This article criticizes the judicial review practice over trademarks infringement in Indonesia. This article argues that to be fair the court should consider the confusion effect to determine whether there is a trademarks infringement case in accordance with Art. 16.1 of the TRIPs Agreement. This article concludes that Indonesia needs to improve its legislation to meet the requirement of the TRIPs Agreement and to improve the judges quality in applying the Trademarks Law properly by considering its purpose which grants the trademark owner a protection of the trademark’s identity and a protection against confusion against unauthorized use by third parties. Artikel ini mengkritisi praktik yudisial atas kasus pelanggaran merek di Indonesia. Atas dasar itu artikel ini berargumen bahwa supaya adil maka pengadilan seyogianya mempertimbangkan efek kebingungan untuk menentukan apakah ada pelanggaran merek sesuai Art. 16.1 TRIPs Agreement. Artikel ini menyimpulkan bahwa Indonesia perlu memperbaiki legislasinya supaya sesuai tuntutan TRIPs Agreement dan meningkatkan kualitas hakimnya dalam menerapkan Hukum Merek secara memadai dengan mempertimbangkan aspek purposivenya untuk memberikan kepada pemilik merek perlindungan atas identitas mereknya itu sendiri dan perlindungan atas kebingungan yang ditimbulkan oleh penggunaan merek tanpa hak oleh pihak ketiga.

This study describes the effect of operating conditions such as weight ratio (H2O2/COD), the initial pH of waste and molar ratio fenton reagent (H2O2/Fe2+) to the degradation of waste alkylbenzene sulfonate (ABS). The degradation of ABS with the Electro Fenton process (E-Fenton) conducted in a laboratory scale batch reactor. The increasing doses of the weight ratio the production of hydroxil radicals will be increase and of course will increase the rate of organic degradation. Using a weight ratio that exceeds the theoretical calculations tend to decrease the degradation of ABS concentration. The weight ratio of 2,1 resulted in a decrease of ABS concentration, COD and BOD5 of 94,075%, 94,040%, 81,273%, respectively. Medium acidity (pH) is one of the most decisive factor of Electro-Fenton process, at a pH 3 yield degradation of ABS amounted 98,093%. ABS removal efficiency increased with the increase of ferrous ion dosage at fenton’s reagent molar ratio and reached highest of ABS concentration, COD and BOD5 of 99,05%, 96,64%, and 91,18%, respectively, for the operating time for 60 minutes. A kinetic study was carried out using first order reaction kinetics model. Temperature changes that occur when the research generates activation energy of 80,811 J/K.mol through the Arrhenius equation. This article expresses the author’s view to disagree with the existence of the KPK and its supporting Constitutional Theory. This article is based on classical model of the trias politica theory and suggests that the existence of executive bodies should conform with the prescription of unitary executive theory. According to the unitary executive theory, the president should have the power to appoint and remove any executive official exclusively. This norm is based on the status of the president as the Chief Executive. According to this notion, the KPK, as independent agency, is unconstitutional. In line with the Constitutional Court Decision No. 36/PUU-XV/2017, qualifying the KPK as executive, our abnormal constitutional order, with the existence of the KPK, should be normalized in accordance with the unitary executive theory.

