Abstract

One of the important points of criminal law reform in the Criminal Code is the regulatory provision regarding living law. The Criminal Code authentically determines that living law is customary criminal law, which is declared valid and further regulated through Local Regulations. The absence of limitations related to customary criminal law standards that can be qualified as a living law has the potential to cause injustice. This study aims to analyze the urgency and the formulation of limitations on living law arrangements in the Criminal Code in realizing justice. The results of the study show that the urgency regarding limitations on living law arrangements in the Criminal Code is meant to protect human rights while at the same time preventing potential criminalization. The formulation of limitations of the living law arrangements in the Criminal Code is to realize justice. Therefore, the limitations of customary criminal law can be categorized as a living law according to the Criminal Code, that are: indigenous people still practice the law; these customary crimes do not conflict with the principles of the rule of law; they do not conflict with Pancasila values; and the crimes are further formulated by local regulations.

Abstract

The passing of Law No. 12 of 2022 on the Crime of Sexual Violence on May 9, 2022, became an umbrella of positive legal protection against sexual violence experienced by women and children as the majority of victims of sexual violence. The Ministry of Women's Protection and Child Protection noted that as many as 25,050 women were victims of sexual violence in 2022. The birth of Law No. 12 of 2022 concerning Criminal Acts of Sexual Violence is a perfection of previous laws and regulations with the same substance so as to protect and guarantee the rights of victims of sexual violence. This study aims to determine the effectiveness of the implementation of Law No. 12 of 2022 concerning Criminal Acts of Sexual Violence in tackling cases of sexual violence crimes, especially against women and children. The method used in this research is normative-empirical law by including secondary data from literature studies and primary data obtained directly from the general public through questionnaires. The conclusion obtained is that Law No. 12 of 2022 concerning Criminal Acts of Sexual Violence has not been implemented effectively because there are still many cases that experience obstacles to justice. Abstract

Di tengah globalisasi dan perubahan sosial yang cepat, generasi muda dihadapkan pada tantangan moral yang kompleks, termasuk dampak negatif dari media sosial dan informasi yang mudah diakses. Untuk mengatasi tantangan ini, karantina moralitas diusulkan sebagai pendekatan yang melindungi dan memperkuat nilai-nilai moral. Ini meliputi integrasi pendidikan moral dalam kurikulum sekolah, keterlibatan aktif keluarga dalam membimbing anak-anak, serta peningkatan kesadaran sosial melalui inisiatif komunitas. Penggunaan teknologi secara bijaksana juga merupakan bagian penting dari upaya ini. Karantina moralitas bertujuan untuk membentuk generasi yang lebih sadar hukum dan etis, sekaligus memperkuat integritas sistem hukum, sehingga menciptakan supremasi hukum yang lebih adil, transparan, dan bertanggung jawab. Dua rumusan masalah utama yang dibahas mencakup bagaimana strategi pendidikan moral dapat diterapkan secara efektif dalam kurikulum sekolah, serta bagaimana peran keluarga berkontribusi dalam membentuk moralitas generasi muda dan dampaknya terhadap kepatuhan hukum. Penelitian ini menekankan bahwa moralitas yang kuat di kalangan generasi muda merupakan fondasi penting untuk keberhasilan supremasi hukum di masa mendatang.

