Abstract

Penelitian ini dilatarbelakangi adanya program kursus pra nikah yang dicanangkan oleh Direktur Jenderal Bimbingan Masyarakat Islam (Dirjen Bimas) dengan tujuan menciptakan keluarga sakinah dengan cara memberikan bekal pengetahuan, pemahaman dan keterampilan dalam hidup berumah tangga. Program kursus ini menjadi sangat penting dan vital bagi pasangan calon pengantin. Sebab, menjaga keutuhan rumah tangga merupakan jalan yang harus ditempuh untuk mewujudkan lahirnya keturunan bermutu serta kemaslahatan rumah tangga itu sendiri. Untuk itu, penyusun merasa perlu untuk menemukan hakikat dari adanya program kursus tersebut melalui pendekatan filosofis dengan harapan agar pihak penyelenggara dan peserta menyadari arti penting dari program kursus pra nikah itu bagi kehidupan rumah tangga mereka. Kajian ini difokuskan pada 1) membahas isi peraturan Dirjen Bimas tentang penyelenggaraan kursus pra nikah tahun 2013 dan unsur-unsur yang diatur di dalamnya, 2) bagaimana pandangan maqashid syariah mengenai Peraturan Direktur Jenderal Bimbingan Masyarakat Islam Nomor: DJ.II/542 Tahun 2013 Jenis penelitian ini merupakan penelitian pustaka dengan sifat kualitatif deskriptif dan menggunakan pendekatan filosofis, serta menjadikan Peraturan Direktur Jenderal Bimbingan Masyarakat Islam Nomor: DJ.II/542 Tahun 2013 tentang Pedoman Penyelenggaraan Kursus Pra Nikah sebagai bahan primer, buku-buku dan penelitian terdahulu yang terkait dengan kursus pra nikah, serta sumber-sumber lain yang masih berhubungan sebagai bahan sekunder. Hasil penelitian ini, pertama sebagai upaya menciptakan keluarga sakinah dengan memberikan bekal pengetahuan, pemahaman, keterampilan dan penumbuhan kesadaran kepada remaja usia nikah, maka BP4 sebagai mitra kerja Kementerian Agama membuat Peraturan Dirjen Bimas Islam Nomor: DJ.II/542 Tahun 2013 tentang Pedoman Penyelenggaraan Kursus Pra Nikah. Kedua, Kursus pra nikah memiliki urgensi karena mengandung nilai positif (maṣlahaḥ) dan kursus pra nikah merupakan al-maqāṣid at-tābi’ah (tujuan pengikut) bagi sebuah pernikahan yang memperkuat dan mendukung terwujudnya hifẓ an-nasl sebagai al-maqāṣid al-aṣliyyah (tujuan asal). Sedangkan kurikulum kursus pra nikah memiliki relevansi dengan aspek pendidikan, aspek agama dan ibadah, aspek ekonomi, aspek sosiologis, aspek psikologis dan aspek biologis. Di samping itu, penyelenggaraan kursus pra nikah juga memiliki relevansi dengan hifẓ an-nasl dan hifẓ al-‘irḍ.

Abstract

Hak waris adalah hak yang diterima ahli waris berdasarkan hukum waris. Hukum waris adalah hukum yang mengatur pemindahan kepemilikan harta pewaris kepada ahli waris dengan menentukan jumlah bagian ahli waris. Yang dalam pelaksanaannya didasarkan pada al-quran dan hadits. Begitupun tentang pemberian nafkah kepada istri dan anak sudah sangat jelas disebutkan dalam al-quran bahwa itu merupakan kewajiban yang harus dipenuhi, apabila tidak dilaksanakan maka berdosa dan telah melanggar perintah Allah. Pada masa kini, banyak terjadi kasus suami yang tidak memberikan nafkah kepada anak dan istrinya dikarenakan istrinya bekerja dan mempunyai penghasilan sendiri, bahkan hanya karena suami malas mencari nafkah. Berdasarkan alasan tersebut penulis tertarik untuk membuat penelitian yang berjudul: “Hak Waris Suami Yang Tidak Memberikan Nafkah Dalam Persfektif Maqashid Syariah”. Penelitian ini bertujuan untuk mengetahui bagaimana hak waris suami yang tidak memberikan nafkah dalam perspektif maqasid syariah. Metode penelitian yang digunakan oleh penulis adalah penelitian kualitatif. Sumber data penelitian ini bersumber dari data primer berupa buku dan artikel data sekunder. Teknik pengumpulan data yang digunakan pada penelitian ini adalah library research (tinjauan kepustakaan). Semua sumber data yang penulis peroleh, kemudian direduksi, disajikan, dan disimpulkan dengan menggunakan teknik analisis deskriptif. Dari hasil penelitian ini penulis mendapati bahwa Dalam maqashid syariah pemberian nafkah termasuk kedalam memelihara jiwa pada tingkat dharuriyat karena melalui pemeliharaan jiwa dengan adanya kebutuhan pokok berupa makanan dan lain lain dapat menjaga eksistensi hidup jiwa manusia, sehingga tidak mengancam eksistensi kehidupan manusia, Menurut Maqasid syariah dengan mengedepankan nilai keadilan, hak waris suami yang tidak memberikan nafkah adalah termasuk dalam menjaga keturunan (hifz an-nasl) dan menjaga harta (hifz al mal) dalam hal hajiyyat dan tahsiniyat. Sehingga suami tetap mendapatkan harta bersama dan hak waris.

