Abstract

Islamic inheritance law is a provision for the transfer of property from a deceased person to the person left behind. Islamic inheritance law in Indonesia has been regulated in KHI in accordance with Presidential Instruction Number 1 of 1991. The purpose of this study aims to determine the position and fair rights attached to both male and female heirs in receiving inheritance, especially in cases of kalalah and radd. The method used in this research is normative juridical, namely by conducting searches of library materials, laws and other literature. Kalalah is a person who dies without leaving a father and children. Debate arises regarding the determination of the meaning of walad which is a requirement for siblings to obtain inheritance. KHI in article 182 seems to globalize the word walad. KHI takes the opinion of Ibn Abbas ra. that the word walad includes boys and girls in order to create gender justice. The radd is the excess of inheritance after being distributed to the heirs and there are no 'asabah heirs. In this radd issue, KHI follows the opinion of Uthman bin Affan that the excess is returned to all heirs as stated in article 193.

Abstract

Artikel ini membahas mengenai pandangan serta pemikiran ulama klasik dan kontemporer terkait aturan, riba, bunga bank, serta mengenai bagi hasil. Perdebatan mengenai apakah bunga yang dikenakan oleh bank termasuk riba yang diharamkan dalam Islam telah menjadi isu penting dalam perkembangan ekonomi modern, terutama dalam konteks perbankan syariah. Adapun penelitian ini merupakan penelitian normatif yang datanya diambil dari studi kepustakaan (library research) serta menggunakan pendekatan kajian literatur, dimana data dikumpulkan dari sumber-sumber literatur utama dan sekunder, baik dari pemikiran ulama klasik maupun kontemporer, dan dianalisasis untuk mengambarkan perkembangan pemikiran mereka terkaiat norma riba, bunga bank, bagi hasil. Hasil penelitian menunjukkan bahwa ulama klasik umumnya menyamakan riba dengan segala bentuk tambahan dalam utang piutang, sementara beberapa ulama kontemporer memberikan perspektif yang lebih fleksibel terkait bunga bank, tergantung pada konteks dan dampaknya terhadap keadilan ekonomi. Kajian ini memberikan kontribusi bagi pemahaman lebih mendalam terkait praktik perbankan syariah dan pengembangan sistem ekonomi yang lebih adil.

Abstract

The establishment of sharia financial institutions is a response to the need for Muslims to carry out aspects of their economic life in accordance with the principles of the Qur'an and Hadith, as well as to meet the need for interest-free banking. However, the main challenge for Islamic banks is to develop amidst the dominance of established conventional banking. The success of Islamic banks not only depends on the formal adoption of Islamic rules in muamalat, but also on the consistency and trust of society in their compliance with sharia principles. This research aims to analyze the implementation of sharia compliance in the development of innovative products in sharia banks. This research uses a normative legal approach. by collecting data from legal literature and related documents, as well as analyzing sharia bank policies and practices in developing innovative products. The research results show that Islamic banks that are successful in developing innovative products are those that are able to maintain consistency with sharia principles in every stage of the product, from planning to implementation. The main obstacles include challenges in implementing a fair and transparent profit sharing system, as well as the need for skilled human resources in sharia bank operations. Nevertheless, there is significant potential for Islamic banks to expand financial access for low-income communities through products that comply with sharia principles.

Abstract

This paper discusses Muhammad Shahrur’s proposal for a “new way” to practice the concept of milk al-yamin in Islam. He believes that the Qur’anic verses pertaining to milk al-yamin can no longer be applied today because of their close connection to slavery. Shahrur argues that the practice of milk al-yamin—particularly in the context of the permissibility of engaging in sexual relations without a marriage contract—can be carried out through mutual consent. This consent is formed through an agreement between a man and a woman, solely for the purpose of engaging in sexual relations. The aim of this paper is to analyze Shahrur’s arguments within the framework of his milk al-yamin theory. The method used in this paper is a normative literature study, employing a juridical-normative approach. The findings of this paper indicate that Shahrur’s theory of milk al-yamin tends to align more closely with Western values of sexual consent than with Islamic values. Moreover, Shahrur’s proposal for milk al-yamin could have significant implications for the development of family law, particularly in Indonesia.

Abstract

This research aims to examine the legal process carried out by the Bengkulu Religious High Court in ensuring the living expenses of children after their parents' divorce. This study is qualitative research with a normative legal approach. Primary data comes from laws, court decisions related to children's rights post-divorce, and children's civil rights, while secondary data is obtained from books, online media, and journals with the same relevance. In exercising its authority, the Bengkulu Religious High Court prioritizes the principle of justice by maintaining the interests of the child, as well as the principles of balance and proportionality. However, there are several challenges such as the lack of public understanding of children's rights and obstacles in the implementation of Religious High Court decisions regarding the enforcement of children's civil rights. More intensive efforts are needed to provide the public with an understanding of children's rights and to improve the quality of enforcement of Religious High Court decisions to ensure optimal protection of the child's interests following their parents' divorce.

