Abstract

Abstract: Dynamic Development of Family Law in Muslim Countries. This article examines the dynamics of the development/renewal of Islamic family law in Muslim countries. The aim is to obtain a concrete picture of the development, from its original form, i.e conventional fiqh, to become positive law and apply it in Muslim countries. This research is classified as library research using a combination of historical and socio-anthropological approaches. Data were obtained from several secondary sources in the form of laws and regulations, books, articles, and many other documents related to the topic under study. The results of this study indicate that the role of the state in enforcing a legal system is absolute, in the sense that a law can be applied when it has been legislated as positive law. Apart from that, this study also found the fact that three models are applied in the development of family law in Muslim countries, namely; First, the state still applies the conventional legal system (fiqh). Second, the state carries out legal reforms within the school of thought. Third, the state makes its family law that is separate from religious norms to keep up with changes and developments in society.

Abstract

Higher education is an effective means of transforming thought and movement to counteract the negative influence of various extreme and deviant religious schools and understandings, one of which is radical ideology, which has recently begun to emerge among students at several tertiary institutions. This study aims to obtain an overview of the steps that have been taken by UIN Raden Intan Lampung, UIN Sunan Ampel Surabaya, and UIN Sunan Gunung Jati Bandung in grounding the concept of religious moderation to anticipate and counteract the radicalism ideology that has recently infiltrated among University students. This research is classified as descriptive qualitative field research, using the maslahah (benefit) theory. Data were obtained from reviewing several documents in the three institutions, which were then processed and analyzed using the content analysis method. This study concludes that although each University has a different approach in its efforts to prevent and overcome radical religious ideology, the concept offered is the same, namely religious moderation, which is based on the principle of welfare, namely “li jalbi al-mashālih wa li daf'i al-mafāsid” (taking benefit and eliminating harm).

Abstract

Berdasarkan fakta sejarah, praktek poligami sebenarnya sudah dilakukan oleh umat sebelum datangnya agama Islam. Ketika Islam datang, aturan tentang poligami muncul dalam rangka menyempurnakan syari’ah sebelumnya sekaligus untuk mengatur, membatasi dan memberikan suatu solusi bagi kebutuhan biologis manusia. Meski Islam memberi peluang bagi kaum pria untuk berpoligami, namun peluang tersebut sangat terbatas dan hanya dapat diberikan jika seseorang mampu berbuat adil dalam arti yang sebenar-benarnya. Oleh karena keadilan bukanlah sesuatu hal yang mudah untuk dilakukan, dapat disimpulkan bahwa meski Islam membolehkan poligami tetapi kecenderungan utamanya adalah monogami.

Abstract

Artikel ini membahas tentang praktek khitan untuk kaum perempuan melalui perspektif hukum Islam. Khitan perempuan dilakukan dengan memotong, melukai dan menghilangkan sebagian dari alat vital yang terpenting dan terkait alat reproduksi perempuan. Praktik ini sesungguhnya tidak harus dilakukan oleh setiap perempuan. Khitan dapat dilakukan oleh perempuan jika ia memiliki libido seksual yang tinggi sehingga dihawatirkan akan membawanya ke jurang kemaksiatan. Namun jika khitan itu tidak mendatangkan manfaat, bahkan merusak organ perempuan, maka perbuatan itu harus ditinggalkan. Dalam Kaidah Fiqh kalau suatu perbuatan mendatangkan lebih banyak mudharat daripada kemaslahatan, (la dharara wa la dhirara), maka hukumnya adalah makruh dan harus ditinggalkan.

Abstract

As a religious tradition, Tahlilan cannot be put in  isolation of debate among Indonesian Muslim society. In one side, it is believed as part of Islamic teachings which do not contradict with the Shari’a, while the other considers it as a syncretistic practice that has no guidance in the Qur’an and As-Sunnah.  Apart from the controversy surrounding it, this study aims to examine, both philosophically and sociologically, how the actual process of inculturation between religious and cultural values in the Tahlilan tradition is constructed and embedded, so that it persists as a tradition constantly alive. As the field research, this study explores data from two different areas, namely Lampung and Banten. As a result, this study would like to describe although the Tahlilan tradition in both areas has the same essence and purpose, as al-adah muhakamahor customs, to recite the holy verses of the Qur’an, dzikir, and pray to the spirit of someone who has died in order to gain God’s forgiveness, the inculturation of both areas has its own distinctions and peculiarities.

Abstract

Piil pesenggiri is a philosophy of life for Lampungnese people that is firmly held by Lampungnese people, as an ancestral heritage which can be said that Lampungnese people are predominantly Muslim, meaning that the philosophy of life then becomes closely related to the way of religion of Lampungnese people from time to time by maintaining a balance between local religious traditions themselves. This study is quite interesting to be discussed further, especially regarding the position of the piil pesenggiri philosophy of life in the moderate religious pattern of Lampungnese people. The method used is a descriptive method with a socio-philosophical approach, while drawing conclusions is by using a deductive thinking. The results of the study indicate that the values contained in the piil pesenggiri philosophy of life have a considerable influence on the Islamic style for Lampungnese people who are moderate and can maintain the values of balance between reason and morality on an ongoing basis.