Abstract

Generasi milenial memiliki kriteria tersendiri dalam memilih pasangan idealnya. Faktanya saat ini ditemukan beberapa kriteria yang dipilih namun belum/kurang sesuai dengan norma yang ajarkan Islam. Penelitian ini bertujuan untuk mengetahui kriteria pasangan ideal pada masyarakat generasi milenial di Desa Maniskidul Kecamatan Jalaksana Kabupaten Kuningan dan bagaimana tinjauannya menurut Fikih Munakahat. Penelitian ini termasuk jenis penelitian lapangan atau field research. Teknik pengumpulan data yang digunakan adalah wawancara dan dokumentasi. Sasaran dalam penelitian ini generasi milenial pada masyarakat milenial Desa Maniskidul Kecamatan Jalaksana Kabupaten Kuningan. Adapun hasil dari penelitian ini yaitu secara keseluruhan dapat disimpulkan bahwa generasi milenial Desa Maniskidul Kecamatan Jalaksana Kabupaten Kuningan dalam hal memilih kriteria pasangan ideal telah sesuai dengan perspektif fikih munakahat. Namun, pada lima responden memberikan kriteria tambahan dalam menentukan pasangan hidup yang ideal yaitu faktor kepribadian diantaranya yaitu pasangan yang menghargai istri, sayang keluarga, bertanggung jawab serta jujur.

Abstract

A marriage (parental) guardian is one of the legal requirements for marriage. Thus, any woman who marries without her guardian's permission is invalid. However, problems arise when the parental guardian is reluctant (adhal) to marry the prospective bride to the groom. The purpose of this research is to find out how the transfer of the parental guardian to the magistrate guardian is determined due to the guardian’s reluctancy (adhal) case number 311/Pdt.P/2022/PA.Kng. as well as Islamic law review on the judgment of the transfer of a parental guardian to a magistrate guardian due to the guardian’s reluctancy (adhal) based on the Fiqh Muqoronah perspective, case number 311/Pdt.P/2022/PA.Kng. This research uses a qualitative method with a descriptive data collection technique. The type of research used is field research. The data sources used are primary and secondary data sources. The data collection techniques used are interviews and documentation. The data analysis used is qualitative data analysis. The obtained data are then reduced, presented, and concluded using descriptive analysis techniques. The conclusions of the research are as follows: (1) Regarding case number 311/Pdt.P/2022/PA.Kng, the Kuningan Religious Court decided to grant the petitioner's request, by appointing the KUA (religious court) as magistrate guardian in place of the parental guardian due to the guardian’s reluctancy (adhal). Based on Islamic law, there is no prohibition between the petitioner and her prospective husband from getting married, because there is no mahram or consanguineous relationship between them. The solution is that these matters should be determined immediately to avoid problems that may arise. (2) Review of Islamic law regarding the judgment of the transfer of a parental guardian to a magistrate guardian due to the guardian’s reluctancy (adhal) based on the Fiqh Muqoronah perspective in the Study of the Judgment of the Kuningan Religious Court Number 311/Pdt.P/2022/PA.Kng, shows that it is in line with the Imam Madzhab, namely the Maliki Madzhab, Asy-Syafii, and Hanbali. According to the majority of Imam Madzhab, if the guardian refuses to marry the bride to the groom even though he is the mujbir guardian, then the magistrate guardian is the one who marries the bride to the groom. This is caused by a situation where the rights of guardian are attached to him, namely the petitioner's older brother, but his rights as guardian are terminated due to circumstances. Meanwhile, based on the perspective of the Hanafi Madzhab, in the case of a guardian’s reluctancy (adhal), it is like an invisible guardian. If the guardian is not present, then the guardianship rights are transferred to the ashabah guardian who has a further relationship according to the composition of the guardian.

