Abstract

STAI Muhammadiyah Probolinggo carries out the Catur Darma of Higher Education policy by adding Al-Islam dan Kemuhammadiyahan as the fourth dharma. This policy is explained through the institution's mandatory course, namely Al-Islam dan Kemuhammadiyahan (AIK) which must be taken by all students, including Muslims from Muhammadiyah and non-Muhammadiyah backgrounds. This research focuses on two aspects: (1) the AIK policy at STAI Muhammadiyah Probolinggo, and (2) the implementation of the AIK policy for students with non-Muhammadiyah backgrounds. This research is qualitative, using observation, in-depth interviews and documentation. The research results show that (1) students from non-Muhammadiyah backgrounds are required to take AIK courses, with lecturers paying attention to proportions, material presented, and local context; and (2) the AIK learning model involves rules of study, which changes the doctrinal approach to a dialogical one, namely using a theory-based curriculum approachWasathiyah as the main analytical tool.

Abstract

Until the mid-19th century, the Dutch colonialism (the Western world) began to intervene in the indigenous legal systems of Indonesia. The current situation marks the beginning of a decline in the civilization of Muslims, particularly in Indonesia. This development raises concerns about the future of Indonesian society as a whole. This decline permeated various aspects of life, including the field of mu’āmala law, which began to adopt usury-based concepts. This research aims to reconstruct the Islamic legal policy on Ultra-Micro (UMi) Financing as practiced by the Indonesian government, which still contains elements of usury (ribā) in its implementation. This study employs a qualitative approach using empirical-socio-legal research methods involving an analysis of UMi Financing contracts, interviews with stakeholders, and direct observations in Surakarta. The analysis is grounded in the theory of maqāṣid al-sharī’a, including the principles of ribā as outlined in classical Islamic jurisprudence (turāth). The findings reveal a research gap that the current legal policy on Sharia ultra-micro financing implemented by the government had ribā, which is found in classical Islamic texts.

Abstract

This article aims to analyze the division of inheritance carried out by the royal family of the Surakarta Sunanate in Central Java Province. Data were collected through interviews and observations involving six royal families. The findings show that the descendants of the Surakarta Sunanate royal family divide inheritance based on agreements reached withing the family. Within the royal family, there are two types of inheritance. The first is the king’s personal property, which is divided according to Paugeran (royal customary law), using a ratio of 2:1 between sons and daughters, unless the king has left a testament. The king’s testament, known as sabda pandita ratu, is considered absolute. If the king issues a testament that removes the inheritance rights of a family member, that person’s rights are annulled. This stands in contrast to Islamic law, which limits the scope of a testament to one-third of the estate and prohibits the disinheritance of a rightful heir. The second type of inheritance is palace property, which may only be inherited by the son or heir who succeeds the late king. These practices illustrate the (dis)harmony between Islamic inheritance law and royal customary inheritance law in specific contexts.

Abstract

Article 28H paragraph (4) of the 1945 Constitution of Indonesia guarantees citizens the right to private property, including land, which cannot be taken arbitrarily. This study aims to: (1) describe current land titling policies; and (2) explain the policy on registering customary land rights. The research uses a normative, qualitative doctrinal approach. In Islamic land law, land is considered the property of Allah SWT, with humans granted authority to manage it in accordance with sharia. Thus, land management should adhere to divine, not human, laws. Indonesia’s current land certification policy is based on the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency No. 12 of 2017, which governs the Acceleration of Complete Systematic Land Registration (PTSL). This program targets certification of 126 million land parcels by 2025. Land registration contributes to community welfare by offering legal certainty and protecting property rights. However, Government Regulation No. 27/1999 does not recognize customary (ulayat) land as eligible for certification, despite the constitutional mandate and the Basic Agrarian Law (UUPA) to protect such lands. To resolve this, the government can issue Customary Land Certificates through Regional Regulations as part of the Customary Land Registration process, ensuring legal recognition and protection of customary community land rights.

Abstract

Corruption remains a serious threat to democracy and governance. High voter turnout does not automatically reflect substantive democracy, as many citizens still have limited political understanding, resulting in suboptimal awareness of their rights, obligations, and oversight role. This study aims to analyze the role of political education as a strategic instrument in preventing corruption by instilling the values of integrity, transparency, and accountability, while strengthening public participation in policy oversight. This research employed a sociological-normative legal approach that combined statutory and doctrinal analysis (das sollen) with empirical observation of legal practices and public responses (das sein). The subjects of this study included statutory documents, legal literature, policy reports, law enforcement perspectives, and community experiences related to anti-corruption efforts. Data were collected through literature review, interviews with selected respondents, field observations, and documentation, then analyzed qualitatively using descriptive and thematic approaches. The findings reveal that political education contributes to increasing legal awareness, fostering anti-corruption values, creating critical voters, and encouraging public oversight of governance. However, its current implementation remains minimal and fragmented, often limited to supplementary material in schools and incidental public campaigns. This study concludes that political education needs to be developed systematically to build an anti-corruption culture and strengthen democracy, involving collaboration between the government, political parties, and educational institutions in curricula and public programs.

Abstract

Law No. 18 of 2003 explains that someone who wants to be an advocate must take advocate professional education. This professional education is based on the enforcement of justice and pursues to strengthen the Rule of Law principles. This study offers the importance of spirituality in advocate education, in order to create an officium nobile who puts justice for the marginal community over the injustice rules. This research method uses a non-doctrinal qualitative approach based on law implementation in society, combined with a philosophical system related to spirituality that integrates science and religion. This study concludes that advocate education with a spiritual dimension is an effort to uphold the advocate profession as an official representative, prioritizing justice access in the community rather than profit, especially in bribery or corruption.

Abstract

This paper analyzes and provides advice on legal protection for rape victims in Indonesia in transcendental, restorative law, and responsive law perspectives. These perspectives are compared and combined in an effort to seek an ideal concept. The implication of this paper is to provide advice for an ideal concept of legal protection for victims of rape in an Indonesian context. This paper uses a normative juridical approach with a legal interpretation method. This paper concludes that law enforcement against perpetrators of rape in the Indonesian context can employ transcendental, restorative law, and responsive law approaches. However, in an effort to find an ideal concept, the transcendental perspective of maṣlaḥah mursalah which considers benefits for the public and prevents harm is more suitable for use in Indonesia’s pluralistic society. This is because, in addition to emphasizing moral, ethical, and religious values in law enforcement, the approach will prevent recurrence of cases through handing out severe punishment to perpetrators of rape and providing physical and psychological rehabilitation to victims to make it in line with restorative justice in which victims get the right to recover physically and mentally without reducing the punishment for rape perpetrators.
