Abstract

Ashabul furudh is a group of heirs who have a certain part in Islamic inheritance. In the process of determining the inheritance share, the ashabul furudh group takes precedence over other inheritance groups. The practice of this determination will determine the share of each heir and describe the heirs who do not inherit. This study will describe the process of determining the part of ashabul furudh through the concept of syajarotul mirats. The method used in this research is a qualitative method with the type of library research. So that in collecting data, a many of books and journals were searched that were relevant to the research theme. Furthermore, the data were analyzed by content analysis. The results of the study concluded that the order of kinship in the concept of syajarotul mirats greatly influences the process of determining the share of heirs. Furthermore, the concept also describes that each heir has a relationship with other heirs. So that each heir will affect the other heirs. Therefore, the results of this study are expected to provide scientific treasures in the practice of dividing Islamic inheritance.

Abstract

The many of Islamic inheritance concepts can change according to the illat that appears. Inheritance cases between siblings and seibu raise polemics in certain cases, because siblings do not get inheritance because they are ashobah. Meanwhile, the seibu brother is in the position of ashabul furudh receiving the inheritance. This study will describe the dynamics of the opinions of friends in inheritance between siblings and mothers in the musytarikah case. The method used in this research is a qualitative form with the type of library research. In collecting data, the researcher traces a number of references from books, books and articles or other scientific works that have relevance to the research theme. Furthermore, the data were analyzed descriptively. The results of the study explain that the friends have different opinions in addressing the inheritance between siblings and mothers. First, it is settled normally, the same-father sibling does not get a share of the inheritance even though they have closer kinship to the heir. Second, resolved by musytarikah or collectively. The position of siblings as ashobah is combined with mother brothers as ashabul furudh. The share received by the mother's sibling is shared with the siblings without distinguishing between kinship status and gender. Keywords : musyatarikah; sibling’s inheritance; half-brother's inheritanceAbstrakSejumlah konsep waris islam dapat berubah sesuai dengan ‘illat yang muncul. Kasus kewarisan antara saudara kandung dan saudara seibu memunculkan polemik dalam kasus tertentu, sebab saudara kandung tidak mendapatkan warisan karena sebagai ashobah. Sementara itu saudara seibu dalam dalam posisi ashabul furudh menerima warisan. Penelitian ini akan menguraikan dinamika pendapat para sahabat dalam kewarisan antara saudara kandung dan saudara seibu pada kasus musytarikah. Adapun metode yang digunakan dalam penelitian ini adalah bentuk kualitatif dengan jenis penelitian pustaka. Dalam pengumpulan data, peneliti menelusuri sejumlah referensi dari kitab, buku dan artikel atau karya ilmiah lainnya yang mempunyai relevansi dengan tema penelitian. Selanjutnya data-data dianalisis secara deskriptif. Hasil penelitian menjelaskan bahwa para sahabat berbeda pendapat dalam menyikapi kewarisan antara saudara kandung dan saudara seibu. Pertama, diselesaikan secara biasa, saudara seayah tidak mendapatkan bagian warisan meskipun mempunyai kekerabatan lebih dekat kepada pewaris. Kedua, diselesaikan secara musytarikah atau kolektif. Kedudukan saudara kandung sebagai ashobah digabungkan dengan saudara seibu sebagai ashabul furudh. Bagian yang diterima oleh saudara seibu dibagi bersama dengan saudara kandung tanpa membedakan status kekerabatan dan jenis kelamin.Kata Kunci : musytarikah; waris saudara kandung, waris saudara seibu.

