Abstract

Islamic education, particularly in Islamic boarding schools, faces serious challenges amid globalization, digitalization, and the development of artificial intelligence (AI), which require a reorientation of the educational paradigm in order to remain relevant, adaptive, and equitable. This article analyzes the application of the principles of Maqāṣid al-Sharī‘ah in the Islamic education system and examines the potential and challenges of integrating AI into Islamic boarding school education from a maqāṣidī perspective. This study uses a qualitative method with a socio-legal approach through literature review and documentation of Islamic legal sources, academic literature, education policies, and empirical studies in Indonesia and Malaysia. The results show that Islamic boarding schools have basically implemented maqāṣid, especially in the aspects of ḥifẓ al-dīn and character building, but it is still symbolic and traditional, not yet touching on substantive dimensions such as the development of critical thinking (ḥifẓ al-‘aql), mental health (ḥifẓ al-nafs), economic empowerment (ḥifẓ al-māl), professional readiness, and gender equality (ḥifẓ al-nasl). The integration of AI has the potential to strengthen santri learning, governance, and digital literacy, but it also risks weakening critical thinking, reducing scientific authority, widening social gaps, and creating value bias if not guided ethically. Comparatively, Indonesia and Malaysia have not yet implemented AI and maqāṣid systematically. Therefore, an integrative and ethical Maqāṣid al-Sharī‘ah-based Islamic education model is needed so that AI functions as a means of benefit, not a source of new harm.

Abstract

This study aims to determine the effectiveness of using snakes and ladders media in algebraic mathematics learning to improve motivation and learning outcomes of class VII students at SMP Negeri 6 Sorong City. The problem raised in this study is the low learning motivation and learning outcomes of students in algebra material due to less interactive learning methods. This study uses a mix method approach with a one group pre-test and post-test design. The research subjects were 29 class VII students. The instruments used included observation of learning implementation, student activity observation sheets, tests (pre-test and post-test), and motivation questionnaires. The results of the study showed that learning with snakes and ladders media with a research instrument percentage of 91% was in the "Very low" category with the results of the N-Gain test showing an increase of 0.4086 in the "Medium" category. Based on these data, snakes and ladders media has proven to be potentially effective in increasing motivation and providing a positive impact on student learning outcomes in algebra material. Thus, snakes and ladders media can be used as an innovative alternative in mathematics learning.

Abstract

The development of the legal paradigm from a formalistic approach toward substantive justice requires the integration of maqāṣid al-syarī‘ah into the practice of religious courts. However, the application of maqāṣid al-syarī‘ah in judicial decisions still tends to be limited and unsystematic, creating a gap between legal rulings and the community’s sense of justice. This study aimed to analyze the application of maqāṣid al-syarī‘ah in judicial decisions in religious courts and its contribution to the realization of substantive justice. This study used a qualitative approach with a literature study design focusing on document analysis of religious court decisions and scholarly journal articles. Data were collected through documentation and systematic searches of credible sources selected through purposive and snowball sampling, and were then analyzed using an interactive model with a thematic approach to identify major patterns and categories. The results showed that the application of maqāṣid al-syarī‘ah in judicial decisions was not yet uniform and was divided into three main patterns, namely implicit, partial, and explicit but not yet systematic. These variations were influenced by judges’ internal factors, limitations of the legal system, and social dynamics. The research findings also showed that the integration of maqāṣid al-syarī‘ah contributed significantly to strengthening substantive justice, particularly in increasing the sensitivity of decisions to public benefit and the protection of vulnerable groups. The conclusion of this study emphasizes the importance of strengthening methodological frameworks and operational guidelines for systematically integrating maqāṣid al-syarī‘ah into legal discovery. The implications of this study include the development of a more substantive theory of Islamic law, the enhancement of judges’ capacity, and the reform of religious court policies oriented toward public benefit.

