Abstract

This study rigorously examines the practical implementation of participatory village autonomy, a linchpin for inclusive governance in Indonesia. Despite formal recognition by Law No. 6 of 2014 and its 2024 amendment , significant  hurdles persist, including elite domination, financial mismanagement, limited community engagement, and insufficient institutional capacity. Employing a normative legal methodology, this inquiry  identifies effective models of community engagement and application for the Indonesian context. Findings  affirm that village autonomy's democratization requires comprehensive legal reform, institutional strengthening, transparent administration, and active citizen involvement. Beyond mere electoral procedures, true democratization  demands cultural adaptation, community empowerment, and robust accountability mechanisms to prevent elite capture.  Synergistic collaboration among central, regional, and village governments is paramount for genuinely responsive local governance. Lessons from diverse precedents  underscore the necessity of community-driven planning and legally mandated public participation for sustainable village development. This research  concludes that empowered village autonomy can substantially foster an equitable and resilient Indonesian governance landscape, contingent upon holistic systemic reforms and diligent application of innovative engagement models.

Abstract

Indonesia’s solid waste management framework continues to face persistent legal and institutional challenges in harmonizing national policies with regional regulations within a decentralized governance structure. Despite the enactment of Law No. 18 of 2008 and subsequent regulatory instruments up to 2023, existing legal scholarship remains largely descriptive, focusing on compliance rather than addressing normative and institutional fragmentation particularly the misalignment between Law No. 18/2008 on Waste Management and Law No. 23/2014 on Regional Government. This study aims to fill that gap by employing a normative-empirical legal approach that combines doctrinal analysis with field-based interviews involving five key stakeholders from the Ministry of Environment and Forestry, provincial agencies, and legal experts. These structural weaknesses undermine policy coherence and highlight the limitations of relying solely on legal standardization. Drawing on decentralization theory and multi-level governance frameworks, this article offers two key contributions. First, it proposes the establishment of a National Regional Harmonization Council for Solid Waste Governance (NRHC–SWG) as a statutory mechanism to enhance vertical coordination. Second, it introduces the Multi-Level Governance Harmonization Index (MLGHI) as an evaluative model to assess coherence across normative, institutional, and operational dimensions. These prescriptive and analytical innovations aim to clarify the constitutional boundaries of regional autonomy under Article 18 of the 1945 Constitution, strengthen institutional synergy, and advance regulatory integration for sustainable solid waste governance in Indonesia.

Abstract

Indonesia faces a severe solid waste crisis, with more than 60 million tons generated annually. Weak law enforcement and insufficient fiscal support—regional budget allocations averaging only 0.6–1% of APBD, far below the 3% benchmark—have further exacerbated the problem. This study aims to develop an integrative legal framework for sustainable waste management that harmonises national environmental law with contemporary Islamic environmental jurisprudence (fiqh al-biʾah). Methodologically, the research employs a systematic review and doctrinal–normative analysis. Data were collected and classified from national statutes, government regulations, regional bylaws, and peer-reviewed literature, as well as case studies from Surabaya, Banyumas, and DKI Jakarta. These materials were then analysed through the lens of uṣūl al-fiqh and qawāʿid fiqhiyyah, including the maxims lā ḍarar wa lā ḍirār, maṣlaḥah ʿāmmah, ḥifẓ al-biʾah, and the principle of istikhlāf. The findings reveal three critical gaps. First, underfunding hinders early-warning systems and sustainable infrastructure. Second, the absence of faith-based fiscal tools—such as Green Zakat and Eco-Waqf—limits financing capacity and raises questions of compatibility with APBN/APBD structures and formal zakat institutions. Third, regulatory disharmony between central and regional authorities undermines effective coordination. This study proposes a holistic model that mandates a minimum 3% APBD allocation, institutionalises Islamic green finance mechanisms, and scales up municipal innovations such as Surabaya’s community-based 3R programs. It also highlights the socio-political dynamics affecting the acceptance of religiously informed legal frameworks. The novelty of this research lies in embedding fiqh al-biʾah into positive law and policy instruments, offering a faith-grounded yet implementable roadmap for Indonesia’s sustainable waste governance.

