Abstract

During the current pandemic, the importance of a Covid-19 vaccination certificate encourages people to carry out vaccination activities. However, it becomes a problem when a few people who are afraid of vaccination make an illegal agreement with the health services to fake or get a vaccine certificate without having to vaccinate in exchange for money. This refers to Law.Number.198of 2016 Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions, which are said to.be criminal acts with a threat of 12 years in. prison and.a fine of 12.billion. The approach.method.used.in this.research.is.normative juridical, namely by combining.secondary.and doctrinal legal regulations that are applied to the issues discussed. The existence of the Ministry of Communication and Information is.regulated in Presidential Regulation-of9the.Republic of Indonesia. Number 54 of 2015 which.essentially assists the president in administering the state government which regulates everything related to documentation or electronic mail. also has the authority to oversee criminal acts of falsification of certificates or documents assisted by the police against irresponsible persons

Abstract

The practice of cooking oil price cartel activities based on Pasal 11 UU No. 5 1999, based on this pasal business actors are explicitly prohibited from entering into agreements with competing business actors for the purpose of regulating the production, marketing of goods and / or services. However, in their activities, cooking oil business actors have been suspected of carrying out activities on the practice of cooking oil price cartels in Indonesia. So the purpose of this study is to find out and understand what factors are the alleged practices of price cartels in cooking oil in Indonesia. The method used in this study, using the normative juridical method, based on this method the researcher conducted research by examining library materials in the form of secondary data or legal research with literature studies related to the alleged practice of cartels of cooking oil prices in Indonesia. The proof of alleged cartel practices with the principles of rule of reason and indirect evidence is still not regulated in the laws and regulations, it should be that the existence of the principle of rule of reason and indirect evidence needs to be considered more deeply in solving alleged cartel practices in Indonesia.

Abstract

As regulated by the 1945 Constitution, the fulfillment of protection, guarantee, and legal certainty by individuals and groups in self-development, namely the discovery of an intellectual property, guaranteed continuity and originality by the State. Under Indonesian law, it is still often found that some irresponsible individuals and groups / individuals, abuse of Intellectual Property Rights, one of which is the use of the Logo without rights, permits, and illegally from the Internet for commercial purposes. The urgency of protection is carried out on the basis that in a work, creation, or innovation found by individuals or groups it has an economic right and moral right, more than that, the benefits of Intellectual Property can be used by the community and also to support the ideals of the nation and the Republic of Indonesia. Indonesia will be a progress and prosperity of a nation. As mentioned above, the state, in this case, is obliged to take all legal aspects to protect the personal reputation of individuals and groups.

Abstract

The purpose of this research is to protect copyright and the government's role in the cultural heritage of the Indonesian nation in terms of Copyright Law no. 28 of 2014. With a normative juridical legal research method, it is concluded: 1. Copyright protection of the cultural heritage of the Indonesian nation in terms of Copyright Law no. 28 of 2014 is stipulated in CHAPTER V Article 38, Article 39 and Article 60- The protection of the copyright law on the cultural heritage of the Indonesian nation covers two main areas, the first is the protection of the cultural heritage of the Indonesian nation where the identity of the creator is unknown. The second area is the protection of the cultural heritage of the Indonesian nation where the creator is known. 2. The role of the Indonesian government in protecting the copyrights of Indonesian cultural heritage by taking actions to take inventory, safeguard and maintain by creating a data base of the nation's cultural heritage, where as a protective measure, the government currently has a National Data Center for Communal Intellectual Property managed by the Directorate General Intellectual Property (DJKI) of the Ministry of Law and Human Rights to make an inventory of data on Communal Intellectual Property owned by the Indonesian nation.

Abstract

Trademarks are part of Intellectual Property Rights which are protected in Law Number 20 of 2016 concerning Marks and Geographical Indications. Legal protection of a brand is very necessary because it is closely related to the economic value attached to a brand. The economic value and reputation of a brand, especially a well-known brand, are often used by business actors with bad intentions to gain instant profits by committing brand violations in the form of passing off. To be able to provide maximum legal protection to brand owners, it is necessary to know in advance what factors caused the violation of trademark rights. Therefore, the author intends to conduct this study with the aim of knowing the factors causing the violation of brand rights related to passing off of well-known brands. The research method used in this thesis is normative juridical, using an approach through legislation as a basis for solving problems related to brand violations in the form of passing off reputations against well-known brands. From the results of this study, it can be concluded that the factors that cause brand violations related to passing off famous brands are economic factors, community cultural factors, regulatory factors, and supervisory factors.

Abstract

Koperasi dipertimbangkan sebagai unsur yang paling fundamental untuk ekonomi Indonesia. Sebagaimana termaktub pada Pasal 33 UUD 1945 disebutkan bahwasannya “Perekonomian Indonesia disusun sebagai usaha. bersama berdasarkan asas kekeluargaan”. Berdasarkan pada uraian penjelasan UUD 1945 ini dijelaskan bahwa badan usaha yang sejalan dengan pasar ini disebut dengan istilah Koperasi, dengan demikian koperasi ini dianggap sebagai bagian yang paling fundamental untuk perekonomian Negara dan sebagai unsur terpenting di dalam keberlangsungan ekonomi Negara Indonesia. Karawang merupakan salah satu Kabupaten yang terkena imbas dari Pandemi covid-19, seperti yang kita ketahui saat ini Kabupaten Karawang merupakan kota indistri, banyak tersebar pabrik yang didirikan dan beroprasi di Karawang. Koperasi dan UMKM yang berada di Kabupaten Karawangpun harus bertahan terhadap efek Pandemi covid 19. Maka diperlukan inovasi agar dapat berkembang salah satunya melalui digitalisasi. Kegiatan ini dilakukan dalam bentuk penyuluhan dengan memanfaatkan sistem aplikasi zoom dan lapangan yang berbentuk kegiatan webinar, isi dari webinar tersebut adalah membahas mengenai Penyuluhan Terhadap Koperasi Untuk Berkembang Di Era Digital Pada Masa Pandemi Di Kabupaten Karawang. Digitalisasi koperasi memiliki tujuan untuk memberikan kemudahan, kecepatan pelayanan, kenyamanan, dan keamanan saat melakukan transaksi dengan koperasi. Maka dari itu, Lembaga koperasi manual harus segera menjadi koperasi digital.

