Abstract

Masalah dalam penelitian ini adalah : Apakah ada hubungan antara kompetensi tutor dengan motivasi belajar warga belajar pendidikan kesetaraan Paket C di PKBM Ceria Desa Sesela Kabupaten Lombok Barat Tahun 2017/2018. Sedangkan tujuan penelitian ini adalah untuk mengetahui hubungan antara kompetensi tutor dengan motivasi belajar warga belajar pendidikan kesetaraan Paket C. Penentuan subjek dalam penelitian ini berjumlah 46 orang yang terdiri dari tutor dan warga belajar Paket C. Metode pengumpulan data yang digunakan yaitu metode angket sebagai metode utama dan dokumentasi sebagai metode pelengkap. Teknik analisis data menggunakan analisis korelasi product moment. Hasil penelitian menunjukkan bahwa nilai r hitung sebesar 0,874 sedangkan r tabel dengan taraf signifikansi 5% untuk N=46 yaitu 0,291 (r hitung 0,874> r tabel 0,291) Hal ini berarti bahwa Ho ditolak sedangkan Ha diterima. Berdasarkan tabel interpretasi koefisien korelasi dapat diketahui bahwa korelasi hitung sebesar 0,874 termasuk kategori yang sangat kuat. Jadi kesimpulan yang diambil adalah terdapat hubungan yang sangat kuat antara kompetensi tutor dengan motivasi belajar peserta didik kesetaraan Paket C di PKBM Ceria tahun 2017/2018.Kata Kunci: Kompetensi tutor, Motivasi belajar

Abstract

Waqf is a unique Islamic economic instrument based on its function on the elements of virtue (birr), goodness (i'hsan) and brotherhood (u'khuwah). The distinguishing characteristic of waqf is that when the waqf is fulfilled, there is a shift in private ownership towards the ownership of Allah SWT which is expected to be eternal, providing sustainable benefits. Through waqf, it is hoped that there will be a process of distributing benefits for the wider community, from private benefits to social benefits. This study uses library research with descriptive qualitative methods, namely, first by recording all findings regarding the concept of global supply and demand in each research discussion obtained in the literature and sources, and or the latest findings regarding productive waqf. and investment. The conclusion of this study is that the real strategy in developing productive waqf lands is as follows, that Nazhir must establish business partnerships with other parties who have capital and business interests in accordance with the existing strategic land position with high commercial value. This collaboration is in order to mobilize all the economic potential of the waqf lands. Once again, it must be emphasized that the system of cooperation with third parties must still follow the Sharia system, both by way of musharaka and mudharabah as previously mentioned.

Abstract

Meningkatnya konsumsi dan penggunaan plastik di era modern menyisakan berbagai permasalahan terhadap lingkungan. Sampah plastik yang sulit terurai, ditambah dengan pengelolaannya yang kurang terintegrasi, berimplikasi pada pencemaran lingkungan di darat dan di laut. Salah satu pihak yang paling bertanggung jawab dalam masalah ini adalah produsen dari produk yang menyisakan sampah plastik. Artikel ini hendak meninjau secara normatif berbagai aturan terkait pengelolaan sampah khususnya sampah plastik di Indonesia, termasuk dan terutama mengenai tanggung jawab produsen di dalam pengelolaan tersebut. Tinjauan dan analisis dilakukan dengan metode penelitian hukum normatif dengan menelaah berbagai peraturan perundang-undangan terkait. Temuan utama mengungkapkan, masih terdapat kekurangan dan tantangan implementasi pada aturan mengenai tanggung jawab produsen dalam pengelolaan sampah. Lebih lanjut, artikel ini juga mencoba menguraikan skema tanggung jawab produsen yang dimungkinkan untuk mengupayakan tanggung jawab produsen dalam mengurangi timbulan sampah plastik dari produk yang mereka hasilkan.

