Abstract

AbstractIn 2020, the world was shocked by the Covid-19 outbreak that emerged from the city of Wuhan, China. This global epidemic has spread to all parts of the world, including Indonesia. More than a year of handling, new cases always appear so that the end time of this outbreak cannot be adequately predicted. The lack of cooperation and community solidarity in dealing with the epidemic is one of the contributing factors. The Qur’an, as a way of life for the majority of the Indonesian population, teaches the importance of cooperation and mutual cooperation to achieve a common goal. This paper aims to highlight human values in mutual cooperation which are analyzed using Farid Esack’s theory of Qur’an hermeneutics and see their relevance to the handling of Covid-19 in Indonesia. This study uses qualitative research methods. The data in this study were sourced from library materials such as books, journals, internet websites, and other sources related to the problems discussed. The data collection technique is by reading, studying, and understanding the materials that have been collected related to the verses of the Qur’an about mutual cooperation and the reality of handling Covid-19. The data that has been collected were analyzed using the theory of hermeneutic keys by Farid Essack and the theory of functionalism. The analysis results show that gotong royong (mutual cooperation) is an attitude taught by Islam for humankind in achieving common prosperity, regardless of ethnicity, race, culture, and religion. Abstrak Tahun 2020, dunia digemparkan dengan wabah Covid-19 yang muncul dari Kota Wuhan, China. Wabah global ini menyebar ke seluruh belahan dunia, tidak terkecuali Indonesia. Lebih dari satu tahun penanganan, kasus baru selalu muncul sehingga waktu berakhirnya wabah ini tidak dapat diprediksi dengan baik. Minimnya kerjasama dan solidaritas masyarakat dalam menangani wabah menjadi salah satu faktor penyebabnya. Al-Qur’an, sebagai way of life mayoritas penduduk Indonesia mengajarkan arti pentingnya kerjasama dan gotong-royong untuk mencapai sebuah tujuan bersama. Tulisan ini bertujuan menyoroti nilai-nilai kemanusiaan dalam gotong-royong yang dianalisis menggunakan teori hermeneutika Al-Qur’an Farid Esack dan melihat relevansinya dengan penanganan Covid-19 Indonesia. Kajian ini menggunakan metode penelitian kualitatif. Data-data dalam penelitian ini bersumber dari bahan yang bersifat pustaka seperti buku-buku, jurnal-jurnal, website internet dan sumber-sumber lain yang berkaitan dengan permasalahan yang dibahas. Teknik pengumpulan data yaitu dengan membaca, menelaah, dan memahami bahan-bahan yang sudah dikumpulkan berkaitan dengan ayat-ayat Al-Quran tentang gotong royong dan realita pada penanganan Covid-19. Data-data yang telah dikumpulkan dianalisis menggunakan teori kunci-kunci hermeneutika oleh Farid Essack dan teori fungsionalisme. Hasil analisis menunjukkan bahwa gotong-royong merupakan sikap yang diajarkan Islam bagi umat manusia dalam menggapai kesejahteraan bersama, tanpa melihat suku, ras, budaya, dan agama.