Abstract

Seringkali perempuan dianggap lemah dengan keterbatasannya dan laki-laki sangat mendominasi karena mampu mengatasi segala hal, sehingga tanpa disadari tindakan diskriminatif akan selalu terjadi dalam tatanan sosial dan meluas di sepanjang kehidupan. Diskriminasi gender tersebut berupa wujud kekerasan maupun psikologis. Dalam hal ini diperlukan pandangan sosiologi hukum untuk mengupayakan kesetaraan hak antara laki-laki dan perempuan mendapat perlindungan hukum yang baik. Tujuan dari penelitian ini adalah untuk menganalisis perspektif sosiologi hukum dan dampak yang diakibatkannya, serta solusi untuk mengatasi diskriminasi gender dalam kerangka sosiologi hukum. Metodologi penelitian khusus ini melibatkan pemanfaatan metode penelitian kualitatif di lingkungan perpustakaan dan teknik analisis isi deskriptif untuk analisis data. Kesimpulan yang diperoleh dari analisis ini adalah untuk memitigasi pertumbuhan kesenjangan gender di semua bidang kehidupan, penting bagi setiap individu untuk memiliki tingkat kesadaran diri yang tinggi mengenai peran dan tugasnya masing-masing. Dengan hal ini memerlukan komitmen yang teguh untuk mematuhi prinsip-prinsip yang mengatur keberadaan manusia.

Abstract

A toddler victim of rabies that causes death violates the right to life, survival and development as outlined in the conception of child protection in the explanation of Law No. 23 of 2002. The problems in this paper are: How is the Legal Sociology Study of the Effectiveness of Rabies Transmission Prevention Regulations, and How is the Legal Protection of Rabies Victims in Bali Causing the Death of Toddlers from a Legal Sociology Perspective? The research method used is Juridical-Empirical. The results showed that the toddler's parents were negligent in the case discussed because the wound was considered small and safe. Hence, the patient (family) was negligent and did not report to the health facility for further treatment. Regarding negligence that causes death, it is explained in Article 359 of the Criminal Code, which reads as follows: "Any person through whose fault (negligence) causes the death of another person shall be punished by a maximum imprisonment of five years or a maximum light imprisonment of one year." From the perspective of Legal Sociology, there is the arbitrary treatment of children carried out by families without paying attention to the child's right to protection following his health condition after being bitten by his pet dog.

Abstract

Globalisasi dan reformasi membawa pengaruh yang besar terhadap kebijakan terhadap lingkungan. Adanya globalisasi dan reformasi merubah nilai dan pola pikir terhadap pengambilan kebijakan tentang lingkungan. Penelitian ini bertujuan untuk menginvestigasi dampak industri terhadap interaksi sosial masyarakat setempat serta faktor-faktor yang mempengaruhi pola interaksi sosial tersebut. Metode penelitian pada aplikasi yang dibuat menggunakan teknik pengumpulan data secara deskriptif. Secara garis besar pendekatan deskriptif adalah dengan teknik pengumpulan data seberapa besar subjek penelitian yang terlibat dalam penggunaan sistem sesuai kebutuhan sistem secara sistematis dan disesuaikan dengan fakta yang ada sehingga akurat. Penelitian deskriptif (descriptive research) bertujuan mendeskripsikan suatu keadaan atau femomena apa adanya. Adanya fenomena isu lingkungan yang terkait dengan dampak negatif yang diakibatkan oleh kegiatan industri turut mempengaruhi manajemen perusahaan untuk membuat kebijakan mengenai peningkatan kinerja. Perubahan izin lingkungan dalam kegiatan usaha sebagaimana diatur dalam Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dinilai lebih memiliki tujuan yang dapat meningkatkan kesejahteraan ekonomi dibandingkan memberikan perlindungan serta pengelolaan lingkungan hidup di Indonesia yang sebelumnya diatur dalam Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Penilaian tersebut muncul akibat pengubahan konsep Izin Lingkungan menjadi Persetujuan Lingkungan dan pelemahan partisipasi masyarakat. Hal ini menjadi kekhawatiran bagi masyarakat Indonesia khususnya terhadap pengaturan izin lingkungan, kegiatan usaha serta dampaknya terhadap perlindungan dan pengelolaan lingkungan hidup di Indonesia pasca ditetapkannya Undang-Undang Cipta Kerja.