Abstract

A mixed marriage is a marriage between two people from different countries or cultures. This can give rise to various legal issues, especially related to the status of children born from the marriage. Mixed marriages have become increasingly common in this era of globalization. However, when couples with different nationalities This article examines various legal issues that often arise from mixed marriages, especially related to the status of children born from the marriage, both related to family law, civil law, and children's rights. This article aims to contribute to understanding the legal complexities that arise from mixed marriages such as the legal aspects of mixed marriages, the rights and obligations of mixed marriage couples, the implementation of the legal aspects of mixed marriages in Indonesia, and the challenges and solutions in the implementation of the legal aspects of mixed marriages and provide insights that can be used to formulate improvements in legal policies and protection of children's rights at the national and international levels. In compiling the article, the researcher chose to use a normative legal approach method, by searching for regulations and literature related to issues regarding the status of children in mixed marriages. The results or findings of this article are that there are rights and obligations of mixed marriage couples, for example, they have the right to obtain citizenship from their husband/wife and must ensure that their marriage complies with the provisions of Indonesian marriage law. Abstract

Before the enactment of the Job Creation Law, liquid waste disposal was governed by a specific permit system. However, with the introduction of the Job Creation Law, this system transitioned to requiring businesses to obtain technical approvals to comply with wastewater quality standards. Challenges have emerged, particularly improper practices that fail to align with ethical environmental principles. This research critically examines Indonesia's legislative framework for liquid waste management, focusing on its implementation and impact under the Job Creation Law, with a specific emphasis on environmental sustainability. A significant finding highlights persistent issues in managing household and laundry wastewater, which remain inadequately addressed under current regulations. Such gaps undermine environmental ethics, both anthropocentrism and ecocentrism. This paper advocates for synchronized regulations and comprehensive guidelines to mitigate adverse effects on environmental sustainability, ensuring stronger legal protections for Indonesian society.

Abstract

Indonesia sebagai negara hukum memiliki kewajiban untuk menegakkan keadilan, kepastian hukum, dan kebermanfaatan. Salah satu pilar utama dalam hukum Indonesia adalah hukum pidana yang bertujuan untuk menjaga ketertiban masyarakat dan melindungi hak asasi manusia. Rancangan Undang-Undang Perampasan Aset menjadi bagian penting dalam reformasi hukum pidana di Indonesia untuk memulihkan kerugian negara yang diakibatkan oleh tindak pidana, terutama tindak pidana korupsi. Namun, tantangan besar muncul dalam implementasi perampasan aset, terutama yang berkaitan dengan hak milik dan perampasan aset yang berada di luar negeri atau dalam bentuk cryptocurrency. Penelitian ini bertujuan untuk menganalisis urgensi pengesahan Undang-Undang Perampasan Aset sebagai bagian dari reformasi hukum pidana di Indonesia, serta untuk mengidentifikasi tantangan dan solusi terkait implementasinya, terutama dalam menangani tindak pidana korupsi dan pengembalian kerugian negara. Penelitian ini menggunakan pendekatan normatif yuridis dengan studi kepustakaan, mengumpulkan bahan hukum dari peraturan perundang-undangan, doktrin, serta literatur yang relevan. Analisis dilakukan dengan mendalami teori hukum, regulasi terkait perampasan aset, dan praktik internasional mengenai perampasan aset tanpa keputusan pengadilan (Non-Conviction Based Asset Forfeiture). Hasil penelitian menunjukkan bahwa Rancangan Undang-Undang Perampasan Aset sangat penting untuk memulihkan kerugian negara akibat tindak pidana, termasuk korupsi. Namun, tantangan utama yang dihadapi adalah perbedaan pandangan mengenai hak milik pribadi dan kesulitan dalam mengimplementasikan perampasan aset yang berada di luar negeri atau dalam bentuk cryptocurrency. Negara-negara seperti Amerika Serikat dan Australia yang telah mengadopsi mekanisme Non-Conviction Based Asset Forfeiture dapat menjadi model untuk Indonesia. Rancangan Undang-Undang Perampasan Aset merupakan langkah penting dalam reformasi hukum pidana di Indonesia, yang tidak hanya bertujuan untuk memulihkan kerugian negara tetapi juga untuk menciptakan sistem hukum yang lebih transparan dan efektif. Implementasi perampasan aset di Indonesia harus mempertimbangkan tantangan yang ada, terutama terkait hak asasi manusia dan perampasan aset internasional. Negara lain yang telah sukses menerapkan sistem ini dapat dijadikan referensi dalam pengembangan hukum di Indonesia.

Abstract

This research aims to analyze the legal implications of the increase in space debris generated through space commercialization activities. This research uses a normative legal method using a qualitative approach to determine the application of law in commercial activities carried out in space. The results of this study, namely: (1) the increase in space junk cases caused by commercial activities in space is increasing until 2022 due to various satellites being launched and causing junk to scatter freely in space. The rules of the Outer Space Treaty 1967 are still unable to guarantee legal certainty so that all parties carrying out commercial activities in space obey them; (2) the calculation of damage caused by commercial activities in space will result in liability that has been regulated in the Space Liability Convention 1972 that there are two legal principles governing the responsibility for compensation carried out by all parties in space, both state and private parties.