Abstract

Abstract: Maqasid sharia is still one of the exciting study themes to be studied. Because of its development, the study of maqasid discourse is still in an effort to find the ideal form of the conceptual formulation. For this reason, this study will review the correlation between the understanding of maqasid sharia and social change as a necessity in an effort to do istinbath al-ahkam. This article uses a qualitative research method that uses authoritative references as primary sources and scientific publications as secondary sources of references which are then analyzed using descriptive-analytical methods. Three main points can be concluded from this article, namely: 1) the development of thought and social change influences the istinbath al-ahkam method of cases that are waqi’iyah; 2) understanding of social changes in society based on socio-anthropological aspects both in the Nubuwwah era and today is significant in maqasidi reasoning; 3) understanding maqashid sharia and social change is very urgent (essential) for a jurist, especially for the purposes of istinbath al-ahkam so that the legal conclusions drawn do not depend on a literal understanding of the text alone; Moreover, this legal case never happened in the time of the Prophet Muhammad p.b.u.h. is still alive, and it is difficult to find the text explicitly, and the resulting law can carry the spirit of the maqasid itself, namely masalih lil ‘ibad.Keywords: Maqashid Sharia; Social Change; Istinbath al-Ahkam.Abstrak: Maqasid al-syari’ah menjadi salah satu tema kajian yang menarik untuk dikaji. Sebab dalam perkembangannya, kajian diskursus maqasid masih dalam upaya mencari bentuk rumusan konsepsi yang ideal. Untuk itu, kajian ini akan mengulas korelasi antara pemahaman atas maqasid al-syari’ah dan perubahan sosial sebagai sebuah keharusan dalam upaya melakukan istinbath al-ahkam. Artikel ini menggunakan metode penelitian kualitatif yang menjadikan rujukan-rujukan otoritatif sebagai sumber primer dan publikasi-publikasi ilmiah sebagai sumber sekunder referensinya yang kemudian dianalisa dengan metode deskriptif-analitis. Ada tiga poin utama yang dapat menjadi kesimpulan artikel ini yaitu: 1) perkembangan pemikiran dan perubahan sosial mempunyai pengaruh terhadap cara istinbath al-ahkam atas kasus-kasus yang bersifat waqi’iyah; 2) pemahaman atas perubahan sosial masyarakat yang berbasis pada aspek sosio-antropologis baik pada masyarakat era nubuwwah maupun saat ini sangat penting dalam nalar maqasidi; 3) memahami maqashid al-syari’ah dan perubahan sosial menjadi sesuatu yang sangat urgen (penting) bagi seorang ulama ahli hukum terutama bagi keperluan istinbath al-ahkam sehingga kesimpulan hukum yang diambil tidak bergantung pada pemahaman nash secara literal semata; apalagi kasus hukum tersebut tidak pernah terjadi di zaman Rasulullah masih hidup, dan sulit dicari nash-nya secara eksplisit, serta hukum yang dihasilkan dapat membawa ruh dari maqasid itu sendiri yaitu masalih lil ‘ibad.Kata Kunci: Maqashid al- Syari’ah; Perubahan Sosial; Istinbath al-Ahkam.

Abstract

In family that plays an important role in shaping the child's personality is the parent. The personality is obtained through the educational process taught by his parents. First and foremost educators for children in the family are parents because it is from them that the child first gets an education. In essence, education in the family occurs implicitly, starting with communication between family members and the daily behavior of their parents. In addition to good communication, the behavior of both parents also participate in the formation of children’s morals. Because the family is the first and primary madrasa for a child. In general, in a family environment, religious values are instilled in children to shape their behavior. Therefore, religious education in the family environment is needed to find out which boundaries are good and bad in children's daily lives. In Islam it is taught to protect the family (or children) from ignorance, even it is highly recommended not to leave the family in a weak state (educational and economic). As explained in the Qur’an surah an-Nisa’ verse 9. This paper will discuss education in the family perspective of surah an-Nisa’ verse 9. This is important to discuss to avoid the birth of a generation of the weak, both weak in education and economically. With an education in the family, it is expected to form a strong generation is facing the challenges of the times ahead.

Abstract

This article discusses the existence of MUI fatwa and its position in Indonesia. So far, people are more likely to use the fatwa law than national law. Many political interests, so that the independence of the fatwa in Indonesia, the MUI fatwa, is doubtful of its integrity. In the context of Islamic law, a fatwa is an essential presence in society, while in national law, a fatwa is only a doctrine whose status is not required to be followed. The deficient legal awareness of the community is a problem in the community because the political influence of the fatwa has a negative impact, so it is feared that it will create a negative thing that lives and develops into a civilization in society. From this writing, it can be concluded that the position of the fatwa is not required to be followed so that public awareness about the law must be socialized by the government so that people can understand. However, if the fatwa is following the constitution, the fatwa can be applied in the law so that the fatwa is not easy to be politicized by any party concerned.

