Abstract

The post-truth era creates uncertainty in the search for absolute truth, where objective facts are less influential in shaping public opinion than emotions and personal beliefs. This phenomenon has a negative impact on the democratic process, public perception of democratic institutions, and legal justice. The challenge of distinguishing facts from fabricated opinions affects law enforcement and the integrity of the democratic process. The research method used in this article is normative legal research that examines law as norms or rules that apply in society, focusing on document analysis and the use of legal sources. This research aims to find legal norms that are relevant in answering certain legal challenges or problems, as well as to produce arguments and theories as guidelines in resolving legal cases using secondary data (library research or document studies). In the post-truth era, law remains an important foundation in maintaining justice and order. Although challenges to political correctness can shake public confidence, the roots of law remain strong. The post-truth phenomenon is an irrational phenomenon, while legal truth (ontologically, epistemologically, and axiologically) is related to rational things, so it is quite difficult to debate and bring these two things together. Therefore, it is important to position the two different things in a position where we can find the most basic thing, both philosophically and legally.

Abstract

Midwives, as health workers, play a crucial role in the provision of maternal and child health services, particularly at Community Health Centers (Puskesmas) as primary healthcare facilities. In their practice, midwives often face potential legal risks, particularly when medical procedures are deemed to exceed their authority or cause harm to patients. This situation places legal protection as a crucial aspect in ensuring professional safety while maintaining the quality of healthcare services. This study aims to analyze the forms of legal protection for midwives in the implementation of medical procedures at the Tanjung Enim Community Health Center and to examine the legal responsibilities that may arise in the event of errors or negligence in the service. The research method used is a mixed approach: normative legal research by examining laws and regulations related to midwifery practice and healthcare services, and empirical research through in-depth interviews with two midwives and the Head of the Tanjung Enim Community Health Center. The data obtained were analyzed to assess the conformity between normative provisions and field practice. The results indicate that preventive legal protection is available through the implementation of Standard Operating Procedures (SOPs), competency improvement training, regulation of authority by the Indonesian Health Workforce Council, and the implementation of informed consent before medical procedures. In addition, repressive protection is also available in the form of administrative clarification mechanisms and assistance from Community Health Centers (Puskesmas) and the Health Office in the event of a complaint. However, midwives' understanding of the legal aspects remains limited, and medical documentation is suboptimal, creating a gap between regulation and implementation. Therefore, strengthening legal literacy, improving the quality of medical records, and developing more comprehensive legal assistance guidelines are needed to ensure legal certainty and the safety of the midwifery profession.

Abstract

This study analyzes the legal and ethical legitimacy of mandatory vaccination policies in schools from a public health law perspective. It focuses on the relationship between the state’s responsibility to protect public health, children’s right to health, and the boundaries of parental autonomy in making medical decisions for children. The study applies public health theory and legal certainty theory to examine the normative and ethical foundations underlying mandatory vaccination. A mixed-methods approach with a sequential explanatory design is employed, combining normative legal analysis with an empirical review of secondary data. The legal analysis examines national regulations concerning health, immunization, and child protection, while the empirical component reviews scholarly literature addressing public acceptance, implementation challenges, and ethical concerns surrounding school-based vaccination programs. The findings indicate that mandatory vaccination policies have strong legal justification as preventive measures aimed at controlling infectious diseases and protecting children’s health. From an ethical perspective, such policies may be justified when implemented proportionally, transparently, and on the basis of scientific evidence, while providing appropriate parental consent procedures and medically justified exemptions. The study further demonstrates that policy effectiveness depends not only on legal authority but also on regulatory clarity, effective risk communication, institutional accountability, and public trust. One important limitation is the restricted availability of primary empirical data concerning the experiences of parents, teachers, healthcare workers, and policymakers involved in school-level implementation. Therefore, future policy development should strengthen legal regulations, improve public health education, and establish transparent communication mechanisms. This study contributes to health law literature by integrating legal and ethical perspectives to develop a balanced framework for protecting collective health, children’s rights, parental autonomy, and legal certainty.

