Abstract

Corruption is a multidimensional challenge that hampers economic, social and political development in Indonesia. Legislative policy plays a key role in efforts to overcome criminal acts of corruption, by providing a legal framework that becomes the basis for law enforcement. This research aims to analyze the influence of legislative policies in tackling criminal acts of corruption in Indonesia, evaluate obstacles in their implementation, and identify strategies to increase their effectiveness. This research uses a qualitative approach with a literature review method, examining various legal documents, reports from related institutions, and academic literature. The research results show that legislative policies, such as Law no. 31 of 1999 jo. Law no. 20 of 2001 concerning the Eradication of Corruption Crimes, played a significant role in establishing anti-corruption institutions, such as the Corruption Eradication Commission (KPK), and provided a strong legal basis for law enforcement. However, the effectiveness of this policy faces obstacles in the form of systemic corruption, political resistance, weak inter-institutional coordination, and policy revisions that weaken the independence of anti-corruption institutions. This research also found that transparency in the legislative process, strengthening the monitoring system, and increasing community participation are strategic steps to support anti-corruption policies. This research concludes that the success of legislative policies in eradicating corruption depends on strong political commitment, the integrity of law enforcement, and active community participation. By overcoming existing obstacles, legislative policies can become a more effective instrument in realizing clean and transparent governance.

Abstract

Platform digital, seperti e-commerce, ride-hailing, dan layanan pemesanan online, telah mengubah cara konsumen dan penyedia layanan berinteraksi. Konsumen dapat dengan mudah mengakses berbagai layanan dan produk dari berbagai tempat tanpa batasan geografis. Namun, dengan kemudahan tersebut muncul berbagai masalah, seperti penipuan, produk yang tidak sesuai deskripsi, layanan yang tidak memenuhi standar, hingga penyalahgunaan data pribadi konsumen. Oleh karena itu, peran hukum dalam mengatur kewajiban penyedia layanan dalam bisnis platform digital menjadi sangat penting untuk melindungi konsumen dari potensi risiko yang ada dalam ekosistem digital ini. Berdasarkan latar belakang di atas, maka identifikasi masalah pada penelitian ini ditetapkan sebagai berikut: Bagaimana efektivitas regulasi yang ada saat ini dalam memberikan perlindungan hukum bagi konsumen dalam perdagangan elektronik di Indonesia? Apa saja tantangan yang dihadapi dalam proses transformasi regulasi perdagangan elektronik untuk meningkatkan perlindungan konsumen di Indonesia? Bagaimana peran dan kontribusi pemerintah serta pelaku usaha dalam mengimplementasikan regulasi perdagangan elektronik untuk menciptakan ekosistem perlindungan konsumen yang lebih baik? Metode penelitian: Penelitian ini menggunakan penelitian hukum normatif. Penelitian hukum normatif disebut juga penelitian hukum doktrinal. Pada penelitian doktrinal, hukum dikonsepkan sebagai apa yang tertuliskanperaturan perundang-undangan (law in books). Penelitian hukum normatif yaitu penelitian yang dilakukan atau ditujukan hanya pada peraturan-peraturan yang tertulis atau bahan-bahan hukum yang lain karena penelitian yang diteliti berdasarkan pada peraturan perundang-undangan yaitu hubungan peraturan yang satu dengan peraturan yang lain serta kaitannya dengan penerapannya dalam praktik. Analisis yang digunakan adalah kualitatif yaitu menganalisis data penelitian untuk selanjutnya dikaji secara mendalam dan diinterpretasikan oleh peneliti untuk mendapatkan kesimpulan yang diharapkan. Hasil penelitian: pengawasan terhadap pelaku usaha dalam perdagangan elektronik masih belum optimal. Banyak konsumen yang melaporkan adanya penipuan, barang yang tidak sesuai deskripsi, hingga kerugian akibat data pribadi yang disalahgunakan, namun penanganannya sering kali lambat atau tidak tuntas  sehingga terkesan proses hukum dalam menangani kasus ini tidak Berjalan. Program literasi digital yang lebih intensif di tingkat konsumen sangat diperlukan untuk meningkatkan pemahaman mereka tentang transaksi elektronik yang aman dan memberikan perlindungan konsumen dapat optimal sehingga bisa menjawab dari tantangan tersebut. Kolaborasi antara pemerintah dan pelaku usaha sangat diperlukan untuk menciptakan ekosistem yang mendukung perlindungan konsumen. Pemerintah dapat memberikan pelatihan dan edukasi kepada pelaku usaha mengenai regulasi terbaru, sementara pelaku usaha dapat memberikan masukan kepada pemerintah mengenai regulasi yang lebih praktis dan mudah diterapkan di lapangan.

