Abstract

Terrorism has become a global phenomenon, affecting not only those hurt or killed by acts of terrorism but also involving women as significant contributors to indoctrination worldwide, including in Indonesia and Uzbekistan. This research aims to explain the evolving roles of women in terrorism in Indonesia and Uzbekistan and how terrorists use cyber indoctrination to target women in these countries. The research was conducted in Indonesia and Uzbekistan using the classical-normative dogmatic juridical method with a library-based approach. Cyber indoctrination has proven highly effective in persuading women to join and take initiative in acts of terror. Women who become involved in terrorism due to exposure to pseudo-religious ideologies through cyber indoctrination have human rights and should be legally protected as victims of cyber indoctrination by terror groups. This article contributes to the recognition of women's rights as victims of cyber indoctrination and sheds light on the changing role of women in terrorism. It aims to raise awareness among society, governments, law enforcement agencies, and religious leaders about the strategies of pseudo-religious cyber indoctrination employed by terrorists. It encourages them to take preventive and repressive actions to combat terrorism and safeguard women from its allure.

Abstract

Berangkat dari permasalahan perlu adanya perhatian serius dari pemerintah terkait jaminan perlindungan tenaga kerja Indonesia di luar negeri melalui penegakan hukum sehingga dapat menepis anggapan bahwa hukum dimanfaatkan oleh oknum tidak bertanggungjawab untuk membuat pola aktivitas perbudakan modern akibat lemahnya penegakan hukum. Pengabdian kepada masayarakat ini bertujuan untuk: 1). Mendeskripsikan perlindungan hukum pekerja migran Indonesia saat ini; dan 2). Mendeskripsikan upaya penyelesaian problem yang menimpa para pekerja migran Indonesia di luar negeri. Hasil pengabdian kepada masyarakat dengan mitra Pimpinan Cabang Istimewa ‘Aisyiyah Hong Kong menunjukan bahwa terdapat permasalahan hukum yang hingga saat ini tengah dihadapi oleh masyarakat antara lain permasalahan belum optimalnya penyelesaian konflik yang dialami oleh pekerja migran Indonesia di luar negeri. Sebagai upaya membantu masyarakat untuk menghadapi persoalan hukum tersebut, maka diselenggarakan pengabdian kepada Masyarakat yang dilakukan secara langsung sebagai wadah untuk menyiapkan pekerja migran Indonesia yang memiliki kesadaran diri dan kepedulian kepada isu-isu hukum dan keadilan sosial. Melalui Pengabdian hukum ini, para Pekerja Migran Indoensia menjadi paham terkait hak-hak dan metode penyelesaian hukumjika terjadi konflik.   Abstract Counseling on Problems and Legal Protection of Indonesian Migrant Workers in Hong Kong. Starting from the problem, there needs to be serious attention from the government regarding guaranteeing the protection of Indonesian workers abroad through law enforcement so that it can dispel the notion that the law is being used by unbalanced individuals to create a modern pattern of freezing activities due to weak law enforcement. This community service aims to: 1). Describe the current legal protection of Indonesian migrant workers; and 2). Describe efforts to resolve problems affecting Indonesian migrant workers abroad. The results of community service with partners from the Special Branch Leader of 'Aisyiyah Hong Kong show that there are legal problems that are currently being faced by the community, among other problems that have not yet optimally resolved the conflicts experienced by Indonesian migrant workers abroad. As an effort to help the community face these legal problems, community service is carried out directly as a forum for preparing Indonesian migrant workers who have self-awareness and concern for legal and social justice issues. Through this legal service, Indonesian migrant workers become aware of their rights and methods of legal resolution if a conflict occurs.

