Abstract

In carrying out their duties, general practitioners have limitations both in terms of knowledge and medical facilities they possess. Furthermore, based on the Omnibus Health Law 2023, there are regulations that govern general practitioners regarding the medical procedures they can and cannot perform. Several articles that regulate referral issues are Article 19, Article 32, Article 189, and Article 360. Meanwhile, the regulation regarding specialist doctors is listed in Articles 233-235. However, it is important to emphasize that the authority of specialist doctors and general practitioners is not directly regulated in the Omnibus Law. Thus, the study that can be conducted is an interpretative study that compares it simultaneously with similar legal products. Other references that can be used are Presidential Regulation no. 31 of 2019 and Minister of Health Regulation no. 36 of 2019. Based on a comparative study and judicial analysis of the Omnibus Health Law 2023, specialist doctors have their own independence, and therefore, if they delegate authority to general practitioners, it is guaranteed by the law, including the Omnibus Health Law 2023, especially because the Omnibus Health Law 2023 opens up flexibility for specialist doctors to practice. If delegation occurs, general practitioners can be legally protected as long as the basis for this delegation is emergency for patient safety, secondly is the delegation of authority to ensure patient safety, and thirdly is part of the education for specialist doctors. Although not explicitly stated, these implications are strongly implied in the articles mentioned in the Omnibus Health Law. Nevertheless, there are certain limits that specialist doctors must follow to ensure that patients' rights are well protected, and in the future, there needs to be a strengthening of regulations so that both general practitioners and specialist doctors do not face criminalization.

Abstract

The increasing number of medical malpractice cases is ironic, because with the current Health Law it is hoped that malpractice cases can be reduced in number. The Health Law and other regulations must be obeyed by all parties in the world of health, especially hospital corporations so that apart from medical personnel or health workers, hospitals, directors and hospital management must also take legal responsibility, in accordance with their respective roles in the event of malpractice in the hospital environment. On the other hand, the stakeholders of this hospital will receive legal protection if they have implemented all their rights and obligations in accordance with applicable legal provisions. The specific purpose of this research is to prove that hospital corporations are also eligible for criminal sanctions if malpractice occurs in the hospital environment, through the application of strict liability principle, compiled with the interconnection of various related legislation products. This research uses normative juridical research methods that are descriptive prescriptive, using data and information from relevant literature sources, primary legal sources in the form of statutory provisions and jurisprudence, corporate theories used to analyse the problems, as well as research data obtained from the internet/website of related agencies. Abstract

The aim of this study is to find out how the hospital's efforts to protect doctors who work under employment agreements such as permanent doctors and non-permanent doctors at the hospital and find out what the content of the contract agreement for permanent and non permanent doctors working at the Hospital. This research was carried out in two stages: literature research which aims to obtain secondary data as the main source of data including key legal documents, namely Law Number 17 of 2023 concerning Health. The researcher draws the conclusion that the protection in the hospital does not guarantee the certainty of legal protection for doctors. It is very important to create an optimal collective bargaining agreement between the doctor and the hospital so that a Light and Wise Legal Dispute Resolution is created. The research can provide new knowledge related to the construction of employment agreements for doctors working in hospitals.

