Abstract

This publication discusses the thought of ushul fiqh Mu’tazilah in the book of Raudhot an-Nadzir wa Jannat al-Manadzir written by Ibnu Qudamah. The book is the summary of Al Mustashfa written by Imam Al Ghozali. Al Mustasfha contains diction which is not easily understood. It relates with the method used by Imam Al Ghazali namely method of Al-Mutakallimin. Therefore, book of Raudhot an-Nadzir wa Jannat al-Manadzir discusses the thought of ushul fiqh Mu’tazilah. The method of the research was qualitative method. It can be identified that Ibnu Qudamah adopts the thought of Al Ghozali without putting down his name in his book. In this book, Ibnu Qudamah sometimes has the same and different opinion with Al Ghozali. However, they also have same thought with different sampling cases. The thought of ushul fiqh Mu’tazilah influences the method of contemporary ushul fiqh. One of the influences is a human freedom to do ijtihad with the right to create their own fate. There is also a difference between old and new Mu’tazilah.  In the old perspective, the law consideration is about God (theocentric). Meanwhile, in the new perspective, the law consideration is about human (anthropocentric) يبحث في هذه النشرة عن آراء المعتزلة الأصولية التي أوردتها ابن قدامة خلال كتابه روضة الناظر وجنة المناظر لما كان هذا الكتاب مختصرا من كتاب المستصفى في علم الأصول لأبي حامد الغزالي فقد عرض كثير من عبارته بغموض وإبهام. هذا لا يخرج عن كون الغزالي نهج منهج المتكلمين في كتابة المستصفى. لهذا قد تميز روضة الناظر بآراء المعتزلة الأصولية. سلك الباحث منهج كيفي تبين من البحث أن ابن قدامة مهما كان أخذ كثير من آراء الغزالي في كتابه، وهو لم يذكر اسم الغزالي قط خلال كتابه، وافق الغزالي تارة وخالفه تارة، أو وافقه في المعنى وخالفه في الأمثلة. وآراء المعتزلة الأصولية لها تأثير كبير في مناهج الأصولية المعاصرة، منها أن باب الاجتهاد فتح بشكل واسع للحرية الأفعال الإنسانية، وجود الفروق بين مبنى الفكرة المعتزلة القدماء بمن يدعى أنه المعتزلة بثوبها الجديد. أن المعتزلة القدماء يجعلون الإله محور كل شيء، أما المعتزلة المعاصرة فإنهم جعلوا الإنسان محور كل شيء.

Abstract

The study discusses the settlement of sharia economic bankruptcy disputes from the perspective of Ibn Rushd Al-Qurtubi. As someone who had a career in the world of Islamic courts in his day, Ibn Rushd had many reflective records of the disputed cases he handled. The phenomenon of resolving bankruptcy disputes experienced by Ibn Rushd at that time was also experienced by most Muslims today, especially seeing that many companies went bankrupt due to the pandemic, so that Ibn Rushd's character, especially ijtihad in resolving bankruptcy disputes, needs to be the primary basis of this research. This study is pure library research and the material used as the primary data source is the book Bidayatul Mujtahid wa Nihayatul Muqtashid. From the results of the research, it is known that even though Ibn Rushd is a Maliki school of thought, in some cases, he puts forward objectivity by using analytic tools to conclude a legal product, even though in settlement of bankruptcy disputes, he is more dominantly inclined to strengthening the Maliki school. Bankruptcy dispute cases that existed in the era of Ibn Rushd, although using a simple transaction background, can be analogous to cases of dispute resolution at this time by prioritizing the similarity of illat (rational reasons), which combines two different cases so that the development of fiqh law goes well without the presence of rigidity.

Abstract

This study analyzed the epistemological theory of Ushul Fiqh, which is currently devoid of the interest of enthusiasts of the fundamentals of jurisprudence and followers of the philosophy of science. Given the demands to use this science cannot be separated from the development of his epistemology. For reference, this study evokes Al-Ghazali who has historically been a representative figure as a representative of classical thinkers. The data presented in this study are taken from the main source, Al-Mustasfa's book from the science of Ushul. This study concluded that Al-Ghazali's ushul fiqh epistemology is deductive rationality, very clearly reject non-rational arguments let alone metaphysics. Al-Ghazali has assumed that the senses can be used as a source of knowledge, Illustrated in three models of thinking, which are semantic thinking based on linguistic principles.Kajian ini menganalisis teori epistemologis ushul fikih, yang saat ini sepi dari minat peminat dasar-dasar fikih dan pengikut falsafah sains. Mengingat tuntutan untuk menggunakan ilmu ini tidak lepas dari perkembangan epistemologinya. Sebagai referensi, kajian ini membangkitkan Al-Ghazali yang secara historis merupakan sosok yang representatif sebagai wakil dari para pemikir klasik. Data yang disajikan dalam penelitian ini diambil dari sumber utama yaitu kitab Al-Mustasfa dari ilmu Ushul. Studi ini menyimpulkan bahwa epistemologi ushul fikih Al-Ghazali adalah rasionalitas deduktif, sangat jelas menolak argumentasi non-rasional apalagi metafisika. Al-Ghazali beranggapan bahwa indera dapat digunakan sebagai sumber ilmu, tergambar dalam tiga model pemikiran, yaitu berpikir semantik berdasarkan kaidah kebahasaan.