Abstract

ABSTRACT Digital transformation has increased children’s and adolescents’ access to various online services, but it has also increased the risk of exposure to sexual content, digital exploitation, and risky cyber behavior. In Sukasirna Village, Rancakalong District, Sumedang Regency, low levels of parental digital literacy and the dominance of repressive supervision practices have resulted in suboptimal protection of children as digital consumers. This condition has the potential to increase the risk of risky sexual behavior associated with child marriage and the threat of stunting. This Community Service Program aimed to improve the community’s legal capacity and practical skills in protecting children through the integration of consumer protection law education and parental control training based on two-way communication. The method used was Participatory Community Empowerment, involving parents and adolescents through legal education, technical workshops on digital supervision, and family communication simulations. The results showed an improvement in parents’ understanding of children’s rights as digital consumers based on Article 4 of the Consumer Protection Law, an improvement in their ability to operate parental control features, and a 76% level of readiness to implement two-way communication in digital supervision. This approach not only improved the community’s legal and digital literacy but also strengthened the family as a micro-level preventive legal instrument for preventing exposure to cybersexual content, risky sexual behavior, child marriage, and factors contributing to stunting. This community service model is suitable for replication as a community empowerment strategy to create a safe, healthy, and child-friendly digital ecosystem. ABSTRAK Transformasi digital telah meningkatkan akses anak dan remaja terhadap berbagai layanan daring, namun juga memperbesar risiko paparan konten seksual, eksploitasi digital, dan perilaku siber berisiko. Di Desa Sukasirna, Kecamatan Rancakalong, Kabupaten Sumedang, rendahnya literasi digital orang tua serta dominannya pola pengawasan yang bersifat represif menyebabkan perlindungan anak sebagai konsumen digital belum berjalan secara optimal. Kondisi tersebut berpotensi meningkatkan risiko perilaku seksual berisiko yang berkaitan dengan perkawinan usia anak dan ancaman stunting. Kegiatan Pengabdian kepada Masyarakat ini bertujuan meningkatkan kapasitas hukum dan keterampilan praktis masyarakat dalam melindungi anak melalui integrasi edukasi hukum perlindungan konsumen dengan pelatihan parental control berbasis komunikasi dua arah. Metode yang digunakan adalah Participatory Community Empowerment yang melibatkan orang tua dan remaja melalui sosialisasi hukum dan lokakarya teknis pengawasan digital serta simulasi komunikasi keluarga. Hasil kegiatan menunjukkan peningkatan pemahaman orang tua mengenai hak anak sebagai konsumen digital berdasarkan Pasal 4 Undang-Undang Perlindungan Konsumen, kemampuan mengoperasikan fitur parental control meningkat, serta kesiapan menerapkan komunikasi dua arah dalam pengawasan digital mencapai 76%. Pendekatan ini tidak hanya meningkatkan literasi hukum dan literasi digital masyarakat, tetapi juga memperkuat keluarga sebagai instrumen hukum preventif mikro dalam mencegah paparan siber seksual, perilaku seksual berisiko, perkawinan usia anak, dan faktor-faktor yang berkontribusi terhadap stunting. Model pengabdian ini layak direplikasi sebagai strategi pemberdayaan masyarakat dalam mewujudkan ekosistem digital yang aman, sehat, dan ramah anak.

