Abstract

In the process of forming a law or legislation, the DPD does not have the power to decide or play a role in the decision-making process at all. Even though there are support requirements to become a member of the DPR. This means that the quality of the legitimacy of DPD members is not at all balanced by the quality of their authority as representatives of the regional people. The aim of this research is to analyze the function and authority of the Regional Representative Council in the Structural Institution of the Republic of Indonesia State Legislative Institution and how to optimize the function and legislative authority of the Regional Representative Council. The type of research we use is normative legal research, namely research carried out by examining the body of literature or secondary data. Strengthening the authority of the DPD by consistently incorporating the Constitutional Court's decisions into statutory regulations and other regulations under it. This is being done pending the issuance of the fifth amendment to the 1945 Constitution. The current revision of the MD3 Law has not yet adopted the authority of the DPD in accordance with the Constitutional Court's decision. The need for the fifth amendment is to reorganize the function of legislation firmly and clearly in the 1945 Constitution, because by reorganizing the function of legislation it will touch all institutions, including the DPR, DPD, President and other institutions.

Abstract

Indonesia sebagai negara maritim memiliki kekayaan sumber daya alam (SDA) melimpah, termasuk sumber daya kelautan yang berkontribusi signifikan terhadap pertumbuhan ekonomi nasional. Namun, eksploitasi ilegal oleh pihak asing, seperti pencurian pasir laut, menimbulkan tantangan ekonomi dan lingkungan yang besar. Penelitian ini menganalisis pertanggungjawaban pidana korporasi dalam kasus pencurian pasir laut, dengan fokus pada tanggung jawab korporasi berdasarkan hukum Indonesia dan standar hukum internasional. Dengan pendekatan yuridis normatif dan analisis data kualitatif, penelitian ini menyoroti penerapan doktrin strict liability dan vicarious liability dalam menangani kejahatan korporasi. Hasil penelitian menunjukkan bahwa pertanggungjawaban pidana korporasi dapat secara efektif mencegah aktivitas ilegal dan melindungi kepentingan publik dengan meminta pertanggungjawaban korporasi atas kerusakan lingkungan dan kerugian ekonomi. Pendekatan ini menekankan pentingnya sanksi yang proporsional untuk menjamin keadilan dan keberlanjutan lingkungan sekaligus meningkatkan efektivitas penegakan hukum dalam menjaga kedaulatan maritim Indonesia.

Abstract

Health services are a critical aspect that requires coordination and cooperation from various parties, including patients, families, communities and medical personnel. Therefore, this research aims to analyze the rights and obligations of patients, families, communities and medical personnel in disaster health services. The method used is literature study. Google and Google Schoolar are used as the main sources of the database used from 2020 to 2024 to extract research via publish or perish software. From the research that has been conducted, disaster health services are a very complex and challenging aspect of the health system, which requires a multi-disciplinary and collaborative approach. A deep understanding of the rights and obligations of patients, families, communities and medical personnel is a strong basis for building a health care system that is fair, effective and sustainable. Cooperation between governments, international organizations, non-governmental organizations, local communities and individuals is essential to ensure that disaster response and recovery efforts can be carried out in a coordinated and effective manner. The development of supportive policies and regulations, as well as adequate funding, are also critical to strengthening disaster health services.

Abstract

In order to maintain a healthy investment climate competition, the Indonesian Government issued its legal product in the form of Government Regulation Number 24 of 2018 concerning Electronic Integrated Business Licensing Services aimed at enforcing business establishment permits and increasing the increase in the business licensing acceleration index in Indonesia. This article research is a normative legal research. The research aperaturan pemerintahroach method uses the legislative aperaturan pemerintahroach and case aperaturan pemerintahroach to examine the legal problems of the business license. The data source for writing this article comes from a literature study whose sources come from books, papers, and journals related to business licensing law in Indonesia. In writing this article, the author discusses how the legal regulation of licensing law and its solution are related to criminal acts related to violations of business licensing in electronic media in Indonesia nation. The results of this study explain that business activities whose operations in electronic media do not follow the legal regulations of business licensing in Indonesia, then the company can be sanctioned, its license revoked and cannot function properly and comprehensively in its operations in the territory of Indonesia.