Abstract

Resesi ekonomi global diproyeksikan oleh banyak ekonom akan terjadi pada tahun 2023 dan berdampak pada pelemahan ekonomi Indoensia. Pemerintah Indonesia juga dihadapkan pada kondisi kualitas dan kuantitas regulasi saat ini yang berpotensi saling tumpang tindih, disharmoni, dan menimbulkan konflik, karena sangat ego sektoral dan ego kedaerahan. Tantangan lain adalah adanya Putusan Mahkamah Konstitusi Nomor  91/PUU-XVIII/2020, menyatakan bahwa UU Cipta Kerja inkonstitusional bersyarat dan harus diperbaiki dalam jangka waktu dua tahun sejak diputuskan pada tanggal 25 November 2021. Rumusan masalah dalam penelitian ini terkait bagaimana mengantisipasi proyeksi resesi ekonomi global 2023 yang semakin dekat simultan dengan reformasi sektor regulasi termasuk UU Cipta Kerja pasca putusan Mahkamah Konstitusi. Penelitian ini mempergunakan metode penelitian yuridis normatif yang bersifat preskriptif analisis, lebih menekankan pada penelitian kepustakaan dengan metode pendekatan konseptual guna memberikan solusi dari permasalahan yang muncul. Hasil analisis dalam penelitian menyimpulkan bahwa keberadaan UU Cipta Kerja  menjadi salah satu unsur pendukung dari berbagai eleman yang dibutuhkan melalui sinegitas seluruh pemangku kepentingannya, bergerak maju secara harmonis untuk mengantisipasi dampak resesi ekonomi global bagi perekonomian Indonesia, dengan menerapkan konsep Blue Ocean Strategy yang diadopsikan dalam tindakan seluruh pemangku kepentingan di Indonesia. Kata kunci : Resesi, Cipta Kerja, Pemangku Kepentingan, Blue Ocean Strategy

Abstract

The Indonesian Criminal Procedure Code (KUHAP) does not differentiate between ethnic groups or nationalities, ensuring that all individuals are treated equally before the court, whether in the District Court, High Court, or Supreme Court. Suspects or defendants are no longer viewed as "objects" but as "subjects" who possess rights and obligations, including the right to claim compensation or rehabilitation in cases of wrongful arrest, detention, prosecution, or legal judgment. The reality that many suspects/defendants are not accompanied by legal counsel during criminal proceedings raises significant questions about why the provisions of KUHAP are not adhered to. This thesis aims to analyze and elaborate on the regulations within KUHAP concerning the obligation of legal counsel to assist suspects/defendants in court proceedings and to analyze and elaborate on the rules that should govern the implementation of the obligation for legal counsel in criminal cases. The type of legal research employed in this work is normative legal research. This research is prescriptive in nature, aiming to provide a careful, comprehensive, and systematic description and analysis of the characteristics of individual or group behavior. Legal assistance by counsel is a fundamental right that must be fulfilled in every legal process, as stipulated in Article 56 of the Indonesian Criminal Procedure Code (KUHAP). Ironically, the hegemony of scientific studies tends to focus more on the subordination and compliance of citizens to the law rather than the subordination and compliance of law enforcement officials to the law itself. This obligation not only aims to protect the rights of suspects but also to ensure that the principles of justice and the protection of human rights are upheld within the criminal justice system in Indonesia.

Abstract

The growing elderly population in Indonesia has created structural challenges in the health care system. One of the crucial challenges arises in the aspect of medical decision-making that becomes increasingly complex, along with the decline in cognitive capacity, comorbidities, and chronic diseases that accompany this age group. Problems arise when elderly patients refuse medical treatment, while doctors have ethical and professional obligations to save lives. This condition is complicated by social pressure from families and collective cultural values that often ignore the right to individual autonomy. As a result, doctors are in a vulnerable position legally and ethically, especially when there are no regulations that explicitly and technically regulate the limits of professional responsibility. This study aims to analyze the form of legal protection for doctors in the face of refusal of medical action by elderly patients. The method used is normative juridical, with statutory and conceptual approaches. The results show that there are no specific rules regarding the mechanism of informed refusal, evaluation of the decision-making capacity of elderly patients, and the limits of legal responsibility of doctors. This creates legal uncertainty, even when doctors have acted according to professional standards and medical ethics. This study recommends the establishment of technical regulations that strictly regulate the procedures for refusal of medical action by elderly patients. Legal protection for doctors is not only a professional guarantee, but also an integral part of a health system that is fair, sustainable, and ensures legal certainty in modern medical practice.

