Abstract

The separation of powers is a fundamental principle for ensuring justice and preventing the abuse of authority within a governance system. In the context of Islamic history, particularly during the Rashidun Caliphate, the need to distinguish between executive and judicial authority emerged as essential to uphold legal integrity and the rule of justice. This study aims to analyze the early development (embryo) of the separation of powers during the Rashidun era, identify the socio-historical factors that influenced it, and evaluate its impact on the effectiveness and integrity of the Islamic judicial system. This research employs a socio-historical approach, utilizing content analysis of classical Islamic texts and historical documents, as well as historical comparison of governance practices of the period. The findings indicate that the institutionalization of judicial independence began under the leadership of Caliph Umar ibn al-Khattab through the appointment of independent qadis, provision of stable salaries, and the establishment of judicial oversight mechanisms. Factors such as urbanization, territorial expansion, increasing societal complexity, and the need for administrative efficiency were central to these reforms. The study concludes that the separation of powers in the Rashidun era was not only a pragmatic solution to governance challenges but also a reflection of core Islamic principles of justice. This historical model offers a valuable precedent for strengthening judicial independence and ethical governance, and remains relevant as a reference for contemporary judicial reform in Muslim-majority societies.

Abstract

Guidance and counseling (BK) services in schools often face issues such as lack of coordination, limited resources, and low student participation. These challenges stem from the suboptimal implementation of the POAC (Planning, Organizing, Actuating, and Controlling) management functions by school counselors. This study aims to analyze the influence of each POAC function on the quality of BK services in junior high schools (SMP) in South Jakarta. The research employs a quantitative approach, with data collected through surveys of 52 BK teachers. Quantitative data were analyzed using multiple linear regression. The results indicate that all POAC variables significantly influence the quality of BK services (p-value < 0.01). Planning has the strongest influence (β = 0.01), followed by organizing (β = 0.00), actuating (β = 0.00), and controlling (β = 0.00). Collectively, the POAC functions explain 72% of the variation in the quality of BK services. In conclusion, the optimal implementation of POAC functions can enhance the quality of BK services. This study recommends management training for BK teachers and the development of operational guidelines for effective POAC implementation. The findings provide practical contributions to improving BK services in schools and enrich empirical evidence on the importance of POAC management in the context of Indonesian education.

Abstract

This article examines Perma No. 7 of 2022 regarding updating the application of electronic settlement of cases, which was previously regulated in Perma No. 3 of 2018 and Perma No. 1 of 2019. This study specifically examines the development of an electronic case settlement system in Perma No. 7 of 2022 and the problems with its application in the Religious Courts, which are then reviewed from the procedural principles of the Religious Courts. This study applies the normative-empirical legal research method. This research reveals changes in Perma No. 7 of 2022, among other things, regarding the necessity of electronic trials in cases that are registered electronically, and in conditions where the defendant does not agree, the Registrar of the Session will assist the process through PTSP. The developments in the Perma in several parts are in line with the principles of procedural law, in particular the principles of simplicity, speed and low cost. However, on the other hand, it also has the potential to hinder the fulfillment of other principles such as the principle of the obligation to reconcile and trials open to the public. In several religious courts, this Perma has not been fully implemented due to certain constraints such as sending summons or notifications by post. Therefore, the existence of this Perma and the electronic case settlement system in general, need to be continuously studied. In its implementation, the presence of this Perma must be balanced with socialization, strengthening human resources, and developing infrastructure that is evenly distributed to all levels of society.

Abstract

Emotional intelligence plays a crucial role in fostering students' ability to manage emotions and navigate interpersonal conflicts effectively. This study examines the impact of emotional intelligence counseling on enhancing self-control among elementary school students when dealing with conflicts. The research aimed to identify the effectiveness of a structured counseling intervention in improving students' emotional regulation and conflict resolution skills. A quasi-experimental method with a pre-test and post-test control group design was employed. The sample consisted of 60 elementary school students selected through purposive sampling, divided equally into experimental and control groups. Data were collected using self-control questionnaires, conflict observation sheets, and structured interviews. The results indicated a significant improvement in self-control among students who participated in emotional intelligence counseling compared to those in the control group. Participants demonstrated enhanced emotional regulation, reduced impulsive behaviors, and improved ability to resolve conflicts constructively. The findings suggest that integrating emotional intelligence counseling into school programs effectively supports the development of students’ social-emotional skills.