Abstract

Introduction to The Problem: Increasing cases of sexual violence, particularly against women, heighten concerns, prompting this group to be vigilant in self-protection. The lack of clarity on electronic-based sexual violence in the TPKS Law may lead to varied interpretations among law enforcement agencies. A normative study is crucial to discern the legislative intent and rationale, ensuring inclusion of these provisions in the TPKS Law. An ideal electronic-based criminal law policy is needed to universally safeguard victims, aligning with the principles of human dignity outlined in SDG 16 of the Global Agenda 2030.Purpose/Objective Study: This investigation sought to delineate the contours of Indonesia's legislative framework pertaining to electronic-based sexual violence within the ambit of criminal law policy. The significance of this inquiry lies in its inherent alignment with and contribution to the realization of Sustainable Development Goal 16, which fundamentally advocates for the promotion of peace, justice, and the fortification of robust institutional frameworks.Design/Methodology/Approach: The research method used is normative legal research with a statutory approach and qualitative analysis.Findings: Law Number 12 of 2022 addresses electronic-based sexual violence in Article 14(1) (a) and (b) but presents drawbacks, particularly concerning consensual consent. Recommending amendments to these articles is crucial to avoid discord with other regulations, striving for an optimal criminal law policy in Indonesia. Legal reforms should consider societal issues and contribute to effective law enforcement. Electronic-based sexual violence legislation must align with both expectations and realities, acknowledging the severity of the offense as a violation of human rights and a significant criminal act under SDG 16. The Indonesian government must establish and enforce laws to combat this activity, crucial for achieving SDG 16. Proposed amendments include introducing supplementary penalties, like revoking access rights to electronic media, to deter offenders.Paper Type: Research Article

Abstract

Introduction to The Problem: The revelation of cases of misuse of humanitarian donations by philanthropic organizations reported by the media. The Aksi Cepat Tanggap (ACT) organization, which is one of the suspects in the misuse of humanitarian donations, is a big question about the implementation of supervision carried out by the government. There are not many cases of ACT, there are several institutions or community organizations to government organizations that have misused their donations. The form of misuse of humanitarian donations with the misuse of public funds to the waste of funds.Purpose/Objective Study: This research aims to reconstruct the legal liability of social philanthropy institutions in the misuse of humanitarian funds. Thus, the collection of humanitarian donations can provide real benefits to the community, and government programs related to poverty alleviation can have a real impact.Design/Methodology/Approach: This type of research is normative juridical with an analytical descriptive approach that discusses legal symptoms and problems with a legislative and doctrinal approach.Findings: The author identifies a significant gap in governmental oversight concerning the collection of money or goods intended for humanitarian aid. This lack of supervision has resulted in the opportunistic exploitation of disaster events, where individuals or groups capitalize on the urgency and generosity elicited by such crises. These actors collect donations ostensibly for relief efforts but instead divert these resources to serve their own personal or financial interests. The absence of stringent regulatory frameworks and effective monitoring mechanisms allows for this misuse, undermining public trust and depriving genuine victims of the essential aid they desperately need. The author underscores the critical need for robust government intervention and accountability measures to safeguard the integrity of humanitarian donations and ensure they reach those most in need.Keywords: Reconstruction; Philanthropic Institutions; Humanitarian Donations

Abstract

Deforestation causes the availability of forest land for ecosystem and environmental, Forest management activities in Indonesia have been regulated in Law Number 41 of 1999 concerning. The Forestry Law states that all forests within the territory of the Republic of Indonesia, including the natural wealth in them, are controlled by the state for the greatest prosperity of the people. there is an environmental law enforcement agency appointed to supervise or take action against illegal loggers as well as a forest use licensing mechanism, however, the facts on the ground show that there are still many forestry activities that damage forest ecosystems and are even increasing. This research was conducted at the Kalaena Forest Management Unit (KPH) which carried out supervision in the Protected Forest Area area, This research is Empirical Research. The data used are primary, secondary and tertiary data. All data and materials obtained from the results of the research were compiled and analyzed qualitatively and presented descriptively.