Abstract

ABSTRACT Indonesia is entering a new era of decolonization of its criminal justice system, shifting toward a restorative and rehabilitative paradigm, with the enactment of Law No. 1 of 2023 (the New Criminal Code) and Law No. 20 of 2025 (the New Criminal Procedure Code) on January 2, 2026. However, the legislative process which has been criticized as rushed has created a gap between the ideal of the law (das Sollen) and on-the-ground reality (das Sein), particularly regarding the potential erosion of civil rights due to the expansion of law enforcement agencies’ authority to use coercive measures without strict judicial oversight. This gap is exacerbated by a lack of public understanding, which risks triggering premature criminalization. This community service program aims to enhance the public’s capacity for self-defense through legal education via a National Webinar-based Participatory Legal Education initiative. Using interactive and dialogic methods, this initiative involves legal practitioners, academics, and the general public to analyze the legal implications and mitigate the risks associated with the legal transition. Based on Soerjono Soekanto’s theoretical framework of legal awareness, evaluation results show a significant increase across all dimensions of participants’ legal awareness, with the highest surge occurring in the indicators of legal behavior and legal understanding. Comparative analysis indicates that participatory outreach methods are effective in transforming normative knowledge into tactical actions, such as readiness to utilize pretrial mechanisms and the right to legal representation. As reflected in the supporting documents, this initiative has proven to be crucial as a social and legal mitigation tool in addressing the structural challenges of the transition period. The program recommends continuing legal literacy efforts at the grassroots level and fostering cross-sectoral collaboration to ensure accountability in democratic law enforcement. ABSTRAK Indonesia tengah memasuki era baru dekolonisasi sistem hukum pidana Indonesia menuju paradigma restoratif dan rehabilitatif, dengan pemberlakuan UU No. 1 Tahun 2023 (KUHP Baru) dan UU No. 20 Tahun 2025 (KUHAP Baru) pada 2 Januari 2026. Namun, proses legislasi yang dinilai tergesa-gesa memicu kesenjangan antara cita hukum (das Sollen) dengan realitas lapangan (das Sein), khususnya terkait potensi pelemahan hak sipil akibat perluasan wewenang upaya paksa aparat tanpa pengawasan yudisial yang ketat. Kesenjangan ini diperparah oleh minimnya pemahaman masyarakat, yang berisiko memicu kriminalisasi prematur. Program pengabdian ini bertujuan meningkatkan kapasitas pertahanan hukum mandiri masyarakat melalui inovasi Penyuluhan Hukum Partisipatif berbasis Webinar Nasional. Menggunakan metode interaktif-dialogis, kegiatan ini melibatkan praktisi hukum, akademisi, dan masyarakat umum untuk membedah implikasi yuridis dan mitigasi risiko transisi hukum. Berdasarkan kerangka teori kesadaran hukum Soerjono Soekanto, hasil evaluasi menunjukkan peningkatan signifikan pada seluruh dimensi kesadaran hukum peserta, dengan lonjakan tertinggi terjadi pada indikator perilaku hukum dan pemahaman hukum. Analisis komparatif menunjukkan bahwa metode penyuluhan partisipatif efektif mentransformasi pengetahuan normatif menjadi tindakan taktis, seperti kesiapan menggunakan mekanisme praperadilan dan hak pendampingan hukum. Sebagaimana tercermin dalam dokumen pendukung, inisiatif ini terbukti krusial sebagai instrumen mitigasi sosial-yuridis dalam menghadapi tantangan struktural masa transisi. Program ini merekomendasikan keberlanjutan literasi hukum di tingkat akar rumput dan sinergi lintas sektor untuk mengawal akuntabilitas penegakan hukum yang demokratis.

Abstract

Medical disputes between dentists and patients present legal challenges, particularly in independent dental practices located in disadvantaged areas where access to professional legal and ethical institutions is limited. This study analyzes the effectiveness of resolving medical disputes between dentists and patients, with particular attention to legal effectiveness, legal certainty, and alternative dispute resolution. This study employs a normative juridical method with a qualitative approach and is classified as sociological legal research with a descriptive-analytical character. Data were obtained through interviews with two independent dentists, two patients, two community leaders, and one Indonesian dental association representative, supported by observations and document studies. The findings show that two identified disputes were resolved through informal verbal mediation facilitated by community figures, without written agreements or referral to professional disciplinary institutions. Mediation was relatively fast, inexpensive, and oriented toward mutually acceptable solutions. However, limited institutional access, community preferences for familial settlement, mediator neutrality, and weak legal enforceability of verbal agreements constrained its effectiveness. The study concludes that strengthening institutional support and written, enforceable mediation procedures is necessary to improve legal certainty and dispute-resolution effectiveness in independent dental practices.

