Abstract

In classical fiqh studies, scholars agree that having children is a desired outcome of marriage. However, in modern times, the promotion of the childfree lifestyle is increasingly advocated through scientific discourse. The question arises: what factors contribute to childfree becoming a goal of marriage, and what is the contribution of this research to the renewal of contemporary Islamic family law? The purpose of this research is to challenge societal paradigms about childfree and work towards building a new perspective as part of the renewal of contemporary Islamic family law. This research is a field study (field research) in the form of qualitative research with a socio-psychological approach using the iceberg theory. Data was collected through interviews with respondents, specifically from the younger generation. The results of the study indicate that the childfree paradigm exists because it is promoted through mass media, print media, scientific articles, and other scholarly discussions that deliberately instill the idea that childfree is a lifestyle choice. The researcher suggests that education on this matter should be provided by various parties, including religious leaders through organizations, religious counselors, health professionals, as well as psychologists and psychiatrists, to build a perspective that having children is one of the main purposes of marriage.

Abstract

In Indonesia, the minimum limit married 19 for men and 16 for women. Age children who have reached adulthood, called puberty phase, at this age the child already has a full awareness of himself, sehingg he was given the burden of responsibility, especially religious and social responsibility.

Abstract: "Tradition ('urf) as a Source of Islamic Law Reasoning; Study Paradigm Sunnah wal Jama'ah Experts in Developing Local Culture "One tradition ( 'urf) can be used as a source of Islamic law if it does not conflict with Personality', and not all traditions can be used as a source of Islamic law. Tradition itself is an activity that is repetitive, but does not violate the order of Shariah, the tradition is not sharia, but branches (furu ') in order to address or even develop Islamic teachings amaliyah (amaliy) or often called (bid’ah hasanah) .The ahlu sunnah wal jama'ah develop local culture such as tahlilan, yasinan, istighasah, tawashul or the like in the implementation of the (practice) there is no standard rules, but it is the implementation of more emphasis on reading tahlil (la ilaha ilallah), or yasinan namely reading yasin as the heart of a Qur'an, namely istighasah appeal help in Allah and not in others, and that is ihtiram tawashul to teachers as washilah in a prayer, and of course this is bid’ah hasanah not teaching out of Personality ' ,Keywords: Tradition, 'urf, Ahl Sunnah Wa al-Jama'ah

Abstract

Islam is a religion rahmatan lil'alamin, for that Islam can put the situation and conditions. Islam is the religion Hanīf, fairness and tolerance to their ikhtilaf (dissent). In terms of the causes and roots, there are two forms ikhtilaf (dispute), the deviation caused by the character and thought. Unjustified deviation is a deviation in aqidah matter of principle. Deviation is actually a little touch on the basic framework of worship. However, when the jurists began to enter the technical and operational principle that no deviation is irreversible appearance. Deviation can be justified is the deviation in trouble furu', and the issue is not the principle I'tiqad. Deviation different from the iftiraq, iftiraq according to the language comes from the word meaning mufarawah division and separation. Meanwhile, according to the terms of the scholars, iftiraq is out of the Sunnah and Jama'ah on one ushul (principal) of a judge actions ushul fundamental, both in aqidah or amaliyah.

Abstract

Tulisan dalam artikel ini membahas mengenai peranan pemerintah daerah terhadap pelaksanaan corporate social responsibility (CSR). Tujuannya untuk mengetahui bagaimana arah kebijakan dan pengaturan CSR di provinsi Lampung. Metode yang digunakan adalah kajian pustaka dengan menggunakan pendekatan yuridis. Berdasarkan Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas mewajibkan setiap perusahaan untuk melaksanakan CSR. Peran pemerintah daerah Provinsi Lampung dalam pelaksanaan CSR yaitu dengan membentuk Peraturan Daerah Provinsi Lampung Nomor 16 Tahun 2012 tentang Tanggung Jawab Sosial Perusahaan dan Peraturan Gubernur Nomor 30 Tahun 2011 tentang Pedoman Pengelolaan CSR/PKBL. Peran pemerintah daerah dalam hal pelaksanaan CSR menurut Pergub No. 30 tahun 2011 yaitu, membentuk forum komunikasi dan tim fasilitasi. Kedua tim tersebut memiliki kewajiban mewadahi seluruh pihak yang terlibat pelaksanaan CSR, yaitu pemerintah, perusahaan dan masyarakat. Pergub No. 30/2011 juga mengatur pedoman mekanisme pengelolaan CSR dimulai dari; 1) perencanaan; 2) pelaksanaan; 3) pembinaan dan pendampingan; 4) pelaporan dan evaluasi. Berdasarkan hal tersebut secara khusus pemerintah kota Metro juga telah menerbitkan Peraturan Daerah Nomor 6 Tahun 2016 tentang Tanggung Jawab Sosial Perusahaan.