Abstract

Program pengabdian pelatihan penulisan bahan ajar berbasis modul bagi guru sejarah di Provinsi Lampung ini adalah bertujuan uuntuk meningkatkan kompetensi guru sejarah yang tergabung dalam Asosiasi di Provinsi Lampung dalam membuat modul yang relevan dengan karakteristik peserta didik, sehingga keterampilan guru meningkat dalam menyusun modul sejarah  yang kreatif, inovatif dan menarik serta mengintegrasikan kearifan lokal. Metode yang digunakan dalam program pengabdian ini adalah sosialisasi dengan bentuk presentasi yang dilakukan oleh narasumber tim pengabdian sendiri dan pelatihan secara langsung dengan bentuk pendampingan kepada peserta pengabdian. Instrument yang digunakan adalah Materi yang tersaji dalam bentuk power point, Contoh modul dan buku ajar sejarah, dan Lembar evaluasi kegiatan dalam bentuk pre test dan post tes. Analisis data dilakukan secara kualitatif. Hasil pengabdian menunjukkan bahwa kegiatan pengabdian pengabdian pelatihan penulisan bahan ajar berbasis modul bagi guru sejarah di Provinsi Lampung terlaksana dengan baik dan meningkatnya kreativitas dan kompetensi  guru terhadap modul sejarah.

Abstract

Meningkatnya konsumsi dan penggunaan plastik di era modern menyisakan berbagai permasalahan terhadap lingkungan. Sampah plastik yang sulit terurai, ditambah dengan pengelolaannya yang kurang terintegrasi, berimplikasi pada pencemaran lingkungan di darat dan di laut. Salah satu pihak yang paling bertanggung jawab dalam masalah ini adalah produsen dari produk yang menyisakan sampah plastik. Artikel ini hendak meninjau secara normatif berbagai aturan terkait pengelolaan sampah khususnya sampah plastik di Indonesia, termasuk dan terutama mengenai tanggung jawab produsen di dalam pengelolaan tersebut. Tinjauan dan analisis dilakukan dengan metode penelitian hukum normatif dengan menelaah berbagai peraturan perundang-undangan terkait. Temuan utama mengungkapkan, masih terdapat kekurangan dan tantangan implementasi pada aturan mengenai tanggung jawab produsen dalam pengelolaan sampah. Lebih lanjut, artikel ini juga mencoba menguraikan skema tanggung jawab produsen yang dimungkinkan untuk mengupayakan tanggung jawab produsen dalam mengurangi timbulan sampah plastik dari produk yang mereka hasilkan.

Abstract

The continued hijack of shipping vessels on the Red Sea by extremists who claim to have declared war against Israel is one of those blowouts that have been caused by the Israel - Hamas conflict. The journey to unencumbered waters and unfettered shipping access itself has led to several agreements between sovereign states towards the maintenance of seamless high-seas traffic. Unfortunately, non-state actors occasionally come on the scene to wreak havoc and destabilize the fragile peace on international waterways. It is in this regard, that this study tends to examine the Red Sea crisis as it affects global shipping maritime transit and economic growth, especially of African countries vis-a-vis the UN Security Council's role of maintaining world peace and security. The study adopts a doctrinal method of study, the data obtained from primary and secondary sources such as laws and academic literature were analyzed using a descriptive and analytical method. The study therefore found that Rebels are using the pretext of Israel's attacks on Gaza to perpetrate piracy. The Israel - Hamas deadlock has created a deadlocked lose-lose situation for the international community and resulted in new incidents of insecurity within the Red Sea. The study therefore concludes and recommends that the United Nations as the global police especially through the UN Security Council examine all options for securing peace and stability in the Red Sea region as attacks on shipping vessels have global ramifications affecting multiple nationalities and invariably affecting world peace. Abstract

Penelitian ini bertujuan untuk :  (1) Menganalisis, mengevaluasi, dan mencari tahu sejauh mana efektivitas UU ITE terhadap tindak pidana pornografi berbasis Dating APPS di Kota Makassar. (2) Menganalisis, mengevaluasi, dan menemukan faktor yang berpengaruh terhadap efektivitas penegak hukum  Terhadap Tindak Pidana Pornografi Berbasis Dating APPS di Kota Makassar. Penelitian ini merupakan penelitian hukum empiris dengan menggunakan pendekatan lapangan, dimulai wawancara yang akan mengkaji dan menganalisis sejauh mana efektivitas UU ITE terhadap tindak pidana pornografi berbasis Dating APPS. Tipe penelitian ini meliputi kajian yang memandang hukum sebagai kenyataan, mencakup kenyataan sosial, kenyataan kultur dan kenyataan penegak hukumnya. Hasil penelitian ini menunjukan bahwa : (1) Dari segi relugasi telah dianggap memumpuni, namun jika dititik beratkan pada struktur penegak hukum, penulis menemukan masih banyaknya penyebaran informasi ataupun konten yang mengandung muatan asusila di beberapa aplikasi dating apps. (2) Efektivitas penegakan hukum belum maksimal dan edukasi tentang penyebaran konten bermuatan asusila belum maksimal sehingga kesadaran hukum masyarakat juga belum menyeluruh dan mendalam tentang regulasi UU ITE terhadap penyebaran konten bermuatan pornografi terkhusus di media dating apps.

