Abstract

International Humanitarian Law and International Environmental Law have paid serious attention to environmental damage resulting from armed conflict, but the legal protection efforts issued by these two laws have not yet been fully used as guidance for the parties to the conflict. This research aims to provide an overview of environmental protection arrangements in situations of armed conflict. A normative juridical method with a case approach and related conventions has been used in this research. The results of the research are that basically the regulations regarding the application of law related to legal protection of the environment in armed conflict are contained in International Humanitarian Law and International Environmental Law, so it is necessary to integrate these two laws so that they can strengthen each other and serve as guidelines for the parties. which is in conflict.

Abstract

The environment is a natural resource that brings great benefits to the survival of society. Problems regarding the environment are currently quite complex problems to discuss considering that the current natural conditions are not getting better, but it can be said that the current natural conditions are getting worse. So the environment currently really needs special attention to continue to be well looked after and preserved. The research method used is normative research or library research, meaning that this research is based on library sources to discuss the problems that have been formulated. This normative research is a process of finding legal rules to answer the legal issues faced. This research uses primary legal materials as main data, secondary legal materials as supporting and complementary data, and testier legal materials as explanatory data from primary and secondary legal materials. Currently, the main spearhead of environmental problems comes from public awareness of environmental sustainability so that if a sense of awareness arises in a person it will create a feeling of protecting, preserving and utilizing the environment wisely. So regulations are needed that can regulate the environment to overcome this problem. Law Number 32 of 2009 concerning Environmental Protection and Management is expected to become a regulation that not only regulates the environment but can address various current environmental problems.

Abstract

Drones are a new technology that can pose a threat to the sovereignty of many countries. Therefore, preventive efforts are necessary for a government to safeguard its interests. In this context, Indonesia needs to establish a legal framework from an international legal perspective, supported by national positive law, to mitigate the use of drones. The research, conducted through a normative-judicial analysis approach, concludes that a considerable number of legal instruments are aimed at protecting Indonesia from drone threats. However, Indonesia's military capability is not yet fully equipped to enforce the mandates of these laws. Consequently, the approach that can be taken is to prohibit drones altogether because they violate human rights and harm society.

Abstract

Compulsory Military Service has become the focal point of debate in the latest National Resource Empowerment Law (PSDN). Some argue that national defence, which forms the basis of compulsory military service, should not be confined solely to military contexts. However, on the other hand, many believe that a military approach is integral to national defence. The author employs a legal and national defence analysis to comprehend the conception of compulsory military service. The findings of the author's research indicate that mandatory military service is a mandate of the law and not voluntary, leaning towards a militaristic approach. Furthermore, the author asserts that all non-militaristic forms of national defense are valid, but a militaristic approach remains obligatory.

Abstract

Taxes play a vital role as the backbone of fiscal sovereignty that ensures the sustainability of national development. However, the institutional position of the Tax Court under the executive branch has long created ambiguity and doubts regarding judicial independence for justice seekers. This study aims to analyze the institutional problems of the Tax Court and the implications of Constitutional Court Decision Number 26/PUU-XXI/2023 for strengthening the independence of the tax judiciary in Indonesia. This study employed a normative legal research method with statutory and conceptual approaches, which were analyzed descriptively-analytically based on secondary legal materials. The results showed that the Constitutional Court’s decision has ended the unconstitutionality of the dual supervisory system by placing the Tax Court entirely under the Supreme Court. This transformation changes the institutional paradigm from an executive regime to a purely judicial regime in order to reduce the potential for conflicts of interest and bureaucratic bias in the trial process. This study emphasizes that the implementation of a one-roof system is an important model for realizing legal certainty, strengthening judicial independence, and increasing trust in Indonesia’s taxation system. In addition, strengthening the dignity of the tax judiciary needs to be followed by the effectiveness of decision enforcement so that tax justice does not stop at the pronouncement of the ruling, but also provides a tangible impact for taxpayers.

Abstract

Although MSMEs are a fundamental pillar in the national economic structure and play an important role in maintaining Indonesia’s economic resilience against global market shocks, studies that specifically discuss the synchronization of MSME tax regulations from the perspective of fiscal justice remain limited. This study aims to analyze the synchronization of MSME tax regulations based on written legal norms and fiscal justice theory. This study employed a normative juridical method with a statutory approach and a conceptual approach. The results show that the establishment of the Kementerian UMKM through Peraturan Presiden Nomor 196 Tahun 2024 and the plan to separate the tax regime in the revision of Peraturan Pemerintah Nomor 55 Tahun 2022 constitute strategic government measures to strengthen the focus of authority and budgetary independence in empowering the micro sector. The policy is designed to create a balance between providing competitive tax incentives for PT Perorangan and individual taxpayers and maintaining the stability of state revenue through more accountable business formalization. These findings contribute to the development of studies in economic and tax law, particularly regarding the design of more adaptive fiscal policies for MSMEs. This study underscores the importance of synchronizing tax regulations that are able to support MSME empowerment while at the same time sustainably safeguarding the state’s fiscal interests.

