Abstract

This research aims to analyze the legal implications of the increase in space debris generated through space commercialization activities. This research uses a normative legal method using a qualitative approach to determine the application of law in commercial activities carried out in space. The results of this study, namely: (1) the increase in space junk cases caused by commercial activities in space is increasing until 2022 due to various satellites being launched and causing junk to scatter freely in space. The rules of the Outer Space Treaty 1967 are still unable to guarantee legal certainty so that all parties carrying out commercial activities in space obey them; (2) the calculation of damage caused by commercial activities in space will result in liability that has been regulated in the Space Liability Convention 1972 that there are two legal principles governing the responsibility for compensation carried out by all parties in space, both state and private parties.

Abstract

Introduction to The Problem: Increasing cases of sexual violence, particularly against women, heighten concerns, prompting this group to be vigilant in self-protection. The lack of clarity on electronic-based sexual violence in the TPKS Law may lead to varied interpretations among law enforcement agencies. A normative study is crucial to discern the legislative intent and rationale, ensuring inclusion of these provisions in the TPKS Law. An ideal electronic-based criminal law policy is needed to universally safeguard victims, aligning with the principles of human dignity outlined in SDG 16 of the Global Agenda 2030.Purpose/Objective Study: This investigation sought to delineate the contours of Indonesia's legislative framework pertaining to electronic-based sexual violence within the ambit of criminal law policy. The significance of this inquiry lies in its inherent alignment with and contribution to the realization of Sustainable Development Goal 16, which fundamentally advocates for the promotion of peace, justice, and the fortification of robust institutional frameworks.Design/Methodology/Approach: The research method used is normative legal research with a statutory approach and qualitative analysis.Findings: Law Number 12 of 2022 addresses electronic-based sexual violence in Article 14(1) (a) and (b) but presents drawbacks, particularly concerning consensual consent. Recommending amendments to these articles is crucial to avoid discord with other regulations, striving for an optimal criminal law policy in Indonesia. Legal reforms should consider societal issues and contribute to effective law enforcement. Electronic-based sexual violence legislation must align with both expectations and realities, acknowledging the severity of the offense as a violation of human rights and a significant criminal act under SDG 16. The Indonesian government must establish and enforce laws to combat this activity, crucial for achieving SDG 16. Proposed amendments include introducing supplementary penalties, like revoking access rights to electronic media, to deter offenders.Paper Type: Research Article

Abstract

Introduction to The Problem: The revelation of cases of misuse of humanitarian donations by philanthropic organizations reported by the media. The Aksi Cepat Tanggap (ACT) organization, which is one of the suspects in the misuse of humanitarian donations, is a big question about the implementation of supervision carried out by the government. There are not many cases of ACT, there are several institutions or community organizations to government organizations that have misused their donations. The form of misuse of humanitarian donations with the misuse of public funds to the waste of funds.Purpose/Objective Study: This research aims to reconstruct the legal liability of social philanthropy institutions in the misuse of humanitarian funds. Thus, the collection of humanitarian donations can provide real benefits to the community, and government programs related to poverty alleviation can have a real impact.Design/Methodology/Approach: This type of research is normative juridical with an analytical descriptive approach that discusses legal symptoms and problems with a legislative and doctrinal approach.Findings: The author identifies a significant gap in governmental oversight concerning the collection of money or goods intended for humanitarian aid. This lack of supervision has resulted in the opportunistic exploitation of disaster events, where individuals or groups capitalize on the urgency and generosity elicited by such crises. These actors collect donations ostensibly for relief efforts but instead divert these resources to serve their own personal or financial interests. The absence of stringent regulatory frameworks and effective monitoring mechanisms allows for this misuse, undermining public trust and depriving genuine victims of the essential aid they desperately need. The author underscores the critical need for robust government intervention and accountability measures to safeguard the integrity of humanitarian donations and ensure they reach those most in need.Keywords: Reconstruction; Philanthropic Institutions; Humanitarian Donations