Abstract

Understanding the concept of purification or spiritual cleansing plays an important role in many religious traditions, including Muhammadiyah. Muhammadiyah, as an Islamic organization that promotes moderate national and Islamic values, has long dedicated itself to understanding religious concepts in the context of the times. However, in the process of adapting to the changing times, there are often different views, both in progressive and conservative approaches, in interpreting and applying religious concepts, including purification. Based on the research findings, the study can generate concrete policy recommendations and strategies to promote inclusive and progressive purification of religious understanding in Muhammadiyah, as well as ways to facilitate dialog and respectful understanding between progressive and conservative views.This research aims to explore the relevance of the concept of purification among Muhammadiyah and identify the main challenges that arise when the concept is interpreted through progressive and conservative views. By understanding the different views, it is hoped that this research can provide a deeper insight into the concept of purification in the context of Muhammadiyah, as well as its implications in religious practice. The approach chosen in this research is to analyze the thoughts, opinions, and interpretations of scholars and key figures from both views, as well as empirical data from among Muhammadiyah citizens. This research is expected to make a significant contribution in expanding the understanding of religious thought in Muhammadiyah and the relevance of the concept of purification in the context of differences in progressive and conservative views. This research aims to analyze the dialectic of purification understanding among Muhammadiyah, between progressive and conservative views. This research examines the relationship between the normative side of the Qur'an and the understanding side, as well as how Muhammadiyah tries to purify religion from shirk, heresy, and khurafat through rationalization and spiritualization of sharia. Based on the research findings, the study can produce concrete policy recommendations and strategies to promote the purification of inclusive and progressive religious understanding in Muhammadiyah, as well as ways to facilitate dialogue and respectful understanding between progressive and conservative views. Abstract

The Indonesian National Health Service (NHS) is part of Indonesia’s national social security system. Its implementation is full of problems, such as the rejection of patients, the NHS payment which is lower than the real health cost, sanctions, fines, etc. The Indonesian National Social Security System, especially the NHS services, was established by the state to give social protection to its citizens. The Black Swan Theory is based on the presumption that all swans are white, thus in this case, the Indonesian NHS is truly a program aimed to give social security in the health sector, just as the general conditions of social securities applied in other countries. This research studies this theory to explore the paradoxes which happen in the Indonesian NHS to find the black swan. In this case, the black swan is a paradoxical symbol regarding the regulations and the problems of the Indonesian NHS. This research uses the juridical-doctrinal or the normative method and is descriptive research with a qualitative approach. Based on the Black Swan theory, this research tries to find paradoxical, extreme, and unpredictable discrepancies in the Indonesian NHS. It is found that the Indonesian NHS is a black swan or unpredicted according to black swan theory. The objectives, practices, and regulations of this NHS are truly different from the NHS which is supposed to be given to the Indonesians. It transfers the government’s burden in establishing the health service and the rights of the citizens to the citizens, coupled with the threat of sanctions which is unknown in NHS. The applied Indonesian NHS has an extensive impact on hundreds of millions of Indonesian citizens.

Abstract

The Indonesian Islamic nomocracy paradigm has a long history and a cultural relationship with the national struggle that coincides with political and religious orientations. The Islamic nomocracy is inseparable from the relationship between Islam and the state rather than being linked to Islamic doctrine and power. This research employed the normative sociological method. It used a philosophical approach from Barbour’s paradigm of the relationship between religion and science and Habermas’ thought on religion in public spaces. This research strives to analyze the Islamic nomocratic paradigm pattern prior to Indonesian independence as a crucial stage that influences the following eras, namely the post-independence era, the Old Order Era, the New Order Era, and the Post-Reformation era up to now. This research aims to find the basics and the development of the Islamic nomocracy in the Indonesian legal system. The roots of the Islamic nomocracy legal thought in Indonesia can be traced to the pre-independence era. In the development of Islamic kingdoms, there was a dialog and integration process between the Islamic nomocracy and the kingdom government. After the War of Java, the conflict and independence pattern was formed. Before Indonesian independence, the Islamic nomocracy thought developed into Pan Islamism which tended to be conical to legal formalization through the caliphate system. After Indonesia’s independence, some of the Islamic nomocracy legal thought recognized the state as one of the legal systems in Indonesia besides customary law and positive law. Then, Indonesia became a partly-Islamic Legal State with a constant up-and-down relationship with the state. The authors also completed this paper with perspectives of Spain and Russia as both have been ruled under Muslim governance.