Abstract

Manusia, dalam menunaikan hak dan kewajibannya terhadap sesama anggota masyarakat, tentunya tidak lepas dari ikatan ketergantungan satu sama lain. Banyak interaksi dan kerjasama yang dilakukan manusia dalam memenuhi kebutuhan hidunya. Sebagai seorang muslim yang memeluk agama Islam dalam melakukan transaksi jual beli tentunya harus sesuai dengan rukun-rukun, syarat-syarat, dan juga bentuk-bentuk jual beli yang diperbolehkan dalam ajaran agama Islam. Jual beli sudah terjadi sejak masa dahulu, namun masih bertahan hingga kini, begitupun di Desa Koto Padang. Desa Koto Padang merupakan salah satu desa yang ada di Kecamatan Tanah kampung, Kota Sungai Penuh. Desa ini mempunyai kerajinan tangan yaitu pandai besi. Para saragi sebelum memasarkan parang keluar daerah mencari dan mendatangi tukang sahoh terlebih dahulu untuk membeli parang. Pada saat terjadi transaksi, maka dengan sendirinya terjadi kesepakatan antara penjual dan pembeli. Ketika permintaan parang banyak, dengan sendirinya terjadi kelangkaan, pada saat yang bersama ada sebagian tukang sahoh yang melakukan penumpukan parang untuk meningkatkan harga. Kelangkaan parang terjadi karena banyaknya permintaan dari laur daerah sedangkan tukauh terlambat mengeluarkan pesanan parang yang dipesan oleh tukang sahoh. Pada saat jumlah parang stabil dijual dengan harga Rp. 500.000 perkodi semua tukang sahoh menjual dengan harga yang sama. Tetapi ketika terjadi kelangkaan parang, tukang sahoh yang melakukan penumpukan parang tadi, menjual dengan harga Rp. 550.000 perkodi sedangkan dia menpunyai persediaan parang yang cukup banyak dan tidak mau kurang dengan harga yang sebesar itu. Berdasarkan objek, penelitian ini adalah penelitian lapangan (field research). Penyajian data dilakukan secara naratif deskriptif. Sumber data ada dua yaitu: sumber data primer dan sumber data sekunder. Teknik pengumpulan data yang digunakan adalah observasi, wawancara, dan dokumenter. Adapun teknik analisis data digunakan adalah teknik analisis yang dikemukan oleh Miles dan Huberman dengan langkah-langkah yaitu reduksi data, penyajian data, dan penarikan kesimpulan. Hal ini penulis rasa penting untuk dikaji, melihat permasalahan tersebut dalam tinjauan hukum Islam. Setelah kajian ini dilakukan penulis berharap dijadikan sebagai bahan masukan dan pertimbangan bagi tukang sahoh dan saragi dalam melakukan jual beli parang di Desa koto Padang.

Abstract

One of the financing instruments developed by Islamic Financial Institutions (LKS) is the murabahah contract. Murabahah financing is a contract that dominates the financing process compared to other contracts. Various regulations support murabahah financing operations in LKS, such as the Fatwa of the National Sharia Council of the Indonesian Ulama Council (DSN-MUI), the Circular Letter of the Financial Services Authority, Law Number 21 of 2008 concerning Islamic Banking and various other regulations. The number of regulations that usually regulate always found multiple problems. One of them is the overlapping regulations that make a regulated object confusing policy implementers and the public. This study aims to explain the position of the murabahah contract based on the regulations that govern it to strengthen the statement of the murabahah contract in Islamic Financial Institutions. This article is legal research that uses a juridical-normative approach. Data analysis techniques used are data reduction, data presentation, and drawing conclusions. The results of the analysis show that there are various regulations governing murabahah financing. The substance of the regulation refers to the fiqh muamalah maliyyah, which was transformed into the Fatwa of the MUI DSN. From these various regulations, there is a harmonization of regulations that are mutually complementary to each other, according to their functions. This is an indication of the harmonization that occurs between Indonesian Sharia Bank (BSI) regulations.

