Abstract

Penelitian ini bertujuan untuk mengetahui penerapan sanksi pelanggar lalu lintas oleh anak pasca penerapan e-tilang dan bentuk tindak lanjut oleh aparat penegak hukum terhadap anak yang ditilang. Penelitian ini merupakan penelitian hukum empiris (empirical research). Dalam rangka memperoleh data yang relevan dengan kebutuhan penelitian ini,. Hasil penelitian menunjukkan bahwa penerapan sanksi pelanggar lalu lintas oleh anak dilakukan tidak sesuai dengan ketentuan undang-undang sistem peradilan pidana anak dan peraturan pemerintah tentang Pedoman Pelaksanaan Diversi dan Penanganan Anak Yang Belum Berumur 12 (Dua Belas) Tahun. Penindakan terhadap pelanggar anak, dilakukan dengan meneruskan berkas pelanggaran anak yang bersangkutan ke Pengadilan dan dijatuhi sanksi berupa denda. Penindakan lanjutan oleh aparat penegak hukum terhadap anak yang ditilang di Kab, Konawe adalah dalam bentuk penjatuhan sanksi Pidana Denda. Aparat penegak hukum masih belum menerapkan UU SPPA khususnya dalam penanganan tindak pidana pelanggaran lalu lintas yang dilakukan oleh anak.

Abstract

AbstractOne of the decisions that can be used as a reference related to the restoration of peatlands is the verdict against the law by PT. Kalista Alam which was sued by the Ministry of Environment and Forestry. In this decision, the company was sentenced to carry out environmental restoration actions on burned peat land covering an area of ​​​​approximately 1000 hectares. This paper aims to analyze the basis of judges' considerations for imposing sentences for reparations, and their relationship to corporate responsibility within the framework of legal arrangements related to guiding principles regarding business and human rights. This paper is a conceptual paper that analyzes the judge's considerations in making the decision normatively, and its relationship to the guiding principles regarding business and human rights. The findings show that the judge's decision is in line with the guiding principles regarding business and human rights which considers access to recovery from environmental damage that has occurred, and the impact on the surrounding community.Keywords: Corporate Responsibilities; Peatland Restoration; Environment. AbstrakSalah satu putusan yang dapat menjadi rujukan terkait dengan pemulihan lahan gambut, adalah putusan perbuatan melawan hukum yang dilakukan oleh PT. Kalista Alam yang digugat oleh Kementerian Lingkungan Hidup dan Kehutanan. Dalam putusan ini, perusahaan dihukum untuk melakukan tindakan pemulihan lingkungan terhadap lahan gambut yang terbakar seluas kurang lebih 1000 hektar. Tulisan ini hendak menganalisis dasar pertimbangan hakim untuk menjatuhkan hukuman tindakan pemulihan, dan hubungannya dengan tanggung jawab korporasi dalam kerangka pengaturan hukum terkait dengan prinsip-prinsip panduan mengenai bisnis dan HAM. Tulisan ini merupakan tulisan konseptual yang menganalisis pertimbangan hakim dalam menjatuhkan putusan tersebut secara normatif, dan hubungannya dengan prinsip-prinsip panduan mengenai bisnis dan HAM. Hasil temuan menunjukkan bahwa putusan hakim telah sejalan dengan prinsip-prinsip panduan mengenai bisnis dan HAM yang mempertimbangkan akses pemulihan kerusakan lingkungan yang terjadi, dan dampak yang ditimbulkan pada masyarakat sekitar. Kata Kunci: Tanggung Jawab Korporasi; Pemulihan Lahan Gambut; Lingkungan Hidup.

Abstract

Introductioan: The current proliferation of online buying and selling is also followed by the high risk of online fraud.Purposes of the Research: Know and understand the legal effects of fraud in online buying and selling agreements in the Indonesian positive law.Methods of the Research: This research is a normative legal research. It applied some approaches such as a statutory approach, a case approach, a conceptual approach, an analytical approach, and a theoretical approach. The legal materials used were qualified as a primary, secondary, and tertiary legal materials. They were then analysed with qualitatively with deductive and inductive methods.Results of the Research: The legal consequence of fraud in online buying and selling agreements in the Indonesian positive law creates responsibility for consumer losses in electronic transactions as regulated by those regulations. For losses of the consumer, the person, who due to his/her fault published the loss, should compensate the loss.

