Abstract

Before the enactment of the Job Creation Law, liquid waste disposal was governed by a specific permit system. However, with the introduction of the Job Creation Law, this system transitioned to requiring businesses to obtain technical approvals to comply with wastewater quality standards. Challenges have emerged, particularly improper practices that fail to align with ethical environmental principles. This research critically examines Indonesia's legislative framework for liquid waste management, focusing on its implementation and impact under the Job Creation Law, with a specific emphasis on environmental sustainability. A significant finding highlights persistent issues in managing household and laundry wastewater, which remain inadequately addressed under current regulations. Such gaps undermine environmental ethics, both anthropocentrism and ecocentrism. This paper advocates for synchronized regulations and comprehensive guidelines to mitigate adverse effects on environmental sustainability, ensuring stronger legal protections for Indonesian society.

Abstract

The implementation of a mortgage auction carries a high potential for lawsuits to cancel the auction due to objections from the debtor. This study analyzes the rights of heirs over assets encumbered with a mortgage based on credit agreements, aiming to provide legal certainty for auction winners and protection for mortgage auction winners. The research is normative with a legislative and conceptual approach. The findings show that inherited property mortgaged by the deceased, the heirs must fulfill the obligations. If they refuse, the bank can auction the property. However, auction winners often face legal disputes from heirs. For example, in Case No. 453/Pdt.G/2021/PN Mks, heirs sued Bank BRI and the auction winner, claiming ownership of the mortgaged property, despite the auction winner having valid proof. A similar issue occurred in Case No. 240/ Pdt.G/2019/PN Mks, where heirs sued PT Penanaman Modal Madani and the auction winner over a mortgaged asset due to non-performing loans. In both cases, auction winners encountered conflicts and difficulties in executing their rights despite winning the auction legally. This highlights that auction winners often lack adequate legal protection, especially in disputes with heirs. Despite existing auction regulations, legal uncertainty remains, and protection for auction winners needs improvement.

Abstract

Penelitian ini bertujuan untuk :  (1) Menganalisis, mengevaluasi, dan mencari tahu sejauh mana efektivitas UU ITE terhadap tindak pidana pornografi berbasis Dating APPS di Kota Makassar. (2) Menganalisis, mengevaluasi, dan menemukan faktor yang berpengaruh terhadap efektivitas penegak hukum  Terhadap Tindak Pidana Pornografi Berbasis Dating APPS di Kota Makassar. Penelitian ini merupakan penelitian hukum empiris dengan menggunakan pendekatan lapangan, dimulai wawancara yang akan mengkaji dan menganalisis sejauh mana efektivitas UU ITE terhadap tindak pidana pornografi berbasis Dating APPS. Tipe penelitian ini meliputi kajian yang memandang hukum sebagai kenyataan, mencakup kenyataan sosial, kenyataan kultur dan kenyataan penegak hukumnya. Hasil penelitian ini menunjukan bahwa : (1) Dari segi relugasi telah dianggap memumpuni, namun jika dititik beratkan pada struktur penegak hukum, penulis menemukan masih banyaknya penyebaran informasi ataupun konten yang mengandung muatan asusila di beberapa aplikasi dating apps. (2) Efektivitas penegakan hukum belum maksimal dan edukasi tentang penyebaran konten bermuatan asusila belum maksimal sehingga kesadaran hukum masyarakat juga belum menyeluruh dan mendalam tentang regulasi UU ITE terhadap penyebaran konten bermuatan pornografi terkhusus di media dating apps.

Abstract

Study examines the legal accountability of household waste management in Makassar City within the framework of Indonesian environmental law and its alignment with Sustainable Development Goals, such as SDG 3 “Good Health and Well-Being” and SDG 14 “Life Below Water”. Employing a normative and empirical legal research approach, the study integrates primary data from legal instruments and field observations with secondary legal sources. The findings highlight that ineffective enforcement of criminal sanctions has contributed to the persistence of poor waste management practices. Instead, administrative sanctions, such as fines and corrective measures, have demonstrated greater effectiveness in ensuring compliance. Additionally, a lack of public awareness and inadequate waste segregation infrastructure further exacerbate waste management challenges. Data analysis from the National Waste Management Information System or Sistem Informasi Pengelolaan Sampah Nasional for 2020 until 2023 reveals that nearly 41% of total waste in Indonesia remains unmanaged, while Makassar alone generates approximately 1,000 tons of waste per day. Given these challenges, this study advocates for the enhancement of legal enforcement mechanisms by prioritizing administrative over criminal sanctions, strengthening public participation, and integrating sustainable waste management policies. Comparative insights from countries with successful waste management strategies, such as Japan and Sweden, underscore the importance of policy coherence, stakeholder collaboration, and technological innovations. The study concludes that an effective regulatory framework, coupled with community engagement and structured law enforcement, is essential for achieving intergenerational sustainability and environmental protection in Indonesia.

Abstract

This research aims to find out the implementation of regional autonomy in Indonesia in general and also to find out about Fiqh Siyasah's view on the implementation of regional autonomy in Indonesia. A qualitative approach was used in conducting this research and data was obtained through relevant literature studies. The result, Islam provides space for ijtihad in the area of ​​siyasah or state politics provided that it is done to achieve the goals of benefit and justice as well as the welfare of the general public. One of the things related to the siyasah area is related to the implementation of regional autonomy in Indonesia. Basically, the provision of regional autonomy in Indonesia is a space to provide opportunities for each region in this country to explore and develop the potential of each region in order to provide prosperity for regional communities. The conclusion, this article highlights the importance of local government autonomy within a federal structure to encourage grassroots democracy and self-governance. Islamic law does not have specific rules regarding regional autonomy, and this concept emerged during the reform era to promote justice and prosperity. However, Islam still acknowledges the concept of baldatun thayyibatun, which is based on the Qur'an and the Sunnah of the Prophet.