Abstract

Narcotics are substances or drugs derived from plants or non-plants, either synthetic or semi-synthetic, which can cause decreased or altered consciousness, loss of feeling, reduced or even eliminated pain, and can cause dependency. Drug abuse in Indonesia has reached a very worrying stage. Drugs no longer recognize age limits , old people, young people, teenagers and even children are users and dealers of illegal drugs. The illegal distribution of drugs in Indonesia is no less worrying, drugs are not only circulating in big cities in Indonesia, but have also penetrated into small areas. The problem raised in this study is the role of the North Sumatra regional police in uncovering narcotics crimes. The type of research used is empirical legal research with conceptual approach methods, legislative approaches, and sociological approaches. The types of data are primary data and secondary data, while the data sources for this study come from the results of interviews with respondents and informants. It was concluded that the role of the North Sumatra Regional Police in disclosing narcotics crimes is that the police conduct counseling in schools, install banners, pamphlets on the highway, carry out patrols and police operations. Furthermore, the police enforce the law starting from the investigation stage to the transfer of cases to the District Court while still referring to Law No. 2 of 2002 concerning the Police and other related regulations. The obstacles faced by the North Sumatra Regional Police are: Community factors, Limited Human Resources, Limited operational funds and Law enforcement factors .

Abstract

This article proposes to review the handling of corruption cases in terms of juridical and morality in Indonesia. This study is a normative legal study with descriptive analysis. This study uses a philosophical approach and a conceptual approach to determine the efforts made by the government to overcome corruption in Indonesia from the juridical and moral aspects of the Indonesian people based on the Pancasila Ideology. Efforts to eradicate corruption have not been able to be overcome optimally because they are spread sporadically in Indonesia. Obstacles are occurring structurally, culturally, instrumentally and management. Prevention and eradication of corruption must be emphasized as the moral responsibility of the Indonesian people. Because it will be one of the biggest threats to the existence of the Indonesian nation. Prevention of corruption must be carried out systematically by strengthening regulations and conducting international cooperation on the issue of corruption as a crime against Human Rights throughout the world, especially in Indonesia. That aspect of law enforcement in eradicating criminal acts of corruption requires the role of all parties involved in achieving the target of eradicating corruption that is rampant in Indonesia, there are four factors causing corruption; political and legal factors, historical factors, social factors and cultural factors, and economic factors. Concrete solutions in eradicating corruption are needed by Indonesia to redesign public services, strengthen transparency, supervision and sanctions against government activities related to the economy and human resources, increase the empowerment of supporting instruments in preventing corruption and to ensure that law enforcement is free from corruption. The strategy to eradicate corruption must be built with the will of all parties who want to eradicate corruption itself, by not giving the slightest tolerance in the act of corruption itself. In realizing an effort to eradicate corruption itself, it requires determination in meeting the prerequisites in terms of existence driven by political ability and will and a strong commitment from all parties, transparent and accountable in its implementation, available and balanced resources and capacity.

Abstract

Examination of a criminal case in a judicial process essentially aims to find the material truth, namely the complete truth of a criminal case by applying the provisions of criminal procedural law honestly and in a timely manner with the aim of finding out who the perpetrator is who can be charged with committing something. violation of law. Making a post mortem et repertum gives the full duty to the doctor as an implementer in the field to assist the prosecutor in determining the direction of the charges that will be brought against the defendant, as well as assisting the judge in finding the material truth in deciding the criminal case. This research includes normative legal research, so the legal materials used are primary, secondary and tertiary legal materials. The technique for collecting legal materials that will be used as a source in this research is library research, namely collecting legal materials by reading statutory regulations, official documents, journals, articles from the internet, and other literature that is closely related to The issues discussed are based on secondary legal materials. The presence of the Pretrial Institution provides a warning that law enforcers must be careful in carrying out their legal actions and every legal action must be based on applicable legal provisions, meaning that they must be able to exercise restraint and distance themselves from arbitrary actions. Thus, it is clear that organizing pretrial proceedings is not an easy task considering that the activities of one law enforcement agency to assess and test the work patterns of other law enforcement agencies is definitely work that must be carried out carefully and mastering all law enforcement mechanisms. The judiciary in Indonesia, one of whose tasks is to examine laws against the constitution, is what we often call judicial review. This judicial review is carried out to protect the rights of citizens who feel disadvantaged by the enactment of a law. In this case, what concerns the author is the judicial review of article 77 of the Criminal Procedure Code, which in this article is felt to be detrimental to someone who is designated as a suspect by investigators, because the article does not regulate the determination of suspects as pre-trial objects.

