Abstract

Beauty clinics have become an integral part of modern lifestyles, offering aesthetic solutions to enhance self-confidence. However, alongside their popularity, several challenges have emerged, including health risks stemming from hazardous chemicals, malpractice, and inadequate professional competence. Widespread consumerism often overlooks safety aspects, driven by media-induced unrealistic beauty standards. In this context, legal protection for consumers utilizing beauty clinic services is of paramount importance. This study aims to analyze the legal liability of beauty clinics in safeguarding consumer rights, focusing on the application of justice principles. These principles encompass distributive justice, which demands equitable access to services without discrimination, and procedural justice, which ensures transparency and active consumer participation in medical decision-making. Employing a normative juridical method. The findings reveal that, despite existing regulations outlining the obligations of service providers, numerous beauty clinics fail to adhere to established standards. Consumers often suffer harm due to unsafe procedures or the use of unregulated beauty products. In such instances, the BPSK offers an effective mechanism for dispute resolution, providing mediation, conciliation, and arbitration services characterized by low costs and simplified procedures. From the perspective of justice, ensuring that all consumers have equal rights to clear information and safe services is imperative. Furthermore, strengthening consumer involvement in medical decision-making processes is critical to avoiding the dominance of paternalistic relationships between healthcare providers and patients. By enforcing robust legal protections and adopting a holistic approach to justice, consumer protection in beauty clinic services can be significantly enhanced. This would not only mitigate potential harm but also foster a more balanced relationship between consumers and service providers.

Abstract

Desa Cibunar, Kecamatan Rancakalong, Kabupaten Sumedang memiliki potensi lokal yang besar berupa keanekaragaman budaya, usaha mikro, kecil, dan menengah (UMKM), serta hasil pangan lokal. Namun, potensi tersebut belum sepenuhnya dipahami dan dimanfaatkan secara optimal oleh masyarakat, terutama dalam aspek pengelolaan, promosi, dan keberlanjutan. Kegiatan pengabdian kepada masyarakat ini bertujuan untuk meningkatkan pengetahuan dan kesadaran masyarakat melalui kegiatan sosialisasi dan edukasi terkait potensi budaya, UMKM, dan pangan lokal Desa Cibunar. Metode pelaksanaan kegiatan dilakukan melalui pendekatan partisipatif berupa sosialisasi, edukasi, pendampingan, serta keterlibatan langsung dalam aktivitas masyarakat, termasuk kegiatan pendidikan, UMKM, kesehatan, dan pelestarian budaya. Sasaran kegiatan meliputi masyarakat desa, pelaku UMKM, anak-anak usia sekolah, serta kader masyarakat. Hasil kegiatan menunjukkan adanya peningkatan pemahaman masyarakat terhadap pentingnya pelestarian budaya lokal, pengembangan UMKM berbasis potensi desa, serta diversifikasi dan pemanfaatan hasil pangan lokal. Kegiatan sosialisasi juga mendorong partisipasi aktif masyarakat dalam kegiatan pendidikan, kesehatan, dan ekonomi kreatif, serta memperkuat sinergi antara mahasiswa dan masyarakat desa. Simpulan dari kegiatan ini adalah bahwa sosialisasi dan edukasi yang dilakukan secara partisipatif mampu menjadi strategi efektif dalam mendukung pemberdayaan masyarakat desa berbasis potensi lokal. Kegiatan ini diharapkan dapat menjadi model pengabdian masyarakat yang berkelanjutan dan direplikasi di desa lain dengan karakteristik serupa.

Abstract

Latar belakang penelitian ini didasarkan pada pesatnya perkembangan telemedicine di Indonesia pascapandemi COVID-19, yang belum diimbangi dengan regulasi hukum yang memadai. Pandemi mempercepat adopsi layanan kesehatan digital, namun perlindungan hukum bagi dokter dalam praktik telemedicine masih lemah dan bersifat sementara. Tujuan penelitian ini adalah untuk menganalisis kekosongan hukum terkait telemedicine dan mengidentifikasi risiko hukum yang dihadapi dokter dalam memberikan layanan kesehatan online. Metode penelitian menggunakan pendekatan yuridis normatif dengan analisis terhadap peraturan perundang-undangan, kebijakan pemerintah, dan literatur terkait. Hasil penelitian menunjukkan bahwa praktik telemedicine di Indonesia masih berada dalam "abu-abu hukum" karena ketiadaan regulasi permanen, ketidakjelasan hubungan hukum antara dokter dan pasien, serta ketidakseimbangan antara tanggung jawab dan perlindungan hukum bagi dokter. Implikasi penelitian ini menekankan pentingnya reformasi hukum yang komprehensif untuk memberikan kepastian dan perlindungan hukum bagi dokter, serta mengintegrasikan telemedicine ke dalam sistem kesehatan nasional secara sah dan terstruktur.