Abstract

The fulfillment of prisoners’ health rights constitutes an integral part of human rights protection as guaranteed under Law Number 22 of 2022 on Corrections. Although these rights have been normatively regulated in a comprehensive manner, their implementation at the level of correctional institutions still faces various challenges. This study analyzes the implementation of prisoners’ health rights at Class IIB Raha Detention Center and identifies the factors influencing its effectiveness. This research employs an empirical juridical approach with a qualitative method, utilizing data collection techniques such as interviews, observations, and document analysis. The findings indicate that the fulfillment of health rights has been implemented. However, it has not yet reached an optimal level due to structural factors such as overcrowding, limited medical personnel, and inadequate healthcare facilities. These conditions result in healthcare services that tend to be reactive rather than preventive and fail to meet ideal service standards. This study concludes that the implementation of Law Number 22 of 2022 in fulfilling prisoners’ health rights remains largely formalistic and has not yet achieved substantive effectiveness. Therefore, structural reforms and strengthened institutional capacity are required to ensure the optimal fulfillment of prisoners’ health rights.

Abstract

Background: Indonesia's e-commerce transaction value reached Rp134.67 trillion in Q3 2025, reflecting rapid digital economic growth. This growth exposes a structural paradox: the principle of equality justifying state intervention against negotiating imbalances is undermined by three overlapping frameworks, the Consumer Protection Law (UUPK), the Electronic Information and Transactions Law (UU ITE), and the Personal Data Protection Law (UU PDP), which define protected legal subjects differently, enforce rights through separate institutions, and were never designed to interact. Because Indonesia's state legal order is itself religiously and normatively plural, this fragmentation is compounded, for the country's Muslim-majority consumer base, by a further, largely uncoordinated layer of halal-assurance and shariah-compliance regulation that intersects with, but is not integrated into, the UUPK–ITE–PDP triad.   Purpose:  This study addresses three questions: how fragmentation among the UUPK, UU ITE, and UU PDP, read together with Indonesia's pluralistic legal architecture, including the halal product assurance regime, produces overlapping protections while leaving gaps in composite digital harm combining economic loss, data breach, and reputational damage; how enforcement institutions under these regimes interact, or fail to interact, in practice; and how substantive equality can be reconstructed, as fragmented equality, to restore institutional coherence for all Indonesian digital consumers, including the specific religious-identity interests of Muslim consumers. In answering these, the study formulates a conceptual and institutional model for integrated consumer protection enforcement.   Methods: This study adopts a socio-legal approach, combining normative-doctrinal analysis of the UUPK, UU ITE, and UU PDP with documentary analysis of institutional practice, including live-commerce disputes, the Constitutional Court's review of UUPK and UU PDP (2025–2026), and secondary evidence of enforcement gaps including BPKN's jurisdictional limits and the absence of an independent data protection authority.   Results:  The three laws define disparate legal subjects, "consumers," "users," and "data subjects," creating enforcement gaps in composite digital harm, illustrated by live-commerce transactions. Applying Fredman's substantive equality framework, Fineman's vulnerability theory, and a legal-pluralism lens attentive to the coexistence of state law with religiously grounded shariah-compliance norms, the study finds this dysfunction stems not from an absence of norms but from fragmented institutional design and uneven enforcement authority, particularly BPKN's limited cross-border jurisdiction, the absence of an independent data protection authority, and the unintegrated position of the halal-assurance regime administered by BPJPH.   Implication: Drawing on the European Union's model of horizontal regulatory integration (GDPR, DSA, CRD), the study proposes a "Coherent Digital Consumer Gateway" as an integrated enforcement mechanism, alongside an independent data protection authority, substantive modernization of the Electronic Commerce Law, and formal inclusion of the halal-assurance and shariah-compliance regime within the Gateway's coordination mandate. Originality: Unlike prior studies examining the UUPK, UU ITE, and UU PDP separately, this study centers on their interaction and dysfunction as its primary object, introduces "fragmented equality" as a framework linking institutional fragmentation to the doctrine of substantive equality, and is among the first to read that fragmentation through Indonesia's legal pluralism, extending the analysis to the position of Muslim consumers whose protection needs combine economic, informational, and religious-identity dimensions