Abstract

This study aims to: 1) Assess the legal strength of the minutes of meetings made by a notary to shareholders through the online system (Teleconference); 2) To check that the deed of the minutes of the meeting made by a notary to the shareholders through the online system (teleconference) is in accordance with the principle of professionalism as regulated in Law no. 2 of 2014 in conjunction with Law no. 30 of 2004 concerning the Position of a Notary. This type of research is normative legal research, namely by reviewing materials from various laws and regulations and other supporting materials from various literatures related to the problem. Non-legal materials obtained using a conceptual approach carried out at Notary and/or PPAT offices in Makassar City through interviews. Then the legal and non-legal materials are analyzed using qualitative methods, namely analyzing legal materials related to the problem under study and the results obtained are described descriptively, namely by describing, explaining and describing according to the problems in this study, conclusions will then be drawn. The results of this study indicate that: 1) The legal force of the deed of minutes of the GMS by a notary through the online teleconference system can be seen in Article 77 of the Company Law which allows that the GMS can be held via teleconference. The implementation of the GMS through teleconference has binding legal force for all parties. However, the implementation of the GMS by teleconference has several drawbacks such as not having a quorum while the rules at the GMS must all be present, the network/internet connection is usually disrupted, the signature on the attendance list in the evidence can be denied, and then there can be forgery of faces or clothes. 2) In terms of conformity with the deed of minutes of the GMS via teleconference which is connected with the principle of professionalism, there are differences of opinion between the notaries, namely, in looking at articles such as Article 77 and Article 76 paragraph (4), namely if the GMS is present and/or represented by all shareholders and all shareholders agree to hold a GMS with a certain agenda, the GMS can be held anywhere with due observance of the provisions as referred to in paragraph (3 ). Based on these rules, it is possible to have conformity with the principles of professionalism of the UUJN.

Abstract

The development of technology brings changes in human life, and the shift of most human activities to cyberspace is now a challenge for every country in the world. Cyber-attacks are crimes that have developed rapidly with the development of information communication and technology (ICT). Due to its impact, cyber-attacks can be considered as a crime called a crime of aggression. The focus of this paper is to determine the urgency of regulating cyberattacks as a crime of aggression and to find out the extent to which the international community has made cybercrime the focus of contemporary crime research, which is referred to as a crime of aggression. This paper shows that international cooperation is needed to create an international regime that is respected and universally accepted by the international community in relation to cyber-attacks, which can also be referred to as crimes of aggression. It is because cyber-attacks in its nature are transnational crimes and need a cooperation such as the framework of ASEAN to deal with.

Abstract

ABSTRAKMeningkatnya konsumsi dan penggunaan plastik di era modern menyisakan berbagai permasalahan terhadap lingkungan. Sampah plastik yang sulit terurai, ditambah dengan pengelolaannya yang kurang terintegrasi, berimplikasi pada pencemaran lingkungan di darat dan di laut. Salah satu pihak yang paling bertanggung jawab dalam masalah ini adalah produsen dari produk yang menyisakan sampah plastik. Artikel ini hendak meninjau secara normatif berbagai aturan terkait pengelolaan sampah khususnya sampah plastik di Indonesia, termasuk dan terutama mengenai tanggung jawab produsen di dalam pengelolaan tersebut. Tinjauan dan analisis dilakukan dengan metode penelitian hukum normatif dengan menelaah berbagai peraturan perundang-undangan terkait. Temuan utama mengungkapkan, masih terdapat kekurangan dan tantangan implementasi pada aturan mengenai tanggung jawab produsen dalam pengelolaan sampah. Lebih lanjut, artikel ini juga mencoba menguraikan skema tanggung jawab produsen yang dimungkinkan untuk mengupayakan tanggung jawab produsen dalam mengurangi timbulan sampah plastik dari produk yang mereka hasilkan.Kata kunci: pengelolaan sampah plastik; tanggung jawab produsen; peraturan perundang-undanganABSTRACTThe increasing number of consumption and use of plastic in the modern era leaves various environmental problems. Plastic waste that is difficult to decompose, added with less integrated management, has implications for environmental pollution on land and at sea. One of the parties that holds responsibility for this problem is the producer of products that generate plastic waste. This article aims to normatively review various regulations related to waste management, especially plastic waste in Indonesia, including and especially regarding the responsibility of producers in such management. The review and analysis are carried out using a normative legal research method by examining various relevant laws and regulations. The main findings reveal that there are shortcomings and challenges in implementing the rules regarding producer responsibility in waste management. Furthermore, this article also tries to outline a possible producer responsibility scheme to seek producer responsibility in reducing the generation of plastic waste from the products they produce.Keywords: plastic waste management; manufacturer's responsibility; laws and regulations.