Abstract

AbstractThis study discusses the problem of the process of determining the share of heirs and the process of inheritance distribution in Islamic inheritance law. This research is a library research, with a qualitative approach. The results in this study are that the ta'yin (determination) of the share of each heir in Islam is obligated to use the provisions of the Qur'an and Hadith. Because the determination of inheritance with a family and customary system can open a gap for jealousy and conflict among heirs, because there is no standard guide in its application. So that the ta'yin process is carried out so that each heir knows what part he will receive. Furthermore, if all the members of heir agreed and have willing to do the sharing inheritance by kinship or tradition, then, this process is valid and do not conflict with Islamic’s law. As a conclusion, ta’yin heir members divisions have to do in every sharing inheritance. Whereas the process of sharing inheritance is given appropriate to the agreement reached by the heirs. Hasil dalam penelitian ini yaitu bahwa ta’yin (penentuan) bagian masing-masing ahli waris dalam Islam wajib hukumnya menggunakan ketentuan al-Qur’an dan Hadis. Karena penentuan warisan dengan sistem kekeluargaan dan adat dapat membuka celah kecemburuan dan konflik sesama ahli waris, sebab tidak adanya panduan baku dalam penerapannya. Sehingga  proses ta’yin dilakukan agar setiap ahli waris mengatahui bagian yang akan diterimanya. Selanjutnya, apabila semua ahli waris bersepakat dan sama-sama ridha untuk melakukan pembagian secara kekeluargaan atau adat, maka proses ini adalah sah dan tidak menyalahi hukum Islam.Kata Kunci: Penentuan Bagian; Ahli Waris; Pembagian Warisan; Ta’yin.

Abstract

Masalah waris sangat urgen dalam ajaran islam, sebab di antara tujuan kewarisan islam adalah memberikan hak-hak para ahli waris sesuai dengan porsinya. Karena itu peralihan hak dari pewaris kepada ahli waris menjadi pembahasan yang sangat serius. Sebagian rumus baku dalam kewarisan islam dapat berubah sesuai dengan konteks yang ada. Kajian ini akan menguraikan dinamisasi maslahat kewarisan dalam ajaran islam, sedangkan metode yang digunakan adalah studi kepustakaan. Dalam pengumpulan data-datanya dilakukan melalui sejumlah penelusuran pada kitab-kitab dan karya ilmiah lainnya yang relevan dengan tema penelitian. Kemudian seluruh data-data dianalisis dalam bentuk deskriptif. Adapun hasil temuan dalam kajian ini adalah bahwa proses kewarisan dalam islam banyak dipengaruhi sejumlah tujuan syariat islam dan lebih didominasi oleh pertimbangan dhoruriyah ketimbang tahsiniyah dan hajiyah. Sehingga nilai-nilai kewarisan yang diterapkan akan berdampak kepada asfek hifzu an-nafs, hifzu al-mal dan hifzu al-‘ird wa an-nasal.

Abstract

ABSTRAKPerubahan dalam melakukan pembelajaran seringkali diawali dengan evaluasi dari kegiatan yang sudah dilakukan. Hasil evaluasi memberikan sumbangan dalam proses membuat strategi baru pada metode pembelajaran. Seorang guru dapat membuat sebuah konsep dan metode yang akan diterapkan berdasarkan hasil refleksi pada kelas tertentu. Kegiatan pengabdian ini bertujuan untuk memberikan pelatihan metode refleksi bagi guru-guru atau komite pembelajaran pada sekolah penggerak di Kabupaten Asahan. Adapun metode yang digunakan untuk mencapai tujuan pengabdian ini adalah dalam bentuk lokakarya. Pada tahapan pelaksanaannya penyampaian materi dilakukan secara andragogy atau pembelajaran bagi orang dewasa dengan melalui tiga tahapan. (1) Pada awal kegiatan peserta diajak untuk melakukan refleksi terhadap proses pembelajaran yang sudah dilakukan, yaitu dengan cara mengisi lembar kerja pertama. (2) Pada lembar kerja kedua, peserta diminta untuk melakukan refleksi sesuai dengan materi tentang refleksi dengan menggunakan metode refleksi. (3) Kemudian, pada lembar kerja ketiga, peserta menyusun rencana moderasi untuk pelaksanaan refleksi yang ideal dalam proses pembelajaran atau fasilitasi. Berdasarkan tiga tahapan tersebut, peserta pelatihan mempunyai paradigma baru bahwa kegiatan refleksi dapat melahirkan sebuah konsep yang lebih efektif dalam kegiatan yang sama. Selain itu, peserta juga telah mampu melakukan refleksi terhadap kegiatan yang dilakukannya sebagai fasilitator pembelajaran dan lainnya. Kata kunci: evaluasi; refleksi; sekolah penggerak; paradigma baru. ABSTRACTChanges in learning often begin with an evaluation of the activities that have been carried out. The results of the evaluation contribute to the process of making new strategies for learning methods. A teacher can create a concept and method that will be applied based on the results of reflection in a particular class. This service activity aims to provide training on reflection methods for teachers or learning committees at driving schools in Asahan Regency. The method used to achieve this service goal is in the form of a workshop. At the implementation stage, the delivery of material is carried out in andragogy or learning for adults through three stages. (1) At the beginning of the activity, participants are invited to reflect on the learning process that has been carried out, namely by filling out the first worksheet. (2) In the second worksheet, participants are asked to reflect according to the material on reflection using the reflection method. (3) Then, on the third worksheet, participants prepare a moderation plan for the ideal implementation of reflection in the learning or facilitation process. Based on these three stages, the training participants have a new paradigm that reflection activities can give birth to a more effective concept in the same activity. In addition, participants have also been able to reflect on their activities as learning facilitators and others. Keywords: evaluation; reflection; driving school; new paradigm.

