Abstract

Clinical subjects are a new model in Faculty of Law Hasanuddin University’s curriculum. It currently is implementing four legal clinics: (1) a civil law clinic; (2) a criminal law clinic; (3) an anti-corruption law clinic; and (4) an environmental law clinic. All of these clinics have been adopted in FH-UNHAS’s curriculum. This paper will focus on those subjects as new clinics and the students as new clinicians. It also discusses many challenges we face in managing the clinics and ensuring that all clinic students are able to engage in quality programming while working with our partners (local civil society organizations [CSOs] and formal justice institutions, such as District Courts and Provincial Prosecutor Offices).

Abstract

Cross-border transactions have always attracted legal risks. Cross-border legal issues are emerging as a separate area of commercial risk that needs to be more precisely identified and better managed. Many cases of injury to multinational companies which would formerly have been pursued as a diplomatic claim by the nation state of the company are now resolved by arbitration between the company and the respondent state. Arbitration is one of dispute settlement bodies to resolve some issues particular trade, business, investment, and financial issues. Those issues are shaping the range and significance of the cross-border legal issue. Those issues also become a crucial issue to be dealt with the arbitral institution. The reason why the parties of contract choose arbitration is because of the place of arbitration, neutrality, confidentiality, cost and speed, recognition and enforcement of arbitral awards, refusing of arbitral awards, a model of arbitration, and arbitration institution. Those reasons are assumed also to be enacted in Indonesian arbitration practice and in the Islamic law.

Abstract

The rising number of sea travel is followed by the emerging number of sea crimes such as sea piracy and maritime terrorism. In recent two decades, the number of crimes on the sea have shown an alarming figure, where areas with a dense traffic of vessels such as the Gulf of Aden and Malacca Strait becomes the hot spots for piracy crime. The main reason behind the emerging of modern piracy is the increasing number of sea transported goods which create a significant opportunity to be a huge target of crime considering the drives behind piracy is financial reason. Some area of sea piracy took place commonly in Africa and Southeast Asia.

Abstract

Before the enactment of the Job Creation Law, liquid waste disposal was governed by a specific permit system. However, with the introduction of the Job Creation Law, this system transitioned to requiring businesses to obtain technical approvals to comply with wastewater quality standards. Challenges have emerged, particularly improper practices that fail to align with ethical environmental principles. This research critically examines Indonesia's legislative framework for liquid waste management, focusing on its implementation and impact under the Job Creation Law, with a specific emphasis on environmental sustainability. A significant finding highlights persistent issues in managing household and laundry wastewater, which remain inadequately addressed under current regulations. Such gaps undermine environmental ethics, both anthropocentrism and ecocentrism. This paper advocates for synchronized regulations and comprehensive guidelines to mitigate adverse effects on environmental sustainability, ensuring stronger legal protections for Indonesian society.
