Abstract

Korupsi Penyalahgunaan Alih Fungsi hutan merupakan bentuk korupsi yang tidak hanya merugikan negara saja, tetapi dapat mengancam stabilitas ekonomi negara bahkan menghambat perkembangan perekonomian negara sebagaimana yang dilakukan oleh Perusahaan PT Darmex Group milik Surya Darmadi yang telah mengubah fungsi kawasan hutan untuk fungsi perkebunan kelapa sawit seluas 37.095 hektar di Riau sejak 2003 hingga 2022 secara ilegal, yang mengakibatkan negara mengalami kerugian sebesar Rp.39,7 Triliun Rupiah. Penelitian ini menggunakan penelitian hukum normatif dengan menganalisis kasus pada Putusan 62/Pid.Sus-Tpk/2022/Pn.Jkt.Pst, sehinga pendekatan yang digunakan ialah pendekatan konseptual, undang – undang, dan kasus yang didukung oleh bahan hukum primer, sekunder dan tersier dalam penelitian ini. Hasil penelitian ini menunjukan bahwa putusan No. 62/Pid.Sus-Tpk/2022/Pn.Jkt.Pst telah mencederai keadilan di masyarakat mengingat kerugian yang ditimbulkan bernominal fantastis. Pemberantasan tindak pidana korupsi bukan hanya berfokus untuk menghukum pelaku saja, tetapi juga berfokus pada pengembalian kerugian negara yang sesuai dengan nominal (aset) yang telah dikorupsi. Sehingga, upaya asset recovery dalam perkara korupsi sangat penting dilakukan, sudah seharusnya pemerintah Indonesia menindaklanjuti proses legislasi nasional Rancangan Undang – Undang Perampasan Aset sebagai bentuk keseriusan pemerintah dalam upaya pemberantasan korupsi di Indonesia.

Abstract

The topic of bullying is never discussed from time to time, the phenomenon of bullying is like an epidemic or a rapidly spreading disease that causes many victims. The phenomenon of bullying is increasingly growing because currently it is a modern era that cannot be separated from technological developments which have positive and negative impacts. Television or social media shows are easier for school-age children to imitate, especially behavior that is considered not good. For example, a fight scene that ends in bullying. Bullying occurs at every school level, from elementary school, middle school, high school to university, both public schools and religious schools and Islamic boarding schools. Bullying is carried out by students, teachers, parents and also school principals with the majority of victims being students. In order to protect and prevent bullying, the government has issued many laws such as the Child Protection Law, the Children's Criminal Justice System Law, the Minister of Education, Culture, Research and Technology Regulations, the Minister of State for Women's Empowerment and Child Protection Regulations, Guidebooks and Programs Anti-bullying from each school and various forms of efforts to anticipate and prevent bullying in schools. In fact, the various regulations issued by the Government have not been able to overcome bullying behavior, which will even increase by 30% in 2023 compared to 2022. This research will complement other research that has been carried out previously, using a different perspective, namely with the concept of sustainability. activities through the PDCA (Plan, Do, Check, Action) system, which requires stakeholders (Government, Teachers, Parents, Students, Law Enforcement and all parties involved) to carry out systematic and holistic prevention efforts, which in every The steps taken must always be reviewed to find out whether the work plan made has succeeded in preventing or not being effective.

Abstract

The provision of restitution to victims of criminal acts is considered not optimal in its implementation with various problems such as from the regulatory aspect and at the level of implementing relevant stakeholders in the implementation of prosecutions. The results of this study will be presented by describing the data obtained through literature studies analyzed by quantitative methods. The study shows that there is a need for an arrangement that contains a substitute crime if the defendant or convicted person is not able to pay a replacement crime as a norm that becomes the legal basis for public prosecutors and judges in prosecuting and deciding cases. The problem arises due to the lack of comprehensive regulations regarding criminal charges in lieu of the payment of compensation, the non-regulation of criminal substitutes for the payment, and the nonregulation of the amount of the criminal substitute. The ideal arrangement in a criminal prosecution that is carried out comprehensively and correctly by the relevant parties is expected to provide legal certainty, justice, and expediency.

Abstract

The development of Ibu Kota Nusantara (IKN) as the new capital of Indonesia has significant impacts on various community groups, including conservative communities residing in the affected areas. Legal certainty is key to ensuring that their rights are protected during the development process. This study aims to analyze the potential violations of land rights and legal protection of environmental rights for conservative communities in the context of the development of Ibu Kota Nusantara, including rights to land, culture, livelihood, and socio-economics. This study analyzes various regulations and policies implemented to sustain the lives of conservative communities and evaluates the effectiveness of existing legal mechanisms in protecting their interests. The research method used is a normative juridical approach with an analysis of applicable laws and regulations as well as related literature reviews. The results show that there are no comprehensive policies regulating the recognition of indigenous communities in the Ibu Kota Nusantara area, leading to overlapping recognition between different regulations. Thus, there is a risk of violations of land and environmental rights for conservative communities due to the development policies of Ibu Kota Nusantara, which have not fully considered legal certainty for the interests and rights of the conservative communities living there.