Abstract

In Islamic inheritance, the process of determining the heirs is carried out before the distribution of inheritance. The categories of heirs are grouped based on their status and kinship to the heirs. Ashobah is a group of heirs who are understood as recipients of the remaining assets. However, the ashobah heirs do not always receive the rest of the property, but the ashobah group can also not get an inheritance at all. This study aims to describe the theory and practice of determining Ashli ​​heir ashobah based on the concept of syajarotul mirats. This study uses a qualitative method with the type of library research. All the data collected were analyzed descriptively. The results of the study explain that the heirs of ashobah in getting an inheritance are between three possibilities. First, ashobah gets all the inheritance. Second, ashobah get the rest of the inheritance after the ashabul furudh group. Third, ashobah does not inherit at all. Furthermore, there is only one heir who becomes ashobah and there cannot be two ashobah. In the concept of syajarotul mirats, all types of ashobah are judged based on jihhah, qorobah and quwwatul qorobah on the bunuwah, ubuwah, ukhuwah and 'umumah lines.

Abstract

Abstract Batak Angkola is one of Batak ethnic who lived at south of Tapanuli in North Sumatera. The societies usually called as Angkola’s people. Up to now, they still hold the local principle tradition. Start from marriage, inheritance moreover about death. All of them have the local tradition to present by society. Then, this research describes about the inheritance system of Muslim Batak Angkola’s society. This research uses the qualitative descriptive method by approaching normative juridical, all of the data which found in the field, describes naturally, and expresses, then considers with surah an-nisa ayat 11, 12 and 176, as four the finding in this research shows that the Batak’s Muslim society follow the patrilineal relationship system, it is the generation line is taken from man. Then, in dividing inheritance, men have dominated from women. So, the men expert of inheritance authorizes most of the inheritance than women. While the women only get the gift from the men. Furthermore, the men expert of inheritance often postponed to divide the inheritance if one of their parents was still alive. While, Alqur’an as the first escort of Islamic inheritance presents in giving the portion of each expert of inheritance. The inhetances is appropriate with Allah’s firmness; it is the determinate is not based on the age, young or old. Furthermore, by explicit law of inheritance settles that in every death must do dividing of the inheritance for the expert of inheritance. Keywords : Tradition Inheritance System, Batak Angkola’s Muslim Abstrak Batak Angkola adalah salah satu sub suku Batak yang mendiami daerah Tapanuli bagian selatan Sumatera Utara. Masyarakatnya disebut dengan istilah orang Angkola. Mereka sampai saat ini masih selalu memegang prinsip adat setempat, mulai dari masalah pernikahan, kewarisan bahkan terkait kematianpun ada aturan adat yang diselenggarakan oleh masyarakat. Jadi, penelitian ini mendeskripsikan tentang sistem waris masyarakat muslim Batak Angkola. Penelitian ini menggunakan metode kualitatif deskriptif dengan pendekatan yuridis normatif, semua data-data yang ditemukan dilapangan diuraikan secara alami dan diungkapkan apa adanya kemudian dikomparasikan dengan surah an-nisa ayat 11, 12 dan 176. Adapun temuan dalam penelitian ini menunjukkan bahwa masyarakat muslim Batak Angkola menganut sistem kekerabatan patrilineal, yaitu garis keturunan diambil dari pihak laki-laki. Kemudian pada tataran pembagian harta warisan, pihak laki-laki mempunyai peranan yang lebih dominan ketimbang pihak perempuan. Jadi, ahli waris laki-laki menguasai hampir seluruh harta warisan, sementara ahli waris perempuan hanya mendapatkan bagian berupa pemberian dari kelompok ahli waris laki-laki. Selanjutnya, para ahli waris sering menunda untuk melakukan pembagian warisan jika salah satu dari kedua orang tua masih hidup. Sementara itu Alqur’an sebagai panduan utama hukum waris islam hadir dengan memberikan porsi bagian kepada masing-masing ahli waris sesuai dengan ketetapan dari Allah Swt, yaitu dengan ketentuan ukuran bagian yang tidak berdasarkan kecil dan besarnya usia. Kemudian secara tegas hukum waris islam menetapkan bahwa setiap ada kematian maka harus dilakukan penentuan bagian masing-masing ahli waris. Kata Kunci: Sistem Waris Adat, Batak Angkola Muslim