Abstract

The development of the Sharia digital economy in Indonesia provides ease of transactions, but it also gives rise to new risks, such as ambiguity in electronic contracts, exploitation of personal data, digital consumptive behavior, and weak consumer protection. Although previous studies have focused more on the formal legality of Sharia transactions, studies on the implementation of the principle of al-ḍarar yuzāl in preventing social and economic harm in the digital space remain limited. This study aims to analyze the relevance and implementation of the principle of al-ḍarar yuzāl in the Sharia digital economy from the perspective of maqāṣid al-syarī‘ah. This study used a qualitative approach with a literature study design through the analysis of scientific literature, regulations, fatwas, and documents related to Sharia fintech practices and the digital economy in Indonesia. Data were collected through documentation and searches of relevant academic sources and were then analyzed descriptively and interpretively. The results show that the implementation of the principle of al-ḍarar yuzāl in the Sharia digital economy has not been optimal because elements of gharar, weak contract transparency, digital algorithm manipulation, and low public digital literacy are still found. The findings also show a transformation in the meaning of harm in the digital space, which is not only manifested in financial losses but also includes the exploitation of personal data, psychological pressure, and technological dependence. From the perspective of maqāṣid al-syarī‘ah, the protection of wealth (ḥifẓ al-māl), intellect (ḥifẓ al-‘aql), and life (ḥifẓ al-nafs) serves as an important foundation for the development of the Sharia digital economy. The conclusion of this study emphasizes that the principle of al-ḍarar yuzāl is relevant as a normative basis for preventing harm in the Sharia digital economy. The implications of this study include the need to strengthen regulation, technological ethics, and Sharia digital literacy in order to realize a digital economic ecosystem that is fair, secure, and oriented toward public welfare.

Abstract

Mafhūm al-mukhālafah is one of the methods of legal derivation in uṣūl al-fiqh used to understand the implicit meaning of a scriptural text through an opposite interpretation of the wording stated. Although it has long been part of classical uṣūl al-fiqh studies, debates regarding its probative authority and relevance in addressing contemporary Islamic legal issues continue to persist. This study aims to analyze the concept, probative authority, and relevance of mafhūm al-mukhālafah in the process of contemporary Islamic legal derivation. This study used a qualitative approach with a library research design. Data were obtained through documentation studies of classical uṣūl al-fiqh texts, scientific articles, books, and contemporary literature discussing mafhūm al-mukhālafah and its application in modern Islamic law. The data were analyzed descriptively and analytically by examining the concept, scholarly arguments, and developments in its use across various contemporary issues. The results show that mafhūm al-mukhālafah has strong methodological legitimacy, particularly within the Shafi‘i school tradition, as an instrument for understanding the implicit meaning of scriptural texts. Its use in contemporary contexts has developed through integration with the maqāṣid al-syarī‘ah approach, making it relevant in responding to legal issues related to the digital economy, electronic transactions, and modern technological developments. This study also found differences in scholarly views regarding the probative authority of mafhūm al-mukhālafah, which are influenced by differing textual and contextual paradigms in legal derivation. The conclusion of this study affirms that mafhūm al-mukhālafah remains relevant as a methodological instrument in the development of contemporary Islamic law when used proportionally and integrated with the principles of maqāṣid al-syarī‘ah. The contribution of this study lies in strengthening an uṣūl al-fiqh methodology that is adaptive to social change without disregarding the normative foundations of sharia.

Abstract

The formation of laws and regulations in Indonesia is still dominated by a legal-positivist approach oriented toward procedure and formal validity, so it has not fully addressed the demands of substantive justice and public welfare. This condition is reflected in the continued existence of regulatory disharmony, overlapping norms, and the low effectiveness of legal implementation. This study aims to analyze the relevance of Maqasid Shariah as a substantive paradigm in the formation of laws and regulations and to formulate a maqasid-based legislative reconstruction model within the national legal system. This study uses a normative legal method with conceptual and statutory approaches. Data were obtained through library research covering laws and regulations, legal literature, scholarly articles, and relevant policy documents, then analyzed qualitatively using descriptive-analytical techniques. The results of the study show that the dominance of the legal-positivist approach in national legislation tends to place formal legality as the primary measure of legal success. In contrast, Maqasid Shariah as developed by Jasser Auda offers a legislative paradigm oriented toward public welfare, justice, protection of fundamental rights, and societal well-being. This study formulates a maqasid-based legislative model through three main stages, namely legislative planning, norm formulation, and regulatory evaluation, with four basic principles: orientation toward public welfare, protection of fundamental rights, inclusive public participation, and policy sustainability. The conclusion of the study affirms that the integration of Maqasid Shariah into the legislative process can strengthen the coherence between formal legality and substantive justice. The implications of this study contribute to the development of legislative theory and provide practical direction for lawmakers in improving regulatory quality and legal effectiveness in Indonesia.

