Abstract

Abstract Biotechnology in human's life gives a new expectation of an ability to create new organisms. Biotechnology has a firm connection with biological diversity as its genetic resources. The Living Modified Organism (LMO) that will be released to the free environtment will also affect the balance of the existing biological diversity. The regulation of biotechnology and its impact on biological diversity is at first mentioned on United Nation Conventions on Biological Diversity (UNCBD) 1992. This convention then has some protocols with specific issues. First, Cartagena Protocol on Biosafety to the Convention on Biological Diversity 2000 that regulates specifically about the transboundary transfer of Living Modified Organism (LMO). Second, The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from Their Utilization 2010 focusing on the use of biological diversity as genetic resources. Third, Nagoya - Kuala Lumpur Supplementary Protocol on Liability and Redress to the Cartagena Protocol on Biosafety 2010 focusing on the regulations to anticipate the emerging impact on biological diversity as the consequence of the LMO’s transboundary transfer.Keywords : Interntional Law, Biotechnology, Biological Diversity

Abstract

Abstraksi Extradition treaty between Republic of Indonesia and Republic of Korea was signed on the 28th November 2000 in Jakarta and ratified through Act Number 42 of 2007. With the ratification of Act Number 42 of 2007 the relationship and cooperation between the two countries for law enforcement and eradication of crimes are mutually beneficial. This study focuses on the history and development of the extradition treaty, procedures to implement the extradition and legal analysis of the extradition treaties of the Republic of Indonesia and the Republic of Korea.Keywords : Extradition, Indonesia, South Korea

Abstract

ABSTRACT At first, the environmental degradation/damage was only limited to the domestic level. But in a very short period of time, environmental damage began to explore the region and manage to affect international relations within ASEAN. Currently, most people are no longer in doubt that the environment is a major problem which makes it as an international issue. With the onset of the problem, causing a conflict between the ASEAN region. There are some cases that have an impact on international relations in the ASEAN region, one of which is the smoke pollution. Among some issues being raised were how the legal basis for cooperation among the ASEAN countries in controlling air pollution, how ASEAN cooperation in the control of environmental pollution in ASEAN and how the implications towards Indonesia due to agreement /cooperation in air pollution control. Results and discussion explaining  environmental pollution issues in ASEAN countries are basically generated from forest management activities result from excessive economic measures, especially among ASEAN countries in terms of the management and utilization of forests as an economic resource. Regulation of fog and smoke pollution in the international sphere can be seen from several declarations or conventions that exist. As in the 1972 Stockholm Declaration which recognizes the fundamental human right to be able to live in a good environment and healthy and as well as the obligation to maintain and be responsible in all actions to prevent pollution especially when it is very harmful to other countries, such as the prevention of burning forests that followed by the 1992 Rio Declaration and the 2002 World Summit in Johanesburg. And applied in the context of an international convention of The Geneva Convention The Convention on Long-Range Transboundary Air pollutants, 1979 (Geneva Convention, 1979), which in Article 2 obligates that States Parties to try to push as low as possible, gradually reduce and prevent air pollution including transboundary air pollution. Cooperation within ASEAN countries in controlling air pollution caused by forest fires can refer to the implementation of cooperation among ASEAN members. The cooperation ranging from the establishment of the ASEAN Agreement on the Conservation of Nature pollutan 1995, the Regional Haze Action Plan 1997, the ASEAN Agreement on Transboundary Haze Pollution in 2002 which is the world's first treaty that specifically addresses the cross-border pollution.   Keywords: Cooperation, ASEAN, air pollution, International Law

