Abstract

Islamic inheritance is synonymous with the comparison of the share between male and female heirs. Furu' and hawasyi heirs often become polemics over the value of the portion received by female heirs in particular. In practice, the share of inheritance for men and women is influenced by the existence of one another. Therefore the value of the part they will receive is determined by the whereabouts of each. This research will describe the practices and methods of solving the inheritance of ashobah bilghoir heirs based on the concept of syajarah al-mirats. The method used is a qualitative form with a type of library research. In this study, researchers collected data by searching some books, books, articles, and other scientific works related to the research theme. Furthermore, the data findings were analyzed descriptively with a conceptual approach. The results of this study explain that the practice of ashobah bilghoir inheritance can occur in the inheritance group of children, grandchildren, great-grandchildren, siblings, and half-brothers of the father. Meanwhile, in the settlement method, each male heir is counted as two people and one woman heir is still counted as one person. In addition, great-grandsons can have their ashobah combined with granddaughters.

Abstract

AbstrakPerubahan batas usia perkawinan yang awalnya 19 tahun untuk laki-laki dan 16 tahun untuk Perempuan menjadi 19 tahun baik untuk laki-laki dan perempuan sesuai yang termaktub dalam Undang-Undang Nomor 16 Tahun 2019 Perubahan dari Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan merupakan upaya pemerintah untuk menekan tingginya angka perkawinan di bawah umur dengan memperhatikan kemaslahatan. Tujuan pengabdian ini dilakukan untuk mensosialisasikan perubahan aturan hukum tersebut sehingga timbul kesadaran di masyarakat. Kegiatan sosialisasi ini dilakukan kepada masyarakat desa binaan Sekolah Tinggi Agama Islam Negeri Mandailing Natal dengan latar belakang usia dan pendidikan yang berbeda dengan jumlah 100 orang. Metode dilakukan dengan beberapa tahapan; pertama, tahap persiapan dengan mengumpulkan peserta dan melakukan pretest secara sederhana kepada peserta untuk memahami sejauh mana tingkat pemahaman mereka terhadap materi sosialisasi, kedua, tahap pelaksanaan dengan memberikan materi sosialisasi, menjelaskan materi tersebut dengan baik, setelah itu dilakukan diskusi interaktif dengan peserta, ketiga,  tahap evaluasi dengan melakukan postest kepada peserta dan dari hasil postest tersebut dijadikan bahan evaluasi terhadap perbaikan pendampingan berikutnya. Hasil kegiatan pasca sosialisasi ini memberikan trend positif terlihat dari antusiasme dan kepuasan peserta mencapai 85% Puas dan 0% Tidak Puas, hal ini menunjukkan kegiatan berjalan dengan baik. Pemahaman peserta juga meningkat menjadi 45% dari sebelumnya 5%, namun karena masih ada dari peserta yang masih Tidak Paham 13% sehingga pendampingan yang berkelanjutan harus dilakukan dengan memberikan akses secara kontinu dengan berbagai media komunikasi untuk keberlanjutan dari kegiatan sosialisasi. Kata kunci : batas usia perkawinan; masyarakat panyabungan; undang-undang perkawinan. AbstractChanges to the marriage age limit from 19 years for men and 16 years for women to 19 years for both men and women as stated in Law Number 16 of 2019. Amendments to Law Number 1 of 1974 concerning Marriage are The government's efforts to reduce the high number of underage marriages by paying attention to welfare. The aim of this service is to socialize changes to legal regulations so that awareness arises in society. This outreach activity was carried out among the village community assisted by the Mandailing Natal State Islamic College with different age and educational backgrounds totaling 100 people. The method is carried out in several stages; first, the preparation stage by conducting a pretest on participants to understand the extent of their understanding of the socialization material, second, the implementation stage by providing socialization material, explaining the material well, after that an interactive discussion is held with the participants, third, the evaluation stage by conducting a posttest to participants and the results of the posttest are used as evaluation material for subsequent improvements in mentoring. The results of this post-socialization activity provided a positive trend as seen from the enthusiasm and satisfaction of participants reaching 85% Satisfied and 0% Dissatisfied, this shows that the activity went well. Participants' understanding also increased to 45% from the previous 5%, however, because there were still 13% of participants who did not understand, ongoing assistance must be carried out by providing continuous access to various communication media for the continuity of socialization activities. Keywords: marriage age limit; panyabungan community; marriage law.