Abstract

Deforestation causes the availability of forest land for ecosystem and environmental, Forest management activities in Indonesia have been regulated in Law Number 41 of 1999 concerning. The Forestry Law states that all forests within the territory of the Republic of Indonesia, including the natural wealth in them, are controlled by the state for the greatest prosperity of the people. there is an environmental law enforcement agency appointed to supervise or take action against illegal loggers as well as a forest use licensing mechanism, however, the facts on the ground show that there are still many forestry activities that damage forest ecosystems and are even increasing. This research was conducted at the Kalaena Forest Management Unit (KPH) which carried out supervision in the Protected Forest Area area, This research is Empirical Research. The data used are primary, secondary and tertiary data. All data and materials obtained from the results of the research were compiled and analyzed qualitatively and presented descriptively.

Abstract

This article aims to examine the form of personal data protection in electronic certificates. This is a normative research with statutory and conceptual approaches. At the beginning of 2021, the Regulation of the Agrarian Affairs Ministry/Head of the National Land Agency concerning Electronic Certificates (it is referred to as Ministerial Regulation of National Land Agency Number 1 of 2021) which was issued on January 12, 2021 to modernize the land handling and services. This modernization is a form of digital transformation of the Ministry of Agrarian Affairs and Spatial Planning of National Land Agency (BPN). The digital transformation which is carried out by The Agrarian Affairs Ministry includes improving digital services and processing personal data from manual to digital, transforming conventional certificates into electronic certificates. The massive data leaks has become public concern regarding personal data. The Law number 27 of 2022 concerning the Protection of Personal Data, it can guarantee the rights of citizens by providing protection for personal data. The result of the research shows a product issued by the government with processing personal data. Based on the PDP Law, it must obtain approval from the Personal Data Protection Officer as a personal data protection form of the land rights holders.

Abstract

The implementation of a mortgage auction carries a high potential for lawsuits to cancel the auction due to objections from the debtor. This study analyzes the rights of heirs over assets encumbered with a mortgage based on credit agreements, aiming to provide legal certainty for auction winners and protection for mortgage auction winners. The research is normative with a legislative and conceptual approach. The findings show that inherited property mortgaged by the deceased, the heirs must fulfill the obligations. If they refuse, the bank can auction the property. However, auction winners often face legal disputes from heirs. For example, in Case No. 453/Pdt.G/2021/PN Mks, heirs sued Bank BRI and the auction winner, claiming ownership of the mortgaged property, despite the auction winner having valid proof. A similar issue occurred in Case No. 240/ Pdt.G/2019/PN Mks, where heirs sued PT Penanaman Modal Madani and the auction winner over a mortgaged asset due to non-performing loans. In both cases, auction winners encountered conflicts and difficulties in executing their rights despite winning the auction legally. This highlights that auction winners often lack adequate legal protection, especially in disputes with heirs. Despite existing auction regulations, legal uncertainty remains, and protection for auction winners needs improvement.

Abstract

Crimes of child pornography in Indonesia are becoming increasingly widespread and increasingly worrying. This is caused by the negligence of parents who do not supervise and provide education to children about the dangers of using the internet. So that this provides an opportunity for perpetrators of child pornography to commit all forms of unlawful acts against children as the target of perpetrators in creating child pornographic content so that the actions caused by the perpetrators must be accounted for according to the legal provisions set by the government. Even though the policies on the Pornography Law, the ITE Law, the Child Protection Law, and the Criminal Code have been stipulated by the government, it turns out that these policies are still not optimal in protecting Indonesian children from pornography crimes. This is because the concept of criminal responsibility in Indonesian positive law still uses the determination of the ability to be responsible in determining mens rea/the inner attitude of perpetrators of child pornography crimes. In addition, child pornography crimes are special crimes (Lex Specialis) so that child pornography liability needs to be studied whether child pornography crimes in the concept of criminal liability are regulated in special provisions or return to general provisions. So from these problems it is necessary to formulate the concept of criminal responsibility in Indonesian positive law, especially in dealing with perpetrators of child pornography, in order to suppress the rapid growth of these crimes and protect Indonesian children from perpetrators of child pornography.

