Abstract

In the problem of femininity, fiqh has a very big role, because it is the science of fiqh that structuring the relationship of male women. This paper describes violence against women rooted in Fiqh al-Nisa 'However it is certainly not fair to judge Fiqh al-Nisa' with the present context. However fiqh is the product of his day. That in general in Fiqh al-Nisa ', women positioned as second actors or objects is due to several factors. First, some verses of the Qur'an and the Prophet's hadith present a patriarchal nuance, a view which places men as superior and inferior women. Secondly, the fiqh historic setting is generally a very patriarchal middle east region and the third, the fiqh writer is a man who is surely better presenting the superiority of men. Basically fiqh is the result of ijtihad miijtahid which is very good, relevant, dynamic in its era. The rigid is the thought of using the old work for the present religious rule. The rigid is the effort to develop new fiqh but still based on the methodology used in designing the old fiqh Dalam problematika keperempuanan, ilmu fiqh memiliki peran sangat besar, karena ilmu fiqh-lah yang menstrukturkan hubungan laki-laki perempuan. Tulisan ini memaparkan kekerasan terhadap perempuan yang berakar pada Fiqh al-Nisa’ Namun demikian tentu tidak fair menghakimi Fiqh al-Nisa’ dengan konteks sekarang. Bagaimanapun fiqh adalah produk zamannya. Bahwa pada umumnya dalam Fiqh al-Nisa’, perempuan diposisikan sebagai pemeran kedua atau obyek adalah karena beberapa faktor. Pertama, beberapa ayat al-Qur’an dan hadis Nabi menghadirkan nuansa patriarkhi, suatu pandangan yang menempatkan laki-laki sebagai superior dan perempuan inferior. Kedua, setting kesejarahan fiqh itu pada umumnya adalah wilayah Timur tengah yang sangat patriarkhi dan ketiga, penulis fiqh itu adalah laki-laki yang tentu lebih mempresentasikan superioritas laki-laki. Pada dasarnya fiqh adalah hasil ijtihad miijtahid yang sangat baik, relevan, dinamis pada zamannya. Yang kaku adalah pemikiran untuk menggunakan karya lama itu untuk tata aturan keagamaan masa kini. Yang kaku ialah usaha menyusun fiqh baru namun tetap berpijak pada metodologi yang digunakan dalam merancang fiqh yang lama

Abstract

Human rights objectively aim noble. It grants basic rights to human beings without distinction of origin, race, color, sex, language or religion. The concept of human rights in maqasid al syariah is Islamic sharia is prescribed in order to protect the human benefit by protecting the interests, safety and welfare of human beings both in life in the world and in the hereafter. The fundamental problem, if Islamic law is confronted with human rights is at least in family law. There arose some offers of methods of understanding nas in order to respond to human development. A verse of qatb'i is by analyzing a number of verses so that a unified understanding of the verses can be obtained. The collaboration of some of these verses shows that the understanding contained therein is definite and undeniable. then the tension in Islamic law, especially allegations of discrimination against women and non-Muslims can be avoided without any need to have allegedly left the Qur'anic verses. Hak-hak Asasi manusia secara obyektif bertujuan mulia. la memberi hak-hak dasar kepada manusia tanpa membedakan asal-usulnya, baik ras, warna kulit, jenis kelamin, bahasa maupun agama. Konsep HAM dalam maqasid al syariah yaitu syariah Islam disyariatkan dalam rangka melindungi kemaslahatan manusia dengan melindungi kepentingan, keselamatan dan kesejahteraan manusia baik dalam hidup di dunia maupun di akhirat. Problem yang mendasar, jika hukum Islam dihadapkan kepada HAM paling sedikit adalah pada hukum keluarga. Muncullah beberapa tawaran metode memahami nas dalam upaya merespon perkembangan kemanusiaan. Suatu ayat qatb 'i adalah dengan menganalisis sejumlah ayat sehingga bisa diperoleh suatu pengertian yang searah dari ayat-ayat tersebut. Kolaborasi sejumlah ayat tersebut menunjukkan bahwa pengertian yang terkandung di dalamnya bersifat pasti dan tak terbantah. maka ketegangan dalam Hukum Islam, khususnya tuduhan diskriminasi terhadap wanita dan non-muslim bisa dihindarkan tanpa perlu ada tuduhan telah meninggalkan ayat-ayat al quran.