Abstract

The purpose of this study is to develop a history learning media integrated with science and technology, especially by implementing the STEM (Science, Technology, Engineering, and Mathematics) approach. One form of learning media innovation developed in this study is Virtual Reality (VR)-based media, which aims to improve students' critical thinking skills. This study uses the Research and Development (R&D) method with a 4D development model, which consists of four stages: 1) analysis stage, 2) design stage, 3) development stage, 4) implementation stage, and added stage 5) evaluation to measure the success of implementation. The research subjects involved students of class XII IPS 1 as the experimental class and XII IPS 2 as the control class at SMA Negeri 4 Bandar Lampung. The type of research used is a quasi-experiment with a pretest-posttest design. After the treatment was given to the experimental class through the use of VR-based HISGO media, the results of the analysis using the SPSS 24 application showed a significance value of 0.000 <0.05. This indicates a significant difference between the learning outcomes of the experimental class and the control class. Thus, this learning media is proven to be effective in improving students' critical thinking skills.

Abstract

Indonesia’s shift from criminal to administrative sanctions in addressing illegal use of forest areas—stipulated under Articles 110A and 110B of Law No. 6 of 2023—aims to legalize approximately 3.3 million hectares of unlicensed oil palm plantations. This study evaluates the effectiveness of administrative sanctions in promoting legal compliance and environmental accountability. Employing a normative legal research method with a descriptive qualitative approach, the study examines statutory frameworks, case studies, and empirical data from the Ministry of Environment and Forestry (MoEF). Findings reveal that while administrative sanctions offer expedited enforcement and reduce judicial burdens, they risk becoming legal loopholes exploited by corporations. The limited number of sanctioned companies—only 49—and the total fines of IDR 175.5 billion are disproportionately low relative to the scale of ecological damage. Nevertheless, the research highlights the potential of a hybrid enforcement model—integrating administrative, criminal, and civil legal instruments—to enhance compliance and ecological justice. It underscores the urgency of robust oversight and the application of criminal sanctions in severe cases to uphold the constitutional right to a healthy environment.

Abstract

This research aims to investigate the issues encountered by parliamentary institutions in Indonesia, focusing specifically on the disproportionate power of the first chamber the (Dewan Perwakilan Rakyat / DPR) People’s Representative Council, relative to the second chamber, the (Dewan Perwakilan Daerah / DPD) Regional Representative Council throughout the legislative process. This research presents normative-conceptual proposals for a reconstruction formula aimed at equilibrating the legislative functions of the two chambers, in alignment with the principles of balanced or robust bicameralism. This study utilises a doctrinal legal research framework, involving the analysis of primary and secondary legal sources in the literature. This study incorporates constitutional, theoretical, and statutory/normative techniques. This study applies a general qualitative descriptive analysis technique, focusing on interpreting legal texts and normative content in a structured manner to identify patterns, meanings, and implications in the legislative relationship between DPR and DPD. The research findings reveal that the legislative authority of the two chambers (DPD & DPR) in legislation making, as delineated in the 1945 Constitution of the Republic of Indonesia and statutory rules, remains disproportionate. This results from the DPD's limited authority to propose draft legislation and discuss proposals without final approval. The DPD continues to be acknowledged as a co-legislator or supplementary power in the legislative process, unlike the unrestricted authority of the DPR. Therefore, the relationship between the two chambers as representative entities must be redefined based on robust or equitable bicameralism. To execute rebuilding plans, it is essential to amend several parts of the Constitution and revise other legislative rules. The two chambers are expected to collaborate and meet the ambitions of both national and local governments to produce high-quality legal documents; however, this study is limited in scope to normative and doctrinal analysis, and further empirical research is needed to assess practical implementation.

Abstract

The purpose of this study is to compare the taxation policies of legislative members’ terms of office in Indonesia with the Philippines and the United States, along with an analysis of the urgency of the legislative member’s term of office. The study methodology employed is normative legal research. The findings of the research show that the legislative member’s term of office has not been regulated in the Indonesian constitution because Law No. 17 of 2014 only regulates the length of office in one period. This is distinct to the Philippines, which establishes a term limit for legislative members, where the term of office of senate members is 6 years and may be re-elected twice, while the term of office for the House of Representatives is 3 years and can be re-elected in three terms. Meanwhile, in the United States, there is also no regulation regarding the taking of terms of office, only the term of office of legislative members in the United States is only 2 (two) years each period, while in Indonesia it is quite long, namely 5 (five) years.

Abstract

Prior to the implementation of the Job Creation Law, wastewater management in Indonesia was governed by the granting of liquid waste management permits. Nevertheless, the implementation of the new law has supplanted these licenses with a technical approval system that mandates adherence to wastewater quality requirements. This study aims to examine the current legal framework governing wastewater management in Indonesia and assess its execution under the Job Creation Law, with a focus on environmental sustainability. The employed methodology is a normative and empirical legal research strategy, utilizing qualitative analysis via document examination and field observation in Kendari City. The findings suggest that the new legislation encounters implementation difficulties, particularly in overseeing wastewater from home and small-scale enterprises, such as laundry services, which are predominantly unregulated. The conclusion is that the existing legal framework has not adequately integrated principles of environmental ethics, including anthropocentrism and ecocentrism. Consequently, legal reform and the establishment of ethical principles are essential to guarantee environmental preservation and foster the sustainability of ecological functions.
