Abstract

Corruption is a universal problem that is taking place all over the world, either in developed countries or developing or under developing countries. It is caused by some issues such as poorly designed economic policies, low levels of education, underdeveloped civil society, and the weak accountability of public institution. Those causes of corruption can be separated in some different types of corruption. The types are bureaucratic corruption, political corruption, grand corruption, and common corruption. In terms of tackling some problems of corruption, there are so many things to do including international law commitment. Some international law commitment can be seen like OAS Convention, OECD’s anti-bribery Convention, the UN Convention against Transnational Organized Crime, and the United Nation Convention against Corruption (UNCAC). Those laws must be analyzed not only in context of substantive of those laws but also how they are implemented in state practices.

Abstract

Drugs Law and Legal Practice in Southeast Asia investigates criminal law and practice relevant to drugs regulation in three Southeast Asian jurisdictions: Indonesia, Singapore and Vietnam. These jurisdictions represent the spectrum of approaches to drugs regulation in Southeast Asia, highlighting differences in practice between civil and common law countries, and between liberal and authoritarian states.

Abstract

During the independence war of Indonesia, particularly, Kraai Operation or in the military base, also known as the Dutch Military Aggression II in the Lampung Residency, made many contributions to maintaining state sovereignty. The revolution in the Lampung region was part of the Sumatra Province, namely the Lampung Residency. This study aimed to find out the impact of the Kraai Operation. The research used historical research methods. We conducted the research in three regions once the Lampung Residency’s emergency capital focused on politics, the military, and economics. During the Kraai Operation period or Dutch Military Aggression II 1949-1950, Lampung Residency led by Gele Harun Nasution issued political, military, and economic policies to counteract the Kraai Operation. He moved the Government and Defense, formed the North Front, Central Front, and Southern Front, and coordinated the camps in the Lampung Residency. Moreover, he printed emergency money for the Residency of Lampung to prevent the spread of the Dutch currency, which affected inflation.Keywords: Lampung Residency; Emergency Government; Kraai Operation; Gele Harun Nasution; Revolution Selama perang kemerdekaan Indonesia, khususnya Operasi Kraai atau Agresi Militer Belanda II, Karesidenan Lampung banyak memberikan kontribusi untuk menjaga kedaulatan negara. Penelitian ini bertujuan untuk mengetahui dampak dari Operasi Kraai di wilayah Keresidenan Lampung. Penelitian ini menggunakan metode penelitian sejarah. Penelitian ini dilakukan di tiga wilayah yang pernah menjadi ibu kota darurat Karesidenan Lampung yang fokus pada bidang politik, militer, dan ekonomi. Pada masa Operasi Kraai atau Agresi Militer Belanda II 1949-1950, Karesidenan Lampung yang dipimpin oleh Gele Harun Nasution mengeluarkan tiga kebijakan yakni politik, militer, dan ekonomi untuk menangkal Operasi Kraai. Ia menggerakkan Pemerintahan dan Pertahanan, membentuk Front Utara, Front Tengah dan Front Selatan serta mengkoordinasikan kamp-kamp di Karesidenan Lampung, dan mencetak uang darurat untuk Karesidenan Lampung untuk mencegah penyebaran mata uang Belanda yang berdampak pada inflasi besar di wilayah republic.Kata Kunci: Karesidenan Lampung; Pemerintah Darurat; Operasi Kraai; Gele Harun Nasution; Revolusi

Abstract

Talking about human rights in the absence of development is nonsense. Therefore, Palestinian human rights are deficient due to the disruption of development in the occupied Palestinian territories. The purpose of this study is principally to analyze the obstacles to the development process in Palestine, examine the scope of the role of the United Nations in supporting development in Palestine under Israeli occupation, and compare that with its role in Rakhine. The methodology refers to a comparative analytical study and a statutory and conceptual approach, revealing that the existence of the Israeli occupation is considered the main obstacle to development in Palestine; and the role of the United Nations has been ineffective to date in ending this occupation; therefore, the role of the United Nations in protecting the Palestinians' right to development is very limited, as the realization of the right to development is linked to the realization of the right to self-determination for the Palestinian people. Development requires the unification of regions and the optimal exploitation of natural resources, but this is not possible in Palestine because of the policies of the Israeli occupation in building settlements, imposing a complete blockade on the Gaza Strip and separating it from the West Bank, and dividing the West Bank into areas of influence, as well as imposing complete control over the natural resources and preventing the Palestinians from benefiting from them, with the aim of keeping the Palestinian economy weak and under Israeli control, thereby keeping the Palestinian decision under the influence of Israel. In conclusion, the role of the United Nations is ineffective in supporting development in Palestine and Rakhine, due to the inability of the Security Council to take any effective action due to the disagreement of the permanent members.