Abstract

The crime of terrorism is an act that uses violence or the threat of violence to create an atmosphere of terror or fear on a widespread basis, aimed at people or groups of people, or damaging public facilities with ideological, political, or security objectives. Terrorism is characterized as an unlawful act committed systematically with the aim of destroying or disrupting the sovereignty of the nation and state. This means that terrorism is not just an ordinary crime but also has ideological or political goals and is carried out by means of violence that makes people feel afraid or panic. Law of the Republic of Indonesia Number 5 of 2018 on the Amendment to Law Number 15 of 2003 on the Eradication of the Criminal Acts of Terrorism provides a more detailed definition of the criminal act of terrorism, including various acts of preparation, attempt, assistance, and the execution of the terrorist act itself. There are various forms of acts of terrorism in Indonesia and there are efforts to prevent criminal acts of terrorism, namely through deradicalization, which is a proactive step and requires caution with consideration of the plurality of Indonesian society and the vulnerability of plurality to social conflict in society.

Abstract

Tujuan penelitian ini adalah untuk menganalisis pengaturan hukum terhadap imigran ilegal di Indonesia dan analisis mengenai penanganan yang dilakukan Pemerintah Republik Indonesia terhadap adanya imigran ilegal. Metode penelitian ini menggunakan yuridis normatif. Problem imigran gelap tidak hanya dipandang dari aspek hukum secara normatif, namun lebih dari itu persoalan imigran adalah persoalan nasib manusia yang ingin mendapatkan kehidupan yang layak dan bermartabat di negara lain. Jika inilah yang menjadi persoalan maka persoalannya bisa dipahami dari aspek kemanusiaan. Tapi jika persoalan imigran adalah dilakukan oleh orang-orang yang akan melakukan kejahatan dan sejenisnya,maka inilah yang perlu mendapatkan penanganan hukum yang serius sampai akhirnya pada proses deportasi ke Negara asal. Faktor adanya imigran gelap ini adalah karena posisi geografis Indonesia yang strategis sebagai penghubung antar kawasan Asia Tengah dan Timur Tengah dengan Australia dalam pergerakan arus migrasi ini menyebabkan Indonesia menjadi wilayah transit yang banyak dilalui oleh para imigran gelap tersebut. Indonesia yang bentuk negaranya adalah kepulauan secara geografis memiliki banyak pintu masuk: bandara, pelabuhan, batas, darat dan perairan. Selain itu, Indonesia yang juga memiliki garis pantai yang sangat panjang, dan merupakan wilayah yang terletak pada posisi silang jalur lalu lintas. Perhatian Pemerintah Indonesia yang cukup besar dalam penanganan imigran gelap seperti pemberian fasilitas tempat tinggal sementara. Adanya pantai selatan menjadi salah satu daerah sangat strategis di Indonesia yang dipakai tempat transit para imigran gelap untuk menyebrang ke Pulau Christmas, Australia. Hal itu sehubungan, jarak antara pantai dan lain-lain merupakan faktor pendukung lain dipilihnya Indonesia sebagai wilayah transit.

Abstract

Casualties of pawned car theft are ensured by both criminal and respectful laws. The criminal component empowers casualties to get remuneration or the return of their automobiles whereas requiring the law to incur serious punishments on the guilty parties. In terms of the respectful component, casualties are entitled to sue for harms. In any case, victims find it challenging to realize their rights because lawful hone is regularly incapable. The court within the case ponder of choice No. 130/Pid.B/2024/PN Mdn was less resolved in maintaining the law against those who benefited from the benefits of wrongdoing and sentenced the casualty without taking into consideration their proprietorship rights to the pawned thing.