Therefore, future policy development should strengthen legal regulations, improve public health education, and establish transparent communication mechanisms. This study contributes to health law literature by integrating legal and ethical perspectives to develop a balanced framework for protecting collective health, children’s rights, parental autonomy, and legal certainty.

Abstract

This study aims to analyze the implementation of Law Number 40 of 2004 concerning the National Social Security System in the context of the Indonesia Case Base Groups (INA-CBGs)-based healthcare financing scheme managed by BPJS Kesehatan. The main focus of the study is directed at identifying legal and technical issues arising from the implementation of the package tariff system, as well as the urgency of strengthening legal certainty in the implementation of national healthcare insurance. This study uses a normative juridical method with a descriptive-analytical approach, where data is collected through a literature review covering legislation, legal doctrine, academic literature, and theories of legal implementation and dispute resolution. The analysis is conducted qualitatively to assess the conformity between legal norms and the implementation practices of INA-CBGs. The research findings indicate that the implementation of the INA-CBGs system has the potential to cause various problems, such as the risk of medical errors, alleged malpractice, claim fraud, and unfair financing for patients with high levels of disease complexity. In addition, the dispute resolution mechanisms through both non-litigation and litigation channels are considered to be less than optimal. The implications of this research emphasize the need for strengthened regulations, improved competency of healthcare workers and claims administrators, and transparency of the financing system to prevent recurrent disputes. The research's uniqueness lies in its integrative approach, which comprehensively links legal aspects, healthcare financing practices, and dispute resolution mechanisms within the INA-CBGs scheme, an area not widely explored in previous research.   Penelitian ini bertujuan untuk menganalisis penerapan Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional dalam konteks skema pembiayaan layanan kesehatan berbasis Indonesia Case Base Groups (INA-CBGs) yang dikelola oleh BPJS Kesehatan. Fokus utama penelitian diarahkan pada identifikasi persoalan hukum dan teknis yang muncul akibat penerapan sistem tarif paket, serta urgensi penguatan kepastian hukum dalam penyelenggaraan jaminan kesehatan nasional. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan deskriptif-analitik, di mana data dikumpulkan melalui studi kepustakaan yang mencakup peraturan perundang-undangan, doktrin hukum, literatur akademik, dan teori implementasi hukum serta penyelesaian sengketa. Analisis dilakukan secara kualitatif untuk menilai kesesuaian antara norma hukum dan praktik pelaksanaan INA-CBGs. Temuan penelitian menunjukkan bahwa penerapan sistem INA-CBGs berpotensi menimbulkan berbagai permasalahan, seperti risiko kesalahan medis, dugaan malpraktik, penyimpangan klaim (fraud), serta ketidakadilan pembiayaan bagi pasien dengan tingkat kompleksitas penyakit yang tinggi. Selain itu, mekanisme penyelesaian sengketa baik melalui jalur nonlitigasi maupun litigasi dinilai belum berjalan optimal. Implikasi penelitian ini menegaskan perlunya penguatan regulasi, peningkatan kompetensi tenaga kesehatan dan administrator klaim, serta transparansi sistem pembiayaan guna mencegah sengketa berulang. Keaslian penelitian terletak pada pendekatan integratif yang mengaitkan aspek hukum, praktik pembiayaan kesehatan, dan mekanisme penyelesaian sengketa dalam skema INA-CBGs secara komprehensif, yang belum banyak dikaji dalam penelitian sebelumnya.
