya akan melahirkan beberapa macam norma sesuai dengan sumbernya. Norma yang tumbuh dalam masyarakat yang berkaitan dengan norma  hukum, antara lain meliputi norma agama, norma etika, norma sopan santun, dan norma hukum itu sendiri. Norma-norma tersebut sangatlah mempengaruhi dalam fikih sosial  sebagai  dasar dalam pergaulan hidup dalam berbangsa dan bernegara.

Abstract

This research aims to determine the results of the implementation of the tahfiz al-Qur'an learning program at the tahfizhul Qur'an al-Imam Ashim Makassar Islamic boarding school. This type of research is classified as qualitative with the research approach used being a theological-normative and pedagogical approach. The data sources in this research are foundation administrators and teachers in the tahfiz al-Qur'an program. Furthermore, the data collection methods used are observation, interviews, documentation and reference tracking. Then, data processing and analysis techniques are carried out through three stages, namely data reduction, data presentation, and drawing conclusions. The results of this research show that the implementation of the Al-Qur'an learning program is said to be good based on the various achievements and graduation activities that have been achieved and participated in by the students of the Al-Qur'an Tahfiz program. To the leadership and supervisors of the Tahfizhul Qur'an Al-Imam Ashim Makassar Islamic Boarding School to continuously encourage and contribute to developing the learning system in terms of concepts and providing intensive supervision. To teachers and teachers of the Koran to continue to innovate and develop various models and learning strategies in teaching the Koran, so that students can adapt models that suit their talents and abilities. Students should always maintain istiqamah in good behavior, especially regarding ethics and manners regarding learning the Koran. Abstrak Penelitian ini bertujuan untuk hasil implementasi pembelajaran program tahfiz al-Qur’an di pondok pesantren tahfizhul Qur’an al-Imam Ashim Makassar. Jenis penelitian ini tergolong kualitatif dengan pendekatan penelitian yang digunakan adalah teologi-normatif dan pendekatan paedagogik. Adapun sumber data dalam penelitian ini adalah pengurus yayasan dan juga guru-guru pada program tahfiz al-Qur’an. Selanjutnya metode pengumpulan data yang digunakan adalah observasi, wawancara, dokumentasi, dan penelusuran referensi. Lalu, teknik pengolahan dan analisis data dilakukan melalui tiga tahapan, yakni reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian ini menunjukkan bahwa implementasi pembelajaran program al-Qur’an dapat dikatakan baik berdasarkan berbagai prestasi dan kegiatan wisuda yang diraih dan diikuti oleh para santri program tahfiz al-Qur’an. Kepada pimpinan dan para pengawas Pondok Pesantrean Tahfizhul Qur’an Al-Imam Ashim Makassar untuk terus-menerus mendorong dan memberikan kontribusi dalam mengembangkan sistem pembelajaran dari segi konsep dan memberikan pengawasan yang intensif. Kepada guru dan pengajar al-Qur’an untuk terus berinovasi dan mengembangkan berbagai macam model dan strategi pembelajaran dalam mengajarkan al-Qur’an, sehingga para santri dapat menyesuaikan model yang sesuai dengan bakat dan kemampuan mereka. Bagi santri hendaknya selalu menjaga keistiqamahan dalam berperilaku baik khususnya kepada etika dan adab terhadap pembelajaran al-Qur’an.

Abstract

Penelitian ini bertujuan untuk mengemukakan kaidah pembagian harta warisan masyarakat di Kecamatan Tellu Siattinge Kabupaten Bone dan selanjutnya dikaji dalam pandangan hukum Islam. Jenis penelitian ini adalah field research deskriptif kualitatif dengan menggunakan tiga pendekatan yaitu teologis normatif (syar’i), yuridis formal dan sosiologi. Sumber data utama yaitu wawancara terhadap tokoh agama, tokoh masyarakat dan masyarakat di Kecamatan Tellu Siattinge. Selanjutnya data dikumpulkan melalui wawancara, observasi dan studi dokumen. Data kemudian diolah dan dianalisis dengan tiga tahapan yaitu reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa kaidah pembagian harta warisan masyarakat di Kecamatan Tellu Siattinge Kabupaten Bone ada dua yaitu mendahulukan kesepakatan daripada penentuan mutlak seperti dalam hukum kewarisan Islam dan mendahulukan ahli waris yang membutuhkan daripada hak-hak yang mutlak diperoleh dari ahli waris yang lain kemudian prinsip ini belaku melalui kesepakatan bersama antara ahli waris. Kaidah pembagian harta warisan masyarakat di Kecamatan Tellu Siattinge Kabupaten Bone tidak sesuai menurut hukum Islam terutama dalam fikih mawāriṡ, namun karena kaidah pembagiannya dilakukan atas dasar kesepakatan bersama (islah) dan saling membantu, sedang hal tersebut dibolehkan dalam Islam, maka hal itu dibolehkan dengan catatan selama hak-hak setiap ahli waris diperhatikan dan tidak terjadi konflik dalam pembagian harta warisan.