Abstract

The imbalance in bargaining position between business actors and consumers frequently places consumers in a vulnerable position to economic exploitation through the inclusion of standard clauses and unfair trade practices. This study aims to analyze the fulfillment of rights and obligations of the parties, identify the comprehensive boundaries of prohibited acts for business actors, and examine the legal binding force of standard clauses in commercial transactions under Law Number 8 of 1999 concerning Consumer Protection (UUPK). The method employed in this research is a normative juridical legal approach with statutory and conceptual analysis, utilizing qualitative analysis of secondary data obtained from library research combined with a deductive reasoning method. The findings underscore two pivotal aspects. First, the weak standing of consumers in the market is driven not only by economic imbalances but also by low legal awareness and minimal information transparency regarding quality standardization. Second, the inclusion of standard clauses that unilaterally transfer liability (exculpatory clauses) is strictly prohibited by Article 18 of UUPK and declared null and void, which aligns with the progressive judicial stance in the landmark Supreme Court Civil Judicial Review Decision Number 124/PK/PDT/2007. The theoretical implication of this study urges a reconstruction of the freedom of contract doctrine bounded by distributive justice, while its practical implication recommends the government, YLKI, and BPKN to tighten preventive oversight through auditing draft standard agreements in public spaces and formulating adaptive regulations toward digital contract disruptions.

Abstract

This research examines the effectiveness of law enforcement regarding child neglect crimes in Ciamis Regency, referring to Decision Number 238/Pid.Sus/2024/PN CMs. The analysis employs human rights theory, effectiveness theory, and law enforcement theory. Findings indicate that enforcement remains suboptimal due to structural, cultural, and substantive barriers, although the Ciamis District Prosecutor’s Office has made humanistic and child-centered efforts. The research highlights the necessity of harmonizing legal norms with human rights–based enforcement policies to ensure justice and protection for children.

Abstract

This study analyzes the effectiveness of implementing Restorative Justice (RJ), particularly through the Diversion mechanism, in addressing juvenile crimes in Indonesia, based on Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (UU SPPA). Restorative Justice demonstrates high effectiveness in achieving its main objectives, namely realizing justice oriented towards restoration and ensuring the best interests of the child, by reducing the risk of stigmatization and criminalization. This study aims to examine in depth the Effectiveness of Implementing Restorative Justice in the Resolution of Juvenile Crimes in Indonesia and the Implementation of Restorative Justice through Fulfilling Restitution for Victims of Juvenile Crimes. This research employs a normative juridical methodology, which involves the analysis and examination of secondary data. The research conducted by the author in relation to a normative juridical approach uses a literature review. Although the Child Protection and Juvenile Justice Law (UU SPPA) has provided a modern and humanistic legal framework, its implementation faces significant challenges. The success of restorative justice and the fulfillment of restitution heavily depends on the readiness of infrastructure (especially the Correctional Centers/Bapas), the improvement of facilitator quality, and a change in mindset of all stakeholders (officials and the community) to support solutions focused on recovery rather than retribution.

Abstract

The revision of national banking regulations through the issuance of the POJK Consumer Protection (2023) is an important milestone in efforts to restore contractual balance between banks and consumers. However, empirical practice shows that standard clauses still dominate the structure of credit agreements, resulting in a significant imbalance in bargaining power. This study examines the extent to which the dominance of standard clauses limits contractual fairness in banking credit relationships and formulates a model for reconstructing balance in line with the principles of civil law, prudence and consumer protection. The results of the discussion emphasize the need for reconstruction through transparency, risk proportionality and effective judicial oversight. It is concluded that the harmonization of civil law and prudential standards is absolutely necessary to achieve balance and consumer protection in national banking practices in a fair and sustainable manner in the future.

