Abstract

Purpose: This study aims to determine the criminal law policy on sexual exploitation in Indonesia and discover the current legal policy from the perspective of victimology.Methodology: This study is based on doctrinal legal research or normative juridical procedures with a legal perspective in the traditional sense of “law in the book”. Normative legal research is essentially a legal research library in which the author studies the legal principles beginning with specific sectors of the legal system and the identification of legislatively enacted legal norms.Results: The findings revealed that the criminal law policy on sexual exploitation in Indonesia and the current legal policy from a victimology view, comprising the legal protection from Law Number 21 of 2007 concerning the Crime of Trafficking in Persons, Law Number 23 of 2002 concerning Protection Children, and Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, have attempted to fulfill the rights of victims, although a detailed explanation of legal protection efforts has been more based on the child protection law. Moreover, according to victimology, focusing on victims, criminal law policies addressing incidents of human trafficking or, more specifically, commercial sexual exploitation of children have prioritized victims’ interests.Benefits: This study was designed to serve as a reference for the government and parties concerned with Indonesia’s criminal law policy on sexual exploitation and its current legal policy from a victimology viewpoint. It is intended to result in law enforcement being more equitable and capable of combating sexual exploitation in the digital age.Novelty/Originality: Regarding responsibility for certain sorts of child sexual exploitation, the child protection legislation is more onerous than the trafficking statute in terms of penalties and threats. The two laws have endeavored to uphold victims’ rights in legal protection. However, the child protection statute includes a more extensive description of the legal protection measures. According to victimology, focusing on victims, criminal law policies addressing incidents of human trafficking or, more specifically, commercial sexual exploitation of children have emphasized victims’ interests

Abstract

Kebijakan perizinana lingkungan dan kepentingan investasi disorot oleh banyak pihak, dianggap mempunyai andil besar yang menyebabkan krisis  lingkungan di negeri ini. Perusakan dan pencemaran bidang lingkungan yang dilakukan pelaku usaha/industri dapat ditelusuri dari berbagai kebijakan pemberian perizinan lingkungan, seperti pendirian pabrik semen, penebangan HPH, reklamasi pantai, tambang  batubara, emas dan lain lain. Perizinan lingkungan yang menimbulkan sengketa lingkungan apabila tidak bisa diselesaikan melalui hukum administrasi semata tetapi dapat juga dilakukan melalui hukum perdata bahkan pidana. Pembuktian hukum perdata biasa memerlukan pembuktian mengenai unsur hubungan sebab akibat,  yang didasarkan pada dalil liabality base on fault  dinilai akan memberatkan pihak yang melakukan gugatan. Karena itu dengan berkembangnya industrialisasi yang menghasilkan resiko yang bertambah besar serta makin rumitnya hubungan sebab-akibat, maka teori hukum telah meninggalkan konsep “kesalahan” dan berpaling ke konsep “resiko” yang menekankan pada tangung jawab mutlak dengan didasarkan pada asas liability base on risk. Model ke depan dalam penyelesaiaan sengketa perizinan lingkungan yang melibatkan masyarakat, pemerintah atau dunia usaha akan lebih baik apabila dilakukan melalui lembaga alternatif, dirancang melalui lembaga mediasi  berdasarkan win win solution. Model penyelesaiaan ini merupakan model penyelesaiaan yang efisien, murah, cepat dan mampu menghasilkan keputusan yang lebih baik. Kata Kunci : Perizinan lingkungan, Gugatan masyarakat dan Penyelesaian sengketa.

Abstract

Epistemology of knowledge, also epistemology of legal studies, which is derived from the senses, rationality, and inner voices, has their own analysis methods to attain truths; inductive reasoning to seek validity of empirical knowledge, deductive reasoning for knowledge based on reason or rationality, and intuition for that derived from inner voices. The three analysis methods often lead to debate and contradicting claims creating a conflicting truth in epistemology.This conflicting claims of truth results in stagnancy, deviation, and distortion, in which the truth attained during the process may be misused for certain parties, since in the field of law, truth may be established to accommodate one’s needs. Therefore, it is crucial to create a concept which reconciles various epistemologies in knowledge, as well in legal studies, which is through a convergence of epistemology in legal studies through the perspective of Islamic philosophy. Through Islamic philosophy which is based on Quran, a conflicting knowledge derived through the senses, rationality, and inner voices will reconcile in one central point.Islamic philosophy which is based on Quran is the basis for epistemological truth derived from the senses, rationality, and inner voices, to simultaneously and jointly understand and complement each others’ strengths and weaknesses through a circular triadic process in order to reach reconciliation.

