Abstract

All forms of violence against women and children in the household are violations of human rights and crimes against human dignity as well as forms of discrimination that must be abolished. However, the psychological violence that occurs in the community, which as of this writing is in Grobogan Regency, is still difficult to find the exact number and is hampered in the process of proving it. The method used in this research is sociological juridical. This paper aims to determine the regulation of psychological violence itself that has been applied in Indonesia and then to describe the legal culture of the community against the occurrence of psychological violence. Basically, the concept of psychological violence is commonly found in the law on the elimination of domestic violence and the law on child protection. It is society habits if there is a psychic occurrence are still in doubt and consider the problem to be a private family problem, even if it is considered a light and embarrassing thing to be disclosed as a form of violence.[]Segala bentuk dari kekerasan terhadap perempuan dan anak dalam rumah tangga merupakan pelanggaran hak asasi manusia, kejahatan terhadap martabat kemanusiaan serta bentuk diskriminasi yang seharusnya dihapuskan. Namun kekerasan psikis yang terjadi di masyarakat yang pada tulisan ini di Kabupaten Grobogan, masih sulit ditemukan jumlah pastinya serta terganjal pada proses pembuktiannya. Metode yang digunakan dalam penelitian ini adalah yuridis sosiologis. Maka tulisan ini bertujuan untuk mengetahui pengaturan dari kekerasan psikis itu sendiri yang telah berlaku di Indonesia kemudian  mendiskripsikan budaya hokum masyarakat terhadap terjadinya kekerasan psikis. Pada dasarnya konsepsi kekerasan psikis bias ditemukan didalam undang-undang tentang penghapusan kekerasan dalam rumah tangga dan undang-undang perlindungan anak. Kebiasaan masyarakat jika terjadinya   psikis masih ragu dan menganggap masalah tersebut masih merupakan masalah privat keluarga bahkan dianggap hal yang ringan dan memalukan untuk diungkap sebagai bentuk kekerasan.

Abstract

Keberadaan Rumah sakit selain memberikan dampak positif sebagai media kesehatan juga memberikan konsekuensi negatif yaitu menghasilkan limbah bahan berbahaya dan beracun (B3) sehingga perlu mendapatkan perhatian. Penelitian ini bertujuan untuk memberikan acuan bagi pihak berkepentingan dalam upaya memajukan pengelolaan limbah B3 dari rumah sakit. Jenis penelitian ini bersifat yuridis empiris, bahan penelitian tersusun atas data primer dan data sekunder. Data-data yang diperoleh dengan metode deskriptif kualitatif. Berdasarkan hasil penelitian kondisi pengelolaan limbah B3 medis rumah sakit belum sesuai dengan persyaratan sebagaimanaterkandung dalam peraturan. Keadaan tersebut diantaranya meliputi pembuangan limbah medis ke lingkungan secara langsung, pengelolaan limbah tanpa izin, pengolahan limbah yang tidak memenuhi kriteria, dependensi jasa pengolah limbah, terbatasnya pengetahuan untuk pengelolaan limbah medis bagi pelaksana maupun aparat penyelidik.

Abstract

The phenomenal of forest destruction in Bima NTB is motivated by various factors, including agricultural factors, policy factors and inter-regional timber trade systems, business development and timber trade is carried out in unlawful ways such as falsification of forest product documents, logging and timber management without a permit. The purpose of this study is to find out the general description of illegal logging crimes in Bima, prevention efforts and the model of accountability for business actors involved in illegal logging crimes in Bima. The method used in this research is empirical legal research with a socio-legal approach and a case approach (legal approach). Types and sources of data in the form of primary data and secondary data. The results of this study indicate that the model of responsibility imposed on business actors who carry out illegal logging, transportation and processing of wood, in the form of imprisonment and additional penalties, if unable to pay the tax, it will be replaced with imprisonment. This can be seen in the decision of the Raba Bima District Court with the number: 231/Pid. B/LH/2020/PN RBI dated 17 June 2020 in the first alternative indictment the Raba Bima District Court sentenced the defendant TF for violating the provisions of chapter 88 verse 1 letter a Jo. Chapter 16 of law no. 18 of 2013 concerning the prevention and eradication of forest destruction.

Abstract

This article aims to explain ‘irfâniy as a method for human beings to acquire knowledge through the intuition of conscience as did the Sufis through the path of Sufism in the teachings of Islam. Man as a battle creature given the highest degree by God, in addition to the sense and sense, also given the conscience to feel things that are not real in concrete and something that is outside the logic. ‘Irfâniy as a method of knowledge epistemology can lead man to a spiritual life close to God. The inner nature of the knowledge of ‘irfâniy has led man to an immaterial life which is sublime in the true life of the world. The path of Sufism’s life which is done by the ‘irfâniy method is able to place the life of ma‘rifat for man, that is, the highest level of life associated with a very close relationship with God. There are several steps that must be taken by humans to achieve ‘irfâniy knowledge, starting from the preparation stage, acceptance, formation and disclosure. Therefore, the subjective nature of ‘irfâniy knowledge, then the quality of knowledge depends on the human ability to perform by the mind. ‘Irfâniy as a form of human inner knowledge is influenced by the empirical and logical experience and spiritual life of the deity of man, so that knowledge ‘irfâniy is direct, whole, fixed and comprehensive. Humans with ‘irfâniy method can reach God truth that is absolute and essential.

