Abstract

Focusing on the connection between customary law and human rights concepts, this study seeks to examine the difficulties and potential solutions surrounding the recording, regulation, and application of customary law in Oman and Indonesia. This study compares and contrasts two nations, Oman and Indonesia, using a normative and comparative method. Literature reviews, statutory rules, official papers, and policies pertaining to law are all sources of legal information. According to the study's findings, the most significant problems include a lack of documentation of customary law, clashes between customary law and human rights principles, and difficulties in incorporating customary law into the country's legal system. A portion of the suggested remedy is to bring formal law and customary law into closer alignment, and another element is to increase indigenous people's involvement in the legislative and judicial processes.

Abstract

The New Indonesian Criminal Code (Law No. 1 of 2023) formally recognizes customary criminal law (living law), yet this development generates a fundamental paradox between legal formalization and the absence of procedural mechanisms. The urgency of this issue arises from the inconsistency between the recognition of customary sanctions and the Criminal Procedure Code (KUHAP), which designates the Prosecutor as the sole authority responsible for executing criminal judgments. In practice, the Prosecutor lacks the cultural competence and institutional capacity to implement spiritual and restorative customary sanctions, which traditionally fall under the authority of Customary Leaders. This misalignment between legal authority and practical competence creates an executorial crisis, rendering sentences in the form of “fulfillment of customary obligations” potentially non-executable. Using normative legal research methods and analysis of primary and secondary legal materials, this study finds that the absence of KUHAP reform accompanying the New KUHP exacerbates legal uncertainty. As a result, non-executable judgments are likely to increase, undermining judicial authority and weakening the functional position of customary law within the national criminal justice system.

Abstract

Interfaith marriage in Indonesia persists in inciting legal controversies due to disparate interpretations and implementations of regulations by the court. This article aims to analyze the legal framework regulating interfaith marriage in the Indonesian legal system, emphasizing statutory provisions and judicial decisions, while evaluating how discrepancies in the interpretation and application of these laws affect legal certainty and the protection of citizens' constitutional rights. This study utilizes normative juridical methodologies, incorporating legislative, conceptual, and case approaches, to analyze Law Number 1 of 1974 on Marriage, Law Number 23 of 2006 on Population Administration, Constitutional Court Decisions Number 68/PUU-XII/2014 and Number 24/PUU-XX/2022, as well as various district court rulings regarding the registration of interfaith marriages. The study's results reveal that, under Indonesian law, the validity of marriage is largely regulated by religious law, but the state retains authority over administrative issues to provide legal order and clarity. Prior to the implementation of rigorous judicial standards, the court used diverse interpretations, resulting in discrepancies in decisions and legal uncertainty. This conflict stems not from an absence of standards but from inconsistencies in legal enforcement. The Constitutional Court has affirmed that restrictions on interfaith marriage do not violate constitutional rights when based on religious beliefs and Article 28j of the 1945 Constitution of the Republic of Indonesia. The issuance of Supreme Court Circular Letter Number 2 of 2023 has improved normative legal clarity; nonetheless, the subsequent obstacle lies in the consistency of its application in judicial practice.

Abstract

Examining how successfully consumer protection legislation in Indonesia have kept up with the evolution of digital technology and how well they have been applied to online transactions is the primary goal of this study. In this age of ubiquitous electronic transactions, the significance of consumer protection has never been greater, as this study shows. Analysis of statutes, regulations, and other relevant legal documents is part of the normative research literature review methodology. Included in the literature review are the following statutes and regulations: Law 8 of 1999, which deals with consumer protection; Government Regulation 71 of 2019, which deals with the implementation of electronic systems and transactions; and Regulation 5 of 2020, which deals with the implementation of private scope electronic systems, which is ministerial decree. While the current standards are thorough, there are still several challenges to putting them into practice, according to the report. Consumers' ignorance of their rights, ineffective dispute resolution processes, and lax law enforcement are all factors contributing to this problem. Furthermore, this study delves into the significance of enhancing consumer safety via education and bolstering monitoring, as well as the need of revising rules to account for ever-evolving technology advancements.