Abstract

ABSTRACT Riadhi Alhayyan 090200029 Kashmir border dispute was very influential and disturbing in the South Asia region, because the dispute involves two major states of India and Pakistan. The bickering two countries fighting over kashmir region as the territory continues and has attracted a lot of attention from various countries in the settlement of the dispute. Kashmir border dispute has put a serious challenge for analysts and policy makers because the conflict is complex and heterogeneous. Kashmir, the disputed territory that lies at the foot of the Himalayas, under the rule of the three countries. Jammu-Cash Society ¬ hmir entered Indian territory, while the people of Ladakh and Jammu-Kashmir-Pakistan respectively controlled by China and Pakistan. Among the three, only the Jammu-Kashmir's turbulent and demanding independence. The research method with normative legal research or legal research literature conducted by examining the literature material, and empirical legal research. The study used the law is normative legal research or collectively, the literature study (library research) with the acquisition of secondary data sourced cider magazines, books, journals, newspapers, online websites, and other library documents. Analysis of the data used is qualitative analysis, ie data obtained and subsequently systematically compiled and then analyzed qualitatively in order to achieve clarity issues to be discussed and the results are set forth in the form of a thesis. Based on the results of the study authors that the status area Kashmir under international law is in dispute, as India and Pakistan both claim Kashmir as their territory. But the ruler of Kashmir when it was a Hindu, would prefer to join with India, so that Kashmiris are now split into two, Pakistan and Kashmir Kashmir India. Kashmir struggle in a dilemma. If using peaceful means and approach to politics, India claimed that the people of Kashmir have accepted the status quo, to be a part of India. Kashmir territorial dispute and the Kashmir conflict occurs because of a conflict of interest between the two countries and the political power that is manifested through unilateral claims of India and Pakistan. Including religious factor, pakistan claims that the khasmir is a muslim majority area integral for pakistan while also claiming in kashmir hindu community are integrated with india. Factors as well as border, it is located in the teritory of Kashmir Indian authorities, however, a dispute can not be separated from the colonial regime that tends to make the inter-state border artificially, meanings the colonial regime tends to create a new border regime without notice in the interests of natural factors such as ethnicity,and socio-cultural condition. Solution to solve the Kashmir region between India struggle with Pakistan should be implemented bilateral relations between the two countries. UN and SAARCsebaiknya entitles India and Pakistan over the Kashmir region in accordance with the location of each region. So there is no reason for India and Pakistan to fight each other for control of the Kashmir region as a whole. In addition, the United Nations and the SAARC should be decisive in resolving the Kashmir conflict annexation. For countries that do not abide by the decision of the United Nations and the SAARC should be subject to strict law. . Keywords: Kashmir dispute

Abstract

ABSTRACT This study aims to determine the regulation of nuclear in international law perspection, international legal regulation in maintaining peace and stability of global security and shape the rules issued by the United Nations in the form of UN Security Council Resolution related to North Korea's nuclear test on 12 February 2013 in order to maintain peace and stability of the global security . The method used is the normative legal research with specification of descriptive research. The results are presented systematically through data collection is done by seeking information through library or secondary data including primary legal materials, secondary and tertiary-related issues. The results showed that the rule of international law that regulates nuclear contained in the UN Charter, UN General Assembly Resolution, UN Security Council Resolution, and the Statute of the IAEA. Setting of international law in maintaining global peace and security stability seen from the formation of the United Nations whose purpose is to maintain international peace and security. The rules issued by the United Nations in the form of UN Security Council Resolution related to North Korea's nuclear test on 12 February 2013 were the United Nations Security Council Resolution No. 2094 which provides for sanctions against North Korea in the form of an order to North Korea to abandon all nuclear weapons programs, enforcement of sanctions new finance to block financial transactions that support North Korea's illegal activities, inspection of suspicious cargo and denial of access to ports and shipping cost related to North Korea in accordance with the law and allow stronger enforcement of the sanctions that have been imposed by the UN Member States. Abstract

ABSTRACT THE CHAGE OF PALESTINE’S ENTITY BY UNITED NATION AND ITS EXISTENCE AS A NON MEMBER OBSERVER STATE   Israel - Palestinian conflict began when the issuance of UN resolution dividing Palestine into two parts. Israel getting more land while the Palestinians got smaller parts. The conflict culminated when Israel established the State of Israel in 1948 in Palestine by the resolution. Ongoing conflict, not a civil society of both Palestinian and Israeli victims. Palestine is a country that was fighting for its independence. In goal it formed the Palestinian Liberation Movement ( PLO ) which is the official representative of the Palestinians in the international world. Monitors the status of Palestine as a non-member entity makes not having a strong juridical status in the eyes of international law when it attacked by other countries. Palestinians do not have the right to vote to apply protection to the United Nations Security Council ( UNSC abbreviated hereafter ) or prosecution by the International Criminal Court, unless the Palestinian states are willing to accept the obligations arising as a result of a peaceful settlement as stated in Article 35 of the UN Charter. Issues raised in this paper is how the basic law or the requirements for recognition of a state by the UN, how to change the status of Palestinian statehood from observer entity to non- member observer state, and how the existence of Palestine as a non-member observer state. The research method used in this thesis tends normative legal research includes a study of the principles of law, the synchronization level of the law, legal history, and comparative law. The research method used in this paper is normative legal research includes a study of the principles of law, the law of synchronization standards, legal history, and comparative law. The method used is normative research using normative juridical approach. The results of this study indicate a change in the entity State of Palestine by the UN Monitoring Non Member is a big step for the Palestinians to get justice in the International Court of Justice. Abstract