Abstract

The right to control from the state is a right that at the highest level is controlled by the state as an organization of power for all the people. This right gives the state authority as stated in Article 2 paragraph (2) of the UUPA. However, these various regulations and policies at the level of implementation do not harm the principles of the rights of the Indonesian people. The presence of the Job Creation Law which regulates land acquisition for development is considered pragmatic, more oriented towards investment and economic interests so it is considered to ignore the ideals and rights as well as the spirit of agrarian reform that favours the interests of farmers. The right of control of this state builds relations between the state and the nation, namely a kind of customary rights relationship that is raised at the highest level, namely the level that affects the entire territory of the country. The meaning of being controlled by the state contained in Article 33 of the 1945 Constitution is not explicitly formulated in its explanation. This allows the emergence of various interpretations of the meaning of this service trying to socialize land acquisition policies in the context of agrarian reform.

Abstract

Lombok is one of the islands of West Nusa Tenggara province with enormous tourism potential, from nature, beaches and culture. So that if this is developed properly it will bring prosperity to the Lombok people in particular and NTB in general. Tourism development policies have not been widely felt to bring effects to welfare to the community. The purpose of this study is to provide an overview of policies and implementation of tourism development policies on tourism on the island of Lombok. Data was collected by observation and interviews. From these data, then analyzed descriptively qualitatively, the data formed becomes a description that describes a situation or event described. Based on the results of the analysis of tourism development policies in Lombok island, it is inseparable from the four tourism pillars contained in regional regulations, namely tourism, marketing, industry and institutional development. The implementation of the policy has not maximally affected the welfare of the people on the island of Lombok, and has even caused new problems in the lower classes.

Abstract

Contract law is part of civil law, which in fiqh is included in muamalah fiqh. This regulation regarding contact is subject to the Civil Code, which should be based on established principles. One of the principles is the principle of agreement (al ittifaq) or the principle of consensualism. This manuscript itended to explain the principle of al ittifaq (consensualism) from the perspective of transcendental philosophy. This research was a desk research, so the data source was secondary data, which was collected through identification and recording of relevant data that can be used to answer the research purposes. Data analysis using the perspective of transcendental philosophy which was based on the relationship of reason and revelation. The results showed that the principle of al ittifaq (consensualism) was the result of human thought based on the arguments of revelation as in Q.S. An Nisa /4 : 29, Q.S. Al Maidah /5 : 1, Q.S. Ali Imron/3 : 159. The result of that thought resulted in fiqh rules as contractual principles. The novelty of this research was the hybridization of the values of Islamic law into positive civil law which should be conducted to give positive law more conscientious and fair. It will reflect Pancasila values which is the source of national law

Abstract

Resolving environmental dispute through court litigation often ends up with failure. As a consequence, society in ccoperation with Non-Governmental Organization (NGO) and environmental organization prefer to use Alternative Dispute resolution (ADR) to reslove environmental dispute. In this regard, mediation is often chosen by the parties as it promotes a “win-win solution”. Moreover, mediation offers efficient, cheap and fast dispute resolution process. However, Indonesian law has not adequately accomodated the use of ADR in environmental dispute. As a consequence, the problem of legal certainty often come up. In order to overcome this situation, it is important to develop a mediation process that ensures the legal certainty for both of the disputants. This can be done by developing a mediation forum which is legalized by court.

Abstract

This study aims, (1) to find out the legal protection of the moral rights of traditional art creators on the recording of a work in Copyright Law; (2) To find out what legal steps can be taken by the Author for the recording of a work in the context of law enforcement in Indonesia. This research method is normative law. Legal approach, case approach and approach, interview research data sources and direct observations and combined with laws and regulations that are closely related to the object of research. Data analysis is descriptive analytical and qualitative withdrawal. The results of the study found a form of legal protection for the rights of the creators of traditional moral arts in the form of performing the basic motion of the Kethek Ogleng dance for recording a work in copyright law in the form of moral rights and economic rights for his creations. Meanwhile, legal steps that can be taken by the author on the recording of the work can be done by recording the change in the name of the right holder, as well as other steps, namely the deletion of the registration of the work to the Minister of Law and Human Rights of the Republic of Indonesia and then re-registering with the creator and rights holder create.

Abstract

Article 28 H paragraph (1) of the 1945 Constitution directly states that social security is the right of every human being. Article 34 paragraph (1) again mentions the constitutional basis for the need for a social security system. The next constitutional basis is Law Number 40 of 2004 concerning the National Social Security System. This background means that the state has a duty to build a comprehensive social security system and provide a wider sense of "security" for all Indonesian citizens, including migrant workers. Social security consists of National Health Insurance (JKN) and Employment Insurance.National Health Insurance is a concept of health protection adopted from various social protection concepts, namely protection efforts for the Indonesian people in general and migrant workers in particular to face vulnerability and illness which is equipped with strategies to obtain or protect health comprehensively. Health insurance for migrant workers can be interpreted as an effort from the state to help migrant workers by providing guarantees or protection for the health of migrant workers. Efforts to fulfill this have several important aspects related to the fulfillment of constitutional rights and legal protection in the context of implementing social security programs for migrant workers