Abstract

Cloud computing is one of the developments of the internet of things. It can say that it is a new industry in era revolution 4.0. particular to store data, including customer data privacy. The research aims to determine some regulations and protection of cloud computing at either international or national levels. The research methods are normative legal research which applies some regulations both international and national legal instruments. The research results show that some international instruments can be seen in general and specific international instruments. The general instruments are such as the Universal Declaration of Human Rights 1948 (UDHR) and International Covenant on Civil and Political Rights 1996; the specific instruments are such as OECD Guidelines Governing the Protection of Privacy and Transborder Flows of Personal Data, 1980, Council of Europe Convention for the Protection of Individuals concerning the Processing of Personal Data, 1981, and United Nation General Assembly Resolution on the Right of Privacy in the Digital Age, 2014. In the Indonesian context, the regulation of it can be seen such as The Law No. 39 of 1999 Concerning Human Rights, The Law No. 14 of 2008 Concerning Public Information Disclosure, The Law No. 36 of 2009 Concerning Health, the Law No. 19 of 2016 concerning amendment of the Law No. 11 of 2008 concerning Information and Electronic Transaction and other sectoral regulation. Therefore, it can conclude that the need for regulation of cloud computing and its protection is needed to guarantee that those data are protected.

Abstract

The development of artificial intelligence (AI) has introduced unprecedented technological advancements and complex legal challenges, particularly in copyright infringement. The capability of the systems to replicate and disseminate copyrighted content without authorization raises questions about the adequacy of existing legal frameworks. Therefore, this research aims to explore the critical question of liability for AI-related copyright infringement, examining the responsibilities of developers, users, and systems. A comprehensive examination of relevant laws and regulations is carried out using a normative qualitative methodology. This is supported by case research and recent legal advancements, with a comprehensive comparison of relevant terms. Legal factors and dispute resolution methods applicable to AI-related copyright infringement are also considered. Due to the systems' autonomy, standard liability frameworks such as Digital Millennium Copyright Act (DMCA) cannot address AI-induced infringement. Meanwhile, a fault-based liability strategy that requires proof of purpose or negligence is suggested to improve accountability. This research reports the strengths and weaknesses of using dispute resolution mechanisms to solve copyright infringement. The results show that World Intellectual Property Organization (WIPO) dispute resolution provides a robust framework for resolving disputes after comparing regulations and mechanism.

Abstract

Rendahnya pemahaman orang tua dalam mendidik anak usia dini memberikanpengaruh yang tidak baik terhadap tumbuh kembang anak. Oleh karena itu melaluipelatihan hypnoparenting yang telah diikuti diharapkan orang tua dapat mendidik danmembesarkan anak-anaknya dengan cara yang baik dan benar. Penelitian ini bertujuanuntuk mengetahui pengaruh pelatihan hypnoparenting terhadap peningkatanpemahaman orang tua dalam mendidik anak usia dini di desa Aikmual kabupatenLombok Tengah tahun 2016.Data diperoleh dengan angket dan dokumentasi darisampel sebanyak 20 orang. Metode penentuan sampel dalam penelitian ini adalahstudi populasi. Data dianalisis menggunakan rumus Chi Kuadrat. Berdasarkan hasilanalisis data diperoleh nilai X2-hitung sebesar 49,829, sedangkan nilai X2-tabeldengan taraf signifikansi 5% sebesar 9,488. Berdasarkan hasil analisis data yangdihasilkan maka hipotesis alternatif (Ha) yang berbunyi “Ada pengaruh pelatihanhypnoparenting terhadap peningkatan pemahaman orang tua dalam mendidik anakusia dini di desa Aikmual Kabupaten Lombok Tengah Tahun 2016” Diterima danhipotesis nihil (H0) yang berbunyi “Tidak ada pengaruh pelatihan hypnoparentingterhadap peningkatan pemahaman orang tua dalam mendidik anak usia dini di desaAikmual Kabupaten Lombok Tengah Tahun 2016” Ditolak. Maka dapat diperolehkesimpulan bahwa “Ada pengaruh pelatihan hypnoparenting terhadap peningkatanpemahaman orang tua dalam mendidik anak usia dini di desa Aikmual KabupatenLombok Tengah Tahun 2016.”Kata Kunci : Pelatihan Hypnoparenting, Pemahaman Orang tua