Abstract

The practice of cheap redemption of products is one form of promotion in a company including in Indomaret Cipicung District, Kuningan Regency, where in its implementation consumers must meet the total shopping requirements determined by Indomaret Cipicung District, Kuningan Regency. However, it is not yet known exactly how the practice of cheap redemption of products at Indomaret Cipicung District, Kuningan Regency and how Islamic law reviews the practice of cheap redemption of these products. This study aims to determine how the practice of cheap redemption of products at Indomaret Cipicung District, Kuningan Regency and this study aims to analyze the review of Islamic law on the practice of cheap redemption carried out at Indomaret Cipicung District, Kuningan Regency. This research is qualitative research and also includes the type offield research. Data collection techniques using interviews with staff and consumers of Indomaret Cipicung District, Kuningan Regency and documentation. The results of this study are first, the practice of cheap redemption of products at Indomaret Cipicung District is a form of reward or appreciation to consumers for reaching total shopping at Indomaret. Second, based on the review of Islamic law, the practice of cheap redemption of products at Indomaret Cipicung District, Kuningan Regency has fulfilled the pillars and legal requirements of buying and selling. In addition, the practice of cheap redemption of these products also has no element of coercion.

Abstract

The number of marriage dispensation cases at the Kuningan Religious Court is very high. Of the 2,579 marriage dispensation cases per year from 2020 to 2024, there were 1,282 cases accepted by the Kuningan Religious Court and 1,297 cases were not accepted by the Kuningan Religious Court. The high number of marriage dispensation cases at the Kuningan Religious Court makes this research important to conduct. This study aims to determine the judge's decision on case Number 186/Pdt.P/2023/PA.Kng regarding the application for marriage dispensation, and to analyze the maqashid sharia review of the judge's decision on case Number 186/Pdt.P/2023/PA.Kng regarding the application for marriage dispensation. The research method used in this study is a qualitative research method with a combined research type, namely field research and library research. In addition, the data collection techniques used in this study were structured interviews and documentation. The results of this study found that the decision of the Kuningan Religious Court judge in determining the marriage dispensation case in case study Number 186/Pdt.P/2023/PA.Kng was not accepted because the prospective husband's biological father was not present at the trial. The judge's decision regarding the application for marriage dispensation that was not accepted in case Number 186/Pdt.P/2023/PA.Kng is not in accordance with the concept of maqashid sharia. The positive legal basis used by the judge in considering the decision does have benefits. However, many things are then neglected according to sharia or maqashid so that the harm caused is greater than the benefits.

Abstract

To fulfill the requirements for livestock feeding, the nearby communities of the Geulis forest gather gmelina leaves and sobsi, resulting in the deterioration and collapse of trees, consequently disrupting the long-term viability of the forest. In order to resolve this problem, we must identify a sustainable livestock feed solution and strengthen our efforts to conserve forests. One approach involves cultivating shade-tolerant hybrids of corn within agroforestry systems. There is currently a lack of widespread awareness regarding the specific varieties of corn plants that possess the ability to tolerate shade. Consequently, it is imperative to demonstrate commitment to the local community in the Mount Geulis forest region. Surveys, focus group discussions, design, training, monitoring, and evaluation are the methods employed for dedication activities. We are committed to improving the community's knowledge and abilities in growing shade-tolerant hybrid corn through the agroforestry method, as well as utilizing corn waste for livestock feed. Abstract