Abstract

Abstrak: Tujuan dari penelitian ini adalah untuk memahami kanduangan Al-qur’an dengan menggunakan metode asbab nuzul, munasabah dan siyaq. Mengingat Al-Qur'an sebagai petunjuk paling penting dalam Islam, yang mudah untuk dibaca oleh seorang muslim, namun sulit dalam memahami kandungannya. Penelitian ini termasuk Metode kualitatif (qualitative method) diman suatu metode yang digunakan untuk mendeskripsikan dan menganalisis fenomena, peristiwa, aktivitas sosial, sikap kepercayaan, persepsi, pemikiran orang secara individu maupun kelompok, peneliti akan berperan sebagai alat peneliti dan berupaya dalam mengumpulkan data, mendeskripsikan dan menganalisa data yang ada di lapangan. Penelitian ini menggunakan pendekatan kepustakaan (library research), pengambilan data diperoleh dari al-Qur’an, artikel, jurnal, dan buku-buku, dengan cara mengumpulkan literatur atau bahan-bahan materi terkait dengan metode asbab an-nuzul, munasabah dan siyaq. Hasil penelitian ini memaparkan bahwa; 1). Metode asbab an-nuzul  adalah; memahami al-qur’an dengan mengaitkan peristiwa yang terjadi ketika ayat tersebut diturunkan baik sebelum atau sesudahnya, sehingga memungkinkan isi ayat tersebut saling berkaitan. Selanjutnya untuk lebih memperkuat argumen yang muncul, maka cara yang paling mudah yakni mencari hadits yang terpercaya dari Nabi SAW. atau dari sesama pengikut Nabi SAW. Dengan mengetahui Asbab al-nuzul, maka seseorang memahami hikmah di balik legalisasi hukum, mengetahui maksud dan makna ayat-ayat yang diturunkan, serta menghindari salah tafsir. 2). Metode munasabah adalah hubungan sebagian AlQur’an dengan bagian yang lainnya, baik dalam satu ayat maupun dalam beberapa ayat, dalam satu surah maupun dalam beberapa surah, sehingga menjadi satu kalimat atau satu kesatuan yang utuh maknanya, teratur susunannya, dan jelas hikmahnya. 3) Metode siyāq dapat didefinisikan sebagai koherensi seperangkat kalimat atau situasi kata yang dapat menunjukkan atau memperjelas maksud seseorang, Siyaq mempunyai beberapa macam, di antaranya; siyaq ayat, siyaq maqhta’dan siyaq surat. Abstract: The aim of this research is to understand the contents of the Qur'anby using the methodasbab nuzul, munasabahand siyaq. Remember Al-Qur'an as the most important guide in Islam, which is easy for a Muslim to read, but difficult to understand its contents.This research includes a qualitative method (qualitative method) in which a method is used to describe and analyze phenomena, events, social activities, attitudes, beliefs, perceptions, thoughts of people individually and in groups, the researcher will act as a research tool and attempt to collect data, describe and analyze data in the field. This study used a library research approach, data collection was obtained from the Koran, articles, journals and books.by collecting literature or materials related to the asbab an-nuzul method, munasabah and siyaq. Research resultthis explains that;1). Mthe asbab an-nuzul method is;understand the Qur'an by associating events that occurred when the verse was revealed either before or after it, so that the contents of the verses are related to each other. Furthermore, to further strengthen the arguments that arise, the easiest way is to look for a trusted hadith from the Prophet SAW. or from fellow followers of the Prophet SAW. By knowing Asbab al-nuzul, one understands the wisdom behind the legalization of law, knows the intent and meaning of the verses that were revealed, and avoids misinterpretation. 2). MethodMunasabah is the relationship between parts of the Qur'an and other parts, either in one verse or in several verses, in one sura or in several surahs, so that they become one sentence or one whole whose meaning is intact, the structure is orderly, and the lesson is clear.3) The siyāq method can be defined as the coherence of a set of sentences or word situations that can show or clarify one's intentions,SiyaqThere are several types, including; siyaq verses, siyaq maqhta' and siyaq letters.

