Abstract

Purpose – This study aims to investigate the autonomy of “Kyai” (religious teachers) within Pesantren in making education policy. In examining these policies, it focuses on the evolution of teaching and the implementation of the “Asas Tunggal Pancasila” in Indonesian educational institutions, the struggles of Pesantren policies that led to the birth of Law No. 18 of 2019, and the dark side of the politicization of religion that has implications for educational policies. Design/methods/approach – This type of research uses qualitative research with a case study of two Islamic boarding schools in East Java (research objects). Primary data sources come from observation and interview results. Secondary data sources come from library sources such as laws, scientific articles (journals), books, etc. Data collection used observation techniques, semi-structured in-depth interviews, and documentation (document analysis). Data analysis techniques used qualitative data analysis techniques, namely data condensation, data presentation, and conclusion drawing. Findings – The research reveals that the law empowers Pesantren and Kyai to shape their institutions in alignment with societal demands, traditions, and evolving times. Though the Kyai’s independence significantly affects the Pesantren’s trajectory, it does not singularly define its identity. The law underscores the imperative for contemporary teaching methods, curriculum evolution, and infrastructure enhancement, urging Kyai to eschew rigid and authoritarian stances. Research implications/limitations – The research has theoretical implications that two contrasting views concerning Pesantren policies’ influence on Kyai’s independence vis-à-vis political elites. Proponents (“Yes”) highlight Alignment of Interest, Empowerment and Development, and Community Engagement. Opponents (“No”) cite the Preservation of Autonomy, the potential for manipulation, and an inherent distrust of political parties. Originality/value – The research provides direction for the complex interplay between religious education and the political domain in Indonesia.

Abstract

The emergence of the concept of religious moderation initiated by the Ministry of Religion of the Republic of Indonesia and set forth in the 2020-2024 National Medium-Term Development Plan (RPJMN) indicates that the program for internalizing and strengthening the values of religious moderation is very important and urgent to implement. The values of religious moderation consist of four points, namely national commitment, tolerance, anti-radicalism, and accommodative to local culture. The direction to internalize the four values of religious moderation is also played by the Anak Jalanan At-Tamur Islamic Boarding School, Bandung. This article aims to reveal the role of the Anak Jalanan At-Tamur Islamic Boarding School in internalizing the values of religious moderation to students. This article uses qualitative research methods that are field research. The research data were obtained from two sources, namely field data sources and library data sources. Data collection techniques used are observation, interviews, and documentaries. The data analysis techniques used are data condensation, data presentation, and drawing conclusions. The results showed that success in internalizing the values of religious moderation to students could be seen from the indicators or values of religious moderation. The four indicators (values) of religious moderation are reflected in the routine activities and attitudes of students of the Anak Jalanan At-Tamur Islamic Boarding School. Commitment to nationalism, tolerance, anti-radicalism and accommodativeness to local culture is imprinted in the personalities of the students of the Anak Jalanan At-Tamur Islamic Boarding School. This is also due to two things: firstly, interfaith dialogue events are often held and secondly, the leader of the Anak Jalanan At-Tamur Islamic Boarding School who has a broad and open view and emphasizes morality in his education.

Abstract

The implementation of the death penalty for corruptors has never been decided by any judges throughout the history of law enforcement in Indonesia. However, Law No. 31 of 1999 jo Law No. 20 of 2001 on Corruption Eradication has established the criteria or conditions for a corruptor to be sentenced to death. This was an empirical legal study which was conducted by library research. This article examines judge decisions by a descriptive analysis. The theory used in this research was maqāṣid al-syarī‘ah. The paradigm was used to determine the dynamics of Islamic law in analysing the death penalty for corruptors. This study was based on the Social Assistance (Bansos) corruption committed by former Minister of Social Affairs, Julia Peter Batubara, during the Covid-19 pandemic. The corruption was committed by Julia Peter Batubara when there was an epidemics and national economic crisis. This study found that the death penalty for corruptors is affected by political power, allowing corrupt officials to escape the death penalty.

Abstract

Abstract: After the merger, three banks under State-Owned Enterprises (BUMN), namely BNI Syariah, BRI Syariah, and Bank Syariah Mandiri, became Bank Syariah Indonesia (BSI), opening opportunities for the development of Islamic financial institutions in Indonesia. However, according to the Masyarakat Tanpa Riba (Society Without Riba) (MTR), Islamic banks are not much different from conventional banks (BK). Therefore, the focus of this article is the law of usury in the view of the MTR, which is seen in three aspects, namely, the perception, attitude, and movement of the MTR. This paper aims to determine the law of usury from the view of the MTR. This article uses a qualitative research method, which is field research. Data collection techniques used are observation, interviews, and documents. The data analysis technique in this paper uses data condensation, data presentation, and conclusion. The study results show that the MTR is an anti-usury community. MTR can be categorised as a textualist and rigid group (mutasyadidun). The rigid MTR method often implies that Islamic economic development is static and monolithic. The existence of the MTR will be productive if it is read not as a threat but as an auto-criticism against Sharia financial practices that are not yet perfect, highlighting the potential impact of the MTR's perspective on Islamic financial practices.

Abstract

This paper examines the ritual tradition of esoteric scientific practices in Islamic boarding schools (pesantren), with a focus on the practical teachings outlined in the Kitab Amalan Khizib Kubro Ismul Haq. The study employs a qualitative research approach, utilizing library research methods. The primary data source is the Kitab Amalan Khizib Kubro Ismul Haq, along with supporting literature such as books, academic articles, and journals relevant to the research topic. Data collection is carried out through documentation, and content analysis is used for data analysis, incorporating techniques of data condensation, presentation, and conclusion drawing. The research findings reveal three main points. First, Islamic boarding schools (pesantren) are key institutions in preserving and developing Islamic traditions, including esoteric scientific practices. Second, esoteric practices are often misunderstood or negatively stigmatized due to a lack of comprehensive understanding, where the outward forms of the practices are emphasized over their deeper meanings. Third, the esoteric practices within pesantren share common ground with Sufism, as both emphasize inner spiritual transformation and the unveiling of hidden truths, with the ultimate aim of attracting benefits and avoiding harm for the practitioner. This paper aims to offer a fresh perspective on the esoteric ritual traditions in Islamic boarding schools and contribute to a deeper understanding of their role in Islamic spiritual practices.

Abstract

Although it has been implemented for more than two decades since Reformasi 1998, democracy in Indonesia has not been fully established in terms of its principles, ethics, philosphy and orientation. There has been a variety of interpretation and narration of democracy in Indonesia in line of its various actors and supporters. The coming of digital era is making the Indonesian democracy more challenging. Therefore, there is a need for a new concept of democracy that can accommodate all forces of modernity and the specific nature of Indonesia. This article explains a form of democracy offered by Yasraf Amir Piliang as a model of Indonesian demoracy in digital era. Indonesia should apply a form of democracy that maintains national identity while keeps up with modernity in its attempt to realise people sovereignty. This article concludes that hybrid democracy in the forms of liberative, agonistic, autonomous and counter democracies is an appropriate model to implement in Indonesia in the digital era.