Fluktuasi debit aliran sungai merupakan salah satu indikator fungsi pengaturan Daerah Aliran Sungai (DAS) dalam penyimpanan dan pelelapasn air hujan yang jatuh pada suatu wilayah DAS. Salah satu indikator yang biasa digunakan adalah Koefisien Regim Aliran Sungai (KRA). Nilai KRA yang dihitung dalam jangka waktu yang pendek (pertahun) sangat bervariasi sehingga terjadi perubahan status DAS tahun satu ke tahun berikutnya padahal kondisi biofisik DAS di lapang tidak banyak mengalami perubahan. Selain itu nilai KRA juga sangat dipengaruhi jumlah curah hujan yang jatuh pada DAS tersebut dari waktu ke waktu. Indek baseflow merupakan cerminan kestabilan kontribusi baseflow terhadap total aliran sungai yang juga dapat digunakan sebagai salah satu indikator kinerja DAS. Tujuan penelitian adalah mengkaji koefisien regim aliran sungai dan indek baseflow sebagai indikator kinerja DAS pada beberapa DAS prioritas di Jawa Barat. Hasil kajian menunjukkan bahwa: 1) nilai koefisien regim aliran sungai (KRA) sangat fluktuatif jika dihitung dalam jangka waktu yang pendek (pertahun) dan cukup stabil jika dihitung dalam selang waktu cukup panjang disesuaikan dengan perubahan kondisi biofisik DAS di lapang; 2) Rataan nilai KRA DAS Citarum Hulu adalah 57.9 yang tergolong kedalam katagori sedang, Ciliwung Hulu 34.1 (rendah), Cisadane Hulu 17.5 (sangat rendah), dan Cipunagara Hulu 52.1 (sedang); 3) rataan indek baseflow DAS Citarum Hulu, Ciliwung Hulu, Cisadane Hulu dan Cipunagara Hulu masing-masing sebesar 0.69, 0.77, 0.72, dan 0.75, dengan koefisien keragaman 5.43%-18.2%; 4) semakin tinggi nilai IBF semakin rendah nilai KRA; dan 5) indek baseflow dapat digunakan sebagai salah satu indikator kinerja DAS yang relatif lebih baik dibandingkan dengan koefisien regim aliran sungai (KRA).

Abstract

The purpose of this study was to determine community participation in this case cadres and to find out the inhibiting factors and find solutions to the problems that hamper the activities of Posyandu Mawar. The method used in this research is descriptive method using a qualitative approach. Collecting data in this study is using interview and observation techniques. Community participation in this case is quite good for cadres as evidenced by the regular implementation of Posyandu Mawar activities, which is once a month on the second Tuesday of the week. The biggest inhibiting factor in this activity is the lack of funds owned by Posyandu Mawar Munengwarangan; Another inhibiting factor is the lack of support from community leaders, RW administrators and other institutions or activity programs in the community for Posyandu Mawar activities. In order for the Posyandu Mawar activities to be more developed and of better quality, there are suggestions; it is expected to increase public awareness including community leaders, RW administrators, and other institutions or activity programs so that they can participate and assist in terms of funding so that Posyandu Mawar activities will increase and be able to reach Strata Mandiri. It is hoped that there will be collaboration with stakeholders and there will be cadre regeneration and collaboration to form Joint Business Groups (KUB) to produce products so as to increase funds for Posyandu Mawar.

Abstract

COVID-19 has emerged as the global challenge confronting the community. The Indonesian government and Muhammadiyah have been engaged in efforts to mitigate the ongoing transmission of COVID-19. Diverse strategies have been employed to combat this disease and prevent its spread and fatalities. This study aims to examine and explain Muhammadiyah’s preventive efforts in Indonesia to combat COVID-19, drawing upon an interpretation of hadiths from the Prophet. A qualitative method was employed to address this issue with a historical, sociological approach to investigate the social conditions during the time of the Prophet and their prevention in relation to contemporary times performed by Muhammadiyah. The study revealed that Muhammadiyah has addressed community and humanitarian issues by implementing efforts to prevent the spread of COVID-19. One such effort was restricting worship activities in mosques and encouraging people to perform them at home until the situation returned to normal. However, in areas deemed safe from COVID-19, worship could still be conducted in mosques while adhering to health protocols such as maintaining social distance, wearing masks, and practicing proper hand hygiene. Furthermore, learning in large group settings has been limited, leading to a shift toward remote online learning from home. Engaging in outdoor muamalah activities, such as working, meetings, religious studies, shopping, and other activities that attract and result in big gatherings, has also been restricted. These efforts aim to disrupt the transmission of COVID-19 as a manifestation of societal care, guided by the teachings of the Prophet as recorded in the hadiths.