Abstract

Economic crime is a new dimension of crime, the perpetrators of which consist of wealthy, intellectual and organized groups. Economic crime is also called white collar crime. Another characteristic of this crime is seen from its high mobility and is carried out not only in one region, but also across national borders. This article aims to explain the meaning and scope of economic crime, define the characteristics of economic crime and determine the regulation of economic crime in the Indonesian legal system. Based on the research, it was found that economic criminal law is part of the criminal law that has its own characteristics, namely the economic character with a very broad scope, including: smuggling, banking crimes, commercial crimes, cyber crimes, environmental crimes, digital economic crimes, crimes in the field of intellectual property rights, corruption, crimes in the field of labor and others. The research method used uses a normative legal approach. The purpose of this study is to determine the efforts of the Indonesian government in implementing regulations related to cases of economic violations in order to realize the eradication of economic crime in Indonesia. The research results state that as a special criminal law, the law governing economic violations certainly has a strong theoretical basis. Economic criminal law has special provisions contained in the field of substantive criminal law and criminal procedure law. Economic crimes are regulated in Emergency Law Number 7 of 1955 concerning the investigation, prosecution and trial of economic crimes.

Abstract

Pendidikan di Indonesia masih menghadapi ketimpangan yang signifikan, terutama dalam hal akses dan kualitas pendidikan di daerah terpencil dan bagi kelompok sosial-ekonomi rendah. Kebijakan “Merdeka Belajar” meskipun menawarkan fleksibilitas, belum mampu mengatasi ketidakadilan struktural yang mengakar dalam sistem pendidikan. Penelitian ini membahas dampak kebijakan “merdeka belajar” terhadap akses pendidikan dan ketimpangan sosial-ekonomi di indonesia serta peran kurikulum demokratis dalam membentuk individu kritis dan menantang hegemoni sistem pendidikan yang menindas. Penelitian ini menggunakan pendekatan yuridis normatif dengan analisis kualitatif terhadap kebijakan pendidikan dan penerapannya dalam konteks sosial. Hasil pembahasan menunjukkan bahwa kampus merdeka yang diciptakan kala pandemi masih menyisakan dampak ketimpangan sosial sekalipun pandemi telah selesai. Hal tersebut dikarenakan kurikulum yang ada saat ini cenderung terpusat dan kurang melibatkan partisipasi siswa, serta tidak cukup mendukung pengembangan pemikiran kritis untuk menanggapi ketidakadilan sosial. Selain itu, kebebasan akademik dan partisipasi kolektif dalam penyusunan kurikulum juga masih cenderung terbatas, meskipun diamanatkan oleh undang-undang. Kesimpulannya, sistem pendidikan Indonesia masih perlu diperbaiki untuk menciptakan pendidikan yang lebih demokratis dan inklusif. Saran yang diberikan adalah agar pemerintah dan institusi pendidikan lebih melibatkan semua aktor pendidikan dalam penyusunan kurikulum serta memastikan kebebasan akademik yang dijamin oleh hukum.

Abstract

Penelitian ini membahas peran lembaga legislatif dalam menghadapi dilema antara memperjuangkan aspirasi publik dan kepentingan politik partai dalam proses legislasi di Indonesia. Sebagai salah satu pilar utama dalam sistem pemerintahan, lembaga legislatif memiliki fungsi penting dalam pembentukan undang-undang, pengawasan, dan pengesahan anggaran negara. Namun, anggota legislatif sering kali dihadapkan pada ketegangan antara kepentingan publik dan tuntutan politik dari partai yang mendukung mereka, yang dapat mempengaruhi kualitas produk hukum yang dihasilkan. Penelitian ini menggunakan metode yuridis normatif untuk menganalisis faktor-faktor hukum, politik, dan sosial yang memengaruhi proses legislasi. Selain itu, penelitian ini menyoroti bagaimana sistem pemilihan umum dan dominasi partai politik menciptakan tekanan pada anggota legislatif, serta pengaruh lobi dari kelompok kepentingan ekonomi dalam proses pembuatan kebijakan. Untuk mengatasi dilema ini, peningkatan transparansi, akuntabilitas, dan partisipasi publik dalam proses legislasi dipandang sebagai solusi penting untuk menciptakan produk hukum yang adil dan inklusif

