Abstract

Domestic violence remains a pervasive social and legal issue in Indonesia, particularly in Batam City, despite existing legal frameworks. This study aims to analyze the effectiveness of resolving domestic violence cases through restorative justice at the Batam City Prosecutor’s Office and to identify factors influencing its implementation. Employing an empirical legal research method with a juridical-sociological approach, data were collected through interviews, observations, and document analysis. The results reveal that while restorative justice provides a humane and efficient alternative to conventional prosecution—prioritizing victim recovery, offender accountability, and the restoration of social harmony—its application faces challenges. These include limited regulatory authority, punitive mindsets among law enforcement, and low public awareness. However, supporting factors such as an established legal basis, positive prosecutorial attitudes, and community involvement contribute to its success. The study concludes that restorative justice is a viable, progressive approach to addressing domestic violence cases. Sustainable implementation requires regulatory refinement, professional training, and cultural shifts toward restorative principles.

Abstract

The electronic licensing transformation through the OSS system in Indonesia faces administrative dysfunction caused by the collision of institutional sectoralism and regional autonomy. This contradicts the governance efficiency of the MalaysiaBiz ecosystem in Malaysia, which operates more adaptively. This research aims to compare the electronic licensing regulatory framework in both countries and formulate a digital administrative governance reconstruction strategy in Indonesia. Employing a normative legal method with statute, comparative, historical, and conceptual approaches, this study examines primary legal materials comprising Law Number 6 of 2023 and the Companies Commission of Malaysia Act 2001. The research results indicate that Indonesia’s licensing architecture rests upon a rigid rule-based approach with ex-ante supervision. Conversely, Malaysia’s efficiency is based on a precise separation between centralized entity registration and local licensing authorities, supported by a strict ex-post compliance audit system. Addressing this gap, this research recommends the implementation of a hybrid regulatory approach for Indonesia’s licensing governance. In the upstream phase, reduce authority fragmentation and regional autonomy impediments by applying the deemed approval instrument. In the downstream phase, this policy must be counterbalanced by the establishment of a cross-authority sanction ecosystem between the OSS management and the Ministry of Law to execute the striking off the register sanction for spatial planning violating corporations. This hybrid approach, contingent on equalizing digital infrastructure, is expected to uphold the supremacy of the legal certainty principle while enhancing Indonesia’s investment competitiveness in the ASEAN economic integration era.

Abstract

The central legal problem of this study lies in the normative inadequacy and weak enforcement construction of the right to be forgotten within the personal data protection regimes of Indonesia and Thailand amid escalating data breaches in Southeast Asia. This research aims to analyze and compare the normative framework governing the right to be forgotten in Indonesia and Thailand with selected global benchmarks, namely the European Union, South Korea, and the United States, in order to formulate ideal legal constructs adaptable to Southeast Asian contexts. This study employs a normative legal research method supported by a comparative legal approach, examining statutory regulations and secondary legal materials from Indonesia, Thailand, the EU (GDPR), South Korea (PIPA), and the United States (CCPA). The findings reveal that although Indonesia’s Personal Data Protection Law and Thailand’s Personal Data Protection Act formally recognize deletion rights, both frameworks remain incomplete due to limited procedural clarity, weak dispute resolution mechanisms, insufficient third-party deletion obligations, and ambiguous safeguards against re-identification risks. In contrast, the EU’s GDPR mandates third-party takedown obligations and imposes severe financial sanctions, South Korea’s PIPA provides strict deletion duties combined with criminal penalties, and the CCPA establishes structured compliance and notification mechanisms. Consequently, strengthening enforcement pathways, clarifying procedural guarantees, and integrating stricter controller obligations are essential for Indonesia and Thailand to ensure effective realization of the right to be forgotten in rapidly expanding digital societies.

Abstract

Indonesia's agricultural sector has been ridden with stagnation and mismanagement, contrasting Singapore, which despite the lack of potential, has been able to facilitate its agricultural sector to thrive while aligning with sustainability. In this context, Indonesia's Plant Variety Protection (PVP) Law represents an IPR regime that can be analyzed further to explore the potential of helping Indonesia tackle climate change. This research analyzes the legal capacity of Indonesia’s PVP regime to integrate climate action initiatives, which provides a novel perspective by bridging intellectual property rights and sustainability, with the added comparative angle of Singaporean perspective. The findings of this research indicate that Indonesia's PVP regime is outdated and ill-equipped to accommodate the regime’s inherent potential in being a part of the climate action. In contrast, Singapore boasts a more robust legal framework that has facilitated the growth of its modern agricultural sector, despite resource constraints, along with the lack of direct normative connection between sustainability and the PVP regime, due to supporting normative architectures. The perspective from Singapore represents a potential model for Indonesia to consider as it seeks to enhance its PVP regime and align it with broader climate change mitigation strategies.

Abstract

The Micro, Small and Medium Enterprises (MSMEs) sector has a significant role in Indonesia's economic development and is considered the main pillar of the national economy. The legal umbrella has been formulated by the government to protect the existence of MSMEs in carrying out their activities such as the distribution of Micro Business Credit (KUM) and People's Business Credit (KUR). However, there are still obstacles such as bad credit or Non-Performing Loan (NPL) which is a challenge in itself, so that the principle of prudence in banking needs to be enforced to manage the risk of bad credit as regulated in Law Number 10 of 1998 concerning Banking and confirmed in Bank Indonesia Regulations in order to maintain banking system stability and realize economic justice. This research uses empirical legal research method where the main focus is to analyze the effectiveness of the implementation of prudential banking principles in the distribution of equitable MSME loans in Batam City. The result of the research shows that there is a high commitment from the banks in Batam City in implementing the prudential principle through thorough and continuous evaluation of the legality, financial capacity, and collateral of prospective debtors, as well as regular monitoring of the development of MSMEs. These measures help maintain the Non-Performing Loan (NPL) ratio and support the sustainability of MSMEs in Batam City.