Abstract

Penelitian ini bertujuan untuk mengemukakan rumah sebagai bagian anak perempuan dalam tradisi pembagian harta warisan di Kecamatan Ponre Kabupaten Bone dan selanjutnya ditelaah menurut hukum waris Islam. Jenis penelitian ini adalah field research deskriptif kualitatif dengan menggunakan tiga pendekatan yaitu teologis normatif (Syar’i/‘Urf), sosiologi dan yuridis formal. Sumber data utama yaitu masyarakat yang terlibat langsung serta pihak-pihak yang dianggap berkompeten untuk memberikan informasi. Data dikumpulkan melalui studi dokumen, observasi, wawancara dan dokumentasi. Kemudian data yang diperoleh diolah dan dianalisis dengan tiga tahapan yaitu reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian ini menunjukkan bahwa tradisi rumah sebagai bagian anak perempuan, secara eksplisit tidak sesuai dengan hukum farāiḍ dan secara tekstual bertentangan dengan nash, tetapi berkaitan dengan hukum kewarisan Islam karena secara kontekstual tujuannya sama yakni untuk kemaslahatan. Kemudian rumah diperuntukkan kepada anak perempuan karena beberapa alasan yang dijadikan pertimbangan, yakni (1) Karena tinggal bersama orang tua (2) Mengikuti tradisi (3) Tidak mampu membikin rumah sendiri (4) Pertimbangan orang tua yang disepakati para ahli waris (5) Ahli waris lain telah mapan (6) Karena belum menikah (7) Ahli waris laki-laki telah mengambil bagiannya. Adapun bentuk keadilannya, yaitu (1) Dilakukan berdasarkan kesepakatan (2) Bagian yang diperoleh sewajarnya (3) Tradisi kewarisan yang dianggap baik (4) Anak perempuan lebih banyak berperan dalam merawat orang tua (5) Memberikan peluang yang sama bagi para ahli waris untuk mewarisi rumah. Selain itu, dalam pelaksanaannya mengutamakan prinsip assitujungeng, asitinajang, assisompungeng lolo untuk mewujudkan rasa keadilan.

Abstract

Pokok masalah dalam penelitian ini adalah pertimbangan hakim terhadap pemberian izin perkawinan poligami menurut undang-undang RI Nomor 1 Tahun 1974 tentang perkawinan. pokok masalah tersebut dibagi menjadi tiga sub masalah, yaitu:  1) Bagaimana jenis pertimbangan hakim dalam pemberian izin perkawinan poligami di Pengadilan Agama Sungguminasa?, 2) Bagaimana persyaratan pemberian izin perkawinan poligami di Pengadilan Agama Sungguminasa?, 3) Bagaimana prosedur pemberian izin perkawinan poligami di Pengadilan Agama Sungguminasa? Jenis penelitian ini adalah field research kualitatif dengan pendekatan yang digunakan ialah pendekatan yuridis normatif, teologis normatif dan sosiologis. Adapun sumber data penelitian ini ialah data primer, sekunder dan tersier. Metode pengumpulan data yang digunakan ialah wawancara, studi dokumen dan observasi. Teknik pengolahan dan analisis data dilakukan dengan reduksi data, penyajian data, dan menarik kesimpulan. Hasil penelitian di Pengadilan Agama Sungguminasa menunjukkan bahwa: 1) pemberian izin poligami di pengadilan Agama Sungguminasa tidak selamanya mengacu kepada undang-undang Perkawinan dan Kompilasi Hukum Islam akan tetapi dilihat dari segi kemaslahatan dan kemufsadatan. 2) dorongan seks yang tinggi menjadi salah satu syarat dikagabulkan permohonan izin poligami. 3) prosedur izin poligami yang sangat penting adalah persetujuan dari istri serta surat pernyataan berlaku adil dan kemampuan secara material. Implikasi dari penelitian ini adalah: 1) perlunya pertimbangan yang matang sebelum melakukan poligami karena poligami dapat menambah beban tanggung jawab. 2) perlu adanya sosialisai kepada masyarakat tentang perlunya kesadaran hukum akan dampaknya perkawinan poligami,serta diperlakukan aturan yang jelas yang mengatur tentang suami yang punya  kemampuan seksual yang tinggi.