Abstract

This research aims to examine electronic signature arrangements in electronic general meetings of shareholders. and to find out about the proof of the electronically signed deed of the minutes of the general meeting of shareholders. The research was carried out using normative research methods using a statutory approach and a conceptual approach. Analysis of legal materials uses descriptive analysis which is used to solve problems regarding the legal issues to be researched. The research results show that regulations regarding electronic signatures are contained in Article 1 number 12 of the ITE Law which explains that every electronic signature contains verified electronic information in it. And Article 11 of the ITE Law explains that electronic signatures must have legal force and legal consequences that fulfill the requirements stated in that article. And when using an electronic signature, it must be registered and certified so that legal certainty is guaranteed. Regarding the strength of the evidence, this is still doubtful because in the UUJN itself there is no specific regulation regarding the preparation of deeds carried out electronically. In implementing the GMS, the GMS minutes deed use the legal principle of lex specialis derogate legi generali. Lex generalis is Article 16 Paragraph (1) letter m, and lex specialis is the provisions of Article 77 Paragraph (4) UUPT. The legal validity of the deed of the GMS Minutes held via teleconference media still has legal force as an authentic deed and can be used as evidence in court if there are problems in the future.

Abstract

Tridharma Perguruan Tinggi merupakan tanggung jawab dosen yang tentunya harus dilakukan. Penelitian dan pengabdian merupakan salah satu aspek yang menjadi kewajiban dari setiap dosen. Penelitian dan pengabdian ini betujuan guna meningatkan keterampilan dosen dalam penggunaan aplikasi pengolah data penelitian agar mendapatkan hasil yang maskimal, sebab Statistical Product and Service Solutions (SPSS) merupakan salah satu aplikasi pengolah data statistik yang tentunya sangat dibutuhkan oleh para dosen untuk membantu mereka dalam menyelesaikan penelitiannya. Namun, masih banyak terdapat dosen FKIP Universitas lampung khususnya para dosen muda yang belum dapat mengoprasionalkan aplikasi SPSS ini dengan maksimal. Oleh karena itu, perlu diadakannya pelatihan guna meningkatkan kemampuan dosen dalam mengoprasikan aplikasi ini. Kegiatan pelatihan menggunakan metode penyuluhan, diskusi, dan workshop. Mitra kegiatan pada pelatihan ini adalah Fakultas Keguruan dan Ilmu Pendidikan Universitas Lampung.

Abstract

This research analyzes the problems of democratic and aspirational recruitment models and mechanisms for legislative candidates by political parties, aiming at formulating cadre-based recruitment arrangements that best represent democratic ideals. Using normative legal, conceptual, statutory and comparative approaches, this article argues that there are two principal recruitment problems. First, legal arrangement pertaining to methods, procedures, and requirements for the recruitment is generally absent from the statutory regulations.  Second, the internal process of decision-making within the political party is generally undemocratic, owing partly to the pragmatism and power-oriented calculation of the elites within the party. Recommendation for ideal recruitment arrangements is thus proposed to ameliorate these problems. Among others, the recruitment by political parties must consider aspects of representativeness, ideological consistency, internal political party flow, development of career path-based cadre systems, and quota fulfillment. Additionally, political party cadre needs training to boost their skills in carrying out main duties and functions as a member of the Board People's Representatives