Abstract

In the modern legal system, Deoxyribonucleic Acid (DNA) testing has become an important tool in the resolution of criminal and civil cases in Indonesia. The use of DNA can assist in determining blood relations, uncovering sexual abuse cases, and proving involvement in other crimes. Nonetheless, there are various legal issues that arise regarding the collection of DNA specimens without the consent of the sample owner. In Indonesia, although there are personal data protection regulations such as the Health and Population Administration Law, there are no specific provisions regarding the legality of unauthorized DNA sampling. This creates uncertainty in the legal system, especially in terms of evidence being recognized in court. Unauthorized DNA sampling can violate an individual's right to privacy guaranteed by the 1945 Constitution and the Criminal Procedure Law. This potentially makes DNA test results inadmissible as valid evidence in court. Therefore, this study aims to analyze the legality of the practice of unauthorized DNA sampling and its impact on the legal evidentiary system in Indonesia. The study also highlights the importance of medical ethics and legal protection of privacy in determining the validity of DNA evidence in judicial proceedings. It also explores the role of medical ethics and privacy law in determining the validity of DNA test results in the judicial process, and provides recommendations for clearer regulations regarding DNA sampling procedures.

Abstract

This study aims to analyze the influence of organizing sports events on economic growth in Indonesia during the endemic transition period and legal regulations on sports events during the endemic transition period. Using normative juridical and normative empirical methods with a qualitative approach, this study examines relevant legal norms, such as the Indonesian Sports Law, on the influence of the country's economy in organizing sports events. Data were obtained from documentation of primary and secondary legal sources and interviews to understand the factors of economic growth through the sports industry. The results of this study indicate that the influence on economic growth through organizing sports events in Indonesia during the endemic transition period has not been fully accommodated by existing regulations. During the endemic transition period until now, the government and several sectors that work together to boost economic growth in Indonesia have not maximized the existing opportunities. However, with the weak implementation of regulations even though regulations regarding the sports industry have been written in the law. So that inappropriate implementation can hinder economic growth, as well as the occurrence of individuals who violate and damage existing facilities and the occurrence of budget efficiency in 2025 also affect the implementation of sports events. This study recommends that the government, private sector, and community collaborate to improve infrastructure evenly and maintain and build local and international appeal through the sports industry to become a source of foreign exchange for the country like developed countries.

Abstract

This study examines the use of nominee agreements as instruments of fraud within Indonesian foundations that operate private educations.  This research focuses on how foundation organs use the foundations to buy land assets for themselves and evade liability. The problem addressed is the gap between civil‐law façade and underlying criminal intent, whereby Patrons, Management, and Supervisors transfer land ownership out of the foundation’s name through a simulated agreement called nominee contracts. The research aims to analyze how these contracts facilitate systemic fraud and to propose a legal framework for holding both individuals and the foundation itself criminally accountable. A doctrinal‐normative method is employed, involving analyses of statutory provisions (Foundation Law, the old and the new Criminal Code), internal regulations, and key court decisions (e.g., Gunung Muria University, Al‐Hilaal Ambon, Morning Star). Findings reveal that nominee agreements consistently conceal intent to defraud, that existing legal provisions are underutilized or applied piecemeal, and that criminal courts have been reluctant to dissolve offending foundations despite clear evidence of strafbaarfeit (criminal act) by the foundation. The main synthesis highlights the necessity of a consistent approach by the law enforcement and the court to interpret nominee‐based transfers as criminal acts to prevent further asset diversion. The study concludes that integrating civil and criminal frameworks, along with strengthening oversight and enabling immediate dissolution of fraudulent foundations, is essential to safeguard public interest and restore trust in the nonprofit sector.

Abstract

This research aims to find out how the criminal law on business competition applies after Law Number 6 of 2023 and find out how the actualization of business actors in unfair business competition is related to the potential for Corruption Crimes. This research uses a normative juridical method through a statutory approach and a conceptual approach. The results of this research are that Law Number 6 of 2023 eliminates the criminal threat of business competition in Law Number 5 of 1999, where this effort is limited to decriminalization without anything else behind it. Then, it was also found that the elimination of the criminal threat of business competition in Law Number 6 of 2023 does not necessarily eliminate the criminal threat of business competition behavior absolutely, it is still possible that there is a threat of criminal acts of corruption which is indicated by unfair business competition. This needs to get the attention of business actors, so in this case the importance of considering the principles of business judgment rules in determining business policies is emphasized in order to avoid this threat.
