Abstract

The phenomenon of oversharing on social media has become a significant issue in the digital age, where individuals often over-share personal information without regard to its impact. In the context of Islamic law, privacy is a fundamental value that must be maintained to protect the honor and dignity of individuals. However, research linking privacy principles in Islamic law with privacy challenges in social media is still limited. This research uses a qualitative method with a literature study approach and normative analysis of Qur'anic verses, hadith, and scholars' opinions to examine the limits of privacy in Islamic law and its implications for oversharing practices on social media. The results show that Islamic law regulates privacy through Maqasid al-Shari'ah, the prohibition of tajassus, and the recommendation to maintain speech and behavior in public spaces. The practice of oversharing on social media can violate these principles, potentially leading to slander, data exploitation, and negative impacts on social and psychological relationships. In addition, education about digital ethics based on Islamic law is important to encourage wise and responsible use of social media. This research makes a novel contribution to understanding the relationship between sharia norms and privacy challenges in the technological age, while offering ethical guidance for social media users to maintain honor and safety in the digital world.

Abstract

This study aims to analyze the suitability of the Health Social Security Organizing Agency (BPJS) in Indonesia with the principles of Islamic law, especially in the perspective of Maqasid al- Shariah. Maqasid al-Shariah focuses on maintaining the five main aspects of life: religion, soul, mind, offspring, and property. This research uses a qualitative method with a descriptive-analytical approach, which examines aspects of BPJS operations such as contracts, fund management, and penalty policies, as well as their impact on Muslim communities. The research findings show that BPJS Kesehatan can support the Maqasid al-Shariah objectives in protecting the soul (hifz al-nafs) and property (hifz al- mal), but there are some technical aspects that need to be adjusted to sharia principles, such as the late payment penalty mechanism and fund management. In this context, solutions based on tabarru' (grant) contracts, ta'widh (compensation), and the application of waqf as an alternative financing can be steps that are in accordance with Islamic law. This research provides an important contribution to the development of BPJS policies that are more inclusive and fair, while reflecting sharia values in Indonesia's social security system.

Abstract

This study is motivated by the complexity of the legislative system in Islamic governance, which integrates divine revelation with the dynamic needs of society. Unlike secular legal systems that rely solely on human rationality, Islamic legislation is rooted in the Qur'an and Sunnah, and further developed through ijtihad methods such as ijma', qiyas, and maqashid al-shari'ah. The objective of this research is to examine the fundamental principles of legislation in Islam, its relationship with public policy, and the challenges of its implementation in contemporary Muslim-majority states. The research applies a normative juridical method, supported by conceptual and sociological approaches, with qualitative descriptive analysis. The findings reveal that the Islamic legislative system is flexible and responsive to social change while maintaining its normative integrity through instruments such as maqashid al-shari’ah and siyasah syar’iyyah. Islamic legislation demonstrates the capacity to adapt to modern governance frameworks, as long as it remains grounded in the values of justice, public interest, and human rights protection.

Abstract

This study aims to reveal a description of the 2023–2024 joint property division case at the Sungguminasa Religious Court, the basis for the judge's considerations in deciding the case, and the application of the maṣlaḥah mursalah principle in the decision-making process. The approach used is empirical juridical through documentation studies and interviews with judges. This type of research uses qualitative research, which is a data collection that is carried out objectively and analyzes data to improve and test a problem. This research was conducted at the Sungguminasa Religious Court Class I A. The results of the study show that the description of cases in 2023-2024 shows a downward trend compared to previous years. The basis for the judge's considerations considers not only the provisions of Law No. 1 of 1974, the Compilation of Islamic Law, and the Civil Code, but also aspects of the contribution of each party in obtaining property during the marriage. Applying the perspective of maṣlaḥah mursalah, the judge's decision is directed at efforts to protect parties who are more vulnerable economically and socially, to avoid harm, and achieve proportional justice.

Abstract

Violation of workers' rights in Indonesia is a central issue in labor relations Commonly violations of workers' rights demand the existence of the Confederation of Trade Unions as an organization formed from, by, and for workers both in the company and outside the company, which is free, open, independent, democratic, and responsible to fight for, defend and protect the rights and interests and welfare of workers. For this reason, this research is oriented in the form of normative empirical research that seeks to observe the provisions of laws and regulations from the aspects of the rights and obligations of workers and employers along with law enforcement and direct observations in the Confederation of Maros Trade Unions in their role defending the rights and interests of workers in Maros Regency. The conclusion in this study is that labor relations outline the existence of inseparable rights and obligations as a definite causality, so disputes over rights and obligations between workers and employers require law enforcement that can be pursued outside the court through Bipartite settlements and mediation and litigation settlements through judicial institutions. In addition, the existence of KSPI Maros plays a very important role in industrial relations and efforts to resolve labor rights disputes through Bipartite, mediation and courts.

