Abstract

Pemerintah Indonesia berupaya meningkatkan efisiensi kegiatan usaha dengan percepatan pelaksanaan berusaha yang disusun dalam Peraturan Pemerintah Nomor 5 Tahun 2021 tentang Penyelenggaraan Perizinan Berusaha Berbasis Risiko Melalui Sistem Online Single Submisson (OSS). Berdasarkan kebijakan tersebut, semua pelayanan perizinan usaha menjadi terintegrasi oleh pusat melalui 1 (satu) Sistem Perizinan Berusaha Secara Elektronik Online Single Submission (OSS). Penyelenggaraan pelayanan publik yang bercirikan good governance merupakan salah satu tugas penting bagi pemerintah. Pada DPMPTSP Kota Surakarta meskipun pelayanan publik dapat dikatakan baik namun, prinsip-prinsip good governance belum terwujud secara optimal. Sehingga penelitian ini bertujuan untuk menjelaskan kebijakan penyelenggaraan perizinan berusaha berbasis risiko melalui sistem Online Single Submission (OSS) berbasis good governance. Metode penelitian yang digunakan adalah pendekatan kualitatif melalui observasi, wawancara dan telaah dokumen. Hasil penelitian menunjukkan bahwa kebijakan perizinan sistem OSS pada DPMPTSP Kota Surakarta berbasis good governance sudah cukup baik. Dalam praktiknya penerapan good governance tersebut dilakukan dengan memberikan wadah bagi masyarakat untuk ikut serta dalam perencanaan memajukan dunia usaha dan perekonomian. Meski demikian, masih terdapat kendala dalam penerapannya baik dari penyampaian informasi dan kejelasan informasi yang disampaikan. Dalam penelitian yang telah dilakukan disimpulkan bahwa good governance dapat terwujud melalui pelayanan publik yang baik pula.

Abstract

This research examines the role of Islamic religious education in overcoming juvenile delinquency at the Babakan Ciwaringin Islamic Boarding School Middle School, Cirebon. Using a qualitative case study type approach, this research collected data through observation, interviews, questionnaires and documentation studies. The results of the research revealed that there were cases of minor juvenile delinquency, such as skipping school, not doing assignments, and other violations of discipline. Causative factors include internal factors such as birth defects, negative traits, imbalance in meeting needs, and lack of positive hobbies, as well as external factors such as lack of parental attention, negative relationships, lack of means of channelling free time, and family/teacher ignorance in dealing with adolescent problems. Islamic religious education plays an important role in overcoming juvenile delinquency through instilling Islamic values in classroom learning and practices in the school environment, such as congregational prayers, religious lectures, maintaining cleanliness, shaking hands with teachers, and giving greetings, saying hello, smiling. This aims to form students' faithful, pious, and noble personalities to avoid deviant behaviour. This research contributes to the development of effective Islamic religious education strategies to overcome juvenile delinquency.

Abstract

Existing studies on watershed and forest conservation in the upstream Bengawan Solo region have largely focused on ecological degradation, technical conservation strategies, or regulatory shortcomings. However, there remains a significant gap in understanding how an ecoregion based approach can be systematically integrated with local wisdom to produce a comprehensive and context specific conservation policy. The study investigates the role of local wisdom in upstream forest management, the existence of gaps in legal protection for watershed conservation, and the impact of integrating local wisdom with legal frameworks on policy effectiveness. An empirical method with a qualitative approach was employed, drawing on primary data obtained through field observations in four regencies, namely Wonogiri, Sukoharjo, Surakarta, and Karanganyar. The results of this study reveal three principal findings. First, sustainable conservation in the upstream Bengawan Solo watershed requires a synergistic model that integrates ecological considerations with community based knowledge systems. Second, fragmented regional regulations and weak legal coordination continue to obstruct effective watershed governance, resulting in inconsistent conservation practices across administrative boundaries. Third, the study highlights the need for comprehensive policy reform through the establishment of interregional cooperation mechanisms supported by a Memorandum of Understanding, which can strengthen institutional governance, harmonize conservation strategies, and enhance long term ecological resilience within the watershed area.

Abstract

The decrease in Bengawan Solo River’s water quality threatens the livelihood of the people living around this river, considering that it is one of the sources of their livelihood. There has been large-scale pollution in the upstream area of Bengawan Solo River caused by alcohol waste, carcasses of pig cattle, and wastewater from textile factories that were not processed in the wastewater processing installation. The aim of this research is to analyze how the ecoregion methods can be applied and how it kan became solution in managing the Bengawan Solo River to free from the threat of waste pollution.. Methods: This research employed the sociological method, where the authors collected field data from seven districts or regencies. The primary data were sourced from  observation and interviews, while the secondary data consisted of regulations, laws, etc. These data were descriptively analyzed to illustrate policies for handling waste. Waste processing issues happen in almost every area in Indonesia. Findings: Even though legal instruments that govern this issue already exist, such an issue cannot be resolved through the regulations of one city or regency. Thus, there is a need for inter-regency regulations. There needs to be a new concept to help protect this river, which is the ecoregion approach.