Abstract

The climate crisis is a threat to countries in the world. One of the factors causing the climate crisis is deforestation. Indonesia as the third largest tropical forest country in the world certainly has an impact on the world's climate. Indonesia is a victim of deforestation, moreover reforestation of forest land does not match the rate of deforestation. This research is a normative legal study, using comparative, conceptual, and regulatory approaches. This study discusses the implementation of the Conference of Parties - 27 (COP-27 ) agreement as the basis for establishing policy instruments in Indonesia in dealing with deforestation and looks at Sweden as a comparison in handling deforestation through a policy instrument scheme. This study found that Sweden, through its green politics concept, was able to control the harvesting and utilization of forest products effectively. COP-27 has environmental control principles, one of which is the global net zero principle, namely the earth's temperature is no more than 1.5 degrees. it is hoped that the principles in COP-27 will guide the Indonesian government in making legal policy instruments for environmental management, especially handling deforestation. This research suggests that, like Sweden's green politics, Indonesia needs to present strategic policies through the Green Environmentally Concept policy through policy instruments, be it through laws and regulations, government regulations, or presidential regulations to the level of regional regulations.

Abstract

Kondisi ekonomi masyarakat yang masih kuarang seperti minimnya keterampilan khususnyayang dimiliki masyarakat, serta rendahnya tingkat pengetahuan masyarakat dalam bidang tata bogayang bisa dijadikan bekal untuk berwirausaha. Rumusan masalah dalam penelitian ini adalahBagaimana Pengaruh Pelatihan Tata Boga Terhadap Sikap Berwirausaha Warga Belajar di SKB(Sanggar Kegitan Belajar) Gerung Kabupaten Lombok Barat Tahun 2016. Tujuan penelitian tujuan yangdicapai dalam penelitian ini adalah untuk mengetahaui bagaimanakah pengaruh pelatihan tata bogaterhadap sikap berwirausaha warga belajar di SKB Gerung Kabupaten Lombok Barat. Tujuan yangdicapai dalam penelitian ini adalah untuk mengetahui Bagaimanakah Pengaruh Pelatihan Tata BogaTerhadap Sikap Berwirausaha Warga Belajar di SKB Gerung Kabupaten Lombok Barat Tahun 2016Metode pengumpulan data yang digunakan yaitu metode angket sebagai metode pertama dandokumentasi metode pelengkap. Sedangkan metode analisis data yang digunakan adalah Chi Kuadrat.Hasil dari penelitian adalah berdasarkan analisa nilai signifikansi 9.866>9.488 maka Ho ditolak dan Haditerima, yang berarti ada pengaruh yang positif program pelatihan tata boga terhadap sikapberwirausaha warga belajar di SKB Gerung Kabupaten Lombok Barat 2016 artinya hasil penelitian iniadalah “signifikan”.Kata kunci: Pengaruh, Pelatihan Tata boga, Sikap Berwirausaha

Abstract

Masalah dalam penelitian ini adalah : Apakah ada hubungan antara kompetensi tutor dengan motivasi belajar warga belajar pendidikan kesetaraan Paket C di PKBM Ceria Desa Sesela Kabupaten Lombok Barat Tahun 2017/2018. Sedangkan tujuan penelitian ini adalah untuk mengetahui hubungan antara kompetensi tutor dengan motivasi belajar warga belajar pendidikan kesetaraan Paket C. Penentuan subjek dalam penelitian ini berjumlah 46 orang yang terdiri dari tutor dan warga belajar Paket C. Metode pengumpulan data yang digunakan yaitu metode angket sebagai metode utama dan dokumentasi sebagai metode pelengkap. Teknik analisis data menggunakan analisis korelasi product moment. Hasil penelitian menunjukkan bahwa nilai r hitung sebesar 0,874 sedangkan r tabel dengan taraf signifikansi 5% untuk N=46 yaitu 0,291 (r hitung 0,874> r tabel 0,291) Hal ini berarti bahwa Ho ditolak sedangkan Ha diterima. Berdasarkan tabel interpretasi koefisien korelasi dapat diketahui bahwa korelasi hitung sebesar 0,874 termasuk kategori yang sangat kuat. Jadi kesimpulan yang diambil adalah terdapat hubungan yang sangat kuat antara kompetensi tutor dengan motivasi belajar peserta didik kesetaraan Paket C di PKBM Ceria tahun 2017/2018.Kata Kunci: Kompetensi tutor, Motivasi belajar