Abstract

Wujud Da’i Kamtibmas adalah upaya merangkul masyarakat untuk dapat berpikir yang moderat. Pola pemikiran yang moderat, akan dapat menjadi filter masuknya paham radikal di wilayah Lampung, sebagai juru dakwah kamtibmas polda Lampung, tentunya harus dapat melakukan bentuk-bentuk perubahan yang akan membawa rahmatan lil alamin, untuk mewujudkan semua itu tentunya membutuhkan kerja keras, diantara upaya itu adalah melakukan bentuk-bentuk pendekatan kepada masyarakat di wilayah tersebut, agar aktivitas dakwah senantiasa dapat menyentuh dan diterima. Yang menjadi menarik adalah bagaimana peran Da’i Kamtibmas Polda Lampung dalam upaya menanamkan nilai-nilai moderasi dalam berdakwah? Kajian ini akan melihat pada peran Da’i Kamtibmas Polda Lampung sebagai Mitra Polri dalam menanamkan nilai-nilai moderasi pada masyarakat dalam bentuk dakwah. Penelitian ini adalah bersifat kualitatif dengan bentuk (fild research) dengan cara wawancara, observasi dan dokumentasi terhadap kejadian empirik yang terjadi dengan pendekatan sosiologis-kultural dengan memanfaatkan nilai nilai falsafat masyarakat Lampung, yaitu Piil Pasenggiri. Hasil penelitian ini menunjukkan bahwa sangat besar peran Da’i Kamtibmas Polda Lampung dalam menanamkan nilai-nilai moderasi di tengah masyarakat, baik melaui media radio Andalas dan RBK, melalui saluran televisi Tegar maupun melalui pembinaan, baik secara internal yaitu kepada para da’i itu sendiri maupun pada masyarakat melaui pembinaan secara eksternal yaitu masyarakat yang telah terindikasi paham radikal atau dalam hal pencegahannya.

Abstract

Abstract : " Perspectives Hadânah Tablighis " Hadânah ismumayiz nurture children who have not (yet able to take care ofhimself ) . In the present era, has many Muslim pilgrims who focuses on propaganda sector and one of them is Tablighis. Khurûj fi sabilillah not only done by the husband, but the wife as the person in charge hadânah child's mother. Mastûrah (proselytizing efforts among women), one aim is to educate children in Islamic. Hadânah structurally is the husband'sresponsibility as the head of the household, but the task be given to his wife, Islam teaches that hadânah is the responsibility of the wife. Rights and obligations of parents towards children are trying to harness the power of which is owned as much as possible to provide suitable andappropriate education and discipline to teach their children. The rights of children that are jasadiyah, `aqliyah and rûhiyyah. In mastûrah is not allowed for children to participate in propaganda. Children entrusted to a grandmother or a close relative, and if you can not then be entrusted to another person who is able to care for children in accordance deal congregation. Cost still be given to people who take care, as the cost of radâ'ah. Law left the child relation to hadânah child is permissible, because his departure to think of religion, not to sin. Islam allows for parents to abandon children as long as his departure for religion, andthe child is entrusted to close relatives or to others by paying the cost of care.

Abstract

Misyar marriage is a marriage in which a wife is willing to give up part of her rights and live separately from her husband. The scholars' differed in their opinion regarding the law of performing misyar, but what is more important to discuss is how the concept of rights and obligations of husband and wife can be achieved. The purpose of this study is to analyze the couple’s rights concept and obligations in misyar. Through a qualitative literature review, this study examines the validity of misyar according to the scholars and the fulfillment of the rights and obligations of husband and wife using an interdisciplinary approach. Misyar is still said to be valid if the conditions and harmonious marriage are fulfilled, as for the cancellation of some of the rights required or permitted by one of the partners does not make this marriage haram, but some scholars call it makruh and even prohibit it, because it will bring harm to the wife and not fulfill the rights and obligations. Misyar seems as if the goal is only to fulfill lust and forget the main purpose of marriage which is essential to achieve a safe family.

Abstract

Children are the responsibility of parents, as long as they are not mature (adult) as their needs are the responsibility of parents, but when they grow up there are limits in both normative and positive laws that allow children to work, in reality many children are already working looking for income under the specified age. The problem is when can children work in both normative and positive law? This research is to be able to clearly describe a rule that applies, so that parents do not employ underage children. This research is a library research, namely a literature review of the views of the scholars and the laws and regulations in Indonesia with a philosophical-sociological approach. From a normative legal perspective, scholars agree that a child who has reached puberty can only carry out his religious obligations, including work, because he is considered an adult, while in Indonesian legislation, a child is said to be an adult when he is 21 years old, so that at that age, the child has an established mind, physically and psychologically.