Abstract

Introduction: Customary law shapes and protects indigenous cultural identity and rights in the face of rapid modernity. However, customary law incorporation into national legal systems, notably in Malaysia and Indonesia, remains difficult. Both nations recognize and integrate customary law into their legal systems, but disparities in indigenous peoples' land, forestry, and natural resource management rights enforcement and protection exist.Purposes of the Research: The study's main objectives are to (1) understand and evaluate customary law's inclusion into Malaysia and Indonesia's legal systems and (2) determine the best framework for this incorporation given the fast rate of modernization.Methods of the Research: This research employs a normative juridical methodology with statutory and comparative approaches. Through a review of relevant laws and literature from both countries, this study seeks to identify and compare how customary law is integrated into the national legal systems of Malaysia and Indonesia.Results of the Research: The research identified discrepancies in indigenous peoples' rights enforcement and protection, notably in land, forestry, and natural resource management, despite both countries adopting customary law into their legal systems. This research emphasizes the necessity for inclusive and participatory customary law incorporation into national legal systems. Customary law is important to these systems and is acknowledged, preserved, and respected. Scholars, attorneys, and legislators in both countries may utilize this study to protect indigenous rights.

Abstract

This Community Service (PKM) aims to improve the digital skills of MSME actors in rural areas, especially in online marketing, through online training using the Zoom platform. This activity is motivated by the low digital skills of MSMEs in rural areas, which limits their access to the digital market. The method used is participatory action research (PAR), involving 30 MSME actors who are selected by purposive sampling. The training lasts four weeks and includes two weekly sessions, covering material on digital marketing, the use of social media, e-commerce, and marketing performance monitoring. The results showed a significant improvement in participants' digital skills, with an average pre-test score of 45 increasing to 80 on the post-test. Implementing the skills learned also resulted in an increase in engagement on social media by 40% and an increase in online transactions by 20%-30%. Participants gave positive feedback regarding the relevance of the training and the application of the skills taught. This activity fills the gap in previous research by focusing on practical strategies adapted to the conditions of MSMEs in rural areas. The main obstacle faced is the problem of internet connectivity, which needs to be considered in the next training. Overall, this activity has succeeded in increasing the competitiveness of MSMEs in the digital market

Abstract

Indigenous societies' social interactions are governed by customary law, which has a major impact on cultural identity. Conflicts between local customs and the standardized elements of positive law make it difficult to integrate customary marriage rules into Indonesia's national legal system. Indonesia acknowledges the importance of customary law, yet there is still inconsistency when it comes to marital customs and other areas where it is included in national laws. The goals of this research are twofold: first, to understand how positive law in Indonesia interacts with customary marital law, and second, to find ways to bring these two systems together in a way that promotes inclusivity, justice, and cultural diversity. This study utilizes a normative juridical method by conducting qualitative and comparative analyses of pertinent literature, legal concepts, and legislation. The article looks at marriage legislation from both a positive and traditional perspective, comparing and contrasting the two. In particular, the results show that there are substantial obstacles to bringing traditional marriage regulations into line with modern legal norms in the areas of marriage registration, gender equality, and the age of consent. The research suggests a mechanism for incorporating Indonesia's traditional marriage rules into the country's formal legal framework, with the goals of protecting cultural values and promoting social justice and human rights. Insights from this study may help academics, legal professionals, and legislators make national law more welcoming and sensitive to other cultures.

Abstract

Marriage is a bond of agreement between human individuals to build a household ship with a happy and eternal goal until the end of their life. In a marriage, there are many factors supporting similarities, differences, economics, religion, social status and so on. Our aim is to research to find out whether it is permissible to marry religious differences are in accordance with the results of the methodology that we are looking for, namely in accordance with the perfective Indonesian positive law, religious law and sociological views on interfaith marriages. Indonesia has its own regulations which are regulated in its law book in the Civil Code, while according to the perspective of religious law in Indonesia, marriages from people of different religions are not allowed, they are considered invalid or forbidden, the sociological view of marriages between different religions is considered valid. Just because in social science a marriage occurs because of mutual love and does not prioritize religion because love occurs because there are similarities and differences that complement each other and there is an attitude of tolerance between partners so that the marriage is eternal and happy.