Abstract

Due to the corona virus's fall in different economic areas, many individuals have difficulties fulfilling their basic demands. Urban farming is one of the answers to food availability, and their primary concerns are food safety, food pricing, and stimulating the local economy. People cultivated short-lived crops in tiny pots or used the hydroponic method in their yards. Integrated urban farming is a type of green economic activity that adheres to maqasid sharia's maslahah aim. Field research is used to gather essential data. It is conducted on the site to be studied and supplemented with field data in the form of interviews. This study is descriptive, with an emphasis on analysis using a logical method. The green economy with integrated urban farming aims to improve the community's economic well-being and can help mitigate the risk of substantial environmental harm, including the pandemic's detrimental impact on macro and micro food security. It can be observed that the green economy concept can be integrated with the pure maqasid sharia values harmoniously.

Abstract

This service activity is carried out to bridge the importance of saving and sacrificial facilities for Muslim congregations from the As-Shaykh Jabir Al-Faifi Mosque, Ngasem Village, Colomadu District, Karanganyar Regency, Central Java. Assistance is carried out by previously holding deliberations with the Mosque Prosperity Council to prepare a design for a savings and joint sacrifice scheme which will then be disseminated to local Muslims through the Rukun Neighbor forum and studies at the mosque. The method used to explore and understand the couple's problems is an observation of related informants and documentation. Data analysis used triangulation of data sources. The results of this activity indicate that there is an increase in the enthusiasm of residents in carrying out Qurban worship after the existence of savings products and qurban joint ventures, as can be seen from the increase in the registration of Qurban participants by 60%.

Abstract

This research is helpful to provide knowledge and reference sources on how to invest in stocks with a scalping trading strategy based on Islamic law, and investors can use it as the basis of Islamic law when investing in stocks with a scalping trading system. This research aims to determine how to invest in stocks using the scalping trading method and how to review Islamic law regarding scalping trading stock investment practices. This research used qualitative method, combines a deductive strategy with a descriptive approach to comprehensively represent the transaction process based on Islamic law. The supporting source for this research is derived from books, journals, and previous research. According to the findings of this research, the practice of investing in stocks using the scalping trading method is prohibited if stock transactions do not involve Islamic stocks. The stock transactions are based on an individual's advice and do not utilize the Sharia Online Trading System (SOTS). However, it is acceptable if the scalper analyses the stock transaction beforehand. This research suggests that people who wish to invest in stocks using the scalping method should use an account or system based on the Sharia Online Trading System (SOTS) and classify their stocks as Islamic stocks to avoid engaging in prohibited practices under Islamic law.Penelitian ini bermanfaat untuk memberikan pengetahuan dan sumber referensi tentang cara berinvestasi saham dengan strategi perdagangan scalping berdasarkan hukum Islam, dan investor dapat menggunakannya sebagai dasar hukum Islam ketika berinvestasi pada saham dengan sistem perdagangan scalping. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana praktik investasi saham dengan metode perdagangan scalping dan bagaimana tinjauan hukum Islam terhadap praktik investasi saham dengan metode perdagangan scalping. Penelitian ini menggunakan metode kualitatif, dengan pendekatan deduktif-deskriptif untuk memberikan representasi secara utuh sehingga proses transaksi berdasarkan hukum Islam dapat direpresentasi secara integral. Sumber referensi dari penelitian ini bersumber dari buku, jurnal, dan penelitian terdahulu sebagai pendukung penelitian. Hasil dalam penelitian ini adalah praktik investasi saham dengan metode perdagangan scalping dilarang jika transaksi saham tidak termasuk dalam saham syariah. Transaksi saham yang dilakukan mengikuti rekomendasi dari pihak tertentu dan tidak menggunakan Syariah Online Trading System (SOTS). Namun, diperbolehkan jika scalper terlebih dahulu melakukan analisa terhadap transaksi saham. Penelitian ini menyarankan agar masyarakat yang ingin berinvestasi saham dengan metode perdagangan scalping hendaknya menggunakan akun atau sistem yang berdasarkan Syariah Online Trading System (SOTS) serta mengklasifikasikan saham kedalam kategori saham syariah agar terhindar dari praktik yang dilarang oleh syariat Islam.

Abstract

This study aims to determine the direction of development of Islamic finance research during the pandemic, focusing on the growth of international publications in the field of Islamic finance in the Scopus database between 2020 and 2022. Bibliometric mapping consists of core journals in international publications in the field of Islamic finance, the productivity of researchers in the field of Islamic finance, the number of publications based on institutional collaboration in international publications in the field of Islamic finance, the development of international publications on research in the field of Islamic finance by subject/field, and a map of the development of international publications on research in the field of Islamic finance.

Abstract

Penelitian ini bertjuan untuk mengetahui perkembangan arah riset perbankan Islam pada masa pandemi tahun 2020-2022. Metode yang digunakan adalah bibliometrik dengan melakukan pemetakan bibliometrik pada publikasi jurnal terindek Scopus mencakup jurnal inti dalam publikasi berdasarkan kolaborasi lembaga dalam publikasi internasional di bidang perbankan Islam, produktivitas peneliti bidang perbankan Islam, jumlah publikasi berdasarkan kolaborasi lembaga dalam publikasi internasional bidang perbankan Islam berdasarkan bidang atau subjek dan peta perkembangan publikasi internasional penelitian bidang keuangan Islam berdasarkan kata kunci dan pengarang.