Abstract

Mediation is a Religious Court facility to resolve disputes outside the court; however, it is often found that the phenomenon of cases that have not been completed from the handling of mediation, for example, in family law disputes, is divorce. What is interesting to study is, what is the role and position of mediation in the Religious Courts? This paper aims to describe and analyze the role and function of mediation in the religious court environment, with the type of qualitative research in the form of library research. The conclusion of this study is that the court has carried out the mediation process with the position of the judge as a mediator. In contrast, the judge is the main role as well as the policymaker, so it becomes a very difficult task to be able to resolve cases outside the court plus, a case that has been entered into court are cases that have been screened through family, community and even customary approaches, and did not visit thoroughly and then refer to the court, what is often the problem is that the mediator who has been the judge, while the judge has a dual role, namely adjudicating and concurrently being a mediator

Abstract

In married life, husband and wife ideally live together in one place of residence so that they can carry out their authority and responsibilities as husband and wife to create a harmonious family. But it’s different with the implementation of the authority and responsibilities of husband and wife that occur in Sukarame Village, Bandar Lampung, where the husband does’nt live with his wife and childrens in one house because the husband works outside the city to earn a living or better families economy, which requires them not to live together for a period, which resulted in them not being able to lead a life together, leaving their wifes and children at home, and have a long distance relationship. The purpose of this study is to examine the exercise of authority and responsibility of husbands and wifes who don’t live together from the perspective of mas̲lah̲ah mursalah. This type of research is qualitative in the form of field research. The results of this study indicate that in Sukarame Village, Bandar Lampung, the authority and responsibilities of husband and wife do not live together, namely by calling each other or WhatsApp and video calls, although they still must meet face to face and transfer some money for their daily needs. From the point of view of mas̲lah̲ah mursalah, it is included in the interests of individuals or minorities and cannot be used as evidence because it only benefits the couple and therefore does not fulfill the conditions required by mas̲lah̲ah mursalah

Abstract

The man is the head of the household, and the wife is the housewife. That is the paradigm embedded in our society in general, because so far men have always been the main ones at the forefront while wives have always been in a limited area. The problem is that contextually, the role of women is no longer in the domestic area alone, but many have also played a role outside the home to help their husbands earn a living. The question is how can the rights and obligations of husband and wife be exercised in this context? The purpose of this research is to obtain a reconstruction of new rights and obligations that are based on fikih mubadalah. This research is a literature review, qualitative type with a mubadalah approach. The result of this research is that the partners between men and women in realising justice in the household must be equal, such as mutual deliberation, mutual democracy and mutual kindness in relationships.

Abstract

Pemikiran Al-Syatibi, seorang ulama besar dalam dunia hukum Islam, memberikan kontribusi signifikan terhadap pembaharuan hukum Islam melalui pendekatan maqasid al-shari'ah (tujuan syariat). Dalam karyanya yang terkenal, Al-Muwafaqat, Al-Syatibi mengembangkan pemahaman bahwa hukum Islam harus dapat diadaptasi dengan perkembangan zaman, selama tetap menjaga prinsip-prinsip dasar syariat. Ia menekankan pentingnya tujuan dari setiap peraturan hukum Islam yang tidak hanya bersifat tekstual, tetapi juga kontekstual, dengan fokus pada perlindungan terhadap lima unsur dasar kehidupan manusia, yakni agama, jiwa, akal, keturunan, dan harta. Al-Syatibi berpendapat bahwa setiap hukum harus diarahkan untuk mencapai kemaslahatan umum (maslahah), dan dalam konteks ini, ijtihad (usaha penafsiran hukum) menjadi instrumen penting dalam menyesuaikan hukum Islam dengan kebutuhan sosial dan perubahan zaman. Pemikirannya ini membuka ruang bagi modernisasi hukum Islam yang tetap berlandaskan pada prinsip-prinsip dasar syariat tanpa mengabaikan kebutuhan masyarakat kontemporer. Abstract

Abstrak: Kajian tentang Rencana RUU menjadi penting, di satu sisi bahwa telah ada Fatwa MUI Nomor 11 Tahun 2019 tentang Hukum Alkohol, namun demikian, bahwa fatwa tidaklah mengikat dan hanya berlaku bagi kaum muslimin di Indonesia, realitanya minuman beralkohol ucap kali ditemukan menjadi tradisi dan kebiasaan dalam acara-acara di wilayah-wilayah tertentu, seperti Sulawesi dan Sumatra Barat, untuk dapat memberlakukan sebuah aturan secara legal, mengikat kepada semua masyarakat, maka perlu dibuat Undang-Undang tentang Larangan Minuman Beralkohol, karena dengan kebiasaan minuman beralkohol, banyak meresahkan masyarakat, merugikan negara, banyaknya kecelakaan lalu lintas serta merusak generasi. Melihat realita yang ada, maka perlu kiranya Indonesia menggas RUU tentang larangan minuman beralkohol, dengan tujuan agar masyarakat Indoesia senantiasa memahami kemudharatan yang terjadi akibat minuman beralkohol. Kajian ini merupakan jenis kualitatif, dalam bentuk studi pustaka (library reseach) yang membahas tentang kemudharatan minuman beralkohol dalam tinjaun filosofis-historis dengan pendekatan maqasid al-syari’ah. Tinjauan maqasid al-Syari’ah terhadap keharaman minuman beralkohol sebagaimana keharaman khamr dalam proses analogi hukum bertujuan untuk; Pertama, Mengambil kemaslahatan dan meniadakan kemudharatan, Kedua, bentuk saad al-Dzari’ah yaitu mencegah celah untuk melakukan tindakan yang membawa kemudharatan lebih besar dengan kaidah dar’ul mafasidi muqaddamun ‘ala jalbil mashalih (mencegah kemudhartan lebih diutamakan daripada mengambil kemaslahatan). Hal ini dilakukan dmemi melindungi agama, jiwa, akal, nasab dan juga harta. Dari sinilah dipastikan bahwa segala minuman yang mendatangkan kemudharatan sebagaimana khamr dihukumi haram sebagaimana khamr, karena memiliki ‘illat (argumen) hukum yang sama.
