Abstract

Corruption crimes in Indonesia are on the rise, particularly through illicit enrichment where individuals accumulate wealth outside of legitimate income. Although Indonesia has ratified the United Nations Convention Against Corruption (UNCAC), the specific issue of illicit enrichment outlined in Article 20 has yet to be implemented in national legislation. This article aims to investigate current and potential future strategies to combat such corruption.  The research is a normative study using a comparative law approach and corpus-based critical analysis to assess Indonesia's anti-corruption efforts, explore the international standards set by illicit enrichment regulations, and draw lessons from the unexplained wealth laws in the United Kingdom and Australia. This research concludes that Indonesia has ratified UNCAC, but illicit enrichment in Article 20 of UNCAC has not been regulated in the law, so the practice of corruption is still so massive. To overcome this, strategic steps are needed in the future, such as revising the corruption law to include illicit enrichment regulations, optimizing institutions through bureaucratic reform, and activating community participation. Therefore, these three steps are very important in implementing the Illicit Enrichment regulation in advancing the corruption eradication agenda in Indonesia in the future.

Abstract

The concrete division of authority for government affairs between the center and the regions is still a matter of debate to this day, even though in principle the principle of broadest autonomy requires regional governments to carry out government affairs independently and freely. The principle of broadest autonomy in question is the independence of regional heads' powers. Abstract

Sexual violence in educational environments, especially universities, is a significant social issue that needs urgent attention. This study highlights the issue of sexual violence in university settings, focusing on understanding the role of victims in cases of sexual violence from a victimological perspective. The purpose of this research is to analyze the extent to which internal and external factors influence victims' decisions to report or not report incidents, as well as to explore victims' involvement in incidents of sexual violence. Using an empirical legal method with a case-based approach, this study combines surveys, interviews, and literature reviews to gather primary and secondary data. The novelty of this research lies in its in-depth analysis of the psychological and social dynamics affecting victims' involvement in sexual violence cases on campus. The findings indicate that in some cases, victims may indirectly contribute to the occurrence of sexual violence due to unawareness of their social surroundings, referred to as "imprudent victims" in victimology. This study recommends establishing a PPKS Task Force and introducing “Sahabat PPKS” in each faculty as strategic measures to create a safe and supportive campus environment for victims. The research aims to contribute to the development of comprehensive protection policies, including legal, psychological, and social support for victims within academic settings.

Abstract

Dynastic politics, practiced by certain groups of individuals with kinship ties or close relationships, dominate political positions in regional head elections and local government administration processes. This phenomenon persists due to the lack of concrete regulations, thereby normalizing it as a political practice in Indonesia. This study aims to elaborate on the facts surrounding dynastic political practices, examine how such practices undermine the democratic ideals envisioned by the people, and propose prospective regulatory frameworks to address this issue. The research employs a normative juridical method with statutory, historical, and conceptual approaches. The findings reveal that dynastic political practices harm the democratic system and tend to be more formalistic rather than providing a genuine opportunity for the people to elect leaders aligned with their will. To prevent such practices in the future, the government, the legislature, and election organizers must collaborate to formulate concrete regulatory norms in the Regional Head Election Law.

Abstract

The continued hijack of shipping vessels on the Red Sea by extremists who claim to have declared war against Israel is one of those blowouts that have been caused by the Israel - Hamas conflict. The journey to unencumbered waters and unfettered shipping access itself has led to several agreements between sovereign states towards the maintenance of seamless high-seas traffic. Unfortunately, non-state actors occasionally come on the scene to wreak havoc and destabilize the fragile peace on international waterways. It is in this regard, that this study tends to examine the Red Sea crisis as it affects global shipping maritime transit and economic growth, especially of African countries vis-a-vis the UN Security Council's role of maintaining world peace and security. The study adopts a doctrinal method of study, the data obtained from primary and secondary sources such as laws and academic literature were analyzed using a descriptive and analytical method. The study therefore found that Rebels are using the pretext of Israel's attacks on Gaza to perpetrate piracy. The Israel - Hamas deadlock has created a deadlocked lose-lose situation for the international community and resulted in new incidents of insecurity within the Red Sea. The study therefore concludes and recommends that the United Nations as the global police especially through the UN Security Council examine all options for securing peace and stability in the Red Sea region as attacks on shipping vessels have global ramifications affecting multiple nationalities and invariably affecting world peace.