Abstract

Abstrak: Tujuan dari penelitian ini secara umum adalah guna mengetahui Tafsir tematik tentang konsep, dan model kepemimpinan Islam yang dijabarkan lebih lanjut dalam beberapa tujuan antara lain: Untukmmendeskripsikan konsep, dan model kepemimpinan Islam dalam kajian tafsir tematik. Dengan demikian, metodologi yang penulis gunakan dalam penelitian ini ialah metodologi penelitian kualitatif, kategori penelitian deskriptif-kritis berdasarkan tujuannya. Sedangkan metode yang digunakan dalam mengumpulkan data adalah studi literatur dan teks Al-Qur'an. Ayat-ayat Al-Qur'an di jadikan sebagai data primer dan sekunder. Adapun hasil penelitian ini memposisikan: 1). Konsep kepemimpinan dalam Islam sebagai suatu konsep interaksi, hubungan, kegiatan yang mempengaruhi, kegiatan yang mengarahkan sekaligus berkoordinasi baik secara horizontal maupun vertical, berazaskan nilai-nilai ke-Islaman. Dalama al-Qur’an, terkait pemimpin diuraikan dengan berbagai macam istilah antara lain: Khalifah Imam, Uliaal-Amri dan Malik. Makna keempat istilah ini terkait dengan makna "pemimpin", para ulama menawarkan interpretasi konsep kepemimpinan berdasarkan ayat-ayat yang menyatakan bahwa makna kepemimpinan mencakup pemimpin risalah, pemimpin khalifah, dan pemimpin doa, serta kepemimpinan dalam manajemen pendidikan. 2). Model kepemimpinan dalam Islam mengacu pada model kepemimpinan “khalifah”, yakni Pendidikan Islam orientasinya padattujuan dan tugasppokok manusia, yaitu sebagai ’abdddan khalifahffilaardh. Sehingga orientasi kehidupan ideal Islami dapat dicapai melalui model kepemimpinan yang Nabi Muhammad SAW terapkan yaitu model kepemimpinan kenabian (prophetic leadership) dan ini merupakan kepemimpinan ideal dalam Islam. Abstract: The purpose of this study in general is to find out thematic interpretations of concepts and models of Islamic leadership which are further elaborated into several objectives, including: To describe concepts and models of Islamic leadership in the study of thematic interpretations. Thus, the methodology that the authors use in this study is a qualitative research methodology, a descriptive-critical research category based on its objectives. While the method used in collecting data is the study of literature and the text of the Qur'an. The verses of the Qur'an are used as primary and secondary data. The results of this study position: 1). The concept of leadership in Islam is a concept of interaction, relationship, influencing activities, activities that direct and coordinate both horizontally and vertically, based on Islamic values. In the Qur'an, leaders are described in various terms, including: Caliph Imam, Uliaal-Amri and Malik. The meanings of these four terms are related to the meaning of "leader", scholars offer an interpretation of the concept of leadership based on verses which state that the meaning of leadership includes treatise leaders, caliph leaders, and prayer leaders, as well as leadership in education management. 2). The leadership model in Islam refers to the "khalifah" leadership model, that is, Islamic education is oriented towards the goals and main tasks of humans, namely as 'abdd and khalifahffilaardh. So that the ideal Islamic life orientation can be achieved through the leadership model that the Prophet Muhammad SAW applied, namely the prophetic leadership model and this is the ideal leadership in Islam.

Abstract

This study aims to determine educational management from the perspective of the Qur'an. This research uses qualitative methods with a literature study approach. The result of this research is that management is the process of utilizing all resources through people and working with them. The process is to achieve common goals effectively, efficiently, and productively. The principles of educational management according to the Qur'an include sincerity, honesty, trustworthiness, justice, responsibility, dynamic, practical, flexible, selective, effective and efficient, open, cooperative and participatory, giving warnings, giving directions and directions. The conclusion of this study is henceforth, management functions such as planning, organizing, mobilizing, and supervising. This function is a process that must be carried out by all parties involved in an organization. Abstract

The aim of this research is to describe the pattern of parenting post-divorce elementary age children in an Islamic perspective. This research is a library research which is descriptive analytic in nature. The approach used is a normative approach based on the principles of Islamic law based on the Qur'an and al-Hadith. The results of this study are as follows. Scholars have agreed that mothers have more rights to care for children of primary age. Because, the mother has a different parenting style than the father. A mother has more ability to provide a sense of security and comfort during the growth and development of elementary age children and has the ability to hold the mandate and responsibility during the formation of adab and character of elementary age children, and has the ability to become uswah hananah for her child in an effort to educate they become good Muslims in the future, as explained in surah at-Tahrim verse 6 and surah al-Baqarah verse 233.