There are two emerging markets in Indonesia, namely traditional markets and modern markets. Traditional market reform is one of the government’s programs to improve the performance of market traders. The existence of medicine environment aspects as the development of the quality of traditional markets is important to be discussed. The greater the health and medicine environmeny that occur shows a is a reflection of the level of public welfare. its development Traditional markets are beginning to be marginalized, this is due to the quality of commodities and un health environment that are not guaranteed.

Abstract

This research aims to prove visum et repertum as an evidence of a rape crime in the trial process at Kupang District Court (PN Kupang), so as to know how the judge assembly accommodate all evidences in the court as a basis to make a verdict, regading the weight of the punishment which will be given the rape crime perpetrator. This is a juridical- empirical descriptive research, as it uses primary and secondary data in the form of the judges’ verdict at the rape crime trial which is absolute and also interviews conducted to subjects who are involved in the research. The health aspect in proving the rape case is evidenced in the visum et repertum papers and expert information from the doctors who examined the victim.

Abstract

Objective: This paper aims to describe the findings on quality, health, and safety guarantee of fish catch andthe related regulations in the Governmental Decree No. 57 of 2015. Method: This research uses the juridicalsociologic research method, with the descriptive qualitative approach, which describes the guarantee ofquality, health, and safety of fish catch based on the Governmental Decree No. 57 of 2015. Results: It isfound that there are violations in the form of an unhygienic method in processing the fish catch. In the FishAuction Center, the processing uses chemical substances which are prohibited for food. Conclusion: Thegovernment should make a policy which support the fishermen, so that they may use a safer and a healthiermethod in processing fish.

Abstract

Abstract: The internet offers unprecedented power to provide users with health information for patients, health professionals, and professionals. Maintaining the integrity, data systems, and confidentiality of individual health information, quality of content, and consumer protection and the commercial interests of the health industry against unethical practices, are areas of greatest concern in the implementation and use of the Internet. However, there is no national and international legislation for regulating the use of online-based health services. This research is a Literature review that aims to explore ethical and legal issues in the use of online-based health services (E-Health). The review process begins by identifying journal articles that are relevant to the research topic. This study concludes that the use of online-based health services (E-Health) is an important public health issue. E-Health emerged as a tool for developing new diagnostics and therapeutic interventions. Ethical issues related to crossing clinical practice and online communication about health services. This allows discriminatory or unethical behavior and is not following the professional code of ethics. E-Health licensing standards and regulations have not been implemented in many countries. So that health workers are required to code of ethics in the use of online-based health services (E-Health).

Abstract

Abstract: Humans are social creatures, namely creatures that require interaction with other humans. Interaction between humans is not only communication but involves all aspects of life, including the legal aspect. Based on law number 36 of 2014 concerning health workers, it is anyone who devotes himself to the health sector and has knowledge and/or skills through education in the health sector which for certain types requires the authority to carry out health efforts. The purpose of this study was to determine the level of compliance of medical personnel in the implementation of informed consent. In addition, medical personnel understand the role of informed consent in preventing lawsuits and medical disputes. The research method used is a non-doctrinal research method, namely the questionnaire method, direct interviews with medical personnel, and medical record documents, especially informed consent sheets. Problem formulation: 1. How is the compliance of medical personnel with the implementation of informed consent? 2. What is the role of Informed Consent in Medical Dispute Prevention efforts? 3. What is the concept of implementing informed consent in order to prevent medical disputes? The results of the study: "Medical Personnel Compliance with the Implementation of Informed Consent: Study on Prevention of Lawsuits for Medical Disputes at the Central Surgical Installation of PKU Muhammadiyah Sragen Hospital" is that the compliance of medical personnel in the implementation of informed consent has not been carried out in accordance with the existing SOPs, so the role of informed consent consent has not been maximally implemented by medical personnel. The concept of implementing informed consent must be made clearly in accordance with standard procedures that must be filled in completely by medical personnel working in the central surgical installation of PKU Muhammadiyah Hospital Sragen.Keywords: Medical Personnel, Informed Consent, Lawsuits, Medical Disputes.Abstrak: Manusia merupakan makhluk sosial, yaitu makhluk yang  membutuhkan interaksi dengan manusia lainnya. Interaksi antar manusia tidak hanya komunikasi saja tetapi menyangkut seluruh aspek kehidupan, tidak terkecuali aspek hukum. Berdasarkan undang undang nomor 36 tahun 2014 tentang tenaga kesehatan adalah setiap orang yang mengabdikan diri dalam bidang kesehatan serta memiliki pengetahuan dan/atau keterampilan melalui pendidikan di bidang kesehatan yang untuk jenis tertentu memerlukan kewenangan untuk melakukan upaya kesehatan.Tujuan dari penelitian ini adalah untuk mengetahui tingkat kepatuhan tenaga medis dalam pelaksanaan informed consent. Selain itu juga sebagai pemahaman tenaga medis atas peran dari informed consent dalam upaya pencegahan gugatan hukum dan sengketa medis.Metode penelitian yang digunakan adalah metode penelitian Non-Doktrinal yaitu dengan metode quesioner, wawancara langsung kepada tenaga medis, dan dokumen rekam medis, khususnya lembar informed consent.Perumusan Masalah: 1. Bagaimana Kepatuhan Tenaga Medis Terhadap Pelaksanaan Informed  Consent ? 2. Apa peran Informed Consent dalam upaya Pencegahan Sengketa Medis? 3. Bagaimana konsep tentang pelaksanaan informed consent  dalam  rangka mencegah sengketa medis?Hasil Penelitian : “Kepatuhan Tenaga Medis Terhadap Pelaksanaan Informed Consent : Studi Pencegahan Gugatan Hukum atas Sengketa Medis di Instalasi bedah sentral RSU PKU Muhammadiyah Sragen” adalah bahwa kepatuhan tenaga medis dalam pelaksanaan informed consent, belum dilaksanakan sesuai dengan SOP yang ada, sehingga peran dari informed consent belum maksimal dilaksanakan oleh tenaga medis. Konsep pelaksanaan informed consent harus dibuat secara jelas sesuai dengan standart prosedur yang harus di isi lengkap oleh tenaga medis yang bekerja di Instalasi bedah sentral RSU PKU Muhammadiyah Sragen.Kata Kunci : Tenaga Medis, Informed Consent, Gugatan Hukum, Sengketa Medis.