Abstract

The rising number of sea travel is followed by the emerging number of sea crimes such as sea piracy and maritime terrorism. In recent two decades, the number of crimes on the sea have shown an alarming figure, where areas with a dense traffic of vessels such as the Gulf of Aden and Malacca Strait becomes the hot spots for piracy crime. The main reason behind the emerging of modern piracy is the increasing number of sea transported goods which create a significant opportunity to be a huge target of crime considering the drives behind piracy is financial reason. Some area of sea piracy took place commonly in Africa and Southeast Asia.

Abstract

The rapid development of buying and selling online today is also followed by a high number of online based frauds. This study aims to determine the legal protection for consumers due to online buying and selling fraud. This research is a normative legal research using a statutory approach, a case approach, a conceptual approach, an analytical approach and a theoretical approach. The result of this study indicates that legal protection for consumers due to online buying and selling fraud creates responsibility for consumer losses in electronic transactions as regulated both in the ITE Law, Civil Code, Criminal Code and Consumer Protection Law. The consumer losses oblige the person who due to his fault published the loss has to compensate the loss. So the recommendation of the researcher is for the online buying and selling agreement is still prone to fraud, with this fraud, it issues legal consequences, the main cause of prone to the online buying and selling business fraud is because there are several parties who are not responsible for all the items sold.

Abstract

AbstractVarious strategic development interests aimed at propelling economic growth in Indonesia are increasingly being realized. A number of facilities are offered to enable the realization of this development, including provision of land through allocation of forest areas. This paper is devoted to normatively analyze the legal provisions regarding the use of forest areas for the realization of various strategic development projects, and to uncover related problems that arise at the normative level. By applying normative legal research methods, the main findings show that there are various legal issues revolving around the use of forest areas for strategic development purposes, including efforts to legitimize the illegal use of forest areas, absence of legal provisions regarding effective remedy from such a violation of forest areas utilization, and absence of legal guarantees for non-recurrence of the violation. These conditions contradict the principles contained in the Guiding Principles on Business and Human Rights (UNGPs).Keywords: Strategic Development; Use of Forest Areas; Recovery and Non-Recurrence Guarantee. AbstrakBerbagai bentuk pembangunan strategis untuk mendorong pertumbuhan ekonomi di Indonesia semakin gencar direalisasikan. Berbagai kemudahan bagi realisasi pembangunan tersebut diberikan termasuk dalam penyediaan lahan, salah satunya dengan mengalokasikan kawasan hutan. Tulisan ini hendak meninjau secara normatif berbagai ketentuan mengenai penggunaan kawasan hutan bagi realisasi proyek pembangunan yang bersifat strategis, dan permasalahan terkait yang timbul dalam tataran normatif. Dengan mengaplikasikan metode penelitian hukum normatif, temuan utama menunjukkan terdapat berbagai permasalahan dalam penggunaan kawasan hutan bagi kepentingan pembangunan strategis termasuk upaya legitimasi penggunaan kawasan hutan yang ilegal, belum adanya ketentuan hukum mengenai pemulihan dalam hal terjadi pelanggaran penggunaan kawasan hutan demikian, dan absennya jaminan hukum ketidakberulangan pelanggaran tersebut. Kondisi-kondisi ini secara keseluruhan bertentangan dengan Prinsip-Prinsip Panduan Bisnis dan Hak Asasi Manusia (UNGPs).Kata Kunci: Pembangunan Strategis; Penggunaan Kawasan Hutan; Pemulihan dan Jaminan ketidakb- erulangan

Abstract

The rapid ratification of the Rome Statute of the International Criminal Court (ICC) and the orderly election of its judges and prosecutor believe the radical nature of the new institution. Indonesia is one of countries that rejected the International Criminal Court (ICC) Statute. Indonesia’s reason at that time was that Indonesian sovereignty would be threatened or its national security would be compromise. Interestingly, some of the crimes within the Rome Statute jurisdiction (Article 5 of the Rome Statute) had been adopted by Indonesia in its domestic law such as the Law No. 26 year 2000 concerning Human Rights Court. Jurisdiction of the Law No. 26 year 2000 is and genocide and crimes against humanity. The Law No. 26 year 2000 also adopts the idea of Ad hoc tribunal that is possible to apply ex post facto justice. Finally, it plays important role in order to protect Indonesian interest and to fulfill international community point of views.