Abstract

The study reviewed the development of the digital era in the legal field, especially The Electronic General Meeting of Shareholders (GMS), which is ruled by law. The problem formulation was how the electronic GMS, according to positive law in Indonesia, and how the impact on the notarial deed related to its implementation. The method used by the researcher was normative and library study based on the primary material (legislation), secondary material (scientific works, journals, books, documents, and other literature), and tertiary legal materials (legal dictionaries). The study results were that E-GMS is effective today, then regulated in Art 77 UUPT and PJOK Number 16/Pojk.04/2020, so that the Limited Liability Company members can carry out the GMS as usual without being physically present to break the chain of the Covid-19 pandemic. Although the e-GMS arrangements have been regulated in the legislation, the lex specialist derogat lex generalist principle cannot be ignored; article 16 paragraph (1) letter (m) and Article 18 UUJN are still prioritized so that the electronic deed of the GMS cannot be carried out or will resulting in the legal force of the proof being a private deed.

Abstract

This legal study investigates the implications of the proposed renaming of West Java Province to Tatar Sunda Province, employing the approach of intuitive semantic dualism to address issues of language, territory, ethnicity, and national identity. The research draws on data from academic journals, books, media reports, and interviews, comparing secondary data with field opinions on the languages and bordering regions of the Sundanese dialect. The findings reveal that, although the Sundanese linguistic system was expected to play a crucial role in the renaming process and promote territorial unity, it falls short due to the inclusion of regions such as Banten, pre-independence Batavia, and bilingual border areas in the east and north. This geographic and linguistic complexity means that the name "Tatar Sunda" does not accurately reflect the distinct linguistic, cultural, and territorial identities of the Sundanese people as described by J. van Baal. Legally, while there are no barriers to the renaming policy, the proposed name fails to adequately represent the region's diverse identities. Consequently, the study recommends further exploration of more representative alternatives that align with the existing legal framework, ensuring that the name change is not only legally valid but also appropriately reflects the region's identity.

Abstract

This research examines the role of Islamic religious education in overcoming juvenile delinquency at the Babakan Ciwaringin Islamic Boarding School Middle School, Cirebon. Using a qualitative case study type approach, this research collected data through observation, interviews, questionnaires and documentation studies. The results of the research revealed that there were cases of minor juvenile delinquency, such as skipping school, not doing assignments, and other violations of discipline. Causative factors include internal factors such as birth defects, negative traits, imbalance in meeting needs, and lack of positive hobbies, as well as external factors such as lack of parental attention, negative relationships, lack of means of channelling free time, and family/teacher ignorance in dealing with adolescent problems. Islamic religious education plays an important role in overcoming juvenile delinquency through instilling Islamic values in classroom learning and practices in the school environment, such as congregational prayers, religious lectures, maintaining cleanliness, shaking hands with teachers, and giving greetings, saying hello, smiling. This aims to form students' faithful, pious, and noble personalities to avoid deviant behaviour. This research contributes to the development of effective Islamic religious education strategies to overcome juvenile delinquency.

Abstract

Every worker has the rights to receive occupational health and safety guarantees. Occupational safety and health are not only a worker's rights, but it is also the employer's responsibility to provide. Protection of norms for pharmaceutical workers, who are included in the group of health workers, includes wages, working time, rest time, and leave. Meanwhile, norms of social security for workers who manage the clinic by ensuring participation in the national health insurance (JKN) are held through the JKN-BPJS Health program and work accident insurance and death benefits are held through the BPJS employment program. In practice, employers have not made this a priority that must be received by every employee. This is felt by several pharmacists at clinics in Semarang. Based on the problems above, it is necessary to conduct the research about the legal protection of occupational safety and health for pharmacists at clinics in Semarang Regency. Research Objectives to optimize the implementation of occupational safety and health legal protection for pharmacy staff at clinics in Semarang. This study used a descriptive method with a qualitative approach and a case study design. The Implementation of Occupational Safety and Health Legal Protection for Pharmacy Personnel at Clinics in Semarang Regency has not been carried out in accordance with the applicable laws and regulations. There are some clinics do not have complete personal protective equipment (PPE) according to standards, and the rights to health and safety that should be given by employers. the pharmacist clinics is not guaranteed yet. Occupational safety and health legal protection for pharmacists at clinics in Semarang has not been implemented in accordance with the applicable laws and regulations.