Abstract

The phenomenon of deteriorating the quality of legislative membersbecomes a problem in this paper. This happens because of the lack of qualityof screening and competence of candidates in the electoral system, and thelow standards of criteria and criteria of candidates in the election regulation,thus affecting the poor quality of legislative members generated . To makecorrections to the weaknesses of the legislative election system can be done byintegrate the values of choosing the leader (caliph) in Islam into the legislativeelectoral system in Indonesia.Abstrak: Fenomena memburuknya kualitas anggota legislatif menjadipermasalan dalam tulisan ini. Hal ini terjadi karena ketidak tersediaannyasaringan kualitas dankompetensi caleg dalam sistem pemilu, serta rendahnyastandar syarat dan kriteria caleg dalam regulasi pemilu, sehingga berdampakterhadap buruknya kualitas anggota legislatif yang dihasilkan.Untuk melakukanpembenahan terhadap kelemahan sistem pemilu legislatif dapat dilakukandengan cara mengintegrasikan nilai-nilai memilih pemimpin (khalifah) dalamIslam kedalam sistem pemilu legislatif di Indonesia.

Abstract

This article discusses the strengthening of halal tourism based onthe Islamic Prophetic Paradigm. Halal tourism built in West Nusa Tenggara is unclear and final about the direction and concept. Many parties are hesitant and criticized about the title of the halal destination carried by the regional government. Is it true that the government is committed to creating a religious and halal tourism environment? Is it in line with the historical social inference of the NTB community in wrapping the cultural customs of the tribes in the region?. This study uses the sociological method of jurisprudence, with the approach of the Islamic prophetic paradigm.Furthermore, it uses the procedureof historical social inference to find convergence between Islamic values and the past, social aspects of the three major tribes in NTB. The results of the study show that the support and commitment of the NTB local government towards halal tourism that was built is based on Ahklak, Adab, and eastern culture. The main scheme is Muslim world tourists. This Akhlak, Adab, and east culture are very important to give a different color and show the local identity of an area. The halal concept was found through the convergence of cultural values and customs of the three tribes in NTB, namely the Sasak, Samawa, and Mbojo (Sasambo) tribes. It is contained and agreed upon in the norms and culture of the community, actualized at specific convergence points. The convergence of Islamic prophetic values with the historical, social benefits of the Sasak, Samawa and Mbojo tribes is seen in terms of halal food patterns, civilized patterns of association, clothing, and other economic trends. Like the Sasambo tribal philosophy “AdatBersendikanSyara’, Syara’ is based on the book of Allah’, which increasingly gives its Islamic identity. These paradigms and philosophies are the principal capital for the creation of regional halal regulations, accommodating local entities that are inherited and civilizedthrough local friendly entities.