Abstract

A brand is the essence of an item or service that refers to the quality and value of its owner. Famous brands are popular and familiar brands and have a high reputation. The abuse of their genuine brand is the product of those who want to seek profits that would harm their true owners. The study will examine the process of settling their disputes and the judge's ruling in the issue of pepsodent strong v formula strong. The study uses normative jurisdictional methods based on laws in Indonesia that apply to the primary law code, legislation no. 20 in 2016 on brands and geographical indications and secondary legal materials: journal, article, paper associated with brand. The results of the research on brand dispute resolution in Indonesia there are two ways, namely litigation by commercial courts and non-litigation through alternative dispute resolution or arbitration. The settlement used in the case of Hardwood Private Limited and PT Unilever tbk. carried out by Litigation in the Commercial Court at the Central Jakarta Court.

Abstract

Sejak disusunnya Draft Rancangan Undang-Undang Cipta Kerja hingga disahkan menjadi Undang-Undang menuai polemik dan kritikan dari berbagai lapisan masyarakat. Salah satu klaster dalam Undang-Undang tersebut yang menuai kritik ialah pada klaster perizinan berusaha terkait penghapusan Izin Lingkungan. Tujuan penelitian ini untuk mengetahui dampak penghapusan izin lingkungan terhadap iklim investasi di Indonesia. Metode pendekatan yang digunakan ialah pendekatan yuridis normatif. Hasil dari penelitian ini ialah dengan dihapusnya ketentuan dalam Pasal 38 Undang-Undang Nomor 32 Tahun 2009 mengakibatkan hak koresksi masyarakat lewat gugatan pengadilan tata usaha negara dihapuskan.

Abstract

The development of the times accompanied by technological advances makes it easy for consumers to fulfill their needs. Currently, consumers can easily and quickly obtain their needs in various marketplaces offered by business actors. Free trade in Indonesia causes many products from abroad to circulate in the community, many of which do not include information using Indonesian, so that the information obtained by consumers is not conveyed clearly, precisely, and completely. Whereas in meeting the needs of the community, they prefer to buy goods and services that are traded freely because the prices are relatively cheaper without thinking about the effects of goods and or services that are traded freely without permission from the Ministry of Health. The number of products on the market that have information that is not clear and complete, especially products from abroad which usually only include information using foreign languages only results in harm to consumers both materially and immaterially, because the information in a product is very important for consumers. as a consideration to see whether the product is in accordance with what is desired or needed and also whether the product is safe for use or consumption. Therefore, as a student, the writer is obliged to inform about the rights and obligations of consumers and business actors in carrying out trading activities, including in including information using Indonesian. Using the normative juridical method where we examine the laws and regulations related to this article. Thus, the use of Indonesian in information on a product is very important for consumers and must be carried out by business actors.

Abstract

Tujuan studi ini bertujuan untuk mengkaji mengenai efektivitas penggunaan negosiasi sebagai alternative penyelesaian sengketa dalam penerapan Online Dispute Resolution (ODR). Studi ini menggunakan penelitian hukum normatif dengan pendekatan perundang-undangan dan komparatif. Hasil studi menunjukan bahwa Negosiasi sebagai salah satu alternatif penyelesaian sengketa dalam Online Dispute Resolution (ODR) telah diatur dalam Undang-Undang nomor 30 tahun 1999 pasal 1 angka 10 Tentang Arbitrase dan Alternatif Penyelesaian Sengketa. Efektivitas dari Negosiasi dalam Online Dispute Resolution (ODR) memiliki keunggulan dimana bersifat fleksibel dan hemat biaya dalam pelaksanaanya, serta mencegah akan terjadinya sebuah perpecahan atau permusuhan karena negosiasi menggunakan sistem win-win solution. Bagi pihak yang bersengketa yang mana melalui proses negosiasi online sebagai bentuk penyelesaian alternative dalam penerapan online dispute resolution contohnya pada masa pandemic ini. The purpose of this study is to examine the effectiveness of using negotiation as an alternative dispute resolution in the application of Online Dispute Resolution (ODR). This study uses normative legal research with a statutory and comparative approach. The results of the study show that Negotiation as an alternative dispute resolution in Online Dispute Resolution (ODR) has been regulated in Law number 30 of 1999 article 1 number 10 concerning Arbitration and Alternative Dispute Resolution. The effectiveness of Negotiations in Online Dispute Resolution (ODR) has the advantage of being flexible and cost-effective in its implementation, and preventing a split or hostility from occurring because negotiations use a win-win solution system. For those who are disputing who go through the online negotiation process as a form of alternative settlement in the application of online dispute resolution, for example during this pandemic.
