Abstract

Organizational culture has become an important element to determine the success of organizations in various sectors. This research aims to analyze the relationship between organizational culture and organizational performance through a comprehensive literature review. With reference to key theories such as Schein's model, Denison, and Barney's competitive framework, this study explores the influence of culture on innovation, employee engagement, and adaptation to changes in the business environment. The analysis shows that a strong organizational culture that is relevant to operational needs can improve performance through various mechanisms, such as strengthening organizational identity, encouraging innovation, and building collaborative relationships across departments. However, challenges such as resistance to change, cultural gaps, and external pressures add complexity to managing organizational culture. Across sectors, culture performs different strategic functions, from driving efficiency in manufacturing to strengthening the culture of innovation in the technology sector. This research concludes that organizational culture becomes an internal element, and a strategic tool to achieve sustainable competitive advantage. Organizations that are able to leverage their culture adaptively and innovatively have a greater chance of surviving and thriving in the global market.

Abstract

Psychological Capital (PsyCap) has become a key concept in human resource management that focuses on its influence on individual job performance. This study uses a literature review approach to analyze the relationship between PsyCap and job performance. The results show that PsyCap, which consists of four dimensions, namely hope, self-efficacy, resilience, and optimism, contributes significantly to improving job performance. The hope dimension provides motivation to design clear goals, self-efficacy increases confidence to complete tasks, resilience helps individuals bounce back from failure, and optimism encourages a positive view of the expected results. The study also revealed that the implementation of PsyCap in the workplace still faces challenges, especially in terms of developing structured training programs and cultural context relevance. However, with strong management support and a positive organizational culture, PsyCap can be leveraged as strategic capital to improve individual productivity and organizational competitiveness. This research concludes that PsyCap is a valuable psychological capital for individuals, and as a tool that can be optimized to support organizational success in the modern era.

Abstract

Business competition in the digital era presents new challenges for startups in Indonesia, such as the dominance of large platforms, algorithmic discrimination, and the lack of digital infrastructure. Law Number 5 of 1999 as the legal basis for business competition has not fully accommodated technological developments such as algorithms, big data, and the digital ecosystem. This research analyzes the application of competition regulations to startups in the digital era, focusing on challenges such as market access inequality and the lack of legal education. Additionally, this research explores opportunities such as the use of disruptive technology and collaboration between startups and regulators. With a normative-empirical approach, this research examines the relevance of current regulations and provides strategic recommendations to create a fair and sustainable digital business ecosystem. The research results indicate that revising regulations to be responsive to the digital era is essential to support healthy competition and innovation in the startup sector.

Abstract

The detention and release of detainees is an essential part of Indonesia's criminal justice system that demands a balance between law enforcement and human rights protection. Although Law No. 8 of 1981 concerning the Criminal Procedure Law (KUHAP) has provided a normative basis for detention procedures, the phenomenon of detention without legal procedures and the release of prisoners that do not comply with administrative standards is still often found in practice. Weak supervision, confusion of legal interpretation, and disharmony between technical regulations at the police, correctional and judicial levels have led to violations of prisoners' rights. This study uses a normative juridical approach to examine the effectiveness of the implementation of detention rules and detainee releases, as well as identify the factors causing deviations from the principles of due process of law. The findings suggest that there is an urgent need to tighten standard procedures, strengthen oversight, improve interagency coordination, and provide legal education to stakeholders. Reforms in the governance of detention and detention release are urgently needed to ensure justice and legal certainty, as well as to create a national criminal justice system that is more effective, transparent, and upholds human rights

Abstract

This study analyzes and evaluates the implementation of the juvenile criminal justice system in Indonesia based on Law No. 11/2012 on the Juvenile Criminal Justice System (UU SPPA), with an emphasis on protecting the rights of children in conflict with the law. Protection of children is a crucial issue, given that children are a vulnerable group prone to exploitation, violence, discrimination, and psychological risks in the conventional criminal justice system, which still has a retributive tone. Legal reform through the UU SPPA has changed the approach to resolving children's cases from repressive to more humane and restorative, including through diversion mechanisms and restorative justice that prioritize the recovery, rehabilitation, and guidance of children rather than punishment alone. This study uses a normative legal method with a literature review of regulations, national and international legal documents, and previous research results. The study results show that the principle of the best protection for children integrated in the SPPA Law has provided a new direction in the juvenile criminal justice system in Indonesia, although its implementation still faces various challenges. These challenges include inconsistencies in understanding and implementation by law enforcement officials, limited resources, insufficient institutional support, and public perceptions that are sometimes still retributive. Future efforts to strengthen the system should focus on ensuring consistent fulfillment of the best interests of the child.