Abstract

This research aims to describe the natural resources management policies in the mineral and coal sectors. The description is based on the social welfare value contained in Law No. 3 of 2020 concerning Amendment of Law No. 4 of 2009 concerning Mineral and Coal Mining, as well as Law No. 11 of 2020 concerning Employment and Labour Law. This research employed a normative judicial method based on law regulations that are conceptualized as principles or norms and have evolved into proper human behavior standards. Secondary data were employed by exploring literature correlated with the mineral and coal mining management law and analyzed using juridical-qualitative techniques. Subsequently, the research indicated that the Indonesian government policy in the Mineral and Coal, alongside Omnibus Laws, are unable to accommodate social welfare values and support only profit-oriented businesspersons. This research is expected to proffer suggestions for the central or regional government to make regulations prior to the social welfare principle.

Abstract

The advocate profession in the early Islamic treasury is not formally institutionalized so that it needs to explore prophetic values in the history of Islamic civilization and objectified into the advocate profession. This study aims to reveal the advocate profession from the perspective of prophetic science and trace prophetic values into the foundation of the advocate profession. This study uses a normative research model through library materials or literature literature as a written source. The results of the study show, first, Islam respects human rights in defending their interests in court. Islam guarantees justice in a trial, equality of rights, and guarantees the right to defend the rights both alone and through legal counsel in accordance with the wakalah system. Second, prophetic values as the foundation of the advocate profession are upholding justice, being a peacemaker, the concept of submitting affairs to the experts leave the matter to the expert / knowledgeable, the concept of mutual help, and advocate ethics. These values are not only human dimensions but also transcendental.

Abstract

The development of legal relations between drivers and online land transportation service application providers is becoming increasingly massive, especially when technological developments and digitalization make it easier to utilize digital-based land transportation services. This research aims to analyze and determine legal prescriptions or solutions to the problem of legal gaps in special regulations that discuss and serve as guidelines in implementing partnership legal relations between online transportation drivers and online land transportation service application providers in terms of the aspect of social justice. This research is normative legal research by prioritizing conceptual and statutory approaches. The research results confirm that the social justice aspect of the partnership legal relationship between drivers and online land transportation service application providers has not actually been fulfilled, which is due to the absence of special regulations regarding partnership relationships that can guarantee legal certainty and protection for online transportation service drivers. Legal protection policies for partnership legal relationships between drivers and online land transportation service application providers can be implemented by establishing regulations regarding special partnership relationships between drivers and online land transportation service application providers to fill the existing legal gaps.

Abstract

This article aims to answer the position of revelation as a prophetic-based ontology of legal science. If the West issues revelations in science and more specifically in the formation of positive law, and glorifies human reason more, then this article explains that these revelations are part of positive law without ignoring human potential, and placing human potential proportionally. By using philosophical methods and approaches, this article shows that revelation in the study of prophetic law occupies a very high position, revelation functions to provide direction and guidance for reason in understanding reality and the formation of positive law. Law is interpreted by the will of Allah SWT which is based on the Koran and the Sunnah of the Prophet Muhammad. Revelation functions as a guide containing norms, values and rules, while reason is tasked with finding laws based on revelation's direction. For this reason, revelation, reason and the senses never come into conflict between the two, instead they become one unit, mutually reinforcing and reinforcing each other. The combination of revelation with reason and human life is then known as the Islamic moderation paradigm which synergizes things that are permanent with things that are flexible, combines the understanding of the Salaf with contemporary reforms (tajdid), is not jumud and liberal, and understand Islam comprehensively. Conflict between revelation and reason will only occur if one of them is fixed and the other is flexible, then of course the fixed one is superior to the flexible one, or both are equally flexible, so even if one is determined by interpreting the view of reason.

Abstract

This study aims to construct the form of customary law empowerment as a means of overcoming family conflict. The research design used is empirical legal research with a qualitative-naturalistic approach. The research was conducted in Palu City, especially in Birobuli Utara Village. The data for this study came from field observations and interviews with traditional leaders. The results of the study indicate that customary law empowerment as a means of overcoming family conflict is constructed in the form of implementing alternative dispute resolution, a method of resolving disputes outside the court with mediation and negotiation techniques. Customary law empowerment as a means of overcoming family conflict should continue to be strengthened from various aspects so that it can be more optimal in carrying out its function as an alternative dispute resolution institution, considering that this institution has been proven to be able to resolve family disputes simply, quickly, and at low cost (speedy administration of justice), while maintaining community harmony. Otherwise, this very valuable social capital will only become wisdom that is increasingly being marginalized.

Abstract

This article aims to discuss the urgency of community consent and involvement in development in the era of the Job Creation Law in Indonesia. Whereas, The Job Creation Law is designed to reduce the complexity and time needed to obtain permits with the aim of ease of doing business. The impact of this policy is to eliminate community consent in building approvals as one of the basic requirements for business licensing. This research uses normative legal research methods with a statutory approach. The data analysis technique uses descriptive analysis by describing general things to specific ones by describing current business licensing policies in Indonesia to provide general ease of doing business. The results of the discussion showed that community involvement in the building approval process is an important aspect that needs to be considered in the context of the Job Creation Law in Indonesia. Community involvement can be in the form of a public consultation process, where the building owners must obtain approval or at least discuss development plans with the surrounding community to ensure that the project does not harm the interests and lives of the local communities. Looking at the process of forming and amending the Job Creation Law, where there are many community rejections and low levels of participation, it can be seen that the legal politics of the Job Creation Law belongs to an authoritarian political configuration whose legal product character is conservative. This includes the substance of the regulation, which eliminates the requirement for community consent in managing Building Approval.Keywords:Law, Job Creation, Business License, Politics