Abstract

The organization of Umrah pilgrimage travel constitutes a religious service that establishes a legal relationship between Umrah pilgrimage travel organizers (PPIUs) and pilgrims as consumers. However, cases of failure to depart, departure delays, and embezzlement of funds continue to cause material and immaterial losses to pilgrims and demonstrate that consumer rights have not been fully fulfilled. This study aimed to analyze the responsibility of business actors in fulfilling Umrah pilgrims’ right to compensation under Law Number 8 of 1999 concerning Consumer Protection through a case study of PT Khazanah Tamma Internasional. This study employed a normative legal method using statutory, conceptual, and case study approaches. Research materials were collected through a literature review of legislation, scientific journals, and news reports related to the PT Khazanah Tamma Internasional case and were then analyzed normatively. The findings showed that PT Khazanah Tamma Internasional, as a business actor, was legally responsible for providing compensation, damages, and/or replacement to pilgrims for losses arising from the failure to provide the services as agreed. This responsibility was based on Article 19 of Law Number 8 of 1999 concerning Consumer Protection. However, fulfilling the right to compensation faced obstacles in the form of the company’s limited assets, lengthy legal proceedings, and weak oversight of PPIUs. This study concludes that the regulation of business actors’ responsibility has provided a legal basis for protecting pilgrims, but the effectiveness of its implementation still needs to be strengthened. These findings imply the need to enhance government oversight and develop more effective legal protection mechanisms to ensure the fulfillment of pilgrims’ rights as consumers of religious services.

Abstract

Perkembangan marketplace telah mengubah pola konsumsi masyarakat Indonesia dalam memperoleh obat dan alat kesehatan, namun kemudahan tersebut turut membuka celah bagi peredaran obat palsu dan alat kesehatan ilegal yang berpotensi membahayakan keselamatan konsumen. Penelitian ini bertujuan mengkaji bentuk perlindungan hukum bagi konsumen di Indonesia terhadap peredaran produk kesehatan ilegal di marketplace, tanggung jawab pelaku usaha dan penyelenggara sistem elektronik, serta upaya penegakan hukum yang dapat dilakukan pemerintah bersama platform digital. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual, bersumber pada bahan hukum primer berupa peraturan perundang-undangan, bahan hukum sekunder berupa literatur dan jurnal hukum, serta bahan hukum tersier, yang dianalisis secara deskriptif-kualitatif. Hasil penelitian menunjukkan bahwa perlindungan hukum konsumen terhadap produk kesehatan ilegal di marketplace bersandar pada Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, dan Peraturan BPOM Nomor 14 Tahun 2024, namun pelaksanaannya masih terkendala lemahnya verifikasi penjual, tingginya volume transaksi, serta kaburnya batas tanggung jawab platform sebagai penyelenggara sistem elektronik. Pelaku usaha dan marketplace dituntut menerapkan prinsip kehati-hatian, verifikasi izin edar, dan tanggung jawab mutlak (strict liability), sementara pemerintah perlu memperkuat pengawasan berbasis teknologi dan sinergi kelembagaan. Penelitian ini merekomendasikan penguatan regulasi tanggung jawab platform (intermediary liability) serta peningkatan literasi digital konsumen sebagai langkah preventif jangka panjang.

Abstract

Law Number 1 of 2023 introduces a conditional death penalty system that allows the suspension of executions for a ten-year probationary period, with the possibility of conversion into life imprisonment based on rehabilitation. This research analyzes the ethical legitimacy and philosophical foundations of this “middle-way” approach, specifically evaluating its alignment with human rights principles and the ultimate objectives of punishment. Using a normative-juridical method with statutory and conceptual approaches, the study examined Law Number 1 of 2023 and relevant human rights instruments. The findings indicated that while the conditional death penalty is presented as a humanization of criminal law, it creates profound ethical tensions. The ten-year waiting period induces extreme psychological suffering, often termed the “death row phenomenon”, which may constitute inhuman treatment. Philosophically, Article 100 reveals a conflict between retributive justice and rehabilitative goals. Furthermore, the state’s role as an arbiter of life remains contested under international human rights standards. The study concludes that this provision serves as a pragmatic political compromise but requires rigorous safeguards to prevent administrative arbitrariness and ensure substantive justice.