Abstract

The development of Islamic law in Indonesia from time to time shows relatively rapid developments, one of which is the obligatory will listed in the Compilation of Islamic Law (KHI) Article 209 Paragraphs 1 and 2. The obligatory will refers to taking property from adoptive parents to adopted children or from adopted children to adoptive parents through a mandatory court decision, whether the person who died said or wrote a will while alive. This KHI is a set of Islamic laws which is the product of Indonesian scholars to answer issues that occur in society and become an official reference for judges. This article uses a library research approach and a qualitative-juridical-philosophical method. Then it is analyzed using maqasid shari'ah al-Shatiby, in terms of problems that align with the goals of shari'ah. The objective of the writing is to find out whether the concept of the obligatory will listed in the KHI is in accordance with the purposes of the shari'a to create the benefit of the ummah or not.   Abstrak: Perkembangan hukum islam di Indonesia dari masa ke masa menunjukkan perkembangan yang cukup pesat, salah satunya adalah wasiat wajibah yang tercantum dalam Kompilasi Hukum Islam (KHI) Pasal 209 Ayat 1 dan 2. Wasiat wajibah yang di maksud dalam KHI ini adalah pengambilan harta dari orang tua angkat untuk anak angkat atau dari anak angkat untuk orang tua angkat melalui keputusan pengadialan yang bersifat wajib, baik orang yang meninggal tersebut mengucapkan atau menulis wasiat Ketika hidup atau tidak. KHI ini adalah merupakan sekumpulan hukum islam yang merupakan hasil produk ulama Indonesia untuk menjawab permasalahan-permasalahan yang terjadi di masyarakat dan menjadi rujukan hakim secara resmi. Artikel ini menggunakan pendekatan library reserch dan metode kualitatif-yuridis filosofis, kemudian di analisis menggunakan maqasid syari’ah al-Shatiby, dilihat dari segi maslahah yang sesuai dengan tujuan syari’at. Apakah konsep wasiat wajibah yang tercantum dalam KHI sudah sesuai dengan tujuan syariat untuk menciptakan kemaslahahan ummat atau tidak.

Abstract

This paper discusses the contribution of the conception of takwil (interpretation) of the Ushuliyyun (theologians) in the concept of inheritance of various religions. The theologians derived the takwil method in the Istibath Ahkam as one of the methodologies of Islamic law. Takwil is a transfer from the foreign meaning to the concealed meaning based on the relevant arguments. This study applies library research as an approach by conducting studies on numerous legal materials considering the concept of takwil in inheritance of various religions. This study contributes comprehensive interpretation view concerning the dubs and educates that must be recognized so that the takwil carried out turns into accepted interpretation. As for takwil which bears no evidence and particularly due to the lust, this interpretation view could not be applied. The purpose of this interpretation approach that dealing with troubles in community concerning Islamic rule could be observed on the takwil application for inheritance in the different religions that are described so as to present the contemporary idea that the inheritance prohibition for different religions is particularly for the harby infidels. A Muslim also can be the heir of the non-Muslim infidels.

Abstract

This article discusses the taklik talak regulation in Indonesia from the maslahah theory point of view. The essence of the study of maslahah is the application of benefit. The idea of mashlahah theory that researcher applies is from Imam al-Ghazali perspective. Actually, taklik talak in positive law of Indonesia is adopted directly from the classical fiqh resources. In the sense that taklik talak from classical fiqh is the main ingredient and element regarding the formation of these regulations into positive law in Indonesia, however, it seems that its application is slightly different from the provisions of taklik talak in classical fiqh. This research is included in normative research using a library research approach and using source materials in the form of books, journals, and websites related to the research focus. By conducting studies on various aspects of benefit in taklik talak applied in Indonesia, it indirectly creates unoriginality with its source in classical fiqh. Through this mashlahah point of view, the author wants to dig deeper into taklik talak in Indonesia. The result of this study explains that the concept of mashlahah or benefit has a role that supports the taklik talak regulations applied by Indonesia. So even though it has differences with taklik talak which comes directly from classical fiqh, the benefits of taklik talak are appropriate for the Muslims Societies in Indonesia.

Abstract

Childfree is a social phenomenon that is becoming an interesting discussion today. It deserves the attention of Islamic law. Nahdlatul Ulama (NU), through the NU Bahtsul Masail Institute (LBM-NU), has issued four fatwas synonymous with the childfree phenomenon. This article aims to analyze the childfree phenomenon from the perspective of the istinbāṭ al-aḥkām method used by NU and its relevance to the four fatwas. This article is qualitative research using a normative Islamic law approach, which examines NU’s legal decisions regarding the denial of childbirth. These decisions are then analyzed to determine the meaning and method of istinbāṭ used. This article finds two things. First, the istinbāṭ al-aḥkām method used by LBM-NU is the qawlī intiqādī method. Second, from the aspect of its application, childfree can be equated in law with decisions that have been determined by LBMNU regarding child refusal, as long as the method adopted is legal. However, from the aspect of substance, where childfree is used as a principle and lifestyle, it requires a new fatwā decision, especially with the manhajī approach.