Abstract

The Class IIB State Detention Pangkalan Brandan is Technical Implementation Unit that has duties and functions of Corrections in accordance based Law Number 22 of 2022 concerning of Corrections. Even though did service for prisoner, The Class IIB State Detention Pangkalan Brandan also provides service for inmates, one of which is Parole program consisting of Conditional Exemption (PB). Conditional Exemption (PB) is more likely to be revoked due to the long probation period. When Conditional Exemption (PB) got released, the inmates who violate general conditions and special conditions in accordance with the provisions of the Minister of Law and Human Rights Regulation Number 7 of 2022 can be revoked. This research type of normative legal was carried out to answer the process of revocation of Conditional Exemption and get the accurate results by drawing from several sources. In the case of revocation of Conditional Exemption, it starts sending a request letter by Class IIB State Detention Pangkalan Brandan Officer then examined by the Community Counselor (PK) to be brought to the Correctional Observation Team session so that the results are reported to the Director General via SPION. The decision to revoke Conditional Exemption is conveyed to the prison and state detention officer to be implemented in accordance with the decision. However, the revocation of Conditional Exemption have problems.

Abstract

This study aims to find out the will law of different religions according to Islamic law so that it can be used as a comprehensive reference in solving the problems of will law of different religions. This research is a descriptive literature research that describes matters relating to testaments of different religions by tracing the literature according to the research theme. Sources of data used are journals, books and research results. The analytical method uses qualitative analysis and is then analyzed comprehensively in finding research results. The results of this study indicate that although there are differences of opinion among scholars regarding the will of different religions, if you look at the Qur'an there are no verses that prohibit inheritance from different religions. A testament to different religions must be seen as a form of helping fellow human beings as a form of human brotherhood regardless of their belief background.

Abstract

The implementation of traditional marriages in the Mandailing community is still very strong today. Because for the Mandailing people, marriage is a procession carried out according to religion and custom. So, until now, marriage in the Mandailing community still follows the customs that have been carried out by the ancestors of the Mandailing community for a long time, even though they have joined the teachings of the Islamic religion which is strongly adhered to by the community. This research was conducted to determine the traditional marriage process in the Mandailing community and its relevance to Islamic law. This research is field research, namely using Tanjung Julu village in Mandailing as a research object. The approach taken is a normative legal approach. In collecting data, observation, interviews, documentation, and a literature study were carried out. Next, all data was analyzed descriptively. The results of the research explain that the traditional marriage practices carried out by the Mandailing community in Tanjung Julu village still take place according to customs that have been passed down from generation to generation. Starting from the process of manyapai boru (khitbah), patibal sere (determining the dowry), and horja (wedding procession). Furthermore, all stages carried out in the wedding procession are adjusted to State Law and Islamic Law, so it can be concluded that Islamic teachings are still very relevant in all processions carried out by the community and do not violate the Law and teachings of the Islamic religion.