Abstract

This study aims to analyze the philosophical foundation of justice as a legal principle in judicial decisions in Indonesia. Using a normative juridical research method, this paper examines the alignment between judicial considerations and the philosophical conception of justice proposed by thinkers such as Aristotle, John Rawls, and Gustav Radbruch. The analysis is based on a literature review of laws, legal doctrines, and selected court decisions that reflect the application of justice as a guiding principle in judicial reasoning. The results show that the philosophical meaning of justice has not been fully realized in every judicial decision, as some judgments still emphasize legal certainty over fairness and moral substance. Therefore, strengthening the philosophical awareness of judges is essential to harmonize justice, certainty, and expediency in Indonesia’s legal system.

Abstract

This study examines the legal implications of relocating Indonesia’s capital city from Jakarta to Nusantara, particularly concerning the status and management of State-Owned Assets (BMN) that have long supported the functions of the central government. Existing regulations, such as Law No. 1 of 2004 on State Treasury and Government Regulation No. 27 of 2014 on the Management of State/Regional Assets—were not designed to anticipate a full-scale relocation of the national government. As a result, a regulatory gap emerges regarding the future of government buildings that will be vacated in Jakarta. Employing a normative juridical research method with statutory, conceptual, and analytical approaches, supported by rechtsvinding (legal discovery), this study explores potential policy options for managing state assets after the relocation. Comparative insights from Canberra, Brasília, and Putrajaya reveal several possible models, ranging from repurposing and leasing schemes to cooperative utilization and selective asset sales. The findings highlight the urgency of establishing a specific Government Regulation in Lieu of Law (Perppu) to govern asset classification, utilization mechanisms, and accountability standards to ensure transparent and effective post-relocation asset management. The study recommends the formation of a National Task Force for BMN Repurposing, the adoption of an asset classification system (A–D), the strengthening of audit mechanisms, and the mandatory publication of utilization reports as a measure of public transparency.

Abstract

This study analyzes the forms and methods of legal discovery (rechtvinding) employed by the Supreme Court Justices in Decision No. 46/K/Pdt/2006, particularly in determining the existence of an unlawful act and assessing the legal reasoning that underlies the judgment. The analysis focuses on how the judges conducted interpretation, legal construction, and the application of legal principles to address gaps or ambiguities in the norms governing civil dispute resolution. Using a normative juridical research method with a case approach, this study finds that the judges applied a combination of systematic interpretation, teleological interpretation, and legal construction through the application of expanded legal principles as developed in jurisprudence. The judges not only applied Article 1365 of the Indonesian Civil Code formally but also engaged in progressive legal discovery by assessing the substance of the defendant’s actions in light of the fundamental purpose of protecting the civil rights of the parties. The study demonstrates that the legal discovery performed in this decision reflects a shift from mere law application toward law creation oriented toward substantive justice. These findings are expected to contribute to the development of jurisprudential studies and civil adjudication practices in Indonesia, particularly concerning the formulation of the boundaries of unlawful acts through responsive and well-reasoned methods of legal discovery.

Abstract

Pancasila, as the source of all sources of law, has a central position in Indonesia's national legal system. However, the main challenge faced is how to translate the abstract values of Pancasila into concrete and operational positive legal norms. This article examines the relevance of the concept of rational natural law as a philosophical approach in interpreting Pancasila contextually in the formation of legislation. Rational natural law emphasizes the importance of reason and universal moral values as the basis for the formation of law, so that the law is not only formally valid, but also substantially fair. In the Indonesian context, Pancasila values such as social justice, fair and civilized humanity, and deliberation are consistent with the principles of rational natural law. Through this approach, Pancasila values can be transformed into legal principles that are relevant to the needs of modern society, such as the principles of proportionality, balance of interests, and protection of natural rights. This study uses a normative juridical method with a legislative approach and qualitative analysis of regulations and court decisions that reflect the application of rational natural law principles. The results of the study show that the interpretation of rational natural law in relation to Pancasila acts as a bridge between philosophical values and positive legal norms, as well as a filter against global influences so that national law continues to reflect the nation's identity.