Abstract

Illegal fishing is an issue that has a broad and serious impact on the economy, environment and maritime security. First of all, this illegal practice causes significant economic losses for Indonesia, estimated at hundreds of trillions of rupiah every year. Apart from that, illegal fishing also has a serious impact on marine ecosystems and the sustainability of fisheries resources. The research method used is normative research. This research aims to analyze and test the application of norms contained in legal regulations, such as laws and other legal literature, which are related to the main issues discussed. The problem approach is used to identify and limit research problems, so that the process of data collection, analysis and discussion becomes more structured and focused. The research results show that Mutual Legal Assistance (MLA) has a crucial role in fighting transnational crime, especially illegal fishing (IUU Fishing) in Indonesia. MLA enables effective international cooperation, facilitating the exchange of information, evidence collection, and cross-border legal action. The types of assistance that can be sought through MLA, such as locating and identifying individuals, obtaining evidence, and seeking the appearance of witnesses in court, have proven to be very important in supporting law enforcement in the fisheries sector. The implementation of regulations such as Law Number 45 of 2009 concerning Fisheries and Law Number 1 of 2006 concerning Mutual Assistance in Criminal Matters, as well as relevant international legal principles, shows that existing regulations are adequate to deal with IUU Fishing.

Abstract

The phenomenon of children dealing with the law with their position as perpetrators is increasingly troubling the community, especially children who are perpetrators of murder. In this case there are two conflicting legal norms related to children's responsibility and children's rights in obtaining legal protection. The purpose of this study is to determine the form of child responsibility in terms of the Juvenile Justice System Law and to find out the solution in handling cases of children who become perpetrators of criminal acts without overriding their rights based on the case in decision No. 3/Pid.Sus-Anak/2022/PN Bnt. The method used is a normative juridical approach. The research was conducted by utilizing secondary data in the form of court decisions and other literature studies. The results showed that based on the Juvenile Justice System Law, the judicial process involves various competent parties and focuses on education and rehabilitation, with lighter sanctions and educational in nature. In the case of the Decision, the child was sentenced to 9 years and 6 months imprisonment in LPKA. In addition, not only punishment, but children are also given the necessary guidance and education as a form of fulfillment of their rights in order to improve their behavior.

Abstract

Problems related to Indonesian Workers (TKI) stem from the ineffective management of companies that distribute TKI. The lack of education of prospective migrant workers makes them vulnerable to fraud. Low understanding of the rules for working abroad is also a serious problem. Government protection for migrant workers is regulated in law, but there are still shortcomings in its implementation. Solutions to overcome this problem include improving recruitment, providing training to prospective migrant workers, and making agreements with the destination countries for migrant workers. Legal protection for migrant workers needs to be strengthened, including for domestic helpers who are vulnerable to exploitation. Current labor laws do not provide adequate protection for them. Improvements in legal protection for migrant workers and domestic helpers need to be made both domestically and abroad.

Abstract

The era of globalization accompanied by technological advances and connectivity between countries opens opportunities for the development of transnational crimes, one of which is narcotics trafficking. In recent years, the global narcotics trade has undergone a significant shift. International syndicates have begun to utilize maritime and water routes as the main distribution route, shifting the focus from the previously dominant land route. This research aims to find out what factors cause the large number of transnational narcotics trafficking through maritime routes and how a comprehensive and integrated international law enforcement strategy to tackle narcotics trafficking through maritime routes. This type of research is normative juridical with a statutory approach and case approach, as well as a literature study method. The result of this research is that factors such as ease of access, sophisticated technology, weak supervision, and economic factors provide a wide gap for drug traffickers. International legal instruments such as UNTOC and the 1988 UN Convention provide a foundation for cooperation and maritime law enforcement. However, high levels of state commitment and close international cooperation are required to overcome these challenges.

Abstract

Universities must design innovative learning to optimize student attitudes, knowledge, and skills. One of them includes the internship program at the Merdeka Campus. However, some parties abuse this situation resulting in the exploitation of students in the Ferienjob Internship Program in Germany. The aim of this research is to determine the government's responsibility towards students in the Ferienjob Internship Program in Germany. The research method used is normative research. This criminal act of human trafficking (TPPO) began with the socialization of the Ferienjob program at various universities by PT Cvgen and PT Sinar Harapan Bangsa (SHB). The perpetrators attract potential participants with tempting promises, such as stating that this internship program equals 20 college credits. The human trafficking case has involved several parties, both the government and the target company, so the government must be responsible for providing protection to the victims. The criminal act of trafficking in persons (TPPO) involves many parties, and students are exploited economically and energetically, so the government has a big responsibility to provide adequate protection. The author suggests that the government immediately develop special regulations for international internship programs for vocational and non-vocational students.

Abstract

The existence and increase in the quantity of Foreign Workers (TKA) in Indonesia has given rise to a lot of debate that has spread in society, especially for workers. So that in certain conditions it can actually give rise to various problems, including violations of the residence and work permits of foreign workers, often in their passports it is written that the permission given by the Indonesian government and immigration authorities is for them to work as foreign workers in Indonesia. position and certain period of time, not just as a tourist. The research conducted by the author is a type of normative juridical research. Normative law focuses on legal concepts, principles and legal rules. Normative legal research focuses on positive legal norms such as statutory regulations. Apart from that, in principle this research also comes from secondary legal materials.. The research results show that the influx of foreign workers (TKA) into Indonesia hampers economic growth, reduces employment opportunities, and reduces the wage level of local workers. Law enforcement is carried out by checking, inspecting and providing sanctions for TKA violations. Administrative sanctions in the form of a fine of IDR 6-36 million in accordance with PP No. 34 of 2021. Apart from that, the sanction for illegal foreign workers is in the form of deportation. Preventive and educational efforts are carried out through outreach to companies regarding the rules for employing foreign workers.