Penelitian ini bertujuan untuk menganalisis kemampuan berpikir kritis siswa dalam menyelesaikan soal ditinjau dari kemampuan awal tinggi dan sedang siswa dengan menggunakan empat indikator berpikir kritis. Penelitian ini merupakan penelitian kualitatif yang disusun untuk mengetahui kemampuan berpikir kritis subjek berdasarkan pemberian tes soal berpikir kritis. Data yang diolah merupakan hasil kemampuan berpikir kritis siswa dengan menggunakan soal tes kemampuan awal untuk pengambilan subjek dan tes kemampuan berpikir kritis. Teknik pengumpulan data yang digunakan adalah pemberian tes dan wawancara. Soal yang digunakan dalam mengukur kemampuan berpikir kritis berupa soal essay berjumlah 2 nomor pada materi perbandingan. Berdasarkan olahan data tersebut, subjek dengan kemampuan awal tinggi mampu menjawab 1 soal tersebut dan mampu memenuhi 4 indikator berpikir kritis. Berdasarkan hasil tes dan wawancara subjek dengan kemampuan awal tinggi dari 1 soal yang dijawab dapat dianalisis bahwa untuk soal nomor 1 bagian a) siswa mampu memenuhi 4 indikator berpikir kritis. Untuk soal nomor 1 bagian b) siswa mampu memenuhi 4 indikator secara berulang dengan mampu menjelaskan soal dengan benar dan tepat. subjek dengan kemampuan awal sedang mampu menjawab 1 soal tersebut hanya mampu memenuhi 3 indikator berpikir kritis. Berdasarkan hasil wawancara subjek dengan kemampuan awal sedang dari 1 soal yang dijawab dapat dianalisis bahwa untuk soal nomor 1 bagian a) siswa mampu memenuhi 3 indikator yakni interpretasi, analisis, evaluasi, dimana siswa mampu menjelaskan hasil tesnya ke dalam wawancara dengan jawaban yang sama dengan hasil tesnya tersebut.

ABSTRACTPT. Bank Central Asia is the biggest private bank in Indonesia that always offer various banking solutions which address customers’ financial needs. Through various high quality and targeted products and services, BCA financial solution supports personal financial planning and customers’ business development. KlikBCA Individual (KBI) is one of the services that BCA offers to enable cutomers required to have a thorough measurement of Information System / Information Technology application performance from several aspects. The methodology used in this research is IT Balanced Scorecard. The result of IS/IT performance analysis at PT. Bank Central Asia using IT Balance Scorecard Framework shows that the highest perspective is the company contribution as much as 19.33%, followed by the future perspective as much as 19%, the user orientation perspective as much as 18.8%, and the last is operationalization perspective as much as 14.58%. The final result is 71.71% which indicates that it has reached a good level.Keywords: IS / IT Performance, IT Balanced Scorecard, KlikBCA Individual.ABSTRAKPT. Bank Central Asia merupakan bank swasta terbesar di Indonesia yang selalu menawarkan beragam solusi perbankan yang menjawab kebutuhan finansial nasabah. Melalui beragam produk dan layanan yang berkualitas dan tepat sasaran, solusi finansial BCA mendukung perencanaan keuangan pribadi dan perkembangan nasabah bisnis. KlikBCA Individual (KBI) adalah salah satu layanan yang diberikan BCA kepada nasabah agar dapat melakukan transaksi perbankan dengan praktis, aman dan mudah. Untuk itu diperlukan sebuah pengukuran kinerja aplikasi Sistem Informasi / Teknologi Informasi secara menyeluruh dari beberapa aspek. Metode yang digunakan dalam penelitian ini adalah IT Balanced Scorecard. Hasil analisa kinerja SI/TI pada PT. Bank Central Asia menggunakan Kerangka IT Balanced Scorecard menunjukkan hasil tertinggi pada perspektif kontribusi perusahaan sebesar 19,33%, lalu perspektif masa depan dengan nilai 19%, yang ketiga adalah perspektif orientasi pengguna sebesar 18,8% dan yang terakhir adalah perspektif operasionalisasi dengan nilai 14,58%. Hasil akhir pencapaian adalah 71,71%, yang berarti sudah berada pada level baik.Kata kunci: Kinerja SI/TI, IT Balanced Scorecard, KlikBCA Individual.