Abstract The United Nations is the biggest international organization in the history of the cooperation growth for many international living sector to all nations in this world. In the international people association, states often get difference of interest so that it can cause a dispute or conflict of state. The existence of the United Nations can take effective in solving international disputes that occur among all nations including in solving the state jurisdiction dispute in the state immunity case between Germany and Italy. The United Nations has the International Court of Justice as the principal judicial organ of the United Nations. International Court of Justice has the competence of the court and legal binding in settle the international disputes based on the United Nations principle. The United Nations has the function through the International Court of Justice in solving the state immunity case between Germany and Italy. The method used in this research is library research data collection. The competence of the International Court of Justice based on the agreement of the state. The legal binding of the International Court of Justice Judgement in deciding international disputes only bind to the parties in case. In addition, the International Court of Justice still effort to settle the case of state immunity between Germany and Italy in peace through the system of Judicial Settlement. Abstract

Abstract Regarding of the implementation of peaceful relations between countries, which generally marked by the opening of diplomatic relations  and in addition followed by the opening of consular relations. Diplomatic relations are political while consular relations is non-political and tends to take care of administrative and commercial issues. To carry out consular functions in a foreign country who establishes consular relations with it, a country appointed  the consular officer.  Vienna Convention 1963 classifies consular officials into namely Career Consular Officers and Honorary Consular Officers. Indonesia and Germany have officially established diplomatic relations since 1952 and at present Germany representatives in Indonesia consists of an embassy and three Honorary Consuls, one of which located in Medan. The scope of consular relations by  Germany Honorary Consul in Medan consists of honorary consulate opening, the appointment of honorary consuls and operational matters of consular relations  by the honorary consul. Tasks and functions of the of Germany Honorary Consul in the field are based on the provisions contained in Konsulargesetz which is an affirmation of the Vienna Convention 1963. While the immunity and privileges acquired  by Germany Honorary Consul in Medan in carrying out its tasks and functions are very limited. It is recommended for reasons of economy and efficiency, the appointment of honorary consuls may be the right choice for countries that want to open a consular representative at the present time. In carrying out its tasks and functions, Germany Honorary Consul in Medan can enhance its role as a liaison of the business activities between Germany and Indonesia. Therefore, in terms of granting immunities and privileges of the Honorary Consul, Indonesia and Germany should make a special agreement on the matter in order to ensure a honorary consul can carry out his functions without a hitch Keyword: diplomatic, consular, relation

Abstract

ABSTRACT Release victims who were killed or wounded in armed conflict more annually increasing . International humanitarian law set in the Art . 79 Prot . Annex I to the second as the protection of civilians in armed conflict . They can not be targeted directly and can not be used as a shield . Military forces must take all necessary measures to protect civilians in conflict areas against the effects of military operations . However , Press who participated in military activities as well as any loss of immune status as civilians dlindungi by international humanitarian law . For example , by equipping themselves with the tools of armed or become a spy for the adverse party . Prisoners must not be tortured or executed without trial before an independent court . Media tools are not military facilities , even if they are used for propaganda or to incite the population to commit atrocities against racial or religious groups or other minorities . According to Art . 52 Prot . Annex I , they should be viewed as a civilian object . For example , a radio station can not be targeted directly , and must be protected against any effects of military operations . Many of the attacks against the press was never investigated because the error is managed by the recognition . The press will always be targeted but the whole international community should do its best to prevent such action .