Abstract

Productive waqf has great potential as an instrument for the economic empowerment and social development of the Muslim community, but the optimization of its management still faces challenges related to transparency, accountability, nazhir professionalism, and the use of digital technology. Although studies on waqf governance and digitalization have developed, research that integrates these two aspects into a sustainable productive waqf management model remains limited. This study aims to analyze the role of integrating good governance and digitalization in improving the effectiveness of productive waqf management and to formulate a sustainable waqf management model in the digital era. This study used a qualitative approach with a library research design. Data were obtained through a review of scholarly articles, books, institutional reports, and relevant documents discussing waqf governance, digital transformation, and productive waqf, then analyzed descriptively and interpretatively through reduction, categorization, and synthesis of findings. The results of the study show that transparency, accountability, participation, and professionalism are the main elements of good governance that can be strengthened through digitalization. The use of digital platforms, technology-based reporting systems, and digital waqf services can increase public trust, expand waqif participation, and support the effectiveness of waqf asset management. The success of waqf digitalization is also influenced by institutional capacity and nazhir competence. The conclusion of the study affirms that the integration of good governance and digitalization can form a more transparent, adaptive, accountable, and sustainable productive waqf management model. The implications of this study provide theoretical contributions to the development of modern waqf literature as well as practical recommendations for waqf institutions and policymakers in strengthening waqf governance in the digital era.

Abstract

The Direct Cash Assistance (BLT) to Poor Households aims to assist the economy of impoverished communities due to the increase in fuel prices in October 2005. For the village of Sonok, the Direct Cash Assistance Program is provided to categorized poor communities, who are registered through the data collection by the Central Statistics Agency (BPS) in collaboration with the local government. Based on the above, the core issue is the Islamic Legal Perspective on the Mechanism of Distributing Direct Cash Assistance (BLT) Funds in the Village of Sonok. The research method used in this thesis is a qualitative method with a case study approach. To investigate the research problem, the researcher also employs a descriptive method towards primary and secondary data. The primary data for this thesis is obtained through interviews and documentation. Secondary data consists of information from other sources such as scholarly works, literature, encyclopedias, dictionaries, archives, and research findings related to the problem to be discussed or studied. From the research conducted, it was found that the BLT assistance has been distributed to both registered and unregistered individuals. As a result, those who receive the BLT assistance do not receive the full amount of 300,000 because of the addition of impoverished residents as per the policy of the local village government. The Islamic legal perspective on the distribution of the BLT funds prohibits this practice, as the existing assistance is intended only for those who are registered. Therefore, the assistance should only be given to them, as it is their rightful entitlement as registered recipients. Anything that is rightfully theirs should be conveyed to them, as it is a trust.

Abstract

Multi Level Marketing (MLM) is a marketing innovation that often generates controversy. Some scholars declare that this system is permissible according to Sharia, while others highlight financial risks and ethical concerns in transactions, such as honesty, justice, and prudence. This study aims to analyze MLM practices in the context of Islamic economic law and transaction ethics, intending to provide a balanced perspective on the permissibility and ethical implications of MLM in Islam. The research employs a descriptive qualitative approach with a literature study. Data are collected from scholarly literature such as books, journals, articles, and fatwas from Islamic scholars related to MLM. Data analysis is conducted using content analysis methods, examining relevant texts about MLM. Source triangulation is used to ensure consistency and validity of the findings. MLM involves selling products through a network of distributors who earn commissions from direct sales and sales made by recruited members. Fatwa DSN MUI No. 75/DSN-MUI/VII/2009 states that MLM is permissible if the products sold are beneficial, transactions are conducted transparently without deception, commissions are based on product sales, and the recruitment system does not harm new members

Abstract

Arabic language learning is influenced not only by cognitive aspects but also by affective factors, particularly teachers’ emotional intelligence. This study aims to synthesize previous research on the role of teachers’ emotional intelligence in Arabic language learning and its impact on learning processes and outcomes. A literature review method was employed by analyzing scholarly articles published between 2022 and 2026 from databases including Google Scholar, Scopus, Dimensions, Garuda, DOAJ, and Crossref. Data were analyzed using thematic analysis to identify major themes across the selected studies. The findings indicate that teachers’ emotional intelligence consists of four key dimensions: self-awareness, self-regulation, self-motivation, and empathy. Its implementation is reflected in positive communication, the creation of a supportive classroom climate, effective classroom management, and the provision of reinforcement and motivation. Furthermore, teachers’ emotional intelligence contributes positively to students’ learning motivation, self-confidence in speaking Arabic, reduced language anxiety, and improved learning achievement. The study concludes that emotional intelligence is an essential component of Arabic language teachers’ professional competence and plays a significant role in enhancing the effectiveness of Arabic language learning and students’ overall language development.