Penelitian ini bertujuan untuk mencari tahu bagaimana orangtua memberi motivasi belajar dan prestasi belajar di Sekolah Dasar Kabupaten Maros pada tahun ajaran 2018/2019. Sampel dalam penelitian ini terdiri dari tiga sekolah yang ada di kabupaten Maros. Metode yang di gunakan dalam pengumpulan data adalah angket dan dokumentasi, data diolah dengan menghitung nilai rata-rata indeks skor perdimensi pola asuh dan rumus presentase untuk menganalisis pengaruh motivasi belajar. Hasil penelitian terdapat pola asuh yang berbeda yang diterapkan orangtua. Pola asuh demokratis lebih cenderung digunakan. Dengan nilai skor rata-rata indeks skor sebesar 61,3, dan perkembangan prestasi belajar anak nilai rata-rata indeks skor 81,23 ada selalu memberi pengaruh pola asuh orangtua terhadap keinginan belajar meningkat, maka hasil belajar sekolah dasar di Kabupaten Maros juga meningkat. This study aims to find out how parents encourage learning motivation and learning achievement of Primary School Students in Maros Regency for academic year 2018/2019. The sample in this study consisted of three schools in Maros Regency. The methods used in data collection are questionnaires and documentation. The data is processed by calculating the average index score for each dimension of parenting and the percentage formula to analyze the effect of learning motivation. The results of the study show that there are different parenting styles implemented by parents. Democratic parenting is more likely to be used. With an average index score of 61.3, and the development of children's learning achievement, with average index score of 81.23, there is always an effect of parenting on learning motivation to increase, so the learning outcomes of primary schools in Maros Regency also increase.

Penelitian ini bertujuan untuk mengetahui apakah Kinerja guru bisa mempengaruhi sekolah dan motivasi yang diberikan oleh kepala sekolah dapat meningkatkan kinerja guru. Jenis penelitian ini adalah berupa penelitian deskriptif kualitatif, maksudnya adalah dalam penelitian deskriftif kualitatif, dimana data yang dikumpulkan bukan berupa angka-angka melainkan data tersebut mungkin berasal dari naskah wawancara, catatan lapangan dokumen pribadi, catatan memo, dan dokumen resmi lainya. subjek dalam penelitian ini adalah kepala sekolah dan guru dari 6 Sekolah Dasar di Kecamatan Curio Kabupaten Enrekang. Data dalam penelitian ini dikumpulkan dengan menggunakan metode observasi, Wawancara dan pembagian angket. Dan dalam penelitian tentang motivasi kepala sekolah terhadap kinerja guru dari 6 sekolah dilaksakan 5 asas yaitu (1) Kepribadian dan Sosial (2) kepemimpinanan pembelajaran (3) pengembangan sekolah/madrasah, (4) manajemen sumber daya (5) supervise pembelajaran. Dari kelima asas tersebut terdapat kepala sekolah memiliki kategori tinggi dan ada kepala sekolah memiliki kategori Sedang. This study aims to determine whether teacher performance can affect schools and motivation given by principals can improve teacher performance. This type of research is in the form of qualitative descriptive research, meaning that the data collected is not in the form of numbers but the data were collected from interview scripts, personal document field notes, memo notes, and other official documents. The subjects in this study were principals and teachers from 6 elementary schools (SD) in Curio District, Enrekang Regency. The data in this study were collected using the method of observation, interviews and questionnaires. And in research on principal motivation towards teacher performance from 6 schools, 5 principles were implemented, namely (1) Personality and Social (2) learning leadership (3) school / madrasah development, (4) resource management (5) learning supervision. Of the five principles, there are school principals in the high category and there are school principals in the Medium category.

Penelitian ini bertujuan untuk mendeskripsikan realisasi kesantunan dan penyimpangan berbahasa siswa kelas 5 SD di kecamatan Tamalanrea kota Makassar. Penelitian ini dilakukan di SD Kecamatan Tamalanrea Makassar. Subjek penelitian ini adalah siswa kelas 5 SD Inpres Tamalanrea 1, SD Inpres Tamalanrea 3, dan SD Inpres Tamalanrea 4. Teknik pengumpulan data dalam penelitian ini menggunakan observasi dan rekaman. Peneliti mengolah data secara kualitatif. Penelitian ini menghasilkan bentuk percakapan kesantunan dan penyimpangan berbahasa. This study aims to describe the realization of politeness and language deviations in 5th grade elementary school students in the Tamalanrea district, Makassar city. This research was conducted in elementary schools (SD) in Tamalanrea District, Makassar. The subjects of this study were 5th grade students of SD Inpres Tamalanrea 1, SD Inpres Tamalanrea 3, and SD Inpres Tamalanrea 4. Data collection techniques in this study using observation and recording. The researcher processed the data qualitatively. This research produces conversational forms of politeness and language deviations.
