Abstract

One of the issues that often arises in the context of marriage is the case of "missing husband/wife."This term refers to a situation where the husband is absent or not present in the household for a long time, causing the marriage to be halted or threatened.In the Indonesian marriage law system, this issue refers to UUP No. 01 of 1974 Article 39 and KHI Article 116 point b.This type of research is normative with a legal, comparative, and conceptual approach.This research examines the urgency of reformulating the provisions for a missing husband in the Indonesian marriage law system through the perspective of maslahah al-Buthi.The analysis shows that the two-year waiting period as regulated in KHI Article 116 b and UUP No. 01 of 1974 Article 39 creates serious legal uncertainty for the wife and children, negatively impacting inheritance rights, economic and psychological well-being, and violating the principle of distributive justice.Based on the principle of maslahah al-Buthi, it is recommended to reduce the waiting period to one year to expedite dispute resolution and minimize harm.This reformulation aligns with the goals of national law—human rights protection, gender justice, and legal certainty—while creating synergy between progressive Islamic legal values and modern norms.The implementation of this proposal is expected to achieve a faster determination of marital status, improve economic access for wives, and prevent family poverty, thereby supporting the attainment of family welfare and harmony.

Abstract

Islamic law in Indonesia is developing rapidly, including wasiat wajibah in the KHI, which is the mandatory transfer of property between parents and adopted children through a court decision. This study is normative in nature, employing the maqasid syari’ah approach of Ibn Asyur. The study aims to analyze the concept of wasiat wajibah as stipulated in the KHI, comparing it with the Egyptian Qanun to determine whether it aligns with the objectives of Islamic law.  This study found several results: 1) Mandatory wills in the KHI are given to adopted children and adoptive parents, with a maximum of 1/3 of the estate. In the Egyptian Qanun, wills are given to grandchildren whose fathers died while their grandparents were still alive and who are prevented from inheriting. 2) In Indonesia, the concept of mandatory bequests has been expanded through a Supreme Court ruling to include adopted children, adoptive parents, and relatives barred from inheritance such as non-Muslims, stepchildren, and children born out of wedlock. In Egypt, according to a ruling by Darul al-Ifta, mandatory bequests are given to grandchildren if their father dies before their grandfather or grandmother. 3) According to Ibn Asyur's maqasid Syariah, the reformulation of Article 209 of the KHI regarding wasiat wajibah is in line with maqasid syariah because it preserves lineage, regulates inheritance proportionally, and creates clarity and peace between heirs and recipients of wasiat wajibah. Abstrak Hukum Islam di Indonesia berkembang pesat, termasuk wasiat wajibah dalam KHI, yaitu pemberian harta secara wajib antara orang tua dan anak angkat melalui putusan pengadilan. Penelitian ini bersifat normatif dengan pendekatan maqasid syari’ah Ibnu Asyur.Penelitian ini bertujuan untuk menganalisis konsep wasiat wajibah yang tercantum dalam KHI yang dibandingkan dengan Qanun negara Mesir sudahkah sesuai dengan tujuan syariat Islam.  Penelitian ini menemukan beberapa hasil penelitian 1) Wasiat wajibah dalam KHI diberikan terhadap anak angkat, dan orang tua angkat maksimal 1/3 dari harta peninggalan, Sedangkan dalam Qanun Mesir wasiat diberikan kepada cucu yang ayahnya meninggal dunia sewaktu kakek atau neneknya masih hidup dan cucu tersebut tehalang untuk mendapatkan warisan. 2) Di Indonesia, konsep wasiat wajibah diperluas melalui putusan Mahkamah Agung, mencakup anak angkat, orang tua angkat, serta kerabat terhalang warisan seperti non-Muslim, anak tiri, dan anak hasil zina. Di Mesir, menurut putusan Darul al-Ifta, wasiat wajibah diberikan kepada cucu jika ayahnya meninggal sebelum kakek atau neneknya. 3) Menurut maqasid Syariah Ibnu Asyur, reformulasi Pasal 209 KHI tentang wasiat wajibah selaras dengan maqasid syariah karena menjaga nasab, mengatur warisan secara proporsional, serta menciptakan kejelasan dan kedamaian antara ahli waris dan penerima wasiat wajibah. Abstract