Abstract

Advocates as one of the professions in the field of law in their duty to defend clients both inside and outside the trial are equipped with privileges in the form of legal protection (immunity), but often these privileges are abused by advocates by obstruction of justice especially in cases of corruption crimes that aim to prevent clients from being investigated by Police Investigators, the Prosecutor's Office or the KPK. There are differences in the parameters of the assessment of good or bad ethics by an Advocate carried out by the Investigator so that it is considered to be an obstruction of justice so that there is a conflict between the legal norms contained in Article 16 of Law Number 18 of 2003 concerning Advocates and the reality that occurs in the field. The problem that causes advocates to be considered not to be good at obstructing justice in corruption cases is due to the absence of assessment parameters of advocates who are not in good faith and the absence of legal protection for advocates who are suspected of obstruction of justice, especially in corruption cases. The method used in this study is normative - empirical legal research, using a case approach, a legislative approach (statue approach) and a conceptual approach (Conceptual Approach). This study aims to examine the assessment parameters of advocates who do not have good faith against the suspicion of obstruction of justice by investigators and to find out the analysis of legal protection (immunity rights) owned by advocates who are considered to have no good faith by committing obstruction of justice, especially in cases of corruption. The results of this study are that the criteria for Advocates who are considered not in good faith are violations of the code of ethics, laws and regulations, oath or promise of Advocates as well as the value of feasibility and propriety. In addition, in order to create legal protection and certainty, a special institution such as the Advocate Honorary Council is needed which aims to determine whether the actions of the Advocate who are considered not to be in good faith are contrary to the etic code or laws and regulations or not.

Abstract

In carrying out their duties, general practitioners have limitations both in terms of knowledge and medical facilities they possess. Furthermore, based on the Omnibus Health Law 2023, there are regulations that govern general practitioners regarding the medical procedures they can and cannot perform. Several articles that regulate referral issues are Article 19, Article 32, Article 189, and Article 360. Meanwhile, the regulation regarding specialist doctors is listed in Articles 233-235. However, it is important to emphasize that the authority of specialist doctors and general practitioners is not directly regulated in the Omnibus Law. Thus, the study that can be conducted is an interpretative study that compares it simultaneously with similar legal products. Other references that can be used are Presidential Regulation no. 31 of 2019 and Minister of Health Regulation no. 36 of 2019. Based on a comparative study and judicial analysis of the Omnibus Health Law 2023, specialist doctors have their own independence, and therefore, if they delegate authority to general practitioners, it is guaranteed by the law, including the Omnibus Health Law 2023, especially because the Omnibus Health Law 2023 opens up flexibility for specialist doctors to practice. If delegation occurs, general practitioners can be legally protected as long as the basis for this delegation is emergency for patient safety, secondly is the delegation of authority to ensure patient safety, and thirdly is part of the education for specialist doctors. Although not explicitly stated, these implications are strongly implied in the articles mentioned in the Omnibus Health Law. Nevertheless, there are certain limits that specialist doctors must follow to ensure that patients' rights are well protected, and in the future, there needs to be a strengthening of regulations so that both general practitioners and specialist doctors do not face criminalization.

Abstract

The increasing number of medical malpractice cases is ironic, because with the current Health Law it is hoped that malpractice cases can be reduced in number. The Health Law and other regulations must be obeyed by all parties in the world of health, especially hospital corporations so that apart from medical personnel or health workers, hospitals, directors and hospital management must also take legal responsibility, in accordance with their respective roles in the event of malpractice in the hospital environment. On the other hand, the stakeholders of this hospital will receive legal protection if they have implemented all their rights and obligations in accordance with applicable legal provisions. The specific purpose of this research is to prove that hospital corporations are also eligible for criminal sanctions if malpractice occurs in the hospital environment, through the application of strict liability principle, compiled with the interconnection of various related legislation products. This research uses normative juridical research methods that are descriptive prescriptive, using data and information from relevant literature sources, primary legal sources in the form of statutory provisions and jurisprudence, corporate theories used to analyse the problems, as well as research data obtained from the internet/website of related agencies.