Abstract

Lembaga Pemasyarakatan (Lapas) Kelas IIB Kualasimpang menerapkan Tata Tertib yang bertujuan untuk mengoptimalkan proses pelaksanaan pembinaan Warga Binaan Pemasyarakatan (WBP). Hal ini dilakukan agar berjalan dengan baik berdasarkan pedoman Peraturan Menteri Hukum dan Ham No. 6 Tahun 2013. Salah satu pemicu terjadinya keributan dan gangguan keamanan dan ketertiban di dalam Lapas adalah Permasalahan Hutang-Piutang antara sesama WBP. Penelitian ini bertujuan untuk mendeskripsikan terkait sebab akibat dari praktik hutang-piutang yang dilakukan oleh sesama WBP di Lapas kelas IIB Kualasimpang. Metode yang digunakan adalah penelitian hukum empiris dengan pendekatan kualitatif. Data-data dikumpulkan melalui observasi, wawancara dan studi pustaka. Selanjutnya data temuan dianalisis secara deskriptif. Hasil penelitian menunjukkan bahwa praktik hutang-piutang terjadi karena sejumlah faktor: (1) kebutuhan untuk membiayai keluarga di  rumah, (2) niat menipu sesama WBP dan (3) Kebiasaan hidup boros. Adapun akibat dari praktik hutang-pitutang adalah (1) Perkelahian, (2) Umpatan yang bersifat Provokasi, (3) Penghinaan secara verbal, (4) Keributan di dalam Kamar sel dan (5) pembulian. Oleh karena itu, pihak Lapas menegakkan disiplin berdasarkan peraturan Menkumham nomor 6 Tahun 2023 serta menggandeng pihak perbankan untuk membuat kartu voucher bagi WBP untuk mencegah peredaran uang tunai.Kata Kunci: Hutang-Piutang, Lapas, WBP, Kualasimpang, Kemenkumahm.AbstractThe Class IIB Kualasimpang Correctional Institution implements Rules and Regulations which aim to optimize the process of implementing WBP coaching. This is done so that it runs well based on the guidelines of Minister of Law and Human Rights Regulation No. 6 of 2013. One of the triggers for commotion and disruption of security and order in Correctional Institution is the problem of debts and receivables between fellow correctional inmates (WBP). This research aims to describe the causes and effects of debt and receivable practices carried out by fellow WBP in the Kualasimpang class IIB Correctional Institution. The method used is empirical legal research with a qualitative approach. Data was collected through observation, interviews and literature study. Next, the finding data was analyzed descriptively. The research results show that the practice of debts and receivables occurs due to a number of factors: (1) The need to support the family at home, (2) The intention to deceive fellow WBP and (3) Extravagant living habits. The consequences of the practice of accounts receivable are (1) Fights, (2) Provocative swearing, (3) Verbal insults, (4) Commotion in the cell room and (5) Bullying. Therefore, the prison authorities enforce discipline based on Minister of Law and Human Rights regulation number 6 of 2023 and collaborate with banks to make voucher cards for inmates to prevent the circulation of cash.Keywords: Debts-Receivables, Correctional Institution, WBP, Kualasimpang, Kemenkumham

Abstract

This research analyzes the legal protection for informal workers within the framework of labor law in Indonesia. Informal workers, including domestic workers and others in the informal sector, often face legal uncertainty and lack adequate protections compared to formal workers. The study adopts a normative legal analysis method by referencing relevant legislative provisions. The findings indicate that although Law Number 13 of 2003 concerning Manpower provides a legal basis for protecting informal workers, its implementation remains limited. Major challenges include difficulty in identifying informal workers and their lack of awareness regarding their rights. Current protections include the right to fair wages, equitable treatment, and access to social security programs. However, there are legal gaps that need to be addressed to enhance protection for informal workers.

Abstract

The legal dualism in the Mandailing Natal community between the rules of school fiqh and the laws and regulations regarding divorce issues still leaves problems. This research aims to answer the phenomenon of divorce outside the Religious Courts in the Mandailing Natal community and the factors that influence it, then the legal consequences that occur in the Mandailing Natal community. This study uses sociological legal methods with a legislative approach and is analyzed philosophically. Data was collected by means of literature study and observation. The study found that the rules in fiqh state that divorce can be carried out anywhere and at any time without being limited by space and time as long as harmony and conditions are met, while the rules in legislation such as the Marriage Law, the Religious Courts Law and the Compilation of Islamic Law ( KHI) states that divorce can only be carried out in front of a court hearing, in other words, there are rules that must be fulfilled when seeking a divorce. The legal consequences of divorce outside the Religious Courts show that the legal rules were made with the aim of maintaining benefits and avoiding mafsadat. So the public needs to understand that even though divorce is a private matter, the presence of the government is an effort to guarantee the rights and legal protection of the community. So that Islamic law can be seen from various aspects of life, so that the goal of sharia, namely legal certainty and order, can be realized.

Abstract

Islamic teachings are built on the foundation of maslahah and anticipate mafsadah. Therefore, changes to a law can occur along with certain conditions and time. This article explains the relationship between social transformation and the distribution of inheritance from an Islamic legal perspective. This also explains how social transformation in the community influences the distribution of inheritance. This research is library research, in collecting data a search was carried out on a number of books, articles and other scientific works that were relevant to the research theme. Based on this study, social transformation can have an impact on the distribution of inheritance, especially in terms of implementing wasiyyat al-wajibah. So, these laws can change due to al-maslahah al-murlahah, whereas, some qath'i (certain) laws regarding the distribution of inheritance will not change even though they are influenced by changing times and social and other influences.