Abstract

There are several facets to the complicated problem of polygamy in Indonesia, including positive law, Islamic law, and societal factors. While Islam does provide a legal framework for polygamy and Law Number 1 of 1974 concerning Marriage does regulate it thoroughly, it might be challenging to put the idea of fairness as the primary criterion into practice. The issue that affects the legal protection of women and children stems from polygamy's injustice, which includes both material and non-material components, and from the lack of strong oversight of unregistered marriage practices. In order to better safeguard women and children involved in polygamy, this research will examine the degree to which legal standards are followed and how these standards are put into effect. Combining a socio-legal framework to comprehend its social application with a legal examination of Islamic and national legal norms, this research employs a normative descriptive technique with a qualitative approach. Findings reveal that unregistered weddings and other legal loopholes continue to be a big problem, even though laws have been enacted to restrict careless polygamy. Legal change, including the digitization of marriage registration, stricter polygamy permission processes, and the empowerment of women, are proposed remedies in this research. Another tactic for creating a flexible and responsive legal system is to combine local values with international norms like CEDAW. This study's findings will help shape Indonesia's marriage law policy in a more equitable and welcoming direction.

Abstract

This study examines the vulnerabilities of philanthropy in Indonesia amid its rapid growth through digital platforms and social organizations, highlighting risks of abuse and misuse of donations. The case of Agus Salim, a victim of acid attack whose Rp1.5 billion in public donations was diverted for personal and family use, illustrates how weak regulatory oversight has triggered a trust crisis in philanthropic institutions. The research aims to analyze manipulative practices in philanthropic activities, the factors contributing to weak supervision, and the resulting legal and social implications. Using a juridical-normative method, the study draws on literature review, case analysis, and relevant regulations, including Law No. 9 of 1961, Government Regulation No. 29 of 1980, the Criminal Code, and the Electronic Transactions Law. By comparing legal norms (das sollen) with empirical practices (das sein), the findings reveal that donation funds are often transferred into personal accounts without accountability, government supervision remains inadequate, and while existing legal instruments such as Articles 372 and 378 of the Criminal Code are applicable, enforcement is slow and inconsistent. The study concludes that philanthropy should be recognized not only as a moral activity but also as a “business of philanthropy” highly vulnerable to manipulation. It underscores the urgency of regulatory harmonization, the establishment of a national philanthropic code of ethics, and the application of good governance principles. Recommendations include the adoption of open public audits and digital reporting systems to strengthen accountability and prevent future misuse.

Abstract

Authentic acts performed by notaries play a crucial role in the Indonesian civil law system because they provide legal certainty and evidentiary guarantees for the parties concerned. Although notaries, as public officials, possess the legal authority to codify the intentions of the parties into lawful deeds with full evidentiary weight as stipulated in Article 1868 of the Civil Code, Indonesian civil law does not require all agreements to be formalized as authentic notarial deeds as long as they comply with the validity requirements in Article 1320 of the Civil Code. In practice, civil agreements without notarial validation are frequently made and documented as handwritten or private deeds, a practice that raises legal challenges in the event of disputes, particularly regarding the legal validity of the agreement and its evidentiary force in court. This study aims to analyze the legal status of civil agreements concluded without an authentic notarial deed and the consequent legal ramifications from the perspectives of civil law and evidentiary law. Employing normative legal research, the study uses statutory and conceptual approaches, supported by an examination of legal concepts and relevant court decisions. The findings demonstrate that a civil agreement without an authentic notarial deed remains legally valid and binding on the parties as long as it fulfills the substantive requirements for validity; however, it lacks comprehensive evidentiary strength because it does not meet the external, formal, and material standards characteristic of an authentic deed. As a result, the parties face weaker legal protection, reduced legal clarity, and a higher potential for disputes. The study concludes that the use of authentic notarial deeds is an essential instrument for preventing legal problems and ensuring legal certainty and clarity in civil relations.

Abstract

This study aims to analyze the role of traditional leaders in Rote Ndao in resolving cases based on restorative justice and to assess the effectiveness of traditional mechanisms in realizing restorative justice at the local level. The method used in this study is a normative juridical approach supported by factual data obtained through literature study, analysis of legislation, and review of literature related to customary dispute resolution practices in Indonesia. The novelty of this research lies in the integration model between Rote Ndao customary law and the principles of restorative justice in handling minor crimes. This model shows that customary mechanisms can serve as an alternative means of case resolution that is in line with substantive justice and local values. The results of the study show that customary leaders play a strategic role as mediators and facilitators of deliberations who are able to resolve cases peacefully without going through litigation. This mechanism not only resolves conflicts but also restores social relations, strengthens community solidarity, and preserves local wisdom values. Conclusion The role of traditional leaders in Rote Ndao is highly relevant to be strengthened as part of dispute resolution policies at the local level. This approach can be used as a model for other regions in integrating customary law and positive law to achieve substantive justice and social sustainability.