Abstract This study critically examines the representation of female desire in Surah Yusuf, verse 31, through the lens of Ibn Kathir’s classical tafsir. Despite growing scholarly attention to gender and sexuality in Islamic texts, focused analyses of female desire within Qur’anic exegesis remain limited. Addressing this gap, the present research offers a pioneering contribution by employing a qualitative descriptive method to analyze both linguistic and interpretative dimensions of the verse. The study pursues three main objectives: (1) to investigate the linguistic nuances and variations across major English translations of the verse; (2) to explore Ibn Kathir’s interpretive framing of the narrative involving the women of Egypt; and (3) to analyze how the concept of female desire is constructed within his tafsir. The findings reveal significant disparities in how translations convey the intensity and consequences of the women’s attraction to Prophet Yusuf. Ibn Kathir’s exegesis characterizes their behavior as influenced by both individual and collective longing, catalyzed by Yusuf’s extraordinary beauty. Notably, the tafsir identifies elements such as physical attraction, emotional overwhelm, and even metaphorical “drunkenness” as markers of female desire. This study contributes to the broader discourse on gender in Islamic thought by highlighting how classical interpretations engaged with complex emotional and psychological dimensions of female figures in the Qur’an. By revisiting these exegetical traditions, the research fosters a more nuanced and historically grounded understanding of female desire, offering critical insights for contemporary debates on gender, sexuality, and the interpretation of sacred texts. Keywords: Female Desire; Surah Yusuf; Ibn Kathir’s Interpretation.Abstrak Penelitian ini secara kritis mengkaji representasi hasrat perempuan dalam Surah Yusuf ayat 31 melalui tafsir klasik Ibn Kathir. Meskipun kajian akademik mengenai gender dan seksualitas dalam teks-teks Islam semakin berkembang, analisis yang secara khusus membahas hasrat perempuan dalam konteks tafsir Al-Qur’an masih sangat terbatas. Untuk menjembatani kekosongan ini, penelitian ini menawarkan kontribusi awal dengan menggunakan metode deskriptif kualitatif guna menganalisis dimensi linguistik dan interpretatif dari ayat tersebut. Penelitian ini memiliki tiga tujuan utama: (1) menyelidiki nuansa kebahasaan dan variasi dalam sejumlah terjemahan bahasa Inggris utama terhadap ayat tersebut; (2) mengeksplorasi cara Ibn Kathir membingkai narasi tentang para perempuan Mesir; dan (3) menganalisis bagaimana konsep hasrat perempuan dikonstruksikan dalam tafsirnya. Hasil penelitian menunjukkan adanya perbedaan yang signifikan dalam cara terjemahan menggambarkan intensitas dan konsekuensi dari ketertarikan para perempuan terhadap Nabi Yusuf. Tafsir Ibn Kathir menggambarkan perilaku mereka sebagai hasil dari hasrat individu maupun kolektif, yang dipicu oleh pesona luar biasa Yusuf. Menariknya, tafsir ini mengidentifikasi unsur daya tarik fisik, gejolak emosi, hingga “mabuk” secara metaforis sebagai penanda dari hasrat perempuan. Studi ini memberikan kontribusi penting bagi diskursus gender dalam pemikiran Islam dengan menyoroti bagaimana tafsir klasik merespons dimensi emosional dan psikologis tokoh-tokoh perempuan dalam Al-Qur’an. Dengan meninjau kembali tradisi tafsir tersebut, penelitian ini menghadirkan pemahaman yang lebih mendalam dan historis tentang hasrat perempuan, sekaligus menawarkan wawasan kritis bagi perdebatan kontemporer mengenai gender, seksualitas, dan penafsiran teks suci. Abstract

Financial management demandstransparent and accountable financial accountability. To implement it effectively, it is necessary to internalize strong Islamic values. This article examined the principles of financial management in the Qur'an by using the interpretation of al MizanTabataba'i. Theological tendencies in al-Mizan's interpretation were relevant to study financial management which required fundamental principles in Islam. This research employed literature study. The results of the study indicated that Surah Yusuf contained fundamental values in carrying out effective financial management. Surah Yusuf verse 43-49 implied that planning was preceded by an assessment of the condition. Surah Yusuf verse 55 conveyed the characteristics that must be possessed by a person in the financial management. Surah Yusuf verse 59 showed the readiness to face auditing or budget evaluation. This study was supported by Surah Al Ma'un verse 1-3 that in the implementation of financial management of education institution, Islamic education institutions should not ignore orphans and the poor.