Abstract

This qualitative study aims to identify the sociological construction of the implementation of legal principles in the inheritance system in Indonesia and its relevance to the Islamic inheritance system. The theory of receptio a contrario and the theory of structural functionalism as a legal sociology perspective are used to see how social construction is related to the implementation of the principle of justice, the principle of freedom of will, and the individual principle in the implementation of the inheritance system in a plural Indonesian society. This study finds the construction of social relations related to legal principles in the implementation of the national inheritance system with Islamic inheritance in Indonesia. The relational construction of these principles leads to the implementation of harmony between the implementation of the national inheritance legal system and the Islamic inheritance system so that both can run in an orderly and well-integrated manner. This study confirms that in sociological construction, the relationship between the principle of law enforcement and the social and cultural values of society cannot be dichotomized.

Abstract

This article critically examines the issue of premature ownership transfer (early name change) in Ijarah Muntahiya Bittamlik (IMBT) contracts within Indonesian Islamic banking, focusing on both sharia and national legal perspectives. Premature transfer is understood as the transfer of ownership before the lease period ends, which raises concerns of legal certainty, potential tadlīs (disguised contract), and elements of gharar (uncertainty). Using a qualitative juridical-empirical approach, this study analyzes DSN-MUI fatwas, national legal regulations, and operational practices of Islamic banks. The findings reveal that premature ownership transfer contradicts both sharia principles and positive law, as it undermines fiduciary guarantees and weakens consumer protection. The main challenge identified is the persistence of such practices in the field due to administrative efficiency, often at the expense of normative compliance. As an alternative, the study recommends the implementation of the wakalah scheme, whereby dealers authorize banks to process ownership transfer only after all lessee obligations have been fulfilled, thus ensuring both compliance and efficiency. Contribution: This study contributes to the development of Islamic economic law by integrating classical fiqh, national regulations, and contemporary practices, while also offering practical recommendations for the Islamic banking industry to strengthen legal certainty, consumer protection, and global competitiveness.

Abstract

This study aims to analyze the legal system adopted in Indonesia. Mix Law System is one of the applicable legal systems, in addition to the enactment of the national legal system applies also Islamic law. The existence of Islamic Law is manifested in the constitution of the State of Indonesia which is commonly known as the 1945 Constitution of the Republic of Indonesia. Where the 1945 Constitution is a basic law that regulates the life of the nation and state in order to realize a just government and a prosperous people. This research uses an empirical sociological approach method that is descriptive analysis with the use of qualitative data as the type of research and library research as one of the data collection techniques. This research concludes that, first: The principles of Islamic Law that are used as the ideal foundation of fiqh are the principle of tauhidullah, the principle of insaniyah, the principle of tasamuh, the principle of ta'awun, the principle of silaturahim bain annas, the principle of justice, and the principle of benefit. As for knowing the theories of Islamic law enforcement in the apostolic period of Muhammad SAW are the theory of confession, the theory of accession, the theory of proof, the theory of verdicts, the theory of oaths, the theory of forgiveness. Second: Dispute resolution based on classical Islamic law namely, Al Sulh (Peace), Tahkim (Arbitration), Wilayat al Qadha (Judicial power). Third: The principles of judicial administration according to fiqh qadha and Indonesian law there is a strong correlation between the state and Islam, including Islamic law which has become a living law in the life of the nation and state. Fourth: The principles in the constitution also have relevance to the principles in Islamic Law which are regulated in the Quran and the Al-Hadith including the principles of justice, equality, and welfare. Based on this, Indonesia, which is based on Pancasila and the 1945 Constitution, can be reviewed from the perspective of Islamic law as an effort to realize the laws regulated in the Quran and Al-Hadith.

Abstract

Penelitian ini bertujuan untuk mengkaji sejarah perkembangan golongan yang ingkar sunnah sampai dengan ajaran-ajaran yang dikembangkan dan didakwahkan kepada masyarakat serta konsikuensi penganut paham ingkar sunnah terkhususnya bagi muslim itu sendiri. Penelitian ini menggunakan pendekatan kualitatif deskriptif, dengan penelaahan dokumen. Penelitian ini menyimpulkan, bahwa ingkar sunnah merupakan bentuk kegagalan dalam memahami sunnah dan pemahaman ini juga sudah ada pada masa kenabian. Sehingga beberapa ulama menerangkan bahwa konsikuensi terhadap penganut paham ini dikategorikan kafir.

Abstract

The resolution of Sharia economic disputes requires compliance, stability, public trust, and protection of rights and business relationships. This qualitative research uses a normative juridical approach with library research to analyze the Sharia economic dispute resolution system in Indonesia. The study covers Sharia economic disputes, Sharia principles, the authority of Religious Courts, dispute resolution methods, and challenges in implementing Sharia principles. The findings show that Sharia economic disputes arise from transactions or activities based on Islamic principles. Key principles in dispute resolution include justice, Sharia compliance, consultation, agreement, confidentiality, consensus, and non-discrimination. Religious Courts have exclusive authority over Sharia economic cases based on Law No. 3/2006, the Constitutional Court Decision No. 93/PUU-X/2012, and Supreme Court Regulation No. 14/2016. Disputes can be resolved through litigation or non-litigation methods such as mediation or arbitration. Challenges include limited legal awareness, legal complexity, infrastructure issues, legal harmonization, and differing interpretations.