Abstract

The tradition of uang panai’ has been rooted in the Makassar Bugis tribe's marriage until now giving birth to several meanings, the higher the uang panai’ given shows the higher the Social strata of the family. Another meaning is also said to be that if there is no uang panai’ then there is no marriage. This tradition affects people's behavior in deciding to get married. Perhaps some of them choose to continue their relationship through silariang (elopement) and even commit suicide because they are frustrated that they cannot meet the demand for uang panai’. This paper examines community behavior in making decisions on the amount of uang panai’ influenced by financial behavior, Social strata, education and religiosity. This research uses a mixed method approach by using SMART-PLS data analysis and analyzing qualitatively with mashlahah analysis. The sampling technique is non-probability sampling with a purposive sampling method by taking samples based on certain criteria and selecting subjects according to the right informant. The results showed that financial behavior does not affect decision-making. The stronger the financial behavior of the community, the less likely the decision to meet the demands of the amount of money panai'. This is in line with the theory of planned behavior, the decision is to make considerations by making specific plans. Religiosity also does not influence decision-making. The stronger one's religious beliefs, the weaker the decision to fulfill the demands of panai'. This religious belief fosters responsibility so it is cautious in making decisions. The description of community behavior towards panai' money decision-making is more appropriate to explain in the concept of mashlahah mursalah.

Abstract

The provisions for the implementation of electronic transactions related to buying and selling followers are contained in article 18 which states that if the sale is carried out via the internet, the contract must be in the form of an electronic agreement that is legally binding. The jurists of the Hambali, Hanafi and al-Shafi'i madhhabs say that the object of the contract must be deliverable, the object must be present at the time the contract is performed, and it must not sell something that does not exist such as unfinished fruit (ripe). In contrast to the Maliki Madhhab which allows the buying and selling of immature fruit, on the basis that the immature part is included in the fruit that has already appeared, and only requires that the object must be present at the time of contract at the time of sacrifice of the fruit. In contrast to the view of law number 11 of 2008 where the provisions for the implementation of electronic transactions related to buying and selling followers are contained in article 18 which reads that if the sale is carried out via the internet, the contract must be in the form of an electronic agreement that is legally binding, then the applicable law must be in accordance with the basic principles of international criminal law and there are exceptions in article 20, namely in electronic agreements that With regard to the decision of both parties in relation to the agreement on the execution of the agreement, then the electronic transaction takes place only if the buyer has agreed and accepted the seller's offer. This research is included in the category of library research and uses methodology in the form of juridical, shari'i and sociological approaches. The data sources used are primary data sources, namely hadith, Qur'anic verses and the views of madhab imams while secondary data sources are journals, library books, data collected through reading, studying, and collecting a number of references related to the material. The journal of this study is, sellers and buyers who buy and sell followers to make an agreement before the contract is closed

Abstract

Technology is an entity of objects and non-objects that is created in an integrated manner through human thoughts to achieve a value that can be utilized in human life. Modern technology has made it easier for humans to communicate even in different places. Islam is not an obstacle to technological development, but Islam is part of technological development. Islam plays a role in development today. Islam really appreciates technology, but Islam does not want humans to use technology in the wrong direction. The presence of technology in the perspective of Islamic law brings various benefits, namely as a means of approaching God, as an instrument for spreading Islamic law and as a solution to solving contemporary problems in the current era. Besides having benefits, technology also has benefits, namely distortion of religious information, ablation of traditional religious practices and social isolation.

Abstract

The purpose of this study is to describe the implementation of policies in emergencies carried out by the government in terms of handling Covid-19 in Makassar City, the views of siyasa dusturiyah regarding constitutional law in emergencies in handling Covid-19. Regarding the abnormal (emergency) state of the country, appropriate actions can be based on ordinary law because the ordinary legal system cannot be applied as it should, to deal with the situation during the Covid-19 pandemic. This research is a field research using a Normative Syar'i approach and an Empirical juridical approach. Based on the results of this study, following the central government's stipulation regarding the Covid-19 pandemic emergency policy from several issued regulations such as Large-Scale Social Restrictions (PSBB), health quarantine and social assistance for the community, the Makassar City government implemented The policy stipulations are in accordance with central government policy regulations. In the siyasa dusturiyah perspective in implementing the functions and functions and authority of the state, the government in carrying out its duties as a state administration official is tasked with making a policy to realize the benefit of the community

Abstract

Purpose  – Wealth is an essential and fundamental aspect of human life. It not only plays an important role in sustaining life, but also serves as a means to achieve prosperity and happiness, both in this world and in the hereafter. Although the Qur'an explicitly prohibits the acquisition of wealth through unlawful means, violations of this provision still occur frequently. In fact, seeking halal livelihood is an obligation for every Muslim. Therefore, it is important to conduct in-depth research on sources of income that are haram, so that they can be avoided, while also examining the perspective of Islamic economics in managing haram wealth for those who are already involved and wish to purify it. Method – This study uses a normative-descriptive method with a sociological-legal approach. Data collection was conducted through literature study by examining various relevant sources, such as fiqh books, scientific journals, fatwas from scholars, and previous research results. Result – The results of the research show in Islamic jurisprudence, unlawful wealth refers to assets acquired through forbidden means, such as gambling, oppression, usury, theft, corruption, or the sale of prohibited goods, as explicitly forbidden by the Quran and Hadith. The management of illicit wealth in the context of Islamic economics must be based on the principles of justice, purification, and divine trust (istikhlāf). Scholars such as al-Ghazālī, Ibn Qudāmah, Wahbah al-Zuḥaylī, and Yūsuf al-Qaraḍāwī agree that wealth obtained unlawfully must be returned to its rightful owner. If the owner is unknown, then the wealth must be allocated for the public good. Therefore, individuals, groups, and governments are obliged to manage unlawful wealth in a manner that brings public benefit and is in accordance with divine justice. Implication – As a practical implication these Islamic legal principles is that Muslims are strictly obligated to cleanse their finances of unlawfully acquired wealth, primarily by returning it to its rightful owner or, failing that, by dedicating it to public good, preferably, the government should establish an institution to facilitate this.