Abstract

Berbagai promo dan iklan yang ditawarkan marketplace berimplikasi terhadap minat masyarakat untuk belanja online. Dengan berbagai macam promo dan iklan tersebut, terlihat adanya kontestasi antar marketplace untuk menarik minat pembeli, baik Tokopedia, Shopee, Bukalapak, Lazada, dan Blibli. Penelitian ini membahas tentang kontestasi antar marketplace dalam melakukan promo dan iklan dalam dunia digital pada era pandemi covid-19. Penelitian ini bertujuan untuk melihat kontestasi yang terjadi antara berbagai macam marketplace dalam melakukan strategi promo maupun iklan di dunia digital. Artikel ini menggunakan metode penelitian kualitatif yang bersifat pustaka. Teknik analisis yang digunakan adalah teknik analisis yang dikenalkan oleh Miles dan Huberman yaitu reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan kontestasi marketplace yang sudah tersistem menjadi sebuah kontestasi yang positif dalam rangka mempertahankan dan menumbuhkan ekonomi masyarakat di era pandemi saat ini.

Abstract

Abstract: This paper discusses fuqaha's view of the mudharabah system in fiqh and Islamic banking. This discussion is critical because the mudharabah contract is one of the contracts that can help the community in conducting economic transactions through Islamic banking. This article aims to oversee the mudharabah contract in fiqh and the mudharabah system in Islamic banking. The research method used is the library research method. The research data used is qualitative. The collection is carried out from several sources for reference, such as books, both online and in print, scientific articles downloaded from journals, fatwas from the National Sharia Council of the Indonesian Ulama Council (DSN-MUI), regulations from the Financial Services Authority (OJK) and other data sources. Data analysis techniques used are data condensation, data presentation, and concluding. The results of the analysis show that the mudharabah contract, according to the majority of Fuqaha, is a contract made by two parties who interact with each other, and one of them becomes the investor and surrenders his assets to share/manage, and the profits will be divided according to what has been determined. In Islamic banking, the mudharabah contract is divided into two forms: a system and a product.

Abstract

This research was conducted with the aim of exploring the content of Al-Quran surah al-’Asr and contextualizing it in order to respond to phenomena in millennial generation that are increasingly inseparable from communication activities through digital technology (social media) especially gadgets. Carefully public relations and gadgets have changed many settings ranging from moral values, culture, mindset, and so forth. In addition to the various benefits, the existence of social media has also been a trigger for various social problems that are counter to peace. Against this background, in this study, the authors sought to examine the Surah al-’Asr, whose contents will be formulated to be guidelines for how smart in optimizing social media. This qualitative research will use the Al-Quran hermeneutic approach that was initiated by Fazlur Rahman, namely the double movement theory. This method emphasizes to find universal values ​​so that the results of interpretations are progressive and can be applied in various contexts of space and time. From this research, it was obtained that Surah al-’Asr, if contextualized, could be obtained from him three moral ideals as proposed by Rahman. If all three are embedded in the consciousness of every human being, then this can be a solution for world peace. In the context of social media efforts that can be done is to optimize it as efficiently and effectively as possible for good and usefulness and to convey all things that are not contrary to the truth and human values.

Abstract

It becomes a dilemma when Muslim communities cannot apply Islamic criminal law. In fact, a law is not only to be understood but also believed to be true by Muslims themselves. So, it is appropriate that the punishment for adultery is less likely to have a deterrent effect on the perpetrator. This is because, apart from conventional criminal law being poorly understood by the Muslim community, the sanctions are also quite light so that the deterrent effect desired by law enforcers cannot be realized. This research aims to analyze adultery law by applying linguistic approaches and ushul fiqh to adultery law. This type of research is normative law using a language and ushul fiqh approach. The data sources were primary and secondary, while data collection techniques were observation and literature study. The results of this research show that adultery is analyzed using a language and ushul fiqh approach is the perpetrator of a criminal act who deliberately commits the elements of inserting male genitalia into female genitalia (in intercourse), which is unlawful according to the substance of the act, not because subḥāt and women bring lust. The punishment for adultery is to jilīd one hundred times. This penalty can be applied if the legal action has been legal before the court by presenting four witnesses. The stipulated punishment cannot be changed with other types of punishment because the punishment is regulated by the text of the Al-Quran.