Abstract

Nilai-Nilai Karakter dalam Syair Lagu Bertema Perjuangan Karya Ismail Marzuki. Derasnya arus globalisasi, akibatnya bangsa Indonesia mengalami tantangan di antara cita-cita mengisi kemerdekaan dan kehidupan sehari-hari. Nilai-nilai nasionalisme mendegradasi dan bisa mengancam persatuan dan kesatuan bangsa. Oleh karena itu, dibutuhkan sebuah upaya untuk menanamkan nilai-nilai nasionalisme dan nilai nilai karakter kepada generasi muda. Salah satu cara untuk memperbaiki keadaan tersebut adalah dengan mengedepankan pendidikan atau penanaman nilai-nilai karakter terhadap generasi muda. Salah satu cara untuk menanamkan nilai-nilai karakter pada generasi muda adalah melalui lagu, seperti lagu perjuangan karya Ismail Marzuki yang selalu berpijak pada idealism dan nasionalisme. Tujuan dari penelitian ini untuk mengetahui nilai-nilai karakter apa saja yang terdapat dalam syair lagu-lagu bertema perjuangan Ismail Marzuki. Metodologi dalam penelitian ini adalah metode penelitian kualitatif. Teknik pengumpulan data yang digunakan yaitu studi kepustakaan. Teknik analisis data yang digunakan yaitu analisis data Kualitatif dengan langkah-langkah reduksi data, penyajian data, kesimpulan atau verifikasi. Hasil penelitian ini menunjukkan: dari 15 lagu-lagu perjuangan yang telah dianalisis, memuat 8 nilai karakter yang terkandung di dalamnya. Nilai karakter yang muncul adalah Cinta Tanah Air, Semangat Kebangsaan, Religius, Kerja Keras, Tanggung Jawab, Menghargai Prestasi, Cinta Damai, dan Peduli Lingkungan. Hal ini berarti lagu-lagu bertema perjuangan karya Ismail Marzuki memiliki nilai edukasi dan nilai-nilai karakter yang penting dan dapat ditanamkan pada generasi muda.Kata kunci: Lagu Bertema Perjuangan, Ismail Marzuki, Nilai Karakter.

Abstract

This research examines the complex relationship between state security and human rights in Indonesia and The Gambia, two nations with distinct sociopolitical landscapes. In times of political unrest, terrorism, or civil conflict, efforts to ensure state security often compromise individual rights. The study explores how each country balances these competing demands, particularly during separatist movements, post-authoritarian transitions, and security crises. Using a comparative approach, it analyzes legal frameworks, institutional responses, and international commitments to human rights. The paper draws on recent case studies, including the Papua conflict in Indonesia and human rights reforms in The Gambia, to highlight ongoing challenges and strategies. The findings shed light on the broader global tension between surveillance-driven security measures and the protection of civil liberties.

Abstract

Salah satu media efektif dalam mengimplementasikan nilai-nilai multikultural adalah melalui pembelajaran sejarah. Penelitian ini bertujuan untuk mengetahui implementasi nilai-nilai multikultural dalam pembelajaran sejarah di SMAN 1 Tulang Bawang Tengah. Penelitian ini merupakan jenis penelitian kualitatif. Teknik pengumpulan data dalam penelitian ini dilakukan dengan observasi, wawancara, angket/kuesioner dan dokumentasi. Teknik pemeriksaan keabsahan data menggunakan teknik trianggulasi teknik dan sumber. Analisis data yang digunakan adalah model analisis interaktif. Hasil penelitian mengungkapkan bahwa implemetasi nilai-nilai multikultural dalam pembelajaran sejarah di SMAN 1 Tulang Bawang Tengah telah terimplementasi maksimal Implementasi nilai-nilai multikultural dalam pembelajaran sejarah di SMAN 1 Tulang Bawang Tengah tidak hanya diajarkan di dalam kelas saja, namun juga melalui pembelajaran di luar kelas.