Abstract

Wedding simulations involving family, neighbors and friends were reactive activities in Islamic Law learning innovations that were carried out online as a result of Covid-19 which was hitting the world. Islamic law online learning which has been limited theoretically to students in the campus environment, now can be executed more practically by involving stakeholders such as family, neighbors and friends. The simulation method was given in three stages; mentoring, training and accompaniment. The simulation process was carried out online with video conference through the Zoom application. Through this simulation, it was seen that the students were actively involved in taking on the role as simulation organizer as well as being active as training participants. Along with this, parents, friends, neighbors, and the society who took part of this had high enthusiasm in following the wedding simulation which was organized by the dedicated Team with very positive satisfaction rates

Abstract

This study describes and explains the concept of radd and its settlement method in Islamic inheritance according to the thought of 'Aly al-Sabuny. The method used is library research with a conceptual approach. The results of the study explain that the additional portion received by the heirs is beyond furud al Muqaddarah. Sheikh 'Aly al-Sabuny classifies cases based on the existence of the husband/wife in the case. First, the origin of the problem is taken from the number of heirs receiving radd or their shares if there is no husband/wife. Second, if there is one of the husband/wife, then the origin of the problem is taken from the denominator number of the husband/wife share. After being given the husband/wife share, the percentage is divided based on the number of heirs or the share value of the radd recipient's heirs.   Abstrak: Kajian ini akan menguraikan dan menjelaskan konsep radd dan metode penyelesaiannya pada kasus waris islam menurut pemikiran ‘Aly al-Sabuny. Metode yang digunakan adalah library research dengan pendekatan konseptual. Hasil kajian menjelaskan bahwa radd bagian tambahan yang diterima oleh ahli waris di luar furud al Muqaddarah. Syekh ‘Aly al-Sabuny mengklasifikasikan kasus berdasarkan keberadaan suami/istri dalam kasus. Pertama, angka asal masalah diambil dari jumlah ahli waris penerima radd atau sahamnya apabila tidak ada suami/istri. Kedua, apabila dalam kasus ada salah satu dari suami/istri, maka asal masalah diambil dari angka penyebut bagian suami/istri, dan sisa setelah diberikan bagian suami/istri dibagi berdasarkan jumlah ahli waris atau nilai saham ahli waris penerima radd.

Abstract

Fulfilling family maintenance is an obligation for a head of family. In fulfilling this living, it must be carried out with full responsibility and prioritizing halal and thoyyib. However, some fulfill the needs of their family by begging in a certain mode. The purpose of this research is to explain the maqashid al-shariah analysis of fulfilling family income by begging. This research is a field study in Panyabungan, Mandailing Natal. In collecting data, researchers conducted observations, interviews and documentation. Furthermore, the data findings were analyzed descriptively with maqashid al-shari'ah. As a result of the findings, beggars who do their job to provide for their families are grouped into three types, namely (1) begging with physical and mental disabilities, (2) begging by pretending to be disabled, (3) begging involving other family members. In the maqasid al-shariah analysis, it is permissible that people beg because they are mentally or physically disabled and do not have anyone else to support themselves and their families. Meanwhile, begging by pretending and involving other families is not justified, because it eliminates self-dignity and dignity.