Abstract

Indonesia faces several issues regarding the discrimination of religious worship rights, which clearly violates the regulations in Indonesia. In many cases of religious discrimination in the country, the neutrality of the government as a public servant is often called into question. Consequently, our society still lacks a proper understanding of religious tolerance. Instilling an understanding of appropriate solutions within families related to the discrimination of worship rights in Indonesia must be addressed more seriously. This study is essential to analyze radicalism in the discrimination of worship rights through the lens of sad dzari’ah. Furthermore, the researcher will examine the role of families in preventing worship rights discrimination from the perspective of Islam Nusantara. This research employs a qualitative approach based on library research. The findings indicate that discrimination against worship rights is inconsistent with sad dzari’ah because it can lead to significant harm, such as division and conflict. Therefore, worship rights discrimination must be prevented to align with the principles of sad dzari’ah. Additionally, strengthening family resilience through the cultivation of Islam Nusantara values can serve as a preventive effort against radicalism in worship rights discrimination.

Abstract

The implementation of Marriage Act No. 1/1974, which was later amended by Act No. 16/2019, and its various provisions, led to the emergence of the phenomenon of nikah siri. Nikah siri is a marriage that takes place in secret and is not registered in accordance with the provisions of the current Marriage Law. This research will include an in-depth analysis of 1) An explanation of nikah siri according to Indonesian positive law and Islamic law. 2) The legal status and criminal sanctions of nikah sirri under Indonesian positive law and Islamic law. This research is normative in nature with a comparative approach to analyse the crime of nikah sirri by comparing Indonesian positive law and Islamic law. The data collected will be analysed descriptively and comparatively to identify the similarities, differences and legal implications of the crime of nikah sirri in the two perspectives. Therefore, it is hoped that this research can increase understanding of the phenomenon and make a positive contribution to our knowledge of the dynamics of human relationships in the context of hidden marriages.

Abstract

A study on gender justice in pesantren is very important, given the persistent stigma that pesantren are patriarchal institutions that limit women’s roles. In fact, when examined more deeply, pesantren hold great potential in realizing equality values that align with Islamic teachings. This article aims to reveal the implementation of gender justice values at Pondok Pesantren Al-Ikhlas Tambakberas Jombang through educational patterns, daily practices, and the role-modeling of the pesantren caretakers. This research employs a qualitative descriptive method with observation, interviews, and questionnaires distributed to 40 male and female students and pesantren administrators. The findings show that principles of gender justice have been applied at Pondok Pesantren Al-Ikhlas through equitable task distribution, active involvement of female students in pesantren activities, and the exemplary role of KH. Hasyim Yusuf demonstrates engagement in domestic and productive activities regardless of gender. All students stated that the implementation of gender justice has had a positive impact, both in shaping critical thinking and in increasing fair participation among students. This study suggests that feminism can be internalized within the pesantren environment without departing from Islamic values and local wisdom.

Abstract

Today's technological advances require humans to always go hand in hand with technology. One of them is buying and selling activities using an online system. This is considered easier and more efficient than offline transactions. One of the popular shopping applications in Indonesia today is Shopee. In practice, Shopee offers a feature called paylater. This research uses a qualitative descriptive research method to describe the practice of using Shopee Paylater loans from the perspective of Islamic law, while what is used is some research that has been done before. This research was conducted using a normative approach to evaluate the strengths and weaknesses of the issues under consideration. In this case, whether the practice of using Shopee Paylater loans is Halal or Haram. Actually, it has been fulfilled by Shopee paylater from the qardh contract both in terms of akid because of the mutual agreement between the two parties, the main object being traded can be trusted, and also shigat in the paylater system there is already a form of transaction confirmation between the two parties which is in accordance with the qardh contract. However, from another aspect, there are instruments that contain usury, namely in the practice of Shopee paylater there are additions. According to the language of usury, it means that in usury activities there is an addition to something that is owed. Meanwhile, according to Imam Sarakhsi from the Hanafi Madzhaf defines usury as an addition required in business transactions without any iwadh (equivalent) justified by sharia for the addition. The paylater mechanism is very easy and very practical. In the paylater itself there is a choice of time periods for payment in installments. Shopee paylater is classified as a debt and credit activity or in Islamic terms it is called qardh. Qardh is allowed in Islam if it does not contain elements of usury in it. But unfortunately, in practice, Shopee paylater has elements of usury, namely additional interest rates every month and fines given if there is a delay.
